A person’s reputation can be damaged by stories about his tightfistedness, his insulting words, his cheating, or his clothing only if the public among whom such tales circulate have shared standards of generosity, polite speech, honesty, and appropriate dress. Without an accepted normative standard from which degrees of deviation may be estimated, the notion of gossip would make no sense whatever. Gossip, in turn, reinforces these normative standards by invoking them and by teaching anyone who gossips precisely what kinds of conduct are likely to be mocked or despised. 13. The power to gossip is more democratically distributed than power, property, and income, and, certainly, than the freedom to speak openly. I do not mean to imply that gossip cannot and is not used by superiors to control subordinates, only that resources on this particular field of struggle are relatively more favorable to subordinates. His magnum opus, The Restitution of Christianity—a rebuttal of Calvin’s Institutes—rejected predestination, denied original sin, called infant baptism diabolical, and further deprecated the Trinity. Servetus imprudently sent Calvin a copy. Calvin sent back a copy of his Institutes. Servetus filled its margins with insulting comments, then returned it. A bitter exchange of letters followed, in which Servetus announced that the Archangel Michael was girding himself for Armageddon and that he, Servetus, would serve as his armor-bearer. Calvin sent Servetus’s letters to a contact in Vienne, who passed them on to Catholic inquisitors in Lyon. Servetus was promptly arrested and sent to prison, but after a few days he escaped by jumping over a prison wall. After spending three months wandering around France, he decided to seek refuge in Naples. En route, he inexplicably stopped in Geneva. Arriving on a Saturday, he attended Calvin’s lecture the next day. Though disguised, Servetus was recognized by some refugees from Lyon and immediately arrested. Calvin instructed one of his disciples to file capital charges against him with the magistrates for his various blasphemies. After a lengthy trial and multiple examinations, Servetus was condemned for writing against the Trinity and infant baptism and sentenced to death. He asked to be beheaded rather than burned, but the council refused, and on October 27, 1553, Servetus, with a copy of the Restitution tied to his arm, was sent to the stake. Shrieking in agony, he took half an hour to die. Calvin approved. “God makes clear that the false prophet is to be stoned without mercy,” he explained in Defense of the Orthodox Trinity Against the Errors of Michael Servetus. “We are to crush beneath our heel all affections of nature when his honor is involved. Everywhere I went, other officers and enlisted men knew I had failed, and every day there were whispers and subtle reminders that maybe I wasn’t up to the task of being a SEAL. At that point in my career I had two options: quit and move on to civilian life, which seemed like the logical choice in light of my recent Officer Fitness Report, or weather the storm and prove to others and myself that I was a good SEAL officer. I chose the latter. Soon after being fired, I was given a second chance, an opportunity to deploy overseas as the Officer in Charge of a SEAL platoon. Most of the time on that overseas deployment we were in remote locations, isolated and on our own. I took advantage of the opportunity to show that I could still lead. When you live in close quarters with twelve SEALs there isn’t anywhere to hide. They know if you are giving 100 percent on the morning workout. They see when you are first in line to jump out of the airplane and last in line to get the chow. They watch you clean your weapon, check your radio, read the intelligence, and prepare your mission briefs. They know when you have worked all night preparing for tomorrow’s training. As month after month of the overseas deployment wore on, I used my previous failure as motivation to outwork, outhustle, and outperform everyone in the platoon. I sometimes fell short of being the best, but I never fell short of giving it my best. In time, I regained the respect of my men. Several years later I was selected to command a SEAL Team of my own. Eventually I would go on to command all the SEALs on the West Coast.

The case against the defendants was strong, and they subsequently defaulted by refusing even to answer the charges against them. But the case was abruptly curtailed and all but shut down by the newly appointed officials of the Obama administration. In the end, they ordered Popper to settle the case for a short, limited, and toothless injunction against only one of the four defendants. There was never a convincing explanation from Eric Holder or the administration as to why the case was cut short.
