In a typical battle of today, it may consist of African American drivers being pulled over more often on the highways. (When Clarence Thomas described his successful but contentious 1991 Supreme Court confirmation hearing as a “high-tech lynching,” it was the epitome of tastelessness but also a sign of how far we have come.) The oppression of women used to include laws that allowed husbands to rape, beat, and confine their wives; today it is applied to elite universities whose engineering departments do not have a fifty-fifty ratio of male and female professors. The battle for gay rights has progressed from repealing laws that execute, mutilate, or imprison homosexual men to repealing laws that define marriage as a contract between a man and a woman. None of this means we should be satisfied with the status quo or disparage the efforts to combat remaining discrimination and mistreatment. It’s just to remind us that the first goal of any rights movement is to protect its beneficiaries from being assaulted or killed. No matter what evidence is marshaled to disprove their theories, it doesn’t matter to these crusaders—it’s just the system covering up for itself.20 This kind of defensive reasoning helps explain the rise of emotional intensity that surrounds the climate issue today. 'Slavery' is this same woman born in a world that loudly proclaims its love of freedom and inscribes this love in its essential texts, a world in which these same professors hold this woman a slave, hold her mother a slave, her father a slave, her daughter a slave, and when this woman peers back into the generations all she sees is the enslaved. she can hope for more. But when she dies, the world - which is really the only world she can ever know - ends. For this woman, enslavement is not a parable. It is damnation. It is the never-ending night. And the length of that night is most of our history. Never forget that we were enslaved in this country longer than we have been free. Never forget that for 250 years black people were born into chains - whole generations followed by more generations who knew nothing but chains. You must struggle to truly remember this past in all its nuance, error, and humanity. You must resist the common urge toward the comforting narrative of divine law, toward fairy tales that imply some irrepressible justice. The enslaved were not bricks in your road, and their lives were not chapters in your redemptive history. They were people turned to fuel for the American machine. Enslavement was not destined to end, and it is wrong to claim our present circumstance - not matter how improved - as the redemption for the lives of people who never asked for the posthumous, untouchable glory of dying for their children. Our triumphs can never compensate for this. Perhaps our triumphs are not even the point. Perhaps struggle is all we have because the god of history is an atheist, and nothing about his world is meant to be. So you must wake up every morning knowing that no promise is unbreakable, least of all the promise of waking up at all. This is not despair. These are the preferences of the universe itself: verbs over nouns, actions over states, struggle over hope.

She posits that prisons are teeming with young black men due primarily to a war on drugs that was launched by the Reagan administration in the 1980s for the express purpose of resegregating society. “This book argues that mass incarceration is, metaphorically, the New Jim Crow and that all those who care about social justice should fully commit themselves to dismantling this new racial caste system,” wrote Alexander.4 “What this book is intended to do—the only thing it is intended to do—is to stimulate a much-needed conversation about the role of the criminal justice system in creating and perpetrating racial hierarchy in the United States.”5 Liberals love to have “conversations” about these matters, and Alexander got her wish. The book was a best seller. NPR interviewed her multiple times at length. The New York Times said that Alexander “deserved to be compared to Du Bois.” The San Francisco Chronicle described the book as “The Bible of a social movement.

I am not a lawyer. I am stuck. Those young men may or may not represent the common-sense majority in the audience, but they have triumphed. Then a tall young woman in jeans rises from the back of the room. "Well," she says calmly, "I have a boa constrictor." This quiets the audience right down. "Once a month," she continues, "I go to the dissection lab on campus to get frozen mice to feed my boa constrictor. There is such an explosion of laughter that even the argumentative young men can't resist. She has made her point: not everyone wants the same thing. A just law can be flexible. Affective realism decimates the ideal of the impartial juror. Want to increase the likelihood of a conviction in a murder trial? Show the jury some gruesome photographic evidence. Tip their body budgets out of balance and chances are they’ll attribute their unpleasant affect to the defendant: “I feel bad, therefore you must have done something bad. You are a bad person.” Or permit family members of the deceased to describe how the crime has hurt them, a practice known as a victim impact statement, and the jury will tend to recommend more severe punishments. Crank up the emotional impact of a victim impact statement by recording it professionally on video and adding music and narration like a dramatic film, and you’ve got the makings of a jury-swaying masterpiece.45 Affective realism intertwines with the law outside the courtroom as well. Imagine that you are enjoying a quiet evening at home when suddenly you hear loud banging outside. You look out the window and see an African American man attempting to force open the door of a nearby house. Being a dutiful citizen, you call 911, and the police arrive and arrest the perpetrator. Congratulations, you have just brought about the arrest of Harvard professor Henry Louis Gates, Jr., as it happened on July 16, 2009. Gates was trying to force open the front door of his own home, which had become stuck while he was traveling. Affective realism strikes again. The real-life eyewitness in this incident had an affective feeling, presumably based on her concepts about crime and skin color, and made a mental inference that the man outside the window had intent to commit a crime.

Yet what are these civilizations, these notions of Muslim-ness, Western-ness, European-ness, American-ness, that attempt to describe where, and with whom, we belong? They are illusions: arbitrarily drawn constructs with porous, brittle, and overlapping borders. To what civilization does a Syrian atheist belong? A Muslim soldier in the US army? A Chinese professor in Germany? A lesbian fashion designer in Nigeria? After how many decades of US citizenship does a Spanish-speaking Honduran-born couple, with two generations of American children and grandchildren descended from them, cease to belong to a Latin American civilization and take their place in an American one? Civilizations are illusions, but these illusions are pervasive, dangerous, and powerful. They contribute to globalization’s brutality. They allow us, for example, to say that we believe in global free markets and, in the same breath, to discount as impossible the global free movement of labor; to claim that we believe in democracy and human equality, and yet to stymie the creation of global institutions based on one-person-one-vote and equality before the law. Civilizations encourage our hypocrisies to flourish. And by so doing, they undermine globalization’s only plausible promise: that we be free to invent ourselves. Why, exactly, can’t a Muslim be European? Why can’t an unreligious person be Pakistani? Why can’t a man be a woman? Why can’t someone who is gay be married? Mongrel. Miscegenator. Half-breed. Outcast. Deviant. Heretic. Our words for hybridity are so often epithets. They shouldn’t be. Hybridity need not be the problem. It could be the solution. Hybrids do more than embody mixtures between groups. Hybrids reveal the boundaries between groups to be false.

