The burden of proof is put on the critics to demonstrate to a certainty that these policies alone were the only possible cause of the worsening that occurred. No burden of proof whatever is put on those who had so confidently predicted improvement. Indeed, it is often asserted that things would have been even worse, were it not for the wonderful programs that mitigated the inevitable damage from other factors. Examples of this pattern are all too abundant. Three will be considered here. The first and most general involves the set of social welfare policies called “the war on poverty” during the administration of President Lyndon B. Johnson, but continuing under other labels since then. Next is the policy of introducing “sex education” into the public schools, as a means of reducing teenage pregnancy and venereal diseases. The third example will be policies designed to reduce crime by adopting a less punitive approach, being more concerned with preventive social policies beforehand and rehabilitation afterwards, as well as showing more concern with the legal rights of defendants in criminal cases.

Of all these issues individual white women with class privilege identified most intimately with the pain of unwanted pregnancy. And they highlighted the abortion issue. They were not by any means the only group in need of access to safe, legal abortions. As already stated, they were far more likely to have the means the to acquire an abortion than poor and working-class women. In those days poor women, black women included, often sought illegal abortions. The right to have an abortion was not a white-women-only issue; it was simply not the only or even most important reproductive concern for masses of American women.

To review briefly, in the late 1960s, men got paid more than women (usually double) for doing the exact same job. Women could get credit cards in their husband's names but not their own, and many divorced, single and separated women could not get cards at all. Women could not get mortgages on their own and if a couple applied for a mortgage, only the husband's income was considered. Women faced widespread and consistent discrimination in education, scholarship awards, and on the job. In most states the collective property of a marriage was legally the husband's since the wife had allegedly not contributed to acquiring it. Women were largely kept out of a whole host of jobs--doctor, college professor, bus driver, business manager--that women today take for granted. They were knocked out in the delivery room... once women got pregnant they were either fired from their jobs or expected to quit. If they were women of color, it was worse on all fronts--work education, health care. (And talk about slim pickings. African American men were being sent to prison and cut out of jobs by the millions.) Most women today, having seen reruns of The Brady Bunch and Father Knows Best, and having heard of Betty Friedan's The Feminine Mystique, the bestseller that attacked women's confinement to the home, are all too familiar with the idealized yet suffocating media images of happy, devoted housewives. In fact, most of us have learned to laugh at them, vacuuming in their stockings and heels, clueless about balancing a checkbook, asking dogs directions to the neighbor's. But we should not permit our ability to distance ourselves from these images to erase the fact that all women--and we mean all women--were, in the 1950s and '60s supposed to internalize this ideal, to live it and believe it.

The communities do not appear on official maps, most have no educational facilities, and residents live under constant threat of having their homes demolished. They razed one unrecognized village that challenged the expropriation of its lands, al-Araqib, 185 times.

Jim Crow was not merely about the physical separation of blacks and whites. Nor was segregation strictly about laws, despite historians' tendency to fix upon legal landmarks as Plessy v. Ferguson (1896), Brown v. Board of Education (1954), and the Civil Rights Act of 1964. In order to maintain dominance, whites needed more than the statutes and signs that specified "whites" and "blacks" only; they had to assert and reiterate black inferiority with every word and gesture, in every aspect of both public and private life. Noted theologian Howard Thurman dissected the "anatomy" of segregation with chilling precision in his classic 1965 book, The Luminous Darkness. A white supremacist society must not only "array all the forces of legislation and law enforcement, " he wrote; "it must falsify the facts of history, tamper with the insights of religion and religious doctrine, editorialize and slant news and the printed word. On top of that it must keep separate schools, separate churches, separate graveyards, and separate public accommodations-all this in order to freeze the place of the Negro in society and guarantee his basic immobility." Yet this was "but a partial indication of the high estimate" that the white South placed upon African Americans. "Once again, to state it categorically, " Thurman concludes, "the measure of a man's estimate of your strength is the kind of weapons he feels he must use in order to hold you fast in a prescribed place.

