This dark present reality didn’t begin with the antebellum South or with the modern warfare state, and it certainly didn’t begin with the Roe v. Wade Supreme Court decision. My blush deepends. Of course he'd speak English in an American school. And I've been living on stupid pears and baquettes for five days. He hands me a bowl of soup and a small plate of chicken salad, and my stomach rumbles at the sight of hot food.

Long live democracy and its immortal leader. So his armorbearer said to [Jonathan], “Do all that is in your heart. Go then; here I am with you, according to your heart.” 1 SAMUEL 14:7 Five simple monosyllables—“here I am with you”—but they helped make the difference between success and failure. Jonathan had already won a battle, for which his father, King Saul, took the credit (1 Sam. 13:1–4), but he didn’t care who got the credit so long as God received the glory and Israel was protected. As God’s people, we have always been in conflict with the enemies of the Lord and we have always been outnumbered. There were three kinds of Israelites on the battlefield that day, just as there are three kinds of “Christian soldiers” in the church today. There are those who do nothing. King Saul was sitting under a tree, surrounded by six hundred soldiers, wondering what to do next. Leaders are supposed to use their offices and not just fill them (1 Tim. 3:13). God had given Saul position and authority but he seemed to have no vision, power, or strategy. He was watching things happen instead of making things happen, and spectators don’t make much progress in life. Along with Saul and his small army were a number of Israelites who had fled the battlefield and hidden themselves, and some had even surrendered to the enemy! When Jonathan and his armorbearer started defeating the Philistines and the Lord shook the enemy camp, these quitters came out into the open and joined in the battle. Do you know any Christians like that? Are you one of them? There are those who fear nothing. Jonathan had already won a battle against the Philistines and was a man of faith who was certain that the God of Israel would give his people victory. Perhaps he was leaning on God’s promises in Leviticus 26:7–8, “You will chase your enemies, and they shall fall by the sword before you. Five of you shall chase a hundred, and a hundred of you shall put ten thousand to flight.” He assured his armorbearer that “nothing restrains the LORD from saving by many or by few” (1 Sam. 14:6). Jonathan expected God to give him a sign that his strategy was right, and God did just that (vv. 9–14). God also caused an earthquake in the enemy camp that made the Philistines panic, and they began to attack each other; and the enemy army began to melt away (v. 16). There are those who hold back nothing. Jonathan’s armorbearer is mentioned nine times in this narrative but his name is never revealed. Like many people in Scripture, he did his job well but must remain anonymous until he is rewarded in heaven. Think of the lad who gave his lunch to Jesus and he fed five thousand people (John 6:8–11), or the Jewish girl who sent Naaman to Elisha to be healed of his leprosy (2 Kings 5:1–4), or Paul’s nephew whose fast action saved Paul’s life (Acts 23:16–22). The armorbearer encouraged Jonathan and promised to stand by him. All leaders, no matter how successful, need others at their side who can help expedite their plans. Aaron and Hur held up Moses’s hands as he prayed for Joshua and the Jewish army in battle (Exod. 17:8–16), and Jesus asked Peter, James, and John to watch with him as he prayed in the garden (Matt. 26:36–46). In v. 6 Abraham asked Sarah to bake some bread, an activity often forbidden to menstruating women in Abraham’s time, so at that point her period had not begun. Yet she would not be confined to her tent unless she actually had her period. If this is the issue, she experienced the onset of her period as dinner is being served. We know even from the Biblical narratives that menstruating women were at times confined to their tents (cf. 31:34–35). This view is also attested in the ancient Near East. Though somewhat speculative, this line of thinking would explain why the announcement that Sarah would bear a child is introduced by a question concerning Sarah’s whereabouts, leading the somewhat embarrassed Abraham to offer the euphemistic explanation that she is “in the tent” as a way of explaining that she is indisposed (note our modern euphemism, “it’s that time of the month”). One could almost imagine a transitional, “Indeed, and that is just the beginning . . .” It would have constituted a remarkable sign of the resumption of her fertility.

The first thing he ran into was the pool table Butch was chilling next to—and there was barely any time for the cop to get that ashtray up off the side rails: Wrath grabbed the gunnels and flipped the thing like it was nothing but a card table, the mahogany and slate-topped behemoth flying up so high, it wiped out the hanging light fixture above, its weight so great it splintered the marble floor beneath on landing.
Without missing a breath, the King EF5’d into his next victim . . . the heavy leather sofa that Rhage had just leaped up off.
Talk about your couch-icopters.
The entire thing came at John at about five feet off the floor, the pair of ends trading places as it spun around and around, cushions flying in all directions. He didn’t take it personally—especially as its mate do-si-doed with the bar, smashing the top-shelf bottles, liquor splashing all over the walls, the floor, the fire that was crackling in the hearth.
Wrath wasn’t finished.
The King picked up a side table, hauled it overhead, and pitched it in the direction of the TV.
It missed the plasma screen, but managed to shatter an old-fashioned mirror—although the Sony didn’t last.
The coffee table that had been in between the two sofas did that deed, killing the muted image of the two Boston guys and the old man from Southie with the baseball bat shilling for DirectTV.
The Brothers just let Wrath go.
It wasn’t that they were afraid of getting hurt.
Hell, Rhage stepped in and caught the first couch before it tore a hunk off of the archway’s molding.