While it is possible that both may ultimately be absorbed by some more general principle, for the present we should note that the laws as they stand present profound differences—-(1) The systems considered in thermodynamics are permanent; species on the contrary are liable to extinction, although biological improvement must be expected to occur up to the end of their existence. (2) Fitness, although measured by a uniform method, is qualitatively different for every different organism, whereas entropy, like temperature, is taken to have the same meaning for all physical systems. (3) Fitness may be increased or decreased by changes in the environment, without reacting quantitatively upon that environment. (4) Entropy changes are exceptional in the physical world in being irreversible, while irreversible evolutionary changes form no exception among biological phenomena. Finally, (5) entropy changes lead to a progressive disorganization of the physical world, at least from the human standpoint of the utilization of energy, while evolutionary changes are generally recognized as producing progressively higher organization in the organic world.

Professor Jonathan Riley-Smith, author of A Short History of the Crusades and one of the world’s leading historians of the period, called the movie “rubbish,” explaining that “it’s not historically accurate at all” as it “depicts the Muslims as sophisticated and civilised, and the Crusaders are all brutes and barbarians. In American law, there is the Constitution and the whole body of common law precedent, and very little of that supports socialism. Consequently, if you are a Left-wing graduate student or professor in literature or law and you are confronted with the Western legal or literary canon, you have two choices. You can take on the opposing traditions, have your students read the great books and the great decisions, and argue with them in your classes. That is very hard work and also very risky—your students might come to agree with the wrong side. Or you can find a way to dismiss the whole tradition, so that you can teach only books that fit your politics. If you are looking for shortcuts, or if you have a sneaking suspicion that the right side might not fare well in the debate, then deconstruction is seductive. Deconstruction allows you to dismiss whole literary and legal traditions as built upon sexist or racist or otherwise exploitative assumptions.

The tie that bound them to the neighbors, that inspired them in the way my patriotism had always inspired me, had seemingly vanished. The symptoms are all around us. Significant percentages of white conservative voters--about one-third--believe that Barack Obama is a Muslim. In one poll, 32 percent of conservatives said that they believed Obama was foreign-born and another 19 percent said they were unsure--which means that a majority of white conservatives aren't certain that Obama is even an American. I regularly hear from acquaintances or distant family members that Obama has ties to Islamic extremists, or is a traitor, or was born in some far-flung corner of the world. Recall that not a single one of my high school classmates attended an Ivy League school. Barack Obama attended two of them and excelled at both. He is brilliant, wealthy, and speaks like a constitutional law professor--which, of course, he is. Nothing about him bears any resemblance to the people I admired growing up; His accent--clean, perfect, neutral--is foreign; his credentials are so impressive that they're frightening; he made his life in Chicago, a dense metropolis; and he conducts himself with a confidence that comes from knowing that the modern American meritocracy was built for him. THE CURIOUS CASE OF THE LEMBA       One of the most outstanding cases of  Black diaspora Jewry is the case of the Lemba of southern Africa. The Lemba have long claimed that they are Jews or Israelites who migrated to Yemen and from there to Africa as traders. Amazingly, DNA evidence has backed the Lemba claim of Jewish ancestry.   Today, the Lemba can be found in southern Africa countries like Malawi, South Africa and Zimbabwe. Many of their customs are similar to Jews such as the wearing of  yarmulke-like skull cups and observing kosher laws such as the requirement not to eat pork. Interestingly they also avoid eating rabbits, scaleless fish, hares and carrion. In short, the Lemba follow the requirements in the Torah, which is the first five books of the Old Testament.     The Lemba claim that about 2500 years ago, their ancestors left Judea for Yemen. Only males are said to have sailed to Africa by boat. The migrants took local wives for themselves. They built a city in Yemen called Sena. From Sena they traveled to Africa where they dispersed. Some remained in East Africa and others traveled to southern Africa. Lemba women do not have 'Semitic' admixture, and this is in line with their oral history.     Professor Tudor Vernon Parfitt, a professor of Jewish Studies then at the University of London, spent several months among the Lemba. By my second year of college, I found myself thinking more and more about law school as a next step. I’d actually been considering it since my freshman year, when I had taken a class with a political science professor named Robert McClure. He was a tough, no-nonsense professor whose class I loved. I learned quite a bit from him about how to make an argument—and, more importantly, that I loved to argue. By the time I was a junior, I had decided to become a lawyer, which was empowering as a decision. I’d been searching for what my path would be and how I’d take control of my life. Now, finally, I’d seized upon one. From my journal entry on January 26, 1991: I am twenty years old now and have actively begun to make what I want happen. It’s a good feeling, though certainly frightening. I know who I am becoming and who I want to be. The horrifying threat of misplaced nostalgia will never affect me as I age, for—succeed or fail—I will have accomplished the satisfaction of attempting. When I applied to law schools, initially I thought I wanted to go to Notre Dame. It was Irish and Catholic, it was in South Bend, Indiana, and I thought it might be fun to see a different part of the country. Plus, it was a great school. I was turned down by Notre Dame, but got a yes from Albany Law School (ALS), right in my hometown, so I could live at home and save some money. Besides, everyone says it’s the Notre Dame of Albany. I would need all the confidence I got from my family and from Jim, because law school was not for the faint of heart. The work was intense and the competition fierce. However, to my mother’s delight, not only did I thrive in law school, but I paid for it myself.