As the result of its systems and of its efforts, it would seem that socialism, notwithstanding all its self-compaceny, can scarcely help perceiving the monster of legal plunder. But what does it do? It disguises it cleverly from others, and even from itself, under the seductive names of fraternity, solidarity, organization, association. And because we do not ask so much at the hands of the law, because we only ask it for justice, it alleges that we reject fraternity, solidarity, organization, and association; and they brand us with the name of individualists. We can assure them that what we repudiate is not natural organization, but forced organization. It is not free association, but the forms of association that they would impose upon us. It is not spontaneous fraternity, but legal fraternity. It is not providential solidarity, but artificial solidarity, which is only an unjust displacement of responsibility. Socialism, like the old policy from which it emanates, confounds Government and society. And so, every time we object to a thingbeing done by Government, it concludes that we object to its being done at all. We disapprove of education by the State--then we are against education altogether. We object to a State religion--then we would have no religion at all. We object to an equality which is brought about by the State then we are against equality, etc., etc. They might as well accuse us of wishing men not to eat, beacuse we object to the cultivation of corn by the State.

Sometimes, for instance, there would be a matter the governor didn’t want to discuss in public, but we knew he’d be asked about it at his next public appearance, or in any case Aaron would be asked about it. Let’s say the head of a cabinet agency had been accused by a state senator of running a cockfighting ring. His behavior would fall within executive purview, but since he had not been indicted or even legally accused, he couldn’t be fired or forced to resign. Aaron knew the governor would be asked about it at a press conference, so our office would issue a statement to any member of the press who asked about it. “[The senator’s] remarks have raised some troubling questions,” the statement might say, “and we’re looking closely at the situation in an effort to determine whether it merits further investigation by state or local law enforcement. At the same time, we want to avoid rushing to judgment, and we hope all concerned will likewise avoid making accusations in the absence of evidence.” This is the kind of statement Aaron would need: one that said something without saying anything. It would get the governor on record without committing him to any course of action. Hence the rhetorical dead weight: “state or local law enforcement” instead of just “law enforcement”; all that about “rushing to judgment” and “making accusations in the absence of evidence,” as if anybody needed to be told that. If a reporter asked the governor about it, he could avoid talking about it without having to use that self-incriminating phrase “No comment.” “I’d go back to what we’ve already said on this,” he might say, and repeat the gaseous phrases of the statement.

I met with a group of a hundred or so fifth graders from a poor neighborhood at a school in Houston, Texas. Most of them were on a track that would never get them to college. So I decided then and there to make a contract with them. I would pay for their four-year college education if they kept a B average and stayed out of trouble. I made it clear that with focus, anyone could be above average, and I would provide mentoring support to them. I had a couple of key criteria: They had to stay out of jail. They couldn't get pregnant before graduating high school. Most importantly, they needed to contribute 20 hours of service per year to some organization in their community. Why did I add this? College is wonderful, but what was even more important to me was to teach them they had something to give, not just something to get in life. I had no idea how I was going to pay for it in the long run, but I was completely committed, and I signed a legally binding contract requiring me to deliver the funds. It's funny how motivating it can be when you have no choice but to move forward. I always say, if you want to take the island, you have to burn your boats! So I signed those contracts. Twenty-three of those kids worked with me from the fifth grade all the way to college. Several went on to graduate school, including law school! I call them my champions. Today they are social workers, business owners, and parents. Just a few years ago, we had a reunion, and I got to hear the magnificent stories of how early-in-life giving to others had become a lifelong pattern. How it caused them to believe they had real worth in life. How it gave them such joy to give, and how many of them now are teaching this to their own children.

