The established order, of course: philosophers have traditionally been employees of the State. The collusion between philosophy and the State was most explicitly enacted in the first decade of the nineteenth century with the foundation of the University of Berlin, which was to become the model of higher learning throughout Europe and in the United States. We may have been encouraged to make that bargain from our public school education, our family home, religion, or culture in general. We associate safety with obedience to authority, for example, going along with government policies. We then make duty, as it is defined by the nation, our unquestioned course. Our motivation is usually not love of country but fear of being without a country that will defend us and our property. Connection is all-important to us; excommunication is the equivalent of death, the finality we can’t dispute. Healthy adult loyalty is a virtue that does not become blind obedience for fear of losing connection, nor total devotion so that we lose our boundaries. Our civil obedience can be so firm that it may take precedence over our concern for those we love, even our children. Here is an example: A young mother is told by the doctor that her toddler is allergic to peanuts and peanut oil. She lets the school know of her son’s allergy when he goes to kindergarten. Throughout his childhood, she is vigilant and makes sure he is safe from peanuts in any form. Eighteen years later, there is a war and he is drafted. The same mother, who was so scrupulously careful about her child’s safety, now waves goodbye to him with a tear but without protest. Mother’s own training in public school and throughout her life has made her believe that her son’s life is expendable whether or not the war in question is just. “Patriotism” is so deeply ingrained in her that she does not even imagine an alternative, even when her son’s life is at stake. It is of course also true that, biologically, parents are ready to let children go just as the state is ready to draft them. What a cunning synchronic-ity. In addition, old men who decide on war take advantage of the timing too. The warrior archetype is lively in eighteen-year-olds, who are willing to fight. Those in their mid-thirties, whose archetype is being a householder and making a mark in their chosen field, will not show an interest in battlefields of blood. The chiefs count on the fact that young braves will take the warrior myth literally rather than as a metaphor for interior battles. They will be willing to put their lives on the line to live out the collective myth of societies that have not found the path of nonviolence. Our collective nature thus seems geared to making war a workable enterprise. In some people, peacemaking is the archetype most in evidence. Nature seems to have made that population smaller, unfortunately. Our culture has trained us to endure and tolerate, not to protest and rebel. Every cell of our bodies learned that lesson. It may not be virtue; it may be fear. We may believe that showing anger is dangerous, because it opposes the authority we are obliged to appease and placate if we are to survive. This explains why we so admire someone who dares to say no and to stand up or even to die for what he believes. That person did not fall prey to the collective seduction. Watching Jeopardy on television, I notice that the audience applauds with special force when a contestant risks everything on a double-jeopardy question. The healthy part of us ardently admires daring. In our positive shadow, our admiration reflects our own disavowed or hidden potential. We, too, have it in us to dare. We can stand up for our truth, putting every comfort on the line, if only we can calm our long-scared ego and open to the part of us that wants to live free. Wittgenstein is able to disentangle the grammar of ‘I have a hat’ from ‘I have a pain’ not only in a way that throws light on the use of personal pronouns like ‘I’ and ‘he’, but in ways which undermine the long-standing assumption that my experiences are a kind of private property. In fact, they seem even more like private property than my hat, since I can give away my hat, but not my pain. Wittgenstein shows us how grammar deceives us into thinking this way, and his case has radical, even politically radical, consequences. The task of the philosopher, Wittgenstein thought, was not so much to resolve these inquiries as to dissolve them – to show that they spring from confusing one kind of ‘language game’, as he called it, with another.

Normality is, truthfully, life's whore, readily embraced and conveniently embracing; secretly, it has the clap. Thinking of plot should then give pause. The treacherous cheat fate and re-write, their 'intended history'. Call it fate. They become authors of an illicit story, penmen of their own gods, living their own fresh creation through a new, egregious, utilitarian drama that is untouched by either truth or beauty.

This was the “veritas” (Dorn) or “theoria” (Paracelsus) for which the old physicians and alchemists strove, and they could do so only by incorporating the Christian revelation into their world of ideas. They continued the work of the Gnostics (who were, most of them, not so much heretics as theologians) and the Church Fathers in a new era, instinctively recognizing that new wine should not be put into old bottles, and that, like a snake changing its skin, the old myth needs to be clothed anew in every renewed age if it is not to lose its therapeutic effect.