Many and various are the New York tales that are told of professor Sidney Morgenbesser. During a conference of linguistic philosophers at Columbia University, he interrupted the pompous J. L. Austin, who was saying that while many double negatives express a positive—as in “not unattractive”—there is no example in English of a double positive expressing a negative. Morgenbesser’s interjection took the form of the two words “Yeah, yeah.” Or it could have been “Yeah, right.” On another occasion, he put his pipe in his mouth as he was ascending the subway steps. A policeman approached and told him that there was no smoking on the subway. Morgenbesser explained—pointed out might be a better term—that he was leaving the subway, not entering it, and had not yet lit up. The cop repeated his injunction. Morgenbesser reiterated his observation. After a few such exchanges, the cop saw he was beaten and fell back on the oldest standby of enfeebled authority: “If I let you do it, I’d have to let everyone do it.” To this the old philosopher replied, “Who do you think you are—Kant?” His last word was misconstrued, and the whole question of the categorical imperative had to be hashed out down at the precinct house. Morgenbesser walked. That, in my opinion, is the way that New York is supposed to be. Irony and a bit of sass, combined with a pugnacious independence, should always stand a chance against bovine officials who have barely learned to memorize such demanding mantras as “zero tolerance” and “no exceptions.” Today, the professor would be stopped, insulted, ticketed, and told that if he didn’t like it he could waste a day in court, or several days dealing with the bureaucracy, or both.

Professor Whitehead points out that centuries of belief in a God who combined ’the personal energy of Jehovah’ with the ‘rationality of a Greek philosopher’ first produced that firm expectation of systematic order which rendered possible the birth of modern science. Men became scientific because they expected Law in Nature, and they expected Law in Nature because they believed in a Legislator. In most modern scientists this belief has died; it will be interesting to see how long their confidence in uniformity survives it. Two significant developments have already appeared— the hypothesis of a lawless sub-nature, and the surrender of the claim that science is true. We may be living nearer than we suppose to the end of the Scientific Age. But if we admit God, must we admit Miracle? Indeed, indeed, you have no security against it. That is the bargain. Theology says to you in effect, ‘Admit God and with Him the risk of a few miracles, and I in return will ratify your faith in uniformity as regards the overwhelming majority of events.’ The philosophy which forbids you to make uniformity absolute is also the philosophy which offers you solid grounds for believing it to be general, to be almost absolute. The Being who threatens Nature’s claim to omnipotence confirms her in her lawful occasions. Give us this ha’porth of tar and we will save the ship. The alternative is really much worse. Try to make Nature absolute and you will find that her uniformity is not even probable. By claiming too much, you get nothing. You get the deadlock, as in Hume. Theology offers you a working arrangement, which leaves the scientist free to continue his experiments and the Christian to continue his prayers.

A famous British writer is revealed to be the author of an obscure mystery novel. An immigrant is granted asylum when authorities verify he wrote anonymous articles critical of his home country. And a man is convicted of murder when he’s connected to messages painted at the crime scene. The common element in these seemingly disparate cases is “forensic linguistics”—an investigative technique that helps experts determine authorship by identifying quirks in a writer’s style. Advances in computer technology can now parse text with ever-finer accuracy. Consider the recent outing of Harry Potter author J.K. Rowling as the writer of The Cuckoo’s Calling , a crime novel she published under the pen name Robert Galbraith. England’s Sunday Times , responding to an anonymous tip that Rowling was the book’s real author, hired Duquesne University’s Patrick Juola to analyze the text of Cuckoo , using software that he had spent over a decade refining. One of Juola’s tests examined sequences of adjacent words, while another zoomed in on sequences of characters; a third test tallied the most common words, while a fourth examined the author’s preference for long or short words. Juola wound up with a linguistic fingerprint—hard data on the author’s stylistic quirks. He then ran the same tests on four other books: The Casual Vacancy , Rowling’s first post-Harry Potter novel, plus three stylistically similar crime novels by other female writers. Juola concluded that Rowling was the most likely author of The Cuckoo’s Calling , since she was the only one whose writing style showed up as the closest or second-closest match in each of the tests. After consulting an Oxford linguist and receiving a concurring opinion, the newspaper confronted Rowling, who confessed. Juola completed his analysis in about half an hour. By contrast, in the early 1960s, it had taken a team of two statisticians—using what was then a state-of-the-art, high-speed computer at MIT—three years to complete a project to reveal who wrote 12 unsigned Federalist Papers. Robert Leonard, who heads the forensic linguistics program at Hofstra University, has also made a career out of determining authorship. Certified to serve as an expert witness in 13 states, he has presented evidence in cases such as that of Christopher Coleman, who was arrested in 2009 for murdering his family in Waterloo, Illinois. Leonard testified that Coleman’s writing style matched threats spray-painted at his family’s home (photo, left). Coleman was convicted and is serving a life sentence. Since forensic linguists deal in probabilities, not certainties, it is all the more essential to further refine this field of study, experts say. “There have been cases where it was my impression that the evidence on which people were freed or convicted was iffy in one way or another,” says Edward Finegan, president of the International Association of Forensic Linguists. Vanderbilt law professor Edward Cheng, an expert on the reliability of forensic evidence, says that linguistic analysis is best used when only a handful of people could have written a given text. As forensic linguistics continues to make headlines, criminals may realize the importance of choosing their words carefully. And some worry that software also can be used to obscure distinctive written styles. “Anything that you can identify to analyze,” says Juola, “I can identify and try to hide.

