Some judicial officials began to notice the unusual frequency of deaths among the inmates of institutions and some prosecutors even considered asking the Gestapo to investigate the killings. However, none went so far as Lothar Kreyssig, a judge in Brandenburg who specialized in matters of wardship and adoption. A war veteran and a member of the Confessing Church, Kreyssig became suspicious when psychiatric patients who were wards of the court and therefore fell within his area of responsibility began to be transferred from their institutions and were shortly afterwards reported to have died suddenly. Kreyssig wrote Justice Minister Gortner to protest against what he described as an illegal and immoral programme of mass murder. The Justice Minister's response to this and other, similar, queries from local law officers was to try once more to draft a law giving effective immunity to the murderers, only to have it vetoed by Hitler on the grounds that the publicity would give dangerous ammunition to Allied propaganda. Late in April 1941 the Justice Ministry organized a briefing of senior judges and prosecutors by Brack and Heyde, to try to set their minds at rest. In the meantime, Kreyssig was summoned to an interview with the Ministry's top official, State Secretary Roland Freisler, who informed him that the killings were being carried out on Hitler's orders. Refusing to accept this explanation, Kreyssig wrote to the directors of psychiatric hospitals in his district informing them that transfers to killing centres were illegal, and threatening legal action should they transport any of their patients who came within his jurisdiction. It was his legal duty, he proclaimed, to protect the interests and indeed the lives of his charges. A further interview with Gortner failed to persuade him that he was wrong to do this, and he was compulsorily retired in December 1941.

The most effective way of making people accept the validity of the values they are to serve is to persuade them that they are really the same as those which they, or at least the best among them, have always held, but which were not properly understood or recognized before. The people are made to transfer their allegiance from the old gods to the new under the pretense that the new gods really are what their sound instinct had always told them but what before they had only dimly seen. Even among us we have “planners for freedom” who promise us a “collective freedom for the group,” the nature of which may be gathered from the fact that its advocate finds it necessary to assure us that “naturally the advent of planned freedom does not mean that all [sic] earlier forms of freedom must be abolished.” Dr. Karl Mannheim, from whose work6 these sentences are taken, at least warns us that “a conception of freedom modelled on the preceding age is an obstacle to any real understanding of the problem.” But his use of the word “freedom” is as misleading as it is in the mouth of totalitarian politicians. Like their freedom, the “collective freedom” he offers us is not the freedom of the members of society but the unlimited freedom of the planner to do with society what he pleases.7 It is the confusion of freedom with power carried to the extreme. In this particular case the perversion of the meaning of the word has, of course, been well prepared by a long line of German philosophers and, not least, by many of the theoreticians of socialism. But “freedom” or “liberty” are by no means the only words whose meaning has been changed into their opposites to make them serve as instruments of totalitarian propaganda. We have already seen how the same happens to “justice” and “law,” “right” and “equality.” The list could be extended until it includes almost all moral and political terms in general use. If one has not one’s self experienced this process, it is difficult to appreciate the magnitude of this change of the meaning of words, the confusion which it causes, and the barriers to any rational discussion which it creates. It has to be seen to be understood how, if one of two brothers embraces the new faith, after a short while he appears to speak a different language which makes any real communication between them impossible. And the confusion becomes worse because this change of meaning of the words describing political ideals is not a single event but a continuous process, a technique employed consciously or unconsciously to direct the people. Gradually, as this process continues, the whole language becomes despoiled, and words become empty shells deprived of any definite meaning, as capable of denoting one thing as its opposite and used solely for the emotional associations which still adhere to them.

The Scottish royal council saw witches as a national problem to be dealt with on a national scale,32 and only the prosecution of treason was more tightly managed by central government. This meant that witch-hunting was one of the ways in which central government could impose its authority on local magnates, allowing Scotland to emerge as a modern nation state.33 Witch-hunting served to legitimise the Scottish state and may have been one of the ways in which the state sought stability at times of anxiety and turmoil.34 In other words, the one thing the state could be relied upon to do was hunt witches. Witch-hunting lay at the foundation of the ‘theocratic government’ of early modern Scotland, legitimating the Stewarts’ ‘godly’ rule as divinely ordained kings.35 Furthermore, the propaganda of Scottish reformers managed to create the impression of a much closer connection between witchcraft and Catholicism than English Protestants ever managed. Even Queen Mary herself was not immune from suspicion. The clergyman William Harrison was convinced that Mary practised sorcery and that she married Henry Stewart, Lord Darnley in 1566 on the advice of witches, who promised Queen Elizabeth’s death and Mary’s succession to the English throne.36 When Mary gave birth to the future James VI in June 1566, it was widely reported that the countess of Atholl attempted to use sympathetic magic to transfer Mary’s labour pains to another person, perhaps with Mary’s connivance.37

The big lie is a term routinely attributed to Adolf Hitler. Supposedly Hitler used the term to describe Nazi propaganda. In his autobiography, Mein Kampf, Hitler contrasts the big lie with little or ordinary lies. “The great masses of the people,” he writes, “more easily fall victim to the big lie than to a little one, since they themselves lie in little things, but would be ashamed of lies that were too big. Such a falsehood will never enter their heads, and they will not be able to believe in the possibility of such monstrous effrontery and infamous misrepresentation in others.” 3 Hitler, however, is not referring to his own big lies. Rather, he is referring to the lies allegedly promulgated by the Jews. The Jews, Hitler says, are masters of the big lie. Now recognize that Mein Kampf is a tireless recitation of libels and calumnies against the Jews. The Jews are accused of everything from being capitalists to being Bolsheviks, from being impotent to lusting after Nordic women, from being culturally insignificant to being seekers of world domination. The charges are contradictory; they cannot simultaneously be true. Yet while lying about the Jews and plotting their destruction, Hitler accuses the Jews of lying and of plotting the destruction of Germany. Hitler employs the big lie even as he disavows its use. He portrays himself as a truth-teller and attributes lying to those he is lying about—the Jews. Could there be a more pathological case of transference, and specifically, of blaming the victim? The big lie is now back, and this time it is about the role of fascism and Nazism in American politics. The political Left—backed by the mainstream of the Democratic Party—insists that Donald Trump is an American version of Hitler or Mussolini. The GOP, they say, is the new incarnation of the Nazi Party. These charges become the basis and rationalization for seeking to destroy Trump and his allies by any means necessary. The “fascism card” is also used to intimidate conservatives and Republicans into renouncing Trump for fear themselves of being branded and smeared. Nazism, after all, is the ultimate form of hate, and association with it, the ultimate hate crime.