As I see it, the War on Drugs—more than any other government program or political initiative—gave rise to mass incarceration as defined above. Although the political dynamics that gave birth to the system date back to slavery, the drug war marked an important turning point in American history, one that cannot be measured simply by counting heads in prisons and jails. The declaration and escalation of the War on Drugs marked a moment in our past when a group of people defined by race and class was viewed and treated as the “enemy.” A literal war was declared on a highly vulnerable population, leading to a wave of punitiveness that permeated every aspect of our criminal justice system and redefined the scope of fundamental constitutional rights. The war mentality resulted in the militarization of local police departments and billions invested in drug law enforcement at the state and local levels. It also contributed to astronomical expenditures for prison building for people convicted of all crimes and the slashing of billions from education, public housing and welfare programs, as well as a slew of legislation authorizing legal discrimination against millions of people accused of drug offenses, denying them access to housing, food stamps, credit, basic public benefits, and financial aid for schooling. This war did not merely increase the number of people in prisons and jails. It radically altered the life course of millions, especially black men who were the primary targets in the early decades of the war. Their lives and families were destroyed for drug crimes that were largely ignored on the other side of town. Those who define “mass incarceration” narrowly, to include only individuals currently locked in prisons or jails, erase from public view the overwhelming majority of

No one acts in a void. We all take cues from cultural norms, shaped by the law. For the law affects our ideas of what is reasonable and appropriate. It does so by what it prohibits--you might think less of drinking if it were banned, or more of marijuana use if it were allowed--but also by what it approves. . . . Revisionists agree that it matters what California or the United States calls a marriage, because this affects how Californians or Americans come to think of marriage. Prominent Oxford philosopher Joseph Raz, no friend of the conjugal view, agrees: "[O]ne thing can be said with certainty [about recent changes in marriage law]. They will not be confined to adding new options to the familiar heterosexual monogamous family. They will change the character of that family. If these changes take root in our culture then the familiar marriage relations will disappear. They will not disappear suddenly. Rather they will be transformed into a somewhat different social form, which responds to the fact that it is one of several forms of bonding, and that bonding itself is much more easily and commonly dissoluble. All these factors are already working their way into the constitutive conventions which determine what is appropriate and expected within a conventional marriage and transforming its significance." Redefining civil marriage would change its meaning for everyone. Legally wedded opposite-sex unions would increasingly be defined by what they had in common with same-sex relationships. This wouldn't just shift opinion polls and tax burdens. Marriage, the human good, would be harder to achieve. For you can realize marriage only by choosing it, for which you need at least a rough, intuitive idea of what it really is. By warping people's view of marriage, revisionist policy would make them less able to realize this basic way of thriving--much as a man confused about what friendship requires will have trouble being a friend. . . . Redefining marriage will also harm the material interests of couples and children. As more people absorb the new law's lesson that marriage is fundamentally about emotions, marriages will increasingly take on emotion's tyrannical inconstancy. Because there is no reason that emotional unions--any more than the emotions that define them, or friendships generally--should be permanent or limited to two, these norms of marriage would make less sense. People would thus feel less bound to live by them whenever they simply preferred to live otherwise. . . . As we document below, even leading revisionists now argue that if sexual complementarity is optional, so are permanence and exclusivity. This is not because the slope from same-sex unions to expressly temporary and polyamorous ones is slippery, but because most revisionist arguments level the ground between them: If marriage is primarily about emotional union, why privilege two-person unions, or permanently committed ones? What is it about emotional union, valuable as it can be, that requires these limits? As these norms weaken, so will the emotional and material security that marriage gives spouses. Because children fare best on most indicators of health and well-being when reared by their wedded biological parents, the same erosion of marital norms would adversely affect children's health, education, and general formation. The poorest and most vulnerable among us would likely be hit the hardest. And the state would balloon: to adjudicate breakup and custody issues, to meet the needs of spouses and children affected by divorce, and to contain and feebly correct the challenges these children face.