I’m the kind of patriot whom people on the Acela corridor laugh at. I choke up when I hear Lee Greenwood’s cheesy anthem “Proud to Be an American.” When I was sixteen, I vowed that every time I met a veteran, I would go out of my way to shake his or her hand, even if I had to awkwardly interject to do so. Professor Joseph Stiglitz, former Chief Economist of the World Bank, and former Chairman of President Clinton's Council of Economic Advisers, goes public over the World Bank’s, “Four Step Strategy,” which is designed to enslave nations to the bankers. I summarise this below, 1. Privatisation. This is actually where national leaders are offered 10% commissions to their secret Swiss bank accounts in exchange for them trimming a few billion dollars off the sale price of national assets. Bribery and corruption, pure and simple. 2. Capital Market Liberalization. This is the repealing any laws that taxes money going over its borders. Stiglitz calls this the, “hot money,” cycle. Initially cash comes in from abroad to speculate in real estate and currency, then when the economy in that country starts to look promising, this outside wealth is pulled straight out again, causing the economy to collapse. The nation then requires International Monetary Fund (IMF) help and the IMF provides it under the pretext that they raise interest rates anywhere from 30% to 80%. This happened in Indonesia and Brazil, also in other Asian and Latin American nations. These higher interest rates consequently impoverish a country, demolishing property values, savaging industrial production and draining national treasuries. 3. Market Based Pricing. This is where the prices of food, water and domestic gas are raised which predictably leads to social unrest in the respective nation, now more commonly referred to as, “IMF Riots.” These riots cause the flight of capital and government bankruptcies. This benefits the foreign corporations as the nations remaining assets can be purchased at rock bottom prices. 4. Free Trade. This is where international corporations burst into Asia, Latin America and Africa, whilst at the same time Europe and America barricade their own markets against third world agriculture. They also impose extortionate tariffs which these countries have to pay for branded pharmaceuticals, causing soaring rates in death and disease.

Disillusionment Charms should be performed daily, as their effects are apt to wear off. MEMORY CHARMS When the worst happens and a Muggle sees what he or she is not supposed to see, the Memory Charm is perhaps the most useful repair tool. The Memory Charm may be performed by the owner of the beast in question, but in severe cases of Muggle notice, a team of trained Obliviators may be sent in by the Ministry of Magic. THE OFFICE OF MISINFORMATION The Office of Misinformation will become involved in only the very worst magical–Muggle collisions. Some magical catastrophes or accidents are simply too glaringly obvious to be explained away by Muggles without the help of an outside authority. The Office of Misinformation will in such a case liaise directly with the Muggle prime minister to seek a plausible non-magical explanation for the event. The unstinting efforts of this office in persuading Muggles that all photographic evidence of the Loch Ness kelpie is fake have gone some way to salvaging a situation that at one time looked exceedingly dangerous. 7. In his 1972 book Muggles Who Notice, Blenheim Stalk asserts that some residents of Ilfracombe escaped the Mass Memory Charm. ‘To this day, a Muggle bearing the nickname “Dodgy Dirk” holds forth in bars along the south coast on the subject of a “dirty great flying lizard” that punctured his lilo.’ 8. Two other highly vocal FMSF Advisory Board members are Dr Elizabeth Loftus and Professor Richard Ofshe. Loftus is a respected academic psychologist whose much quoted laboratory experiment of successfully implanting a fictitious childhood memory of being lost in a shopping mall is frequently used to defend the false memory syndrome argument. In the experiment, older family members persuaded younger ones of the (supposedly) never real event. However, Loftus herself says that being lost, which almost everyone has experienced, is in no way similar to being abused. Jennifer Freyd comments on the shopping mall experiment in Betrayal Trauma (1996): “If this demonstration proves to hold up under replication it suggests both that therapists can induce false memories and, even more directly, that older family members play a powerful role in defining reality for dependent younger family members." (p. 104). Elizabeth Loftus herself was sexually abused as a child by a male babysitter and admits to blacking the perpetrator out of her memory, although she never forgot the incident. In her autobiography, Witness for the Defence, she talks of experiencing flashbacks of this abusive incident on occasion in court in 1985 (Loftus &Ketcham, 1991, p.149) In her teens, having been told by an uncle that she had found her mother's drowned body, she then started to visualize the scene. Her brother later told her that she had not found the body. Dr Loftus's successful academic career has run parallel to her even more high profile career as an expert witness in court, for the defence of those accused of rape, murder, and child abuse. She is described in her own book as the expert who puts memory on trial, sometimes with frightening implications. She used her theories on the unreliability of memory to cast doubt, in 1975, on the testimony of the only eyewitness left alive who could identify Ted Bundy, the all American boy who was one of America's worst serial rapists and killers (Loftus & Ketcham, 1991, pp. 61-91). Not withstanding Dr Loftus's arguments, the judge kept Bundy in prison. Bundy was eventually tried, convicted and executed.

