Officers approached the 43-year-old Garner on July 17 in a high-crime area near the Staten Island Ferry Terminal and accused him of illegally selling untaxed cigarettes—the kind of misdemeanor that Broken Windows policing aims to curb. As captured in a cell-phone video, the 350-pound man loudly objected to the charge and broke free when an officer tried to handcuff him. The officer then put his arm around Garner’s neck and pulled him to the ground. Garner repeatedly stated that he couldn’t breathe, and then went eerily stiff and quiet. After a seemingly interminable time on the ground without assistance, Garner was finally put on a stretcher to be taken to an emergency room. He died of cardiac arrest before arriving at the hospital. Garner suffered from severe asthma and diabetes, among other ailments, which contributed to his heart attack.

To label the Samaritan, any Samaritan, a 'good Samaritan' should be, in today's climate, seen as offensive. It is tantamount to saying, 'He's a good Muslim' (as opposed to all those others who, in this configuration, would be terrorists) or 'She's a good immigrant' (as opposed to all those others who, in this same configuration, are here to take our jobs or scam our welfare system), or, as Heinrich Himmler put it to a gathering of SS officers, every German 'has his decent Jew' - that is, knows one good Jew - and as far as Himmler was concerned, even one was too many, because that might create sympathy. The problem with the labeling is not simply a lack of sensitivity toward the Samaritan people - yes, there are still Samaritans. It is also a lack of awareness of how odd the expression 'good Samaritan' would have seemed to Jesus's Jewish contemporaries.

What they could endure least of all, however, was silence, for when silence fell they became terrified by the realization of what was happening to their lives. Timothy Meaher, a wealthy Mobile shipper and shipyard owner who had built the schooner Clotilde in Mobile in 1856.15 This is the official version of the story, also found in a piece emanating from the office of former representative Herbert “Sonny” Callahan, created in 2000 for the Local Legacies Project of the Library of Congress.16 The Africatown Community Mobilization Project uses it on its brochure. George Mumford, a Newton-based mindfulness teacher, one such moment took place in 1993, at the Omega Institute, a holistic learning center in Rhinebeck, New York. The center was hosting a retreat devoted to mindfulness meditation, the clear-your-head habit in which participants sit quietly and focus on their breathing. Leading the session: meditation megastar Jon Kabat-Zinn. Originally trained as a molecular biologist at MIT, Kabat-Zinn had gone on to revolutionize the meditation world in the 1970s by creating a more secularized version of the practice, one focused less on Buddhism and more on stress reduction and other health benefits. After dinner one night, Kabat-Zinn was giving a talk about his work, clicking through a slide show to give the audience something to look at. At one point he displayed a slide of Mumford. Mumford had been a star high school basketball player who’d subsequently hit hard times as a heroin addict, Kabat-Zinn explained. By the early 1980s, however, he’d embraced meditation and gotten sober. Now Mumford taught meditation to prison inmates and other unlikely students. Kabat-Zinn explained how they were able to relate to Mumford because of his tough upbringing, his openness about his addiction — and because, like many inmates, he’s African-American. Kabat-Zinn’s description of Mumford didn’t seem to affect most Omega visitors, but one participant immediately took notice: June Jackson, whose husband had just coached the Chicago Bulls to their third consecutive NBA championship. Phil Jackson had spent years studying Buddhism and Native American spirituality and was a devoted meditator. Yet his efforts to get Michael Jordan, Scottie Pippen, and their teammates to embrace mindfulness was meeting with only limited success. “June took one look at George and said, ‘He could totally connect with Phil’s players,’ ’’ Kabat-Zinn recalls. So he provided an introduction. Soon Mumford was in Chicago, gathering some of the world’s most famous athletes in a darkened room and telling them to focus on their breathing. Mumford spent the next five years working with the Bulls, frequently sitting behind the bench, as they won three more championships. In 1999 Mumford followed Phil Jackson to the Los Angeles Lakers, where he helped turn Kobe Bryant into an outspoken adherent of meditation. Last year, as Jackson began rebuilding the moribund New York Knicks as president, Mumford signed on for a third tour of duty. He won’t speak about the specific work he’s doing in New York, but it surely involves helping a new team adjust to Jackson’s sensibilities, his controversial triangle offense, and the particular stress that comes with compiling the worst record in the NBA. Late one April afternoon just as the NBA playoffs are beginning, Mumford is sitting at a table in O’Hara’s, a Newton pub. Sober for more than 30 years, he sips Perrier. It’s Marathon Monday, and as police begin allowing traffic back onto Commonwealth Avenue, early finishers surround us, un-showered and drinking beer. No one recognizes Mumford, but that’s hardly unusual. While most NBA fans are aware that Jackson is serious about meditation — his nickname is the Zen Master — few outside his locker rooms can name the consultant he employs. And Mumford hasn’t done much to change that. He has no office and does no marketing, and his recently launched website, mindfulathlete.org, is mired deep in search-engine results. Mumford has worked with teams that have won six championships, but, one friend jokes, he remains the world’s most famous completely unknown meditation teacher. That may soon change. This month, Mumford published his first book, The Mindful Athlete, which is part memoir and part instruction guide, and he has agreed to give a series of talks and book signings