In seeking to establish the causes of poverty and other social problems among black Americans, for example, sociologist William Julius Wilson pointed to factors such as “the enduring effects of slavery, Jim Crow segregation, public school segregation, legalized discrimination, residential segregation, the FHA’s redlining of black neighborhoods in the 1940s and ’50s, the construction of public housing projects in poor black neighborhoods, employer discrimination, and other racial acts and processes.”1 These various facts might be summarized as examples of racism, so the causal question is whether racism is either the cause, or one of the major causes, of poverty and other social problems among black Americans today. Many might consider the obvious answer to be “yes.” Yet some incontrovertible facts undermine that conclusion. For example, despite the high poverty rate among black Americans in general, the poverty rate among black married couples has been less than 10 percent every year since 1994.2 The poverty rate of married blacks is not only lower than that of blacks as a whole, but in some years has also been lower than that of whites as a whole.3 In 2016, for example, the poverty rate for blacks was 22 percent, for whites was 11 percent, and for black married couples was 7.5 percent.4 Do racists care whether someone black is married or unmarried? If not, then why do married blacks escape poverty so much more often than other blacks, if racism is the main reason for black poverty? If the continuing effects of past evils such as slavery play a major causal role today, were the ancestors of today’s black married couples exempt from slavery and other injustices? As far back as 1969, young black males whose homes included newspapers, magazines, and library cards, and who also had the same education as young white males, had similar incomes as their white counterparts.5 Do racists care whether blacks have reading material and library cards?

No respecter of evidence has ever found the least clue as to what life is all about, and what people should do with it. Oh, there have been lots of brilliant guesses. But honest, educated people have to identify with them as such--as guesses. What are guesses worth? Scientifically and legally, they are not worth doodley-squat. As the saying goes: “Your guess is as good as mine.” The guesses we like best, as with so many things we like best, were taught to us in childhood--by people who loved us and wished us well. We are reluctant to criticize those guesses. It is an ultimate act of rudeness to find fault with anything which is given to us in a spirit of love. So a modern, secular education is often painful. By its very nature, it invites us to question the wisdom of the ones we love. Too bad. I have said that one guess is as good as another, but that is only roughly so. Some guesses are crueler than others--which is to say, harder on human beings, and on other animals as well. The belief that God wants heretics burned to death is a case in point. Some guesses are more suicidal than others. The belief that a true lover of God is immune to the bites of copperheads and rattlesnakes is a case in point. Some guesses are greedier and more egocentric than others. Belief in the divine right of kings and presidents is a case in point. Those are all discredited guesses. But it is reasonable to suppose that other bad guesses are poisoning our lives today. A good education in skepticism can help us to discover those bad guesses, and to destroy them with mockery and contempt. Most of them were made by honest, decent people who had no way of knowing what we know, or what we can find out, if we want to. We have one hell of a lot of good information about our bodies, about our planet, and the universe--about our past. We don’t have to guess as much as the old folks did. Bertrand Russell declared that, in case he met God, he would say to Him, “Sir, you did not give us enough information.” I would add to that, “All the same, Sir, I’m not persuaded that we did the best we could with the information we had. Toward the end there, anyway, we had tons of information.