can be horribly fallible, and is over-rated in courts of law. Psychological experiments have given us some stunning demonstrations, which should worry any jurist inclined to give superior weight to ‘eye-witness’ evidence. A famous example was prepared by Professor Daniel J. Simons at the University of Illinois. Half a dozen young people standing in a circle were filmed for 25 seconds tossing a pair of basketballs to each other, and we, the experimental subjects, watch the film. The players weave in and out of the circle and change places as they pass and bounce the balls, so the scene is quite actively complicated. Before being shown the film, we are told that we have a task to perform, to test our powers of observation. We have to count the total number of times balls are passed from person to person. At the end of the test, the counts are duly written down, but – little does the audience know – this is not the real test! After showing the film and collecting the counts, the experimenter drops his bombshell. ‘And how many of you saw the gorilla?’ The majority of the audience looks baffled: blank. The experimenter then replays the film, but this time tells the audience to watch in a relaxed fashion without trying to count anything. Amazingly, nine seconds into the film, a man in a gorilla suit strolls nonchalantly to the centre of the circle of players, pauses to face the camera, thumps his chest as if in belligerent contempt for eye-witness evidence, and then strolls off with the same insouciance as before (see colour page 8). He is there in full view for nine whole seconds – more than one-third of the film – and yet the majority of the witnesses never see him. They would swear an oath in a court of law that no man in a gorilla suit was present, and they would swear that they had been watching with more than usually acute concentration for the whole 25 seconds, precisely because they were counting ball-passes. Many experiments along these lines have been performed, with similar results, and with similar reactions of stupefied disbelief when the audience is finally shown the truth. Eye-witness testimony, ‘actual observation’, ‘a datum of experience’ – all are, or at least can be, hopelessly unreliable. It is, of course, exactly this unreliability among observers that stage conjurors exploit with their techniques of deliberate distraction.

There was an original purpose to the Second Amendment, but it wasn’t to keep people safe. It was to preserve white supremacy and slavery. The Second Amendment is in the Constitution because Patrick Henry (Virginia’s governor at the time that the Constitution was being debated) and George Mason (the intellectual leader of the movement against the Constitution, the “anti-federalists”) won a debate against James Madison (the guy who wrote most of the Constitution and its original ten amendments). Henry and Mason wanted the Second Amendment in there to guard against slave revolts. Although, overall, white Southerners outnumbered their enslaved populations, that numerical advantage did not hold in every region. In parts of Virginia, for instance, enslaved Black people outnumbered whites. Predictably, whites were worried about slave revolts because, you know, holding people in bondage against their will is not all that easy to do without numerical and military superiority. The principal way of quelling slave revolts was (wait for it): armed militias of white people. Gangs of white people roving around, imposing white supremacy, is nothing new. But the slavers worried that the new Constitution put the power of raising militias with the federal government and not with the individual states. That would mean that the federal government, dominated by Northerners, could choose to not help the South should their population of oppressed humans demand freedom. In a May 2018 New York Times article, Professor Carl Bogus of Roger Williams University School of Law explained the argument like this: During the debate in Richmond, Mason and Henry suggested that the new Constitution gave Congress the power to subvert the slave system by disarming the militias. “Slavery is detested,” Henry reminded the audience. “The majority of Congress is to the North, and the slaves are to the South.” Henry and Mason argued that because the Constitution gave the federal government the power to arm the militias, only the federal government could do so: “If they neglect or refuse to discipline or arm our militia, they will be useless: the states can do neither—this power being exclusively given to Congress.” Why would the federal government “neglect” a Southern militia? Henry and Mason feared the Northerners who “detested” slavery would refuse to help the South in the event of a slave uprising. Madison eventually gave in to the forces of slavery and included the Second Amendment, along with his larger Bill of Rights.

Power is seeping away from autocrats and single-party systems whether they embrace reform or not. It is spreading from large and long-established political parties to small ones with narrow agendas or niche constituencies. Even within parties, party bosses who make decisions, pick candidates, and hammer out platforms behind closed doors are giving way to insurgents and outsiders—to new politicians who haven’t risen up in the party machine, who never bothered to kiss the ring. People entirely outside the party structure—charismatic individuals, some with wealthy backers from outside the political class, others simply catching a wave of support thanks to new messaging and mobilization tools that don’t require parties—are blazing a new path to political power. Whatever path they followed to get there, politicians in government are finding that their tenure is getting shorter and their power to shape policy is decaying. Politics was always the art of the compromise, but now politics is downright frustrating—sometimes it feels like the art of nothing at all. Gridlock is more common at every level of decision-making in the political system, in all areas of government, and in most countries. Coalitions collapse, elections take place more often, and “mandates” prove ever more elusive. Decentralization and devolution are creating new legislative and executive bodies. In turn, more politicians and elected or appointed officials are emerging from these stronger municipalities and regional assemblies, eating into the power of top politicians in national capitals. Even the judicial branch is contributing: judges are getting friskier and more likely to investigate political leaders, block or reverse their actions, or drag them into corruption inquiries that divert them from passing laws and making policy. Winning an election may still be one of life’s great thrills, but the afterglow is diminishing. Even being at the top of an authoritarian government is no longer as safe and powerful a perch as it once was. As Professor Minxin Pei, one of the world’s most respected experts on China, told me: “The members of the politburo now openly talk about the old good times when their predecessors at the top of the Chinese Communist Party did not have to worry about bloggers, hackers, transnational criminals, rogue provincial leaders or activists that stage 180,000 public protests each year. When challengers appeared, the old leaders had more power to deal with them. Today’s leaders are still very powerful but not as much as those of a few decades back and their powers are constantly declining.”3