Team Obama joined the fight against teachers unions from day one: the administration supported charter schools and standardized tests; they gave big grants to Teach for America. In Jonathan Alter’s description of how the administration decided to take on the matter, it is clear that professionalism provided the framework for their thinking. Teachers’ credentials are described as somewhat bogus; they “often bore no relationship to [teachers’] skills in the classroom.” What teachers needed was a more empirical form of certification: they had to be tested and then tested again. Even more offensive to the administration was the way teachers’ unions had resisted certain accountability measures over the years, resulting in a situation “almost unimaginable to professionals in any other part of the economy,” as Alter puts it.15 As it happens, the vast majority of Americans are unprofessional: they are the managed, not the managers. But people whose faith lies in “cream rising to the top” (to repeat Alter’s take on Obama’s credo) tend to disdain those at the bottom. Those who succeed, the doctrine of merit holds, are those who deserve to—who race to the top, who get accepted to “good” colleges and get graduate degrees in the right subjects. Those who don’t sort of deserve their fates. “One of the challenges in our society is that the truth is kind of a disequalizer,” Larry Summers told journalist Ron Suskind during the early days of the Obama administration. “One of the reasons that inequality has probably gone up in our society is that people are being treated closer to the way that they’re supposed to be treated.”16 Remember, as you let that last sentence slide slowly down your throat, that this was a Democrat saying this—a prominent Democrat, a high-ranking cabinet official in the Clinton years and the man standing at the right hand of power in the first Obama administration.* The merit mind-set destroyed not only the possibility of real action against inequality; in some ways it killed off the hopes of the Obama presidency altogether. “From the days of the 2008 Obama transition team offices, it was clear that the Administration was going to be populated with Ivy Leaguers who had cut their teeth, and filled their bank accounts, at McKinsey, Goldman Sachs and Citigroup,” a labor movement official writes me. The President, who was so impressed with his classmates’ intelligence at Harvard and Columbia, gave them the real reins of power, and they used those reins to strangle him and his ambition of being a transformative President. The overwhelming aroma of privilege started at the top and at the beginning.… It reached down deep into the operational levels of government, to the lowest-level political appointees. In the course of history, kings have welcomed more and more people to their courts, which became more and more brilliant. Is it not obvious that these courtiers and the "officers" were stolen from the feudal lords, who just lost at one fell swoop, their retinues and their administrators? The modern state nourishes a vast bureaucracy. Is not the corresponding decline in the staff of the employer patent to all? Putting the mass of the people to productive work makes possible at any given moment of technical advance the existence of a given number of non-producers. These non-producers will either be dispersed in a number of packets or concentrated in one immense body, according as the profits of productive work accrue to the social or to the political authorities. The requirement of Power, its tendency and its raison d'etre, is to concentrate them in its own service. To this task, it brings us so much ardour, instinctive rather than designed that in course of time it does to a natural death the social order which gave it birth. This tendency is due not to the form taken by any particular state but to the inner essence of Power, which is the inevitable assailant of the social authorities and sucks the very lifeblood. And the more vigorous a particular power is a more virile it is to the role of vampire. When it falls to weak hand, which gives aristocratic resistance a chance to organize itself, the state's revolutionary nature becomes for the time being effaced. This happens either because the forces of aristocracy opposed to the now enfeebled statocratic onslaught a barrier capable of checking it, or, more frequently, because they put a guard on their assailant, by laying hands on the apparatus which endangers them; they guarantee their own survival by installing themselves in the seat of government. This is exactly what did happen to the two epochs when the ideas of Montesquieu and Marx took shape. The counter-offensive of the social authorities cannot be understood unless it is realized that the process of destroying aristocracy goes hand in hand with a tendency in the opposite sense. The mighty are put down - if they are independent of the state; but simultaneously, a statocrcy is exalted, and the new statocrats do more than lay a collective hand on the social forces - they laid them on the lay them each his own hand; in this way, they divert them from Power and restore them again to society, in which thereafter the statocrats join forces, by reason of the similarity of their situations and interests, with the ancient aristocracies in retreat. Moreover, the statocratic acids, in so far as they break down the aristocratic molecules, do not make away with all the forces which they liberate. Part of them stays unappropriated, and furnishes new captains of society with the personnel necessary to the construction of new principates. In this way, the fission of the feudal cell at the height of the Middle Ages released the labour on which the merchant-drapers rose to wealth and political importance. So also in England, with a greed of Henry VIII had fallen on the ecclesiastical authorities to get from their wealth, the wherewithal to carry out his policies, the greater part of the monastic spoils, stuck to the fingers of hands, which had been held out to receive them. These spoils founded the fortunes of the nascent English capitalism. In this way, new hives are forever being built, in which lie hidden a new sort of energies; these will in time inspire the state to fresh orgies of covetousness. That is why the statocratic aggression seemed never to reach its logical conclusion - the complete atomization of society, which should contain henceforward nothing but isolated individuals whom the state alone rules and exploits.