As after any revolution, purists were vigilant for signs of ideological backsliding and departures from the one true faith. The 1780s and 1790s were to be especially rich in feverish witch hunts for traitors who allegedly sought to reverse the verdict of the war. For the radicals of the day, revolutionary purity meant a strong legislature that would overshadow a weak executive and judiciary. For Hamilton, this could only invite legislative tyranny. Rutgers v. Waddington represented his first major chance to expound the principle that the judiciary should enjoy coequal status with the other two branches of government. If Rutgers v. Waddington made Hamilton a controversial figure in city politics in 1784, the founding of the Bank of New York cast him in a more conciliatory role. The creation of New York’s first bank was a formative moment in the city’s rise as a world financial center. Banking was still a new phenomenon in America. The first such chartered institution, the Bank of North America, had been started in Philadelphia in 1781, and Hamilton had studied its affairs closely. It was the brainchild of Robert Morris, and its two biggest shareholders were Jeremiah Wadsworth and Hamilton’s brother-in-law John B. Church. These two men now cast about for fresh outlets for their capital. In 1783, John Church sailed for Europe with Angelica and their four children to settle wartime accounts with the French government. In his absence, Church named Hamilton as his American business agent, a task that was to consume a good deal of his time in coming years. When Church and Wadsworth deputized him to set up a private bank in New York, Hamilton warmed to it as a project that could help to rejuvenate New York commerce. He was stymied by a competing proposal from Robert R. Livingston to set up a “land bank”—so called because the initial capital would be pledged mostly in land, an idea Hamilton derided as a “wild and impracticable scheme.” 49 Since land is not a liquid asset and cannot be converted into ready cash in an emergency, Hamilton favored a more conservative bank that would conduct business exclusively in notes and gold and silver coins. When Livingston solicited the New York legislature for a charter, the tireless Hamilton swung into action and mobilized New York’s merchants against the effort. He informed Church that he had lobbied “some of the most intelligent merchants, who presently saw the matter in a proper light and began to take measures to defeat the plan.

Hubbie 1 used to get wholly pissed when I made
myself come. I’m right here!, he’d sputter, blood
popping to the surface of his fuzzed cheeks,
goddamn it, I’m right here! By that time, I was
in no mood to discuss the myriad merits of my
pointer, or to jam the brakes on the express train
slicing through my blood, It was easier to suffer
the practiced professorial huff, the hissed invectives
and the cold old shoulder, liver-dotted, quaking
with rage. Shall we pause to bless professors and
codgers and their bellowed, unquestioned ownership
of things? I was sneaking time with my own body.
I know I signed something over, but it wasn’t that.
II.
No matter how I angle this history, it’s weird,
so let’s just say Bringing Up Baby was on the telly
and suddenly my lips pressing against
the couch cushions felt spectacular and I thought
wow this is strange, what the hell, I’m 30 years old,
am I dying down there is this the feel, does the cunt

Don’t hate me because I am multiple, hurtling.
As long as there is still skin on the pad of my finger,

he leans back, coos, edges me along, keeps wondering
count. He falls to his knees in front of it, marvels

My body bucks, slave to its selfish engine,

IV.
We know the record. As it taunts us, we have giggled,
considered stopwatches, little laboratories. Somewhere
beneath the suffering clean, swathed in eyes and silver,
she came 134 times in one hour. I imagine wires holding
her tight, her throat a rattling window. Searching scrubbed
places for her name, I find only reams of numbers. I ask
the quietest of them:

The Supreme Court was beyond their constitutional power when they handed George W. Bush the victory in 2000 by ruling that if all the votes were counted in Florida, as that state’s supreme court had ordered, it would “cause irreparable harm to petitioner [George W. Bush].” They were beyond their constitutional power every single time they struck down a law passed by Congress and signed by the president over the years. And most important, the Supreme Court was way beyond their constitutional authority every single time they created out of whole cloth new legal doctrines, such as “separate but equal” in Plessy v. Ferguson, “privacy” in Roe v. Wade, or “corporations are people” in Citizens United v. Federal Election Commission. But in the fine tradition of John Marshall, today’s Supreme Court wants you to believe that they are the über-overlords of our nation. They can make George W. Bush president, without any appeal. They can make money into speech, they can turn corporations into people, and the rest of us have no say in it. And they’re wrong. It’s not what the Constitution says, and it’s not what most of our Founders said. Which raises the question: If the Supreme Court can’t decide what is and what isn’t constitutional, then what is its purpose? What’s it really supposed to be doing? The answer to that is laid out in the Constitution in plain black-and-white. It’s the first court where the nation goes for cases involving disputes about treaties, ambassadors, controversies between two or more states, between a state and citizen of another state, between citizens of different states, and between our country and foreign states. Read Article 3, Section 2 of the Constitution—it’s all there. Not a word in there about “judicial supremacy” or “judicial review”—the supposed powers of the court to strike down (or write) laws by deciding what is and what isn’t constitutional. President Thomas Jefferson was pretty clear about that—as were most of the Founders—and the court didn’t start seriously deciding “constitutionality” until after all of them were dead. But back in the day, here’s what Jefferson had to say: The Constitution has erected no such single tribunal, knowing that to whatever hands confided, with the corruptions of time and party, its members would become despots. It has more wisely made all the departments co-equal and co-sovereign within themselves… When the legislative or executive functionaries act unconstitutionally, they are responsible to the people in their elective capacity.177 Their elective capacity? That’s a fancy presidential-founder way of saying that the people can toss out on their butts any member of Congress or any president who behaves in a way that’s unconstitutional. The ultimate remedy is with the people—it’s the ballot box. If we don’t like the laws being passed, then we elect new legislators and a new president. It’s pretty simple.