BUYING OFF THE ENVIRONMENTALISTS Where are the environmentalists? In 1971, Oregon governor and environmentalist Tom McCall told a CBS interviewer, “Come visit us again. . . . The Sierra Club began sounding the alarm over the country’s expanding population in 1965—the very year Teddy Kennedy’s immigration act passed65—and in 1978, adopted a resolution expressly asking Congress to “conduct a thorough examination of U.S. immigration laws.” For a while, the Club talked about almost nothing else. “It is obvious,” the Club said two years later, “that the numbers of immigrants the United States accepts affects our population size and growth rate,” even more than “the number of children per family.”66 Over the next three decades, America took in tens of millions of legal immigrants and illegal aliens alike. But, suddenly, about ten years ago, the Sierra Club realized to its embarrassment that importing multiple millions of polluting, fire-setting, littering immigrants is actually fantastic for the environment! The advantages of overpopulation dawned on the Sierra Club right after it received a $100 million donation from hedge fund billionaire David Gelbaum with the express stipulation that—as he told the Los Angeles Times—“if they ever came out anti-immigration, they would never get a dollar from me.”67 It would be as if someone offered the Catholic Church $100 million to be pro-abortion. But the Sierra Club said: Sure! Did you bring the check? Obviously, there’s no longer any reason to listen to them on anything. They want us to get all excited about some widening of a road that’s going to disturb a sandfly, but the Sierra Club is totally copasetic with our national parks being turned into garbage dumps. Not only did the Sierra Club never again say another word against immigration, but, in 2004, it went the extra mile, denouncing three actual environmentalists running for the Club’s board, by claiming they were racists who opposed mass immigration. The three “white supremacists” were Dick Lamm, the three-time Democratic governor of Colorado; Frank Morris, former head of the Black Congressional Caucus Foundation; and Cornell professor David Pimentel, who created the first ecology course at the university in 1957 and had no particular interest in immigration.68 But they couldn’t be bought off, so they were called racists.

Since his angle was no longer the patent case, he didn’t bother to reach out to the Fuiszes. — WHEN PARLOFF’S COVER STORY was published in the June 12, 2014, issue of Fortune, it vaulted Elizabeth to instant stardom. Her Journal interview had gotten some notice and there had also been a piece in Wired, but there was nothing like a magazine cover to grab people’s attention. Especially when that cover featured an attractive young woman wearing a black turtleneck, dark mascara around her piercing blue eyes, and bright red lipstick next to the catchy headline “THIS CEO IS OUT FOR BLOOD.” The story disclosed Theranos’s valuation for the first time as well as the fact that Elizabeth owned more than half of the company. There was also the now-familiar comparison to Steve Jobs and Bill Gates. This time it came not from George Shultz but from her old Stanford professor Channing Robertson. (Had Parloff read Robertson’s testimony in the Fuisz trial, he would have learned that Theranos was paying him $500,000 a year, ostensibly as a consultant.) Parloff also included a passage about Elizabeth’s phobia of needles—a detail that would be repeated over and over in the ensuing flurry of coverage his story unleashed and become central to her myth. When the editors at Forbes saw the Fortune article, they immediately assigned reporters to confirm the company’s valuation and the size of Elizabeth’s ownership stake and ran a story about her in their next issue. Under the headline “Bloody Amazing,” the article pronounced her “the youngest woman to become a self-made billionaire.” Two months later, she graced one of the covers of the magazine’s annual Forbes 400 issue on the richest people in America. More fawning stories followed in USA Today, Inc., Fast Company, and Glamour, along with segments on NPR, Fox Business, CNBC, CNN, and CBS News. With the explosion of media coverage came invitations to numerous conferences and a cascade of accolades. Elizabeth became the youngest person to win the Horatio Alger Award. Time magazine named her one of the one hundred most influential people in the world. President Obama appointed her a U.S. ambassador for global entrepreneurship, and Harvard Medical School invited her to join its prestigious board of fellows.

"Slavery" is this same woman born in a world that loudly proclaims its love of freedom and inscribes this love in its essential texts, a world in which these same professors hold this woman a slave, hold her mother a slave, her father a slave, her daughter a slave, and when this woman peers back into the generations all she sees is the enslaved. She can hope for more. She can imagine some future for her grandchildren. But when she dies, the world - which is really the only world she can ever know - ends. For this woman, enslavement is not a parable, It is damnation. It is the never-ending night. And the length of that night is most of our history. Never forget that we were enslaved in this country longer than we have been free. Never forget that for 250 years black people were born in to chains - whole generations followed by more generations that knew nothing but chains. You must struggle to remember this past in all its nuance, error, and humanity. You must resist the common urge toward the comforting narrative of divine law, toward fairy tales that imply some irrepressible justice. The enslaved were not bricks in your road, and their lives were not chapters in your redemptive history. They were people turned to fuel for the American machine. Enslavement was not destined to end, and it is wrong to claim our present circumstance - no matter how improved - as the redemption for the lives of the people who never asked for the posthumous, untouchable glory of dying for their children. Our triumphs can never compensate for this. Perhaps our triumphs are not even the point. Perhaps struggle is all we have because the god of history is an atheist, and nothing about his world is meant to be. So you must wake up every morning knowing that no promise is unbreakable, least of all the promise of waking up at all. This is not despair. These are the preferences of the universe itself: verbs over nouns, actions over states, struggle over hope.