In the real world, however, the claim that censorship or enforced orthodoxy protects minorities and the marginalized has been comprehensively disproved, again and again and again. “Censorship has always been on the side of authoritarianism, conformity, ignorance, and the status quo,” write Erwin Chemerinsky and Howard Gillman in their book Free Speech on Campus, “and advocates for free speech have always been on the side of making societies more democratic, more diverse, more tolerant, more educated, and more open to progress.”30 They and former American Civil Liberties Union president Nadine Strossen, in her powerful book Hate: Why We Should Resist It with Free Speech, Not Censorship, list the horrors and oppressions which have befallen minorities in the name of making society safe from dangerous ideas. “Laws censoring ‘hate speech’ have predictably been enforced against those who lack political power,” writes Strossen.31 In America, under the Alien and Sedition Acts, authorities censored and imprisoned sympathizers of the opposition party (including members of Congress) and shut down opposition newspapers; under the Comstock laws, they censored works by Aristophanes, Balzac, Oscar Wilde, and James Joyce (among others); under the World War I anti-sedition laws, they convicted more than a thousand peace activists, including the Socialist presidential candidate Eugene V. Debs, who ran for president in 1920 from a prison cell.32 In more recent times, when the University of Michigan adopted one of the first college speech codes in 1988, the code was seized upon to charge Blacks with racist speech at least twenty times.33 When the United Kingdom passed a hate-speech law, the first person to be convicted was a Black man who cursed a white police officer.34 When Canadian courts agreed with feminists that pornography could be legally restricted, authorities in Toronto promptly charged Canada’s oldest gay bookstore with obscenity and seized copies of the lesbian magazine Bad Attitude.35 All around the world, authorities quite uncoincidentally find that “hateful” and “unsafe” speech is speech which is critical of them—not least in the United States, where, in 1954, the U.S. Postal Service used obscenity laws to censor ONE, a gay magazine whose cover article (“You Can’t Print It!”) just happened to criticize the censorship policies of the U.S. Postal Service.

In the contemporary world there are two classes of bad plans-the plans invented and put into practice by men who do not accept our ideal postulates, and the plans invented and put into practice by the men who accept them, but imagine that the ends proposed by the prophets can be achieved by wicked or unsuitable means. Hell is paved with good intentions, and it is probable that plans made by well-meaning people of the second class may have results no less disastrous than plans made by evil-intentioned people of the first class. Which only shows, yet once more, how right the Buddha was in classing unawareness and stupidity among the deadly sins. Let us consider a few examples of bad plans belonging to these two classes. In the first class we must place all Fascist and all specifically militaristic plans. Fascism, in the words of Mussolini, believes that "war alone brings up to its highest tension all human energy and puts the stamp of nobility upon the peoples who have the courage to meet it." Again, "a doctrine which is founded upon the harmful postulate of peace is hostile to Fascism." The Fascist, then, is one who believes that the bombardment of open towns with fire, poison and explosives (in other words, modern war) is intrinsically good. He is one who rejects the teaching of the prophets and believes that the best society is a national society living in a state of chronic hostility towards other national societies and preoccupied with ideas of rapine and slaughter. He is one who despises the non-attached individual and holds up for admiration the person who, in obedience to the boss who happens at the moment to have grabbed political power, systematically cultivates all the passions (pride, anger, envy, hatred) which the philosophers and the founders of religions have unanimously condemned as the most maleficent, the least worthy of human beings. All fascist planning has one ultimate aim: to make the national society more efficient as a war machine. Industry, commerce and finance are controlled for this purpose. The manufacture of substitutes is encouraged in order that the country may be self-sufficient in time of war. Tariffs and quotas are imposed, export bounties distributed, exchanges depreciated for the sake of gaining a momentary advantage or inflicting loss upon some rival. Foreign policy is conducted on avowedly Machiavellian principles; solemn engagements are entered into with the knowledge that they will be broken the moment it seems advantageous to do so; international law is invoked when it happens to be convenient, repudiated when it imposes the least restraint on the nation's imperialistic designs. Meanwhile the dictator's subjects are systematically educated to be good citizens of the Fascist state. Children are subjected to authoritarian discipline that they may grow up to be simultaneously obedient to superiors and brutal to those below them. On leaving the kindergarten, they begin that military training which culminates in the years of conscription and continues until the individual is too decrepit to be an efficient soldier. In school they are taught extravagant lies about the achievements of their ancestors, while the truth about other peoples is either distorted or completely suppressed. the press is controlled, so that adults may learn only what it suits the dictator that they should learn. Any one expressing un-orthodox opinions is ruthlessly persecuted. Elaborate systems of police espionage are organized to investigate the private life and opinions of even the humblest individual. Delation is encouraged, tale-telling rewarded. Terrorism is legalized. Justice is administered in secret; the procedure is unfair, the penalties barbarously cruel. Brutality and torture are regularly employed.