The first suggested definition of “justice,” at the beginning of the Republic, is that it consists in paying debts. This definition is soon abandoned as inadequate, but something of it remains at the end. There are several points to be noted about Plato’s definition. First, it makes it possible to have inequalities of power and privilege without injustice. The guardians are to have all the power, because they are the wisest members of the community; injustice would only occur, on Plato’s definition, if there were men in the other classes who were wiser than some of the guardians. That is why Plato provides for promotion and degradation of citizens, although he thinks that the double advantage of birth and education will, in most cases, make the children of guardians superior to the children of others. If there were a more exact science of government, and more certainty of men following its precepts, there would be much to be said for Plato’s system. No one thinks it unjust to put the best men into a football team, although they acquire thereby a great superiority. If football were managed as democratically as the Athenian government, the students to play for their university would be chosen by lot. These negative-sum games of coercion and extortion lead to highly inefficient outcomes, and they can only be avoided by carefully crafting the ex ante rules to avoid such coercion and extortion. These coercive threats that make negative-sum games possible, and that decrease the payoffs of positive-sum games, cannot be neatly distinguished in practice from innocent externalities: any act or omission of one party that harms another, i.e. any externality, doubles as a threat, whether a tiny threat or a large threat, from which an extortion premium, its size depending on the size of the threat, can be extracted. In order to try to distinguish coercion, and the extortion it gives rise to, from an "innocent" externality that can be cured by efficient bargaining, there are ways to exclude some of these extreme possibilities from the prior allocation of rights. And indeed criminal and tort law do this: they distinguish purposeful behavior from negligent, and negligent from the mere unfortunate accident. But any such ex ante distiction contradicts the claim that the Coase Theorem applies to any prior allocation of rights. Voluntary bargaining cannnot give rise to tort and criminal law. Quite the opposite is true: at least a basic tort law is necessary to make voluntary bargaining possible. Tort law (and the associated property law which defines boundaries for the tort of trespass) is logically prior to contract law: good contracts depend on good tort and property law. Without a good tort law already in place, nobody, including the "protection firms" posited by anarcho-capitalism, can engage in the voluntary bargains that are necessary for efficient outcomes. This is not to claim that the polar opposite of anarcho-capitalism must be true, i.e. that "the government" along the lines we are familiar with is necessary. Instead, a system of political property rights that is unbundled and decentralized is possible, and may give rise to many of the benefits (e.g. peaceful competition between jurisdictions) promised by anarcho-capitalism. But political property rights are not based on a Rothbardian assumption of voluntary agreement -- instead, in these systems the procedural law of political property rights, as well as much of substantive property rights and tort law, is prior to contract law, and their origin necessarily involves some degree of coercion. Political and legal systems have not, do not, and cannot originate solely from voluntary contract. Both traditional "social contract" justifications of the state and the Rothbardian idea that contracts can substitute for the state are false: in all cases coercion is involved, both at the origin and in the ongoing practice of legal procedure. In both cases the term "contract" is used, implying voluntary agreement, when the term "treaty", a kind of agreement often forced by coercion, would far more accurately describe the reality. The real task for libertarians and other defenders of sound economics and law is not to try to devise law from purely voluntary origins, an impossible task, but to make sure the ex ante laws make voluntary bargaining possible and discourage coercion and extortion (by any party, including political property rights holders or governments) as much as possible.