The Sixteen Conclusions of Reverend Kirk In the last half of the seventeenth century, a Scottish scholar gathered all the accounts he could find about the Sleagh Maith and, in 1691, wrote an amazing manuscript entitled The Secret Commonwealth of Elves, Fauns and Fairies. It was the first systematic attempt to describe the methods and organization of the strange creatures that plagued the farmers of Scotland. The author, Reverend Kirk, of Aberfoyle, studied theology at St. Andrews and took his degree of professor at Edinburgh. Later he served as minister for the parishes of Balquedder and Aberfoyle and died in 1692. Kirk invented the name "the Secret Commonwealth" to describe the organization of the elves. It is impossible to quote the entire text of his treatise, but we can summarize his findings about elves and other aerial creatures in the following way: 1. They have a nature that is intermediate between man and the angels. 2. Physically, they have very light and fluid bodies, which are comparable to a condensed cloud. They are particularly visible at dusk. They can appear and vanish at will. 3. Intellectually, they are intelligent and curious. 4. They have the power to carry away anything they like. 5. They live inside the earth in caves, which they can reach through any crevice or opening where air passes. 6. When men did not inhabit most of the world, the creatures used to live there and had their own agriculture. Their civilization has left traces on the high mountains; it was flourishing at a time when the whole countryside was nothing but woods and forests. 7. At the beginning of each three-month period, they change quarters because they are unable to stay in one place. Besides, they like to travel. It is then that men have terrible encounters with them, even on the great highways. 8. Their chameleon-like bodies allow them to swim through the air with all their household. 9. They are divided into tribes. Like us, they have children, nurses, marriages, burials, etc., unless they just do this to mock our own customsor to predict terrestrial events. 10. Their houses are said to be wonderfully large and beautiful, but under most circumstances they are invisible to human eyes. Kirk compares them to enchanted islands. The houses are equipped with lamps that burn forever and fires that need no fuel. 11. They speak very little. When they do talk among themselves, their language is a kind of whistling sound. 12. Their habits and their language when they talk to humans are similar to those of local people. 13. Their philosophical system is based on the following ideas: nothing dies; all things evolve cyclically in such a way that at every cycle they are renewed and improved. Motion is the universal law. 14. They are said to have a hierarchy of leaders, but they have no visible devotion to God, no religion. 15. They have many pleasant and light books, but also serious and complex books dealing with abstract matters. 16. They can be made to appear at will before us through magic. The similarities between these observations and the story related by Facius Cardan, which antedates Kirk's manuscript by exactly two hundred years, are clear. Both Cardan and Paracelsus write, like Kirk, that a pact can be made with these creatures and that they can be made to appear and answer questions at will. Paracelsus did not care to reveal what that pact was "because of the ills that might befall those who would try it." Kirk is equally discreet on this point. And, of course, to go deeper into this matter would open the whole field of witchcraft and ceremonial magic, which is beyond my purpose in the present book.

What you believe about climate change doesn’t reflect what you know,” said Dan Kahan, a professor at Yale Law School who studies risk perception. “It expresses who you are." To illustrate this point, Kahan cited the results of yet another survey by the Pew Research Center. This survey was designed to test basic scientific knowledge and it posed questions like “What is the main function of red blood cells?” When respondents were asked what gas “most scientists believe causes temperatures in the atmosphere to rise,” 58 percent chose the correct answer: “carbon dioxide.” There was little difference in the proportion of Democrats and Republicans who gave the right response; among the former it was 56 percent, among the latter 58 percent. (Among Independents, 63 percent chose correctly.) But polls that ask Americans about their own beliefs about global warming show a significant partisan divide; in another Pew survey, 66 percent of Democrats said they believed that human activity was the “main cause” of global warming, while only 24 percent of Republicans did. This suggests there are many Democrats who don’t know what’s causing climate change but still believe humans are responsible for it and many Republicans who do know, yet still deny that humans play a role. And what this shows, according to Kahan, is that people’s views on climate change are shaped less by their knowledge of the science than by their sense of group identity. To break the political logjam, he argues, Americans need to find ways of talking about climate change that don’t require members of one group or the other to renounce their cultural identity. “If you show people there is some way of responding to the problem that’s consistent with who they are, then they’re more likely to see the problem,” Kahan told me. Kari Marie Norgaard is a sociologist at the University of Oregon who has studied how people talk about climate change. She, too, believes there’s a strong cultural component to Americans’ attitudes, but she sees the problem as reflecting the strategies people use to avoid painful subjects. Norgaard argues that it’s difficult even for people who are privately worried about climate change to discuss the issue in public because on the one hand they feel guilty about the situation and on the other they feel helpless to change it. “We have a need to think of ourselves as good people,” she told me. Meanwhile, the very lack of discussion about the issue feeds itself: people feel that if it really were a serious problem, others would be dealing with it: “It’s difficult for people to feel that climate change is really happening in part because we’re embedded in a world where no one else around us is talking about it.” “It becomes a vicious cycle between the political gridlock and the cultural and individual gridlock,” Norgaard went on. As White terrorists brutalized, raped, and killed people in communities around the Black world, the first crop of Western criminologists were intent on giving criminals a Black face and the well-behaved citizen a White face. Lombroso’s student, Italian law professor Raffaele Garofalo, invented the term “criminology” (criminologia) in 1885. British physician Havelock Ellis popularized Lombroso in the English-speaking world, publishing a compendium of his writings in 1890.20

He believed that born criminals emitted physical signs that could be studied, measured, and quantified, and that the “inability to blush”—and therefore, dark skin—had “always been considered the accompaniment of crime.” Black women, in their close “degree of differentiation from the male,” he claimed in The Female Offender in 1895, were the prototypical female criminals. As White terrorists brutalized, raped, and killed people in communities around the Black world, the first crop of Western criminologists were intent on giving criminals a Black face and the well-behaved citizen a White face. Lombroso’s student, Italian law professor Raffaele Garofalo, invented the term “criminology” (criminologia) in 1885. British physician Havelock Ellis popularized Lombroso in the English-speaking world, publishing a compendium of his writings in 1890.20

The other component was to build cadres through political education. Republicans sought out wealthy donors to set up foundations and think tanks as safe spaces outside the university for elaborating the Republican catechism, a document that grew from a cocktail napkin to a vast library of popular books and academic policy studies. They set up summer camps where college students could read Aristotle and Alexander Hamilton and Friedrich von Hayek, and learn to connect them. They set up reading groups for professors, who got paid to attend. They funded graduate students and apprenticed them under movement-approved professors. They also funded campus newspapers and national organizations like the Federalist Society, which introduces students to the "originalist" interpretation of constitutional law and acts as an an employment agency for young lawyers looking for clerkships and teaching positions. This one organization has revolutionized the way law is taught and interpreted in this country, and therefore how we are governed. It is the fruit of the conservatives' pedagogical strategy. The movement's fathers and godfathers, some of whom had once been Trotskyites, understood intuitively that to make lasting change the movement would have to build and sustain cadres, and send them out with full backpacks on the long march through the institutions. Marching with the aim of dismantling government by first seizing control of it, thus achieving anti-political ends by political means.