Particularly galling was the way the Homestead Act was abused. Passed during the Civil War, it was supposed to make a reality out of Lincoln’s version of the free labor, free soil dream. But fewer than half a million people actually set up viable farms over nearly half a century. Most public lands were taken over by the railroads, thanks to the government’s beneficent land-grant policy (another form of primitive accumulation); by land speculators backed by eastern bankers, who sometimes hired pretend “homesteaders” in acts of outright fraud; or by giant cattle ranches and timber companies and the like who worked hand in glove with government land agents. As early as 1862 two-thirds of Iowa (or ten million acres) was owned by speculators. Railroads closed off one-third of Kansas to homesteading and that was the best land available. Mushrooming cities back east became, in a kind of historical inversion, the safety valve for overpopulated areas in the west. At least the city held out the prospect of remunerative wage labor if no longer a life of propertied independence. Few city workers had the capital to migrate west anyway; when one Pennsylvania legislator suggested that the state subsidize such moves, he was denounced as “the Pennsylvania Communist” for his trouble. During the last land boom of the nineteenth century (from about 1883 to 1887), 16 million acres underwent that conversion every year. Railroads doubled down by selling off or mortgaging portions of the public domain they had just been gifted to finance construction or to speculate with. But land-grant roads were built at costs 100 percent greater than warranted and badly built at that, needing to be rebuilt just fifteen years later.

African American prisoners surpassed all other groups in 1988, but by 1995, they had been overtaken by Latinos; however, Black people have the highest rate of incarceration of any racial/ethnic grouping in California, or, for that matter, in the United States (see also Bonczar and Beck 1997). Los Angeles is the primary county of commitment. Most prisoners are modestly educated men in the prime of life: 88 percent are between 19 and 44 years old. Less than 45 percent graduated from high school or read at the ninth-grade level; one in four is functionally illiterate. And, finally, the percentage of prisoners who worked six months or longer for the same employer immediately before being taken into custody has declined, from 54.5 percent in 1982 to 44 percent in 2000 (CDC, Characteristics of Population, various years). On the one hand, the political rhetoric, produced and reproduced in the media, concentrated on the need for laws and prisons to control violence. “Crime” and “violence” seemed to be identical. However, as table 5 shows, there was a significant shift in the controlling (or most serious) offenses for those committed to the CDC, from a preponderance of violent offenses in 1980 to nonviolent crimes in 1995. More to the point, the controlling offenses for more than half of 1995’s commitments were nonviolent crimes of illness or of illegal income producing activity: drug use, drug sales, burglary, motor vehicle theft. The outcome of the first two years of California’s broadly written “three strikes” law presents a similar picture: in the period March 1994–January 1996, 15 percent of controlling offenses were violent crimes, 31 percent were drug offenses, and 41 percent were crimes against property (N = 15,839) (Christoper Davis et al. 1996). The relative surplus population comes into focus in these numbers. In 1996, 43 percent of third-strike prisoners were Black, 32.4 percent Latino, and 24.6 percent Anglo. The deliberate intensification of surveillance and arrest in certain areas, combined with novel crimes of status, drops the weight of these numbers into particular places. The chair of the State Task Force on Youth Gang Violence expressed the overlap between presumptions of violence and the exigencies of everyday reproduction when he wrote: “We are talking about well-organized, drug-dealing, dangerously armed and profit-motivated young hoodlums who are engaged in the vicious crimes of murder, rape, robbery, extortion and kidnapping as a means of making a living” (Philibosian 1986: ix; emphasis added).

And what is the sensitivity to the surface? And can you write the Hamiltonian of the system? "And if I tell him, I don't care, what interests me is this shape, the mathematics of the shape and the evolution, the bifurcation from this shape to that shape to this shape, he will tell me, that's not physics, you are doing mathematics. Initially, CERs did spur some forest projects in the tropics. But they also increased activity in an unexpected quarter. A small number of companies in China and India produced a chemical used in refrigerators. Their manufacturing process created a by-product called HFC-23. This chemical has an unusual property: it is a super greenhouse gas. Just one HFC-23 molecule causes as much global warming as 11,700 molecules of carbon dioxide. The manufacturers spotted an opportunity with CERs. Five years into the trading program, it emerged that these companies had doubled their output and had earned roughly half the world’s total CERs. The market for refrigerants had not grown, though, so why had they ramped up production? These companies had changed their business model. Almost immediately Floyd Lowe, president of the California Real Estate Association, set up an office in East Palo Alto to panic white families into listing their homes for sale, a practice known as blockbusting. He and other agents warned that a 'Negro invasion' was imminent and that it would result in collapsing property values. Soon, growing numbers of white owners succumbed to the scaremongering and sold at discounted prices to the agents and their speculators. The agents, including Lowe himself, then designed display ads with banner headlines-"Colored Buyers!"-which they ran in San Francisco newspapers. African Americans desperate for housing, purchased the homes at inflated prices. Within a three-month period, one agent alone sold sixty previously white-owned properties to African Americans. The California real estate commissioner refused to take any action, asserting that while regulations prohibited licensed agents from engaging in 'unethical practices,' the exploitation of racial fear was not within the real estate commission's jurisdiction. Although the local real estate board would ordinarily 'blackball' any agent who sold to a nonwhite buyer in the city's white neighborhoods (thereby denying the agent access to the multiple listing service upon which his or her business depended), once wholesale blockbusting began, the board was unconcerned, even supportive. At the time, the Federal Housing Administration and Veterans Administration not only refused to insure mortgages for African Americans in designated white neighborhoods like Ladera; they also would not insure mortgages for whites in a neighborhood where African Americans were present. So once East Palo Alto was integrated, whites wanting to move into the area could no longer obtain government-insured mortgages. State-regulated insurance companies, like the Equitable Life Insurance Company and the Prudential Life Insurance Company, also declared that their policy was not to issue mortgages to whites in integrated neighborhoods. State insurance regulators had no objection to this stance. The Bank of America and other leading California banks had similar policies, also with the consent of federal banking regulators. Within six years the population of East Palo Alto was 82 percent black. Conditions deteriorated as African Americans who had been excluded from other neighborhoods doubled up in single-family homes. Their East Palo Alto houses had been priced so much higher than similar properties for whites that the owners had difficulty making payments without additional rental income. Federal and state hosing policy had created a slum in East Palo Alto. With the increased density of the area, the school district could no longer accommodate all Palo Alto students, so in 1958 it proposed to create a second high school to accommodate teh expanding student population. The district decided to construct the new school in the heart of what had become the East Palo Alto ghetto, so black students in Palo Alto's existing integrated building would have to withdraw, creating a segregated African American school in the eastern section and a white one to the west. the board ignored pleas of African American and liberal white activists that it draw an east-west school boundary to establish two integrated secondary schools. In ways like these, federal, state, and local governments purposely created segregation in every metropolitan area of the nation.

This can be demonstrated easily even if you shoot a single photon one at a time through a double-slit apparatus.312 However—and this is the frosting on the quantum measurement problem—those very same chunks of stuff behave like particles when you do look at them. Technically, the process of looking is called gaining “which-path” information, in which you learn which path a photon took as it traveled through the double-slit apparatus. To repeat: If you know that it goes through the left slit or the right slit, typically determined using a detector placed behind each slit, then the photon will behave like a particle. But if you don’t know, then it will behave like a wave. Assumptions The experiment we conducted took advantage of this intriguing effect. It was based on two assumptions: (A) If information is gained—by any means—about a photon’s path as it travels through two slits, then the quantum wavelike interference pattern, produced by photons traveling through the slits, will “collapse” in proportion to the certainty of the knowledge obtained. (B) If some aspect of consciousness is a primordial, self-aware feature of the fabric of reality, and that property is modulated by us through capacities we enjoy as attention and intention, then focusing human attention on a double-slit system may extract information about the photon’s path, and in turn that will affect the interference pattern.

When an elementary quantum object is not being observed, it remains in what’s called an “indeterminate state.” In that unobserved condition, the object has no definite properties yet—no size, shape, location, polarization, spin, or any other property that we ascribe to ordinary real objects. The consciousness collapse idea further proposes that when, and only when, an object is consciously observed does it take on real properties. To repeat—because this concept may make your brain hurt the first time you encounter it—if you take measurements of a quantum system using an inanimate recording device, like a camera, then that system will remain in an indeterminate state until it is observed. This ridiculous-sounding idea has been tested in conventional physics labs and it has definitely been shown to exist. That type of study is called the delayed-choice experiment.154, 324 We tested this idea in the present context by using a time-reversed version of our double-slit experiment, somewhat like the studies that Daryl Bem conducted, as discussed earlier in the chapter on precognition. This test also provided a more rigorous way for us to test the effect of participants being located within a few meters of the optical system, because all the data in this study were generated and recorded with the apparatus located by itself inside the shielded chamber, and with no one else present in the laboratory.