General Gerardo Machado always had an eye for the ladies and enjoyed partying at the swankiest nightclubs in Havana. For a time he even owned his own club, which was the place for his political hacks to be seen. Machado was frequently there in the company of some of the most enticing ladies in the country. Through a combination of threats and bribery, he maintained control of the Army. In April of 1928 the Cuban Congress at the behest of Machado passed a law barring any presidential nominations by any party other than the Liberal, Conservative and Popular parties. Interestingly enough Machado declared himself the only legal candidate for those parties, and thus ran for a second term unopposed. Not only had he overspent money from the national treasury, but now he also alienated the Cuban public, who denounced him as an authoritarian nationalist and tyrant. Students, labor unions and intellectuals branded him an outright dictator. It was during this time that Marxist thinking was gaining strength throughout the world. The Communist philosophy was also becoming ever more popular among intellectuals, professors and students at the Universidad de La Havana. Realizing that he was now in danger of losing control, Machado made a power grab and declared Martial Law in Cuba. Intent on holding on to power, he became even more despotic than ever, creating a secret police known to the people as La Porra, meaning a big stick! As President, Machado became openly vindictive and did not hesitate to torture or even assassinate his foes in order to maintain tight sway over the Cuban population. With the Great Depression of 1928, things only got worse. The economy, which was single-sided, was extremely dependent upon sugar. Poverty was widespread, and even necessities all but disappeared, leaving the Cuban people destitute and in misery.

One of the most commonly used American history textbooks is The Americans: Reconstruction to the 21st Century. A thousand-page volume, published by Holt McDougal, a division of the publishing giant Houghton Mifflin Harcourt, it lists several well-respected professors as authors and editors. The 2012 edition has this to say about residential segregation in the North: “African Americans found themselves forced into segregated neighborhoods.” That’s it. One passive voice sentence. No suggestion of who might have done the forcing or how it was implemented.

A college student who wants to file a complaint of sexual assault within the campus disciplinary system informs a university employee such as an assistant dean for student life, or perhaps the Title IX coordinator. That person eventually forwards the complaint to a university disciplinary panel that may be composed of, for example, an associate dean with a master's degree in English literature, a professor of chemistry, and a senior majoring in anthropology. Unlike criminal prosecutors, members of the disciplinary panels do not have access to subpoena powers or to crime labs. They often have no experience in fact-finding, arbitration, conflict resolution, or any other relevant skill set. There is, to put it mildly, little reason to expect such panels to have the experience, expertise, and resources necessary to adjudicate a contested claim of sexual assault. Making matters worse, most campus tribunals ban attorneys for the parties (even in an advisory capacity), rules of procedure and evidence are typically ad hoc, and no one can consult precedents because records of previous disputes are sealed due to privacy considerations. Campus "courts" therefore have an inherently kangoorish nature. Even trained police officers and prosecutors too often mishandle sexual assault cases, so it's not surprising that the amateurs running the show at universities tend to have a poor record. And indeed, some victims' advocacy groups, such as the Rape, Abuse and Incest National Network (RAINN), oppose having the government further encourage the campus judicial system to primarily handle campus sexual assault claims, because that means not treating rape as a serious crime. A logical solution, if federal intervention is indeed necessary, would be for OCR [US Department of Education's Office of Civil Rights] to mandate that universities encourage students who complain of sexual assault to report the assault immediately to the police, and that universities develop procedures to cooperate with police investigations. Concerns about victims' well-being when prosecutors decline to pursue a case could also be adjudicated in a real court, as a student could seek a civil protective order against her alleged assailant. OCR could have mandated or encouraged universities to cooperate with those civil proceedings, which in some cases might warrant excluding an alleged assailant from campus.

Suppose 225 million Americans all join in a coin-tossing contest in which each player bets a dollar each day on whether the toss of a coin will turn up heads or tails. Overall, the problem with gun-control laws is not too little regulation, but rather that the regulations disarm law-abiding citizens. Consider a criminal who is intent on massacring people and then planning on taking his own life. He would unlikely be deterred by any penalties for violating gun regulations. For example, expelling students or firing professors for violating campus gun-free zones represent a real life-changing experience for law-abiding citizens—especially since other academic institutions will not admit or hire people who have such gun offenses on their records. But even assuming the killer survives the attack, it is absurd to imagine that after facing multiple life prison sentences or death penalties for killing people, the threat of expulsion from school will be the penalty that ultimately deters the attack.

When all is said and done, the friends you make in law school will be one of the best features of your entire experience. If you spot someone at one of these events who you know is going to be one of your first-year professors (they’ll usually be wearing name tags), go up and introduce yourself. This is hard for a lot of people to do, but as elaborated on in Chapter 9, there is value in getting to know and being known by your professors. The fact that they’re attending the event (most profs don’t) means that they’re probably approachable people. Many law professors are shy, introverted types who are not good at “making the rounds,” so don’t wait for them to approach you. Don’t worry. They’re not going to ask you deep legal questions, but they may default to asking the classic introductory question, “What made you decide to come to law school?”, which is the law professor
