There was a shamefulness about the experience of Herbert's execution I couldn't shake. Everyone I saw at the prison seemed surrounded by a cloud of regret and remorse. The prison officials had pumped themselves up to carry out the execution with determination and resolve, but even they revealed extreme discomfort and some measure of shame. Maybe I was imagining it but it seemed that everyone recognized what was taking place was wrong. Abstractions about capital punishment were one thing, but the details of systematically killing someone who is not a threat are completely different. I couldn't stop thinking about it on the trip home. I thought about Herbert, about how desperately he wanted the American flag he earned through his military service in Vietnam. I thought about his family and about the victim's family and the tragedy the crime created for them. I thought about the visitation officer, the Department of Corrections officials, the men who were paid to shave Herbert's body so that he could be killed more efficiently. I thought about the officers who had strapped him into the chair. I kept thinking that no one could actually believe this was a good thing to do or even a necessary thing to do. The next day there were articles in the press about the execution. Some state officials expressed happiness and excitement that an execution had taken place, but I knew that none of them had actually dealt with the details of killing Herbert. In debates about the death penalty, I had started arguing that we would never think it was humane to pay someone to rape people convicted of rape or assault and abuse someone guilty of assault or abuse. Yet we were comfortable killing people who kill, in part because we think we can do it in a matter that doesn't implicate our own humanity, the way that raping or abusing someone would. I couldn't stop thinking that we don't spend much time contemplating the details of what killing someone actually involves.

It was certainly true that I had “no sense of humour” in that I found nothing funny. I didn’t know, and perhaps would never know, the feeling of compulsion to exhale and convulse in the very specific way that humans evolved to do. Nor did I know the specific emotion of relief that is bound to it. But it would be wrong, I think, to say that I was incapable of using humour as a tool. As I understood it, humour was a social reflex. The ancestors of humans had been ape-animals living in small groups in Africa. Groups that worked together were more likely to survive and have offspring, so certain reflexes and perceptions naturally emerged to signal between members of the group. Yawning evolved to signal wake-rest cycles. Absence of facial hair and the dilation of blood vessels in the face evolved to signal embarrassment, anger, shame and fear. And laughter evolved to signal an absence of danger. If a human is out with a friend and they are approached by a dangerous-looking stranger, having that stranger revealed as benign might trigger laughter. I saw humour as the same reflex turned inward, serving to undo the effects of stress on the body by activating the parasympathetic nervous system. Interestingly, it also seemed to me that humour had extended, like many things, beyond its initial evolutionary context. It must have been very quickly adopted by human ancestor social systems. If a large human picks on a small human there’s a kind of tension that emerges where the tribe wonders if a broader violence will emerge. If a bystander watches and laughs they are non-verbally signaling to the bully that there’s no need for concern, much like what had occurred minutes before with my comments about Myrodyn, albeit in a somewhat different context. But humour didn’t stop there. Just as a human might feel amusement at things which seem bad but then actually aren’t, they might feel amusement at something which merely has the possibility of being bad, but doesn’t necessarily go through the intermediate step of being consciously evaluated as such: a sudden realization. Sudden realizations that don’t incur any regret were, in my opinion, the most alien form of humour, even if I could understand how they linked back to the evolutionary mechanism. A part of me suspected that this kind of surprise-based or absurdity-based humour had been refined by sexual selection as a signal of intelligence. If your prospective mate is able to offer you regular benign surprises it would (if you were human) not only feel good, but show that they were at least in some sense smarter or wittier than you, making them a good choice for a mate. The role of surprise and non-verbal signalling explained, by my thinking, why explaining humour was so hard for humans. If one explained a joke it usually ceased to be a surprise, and in situations where the laughter served as an all-clear-no-danger signal, explaining that verbally would crush the impulse to do it non-verbally.

But not necessarily an innocent one … The implication of the bus slogan is that enjoyment would be your natural state if you weren’t being “worried” by us believer … Take away the malignant threat of God-talk, and you would revert to continuous pleasure, under cloudless skies. What’s so wrong with this, apart from it being total bollocks? … Suppose, as the atheist bus goes by, that you are the fifty-something woman with the Tesco bags, trudging home to find out whether your dementing lover has smeared the walls of the flat with her own shit again. Yesterday when she did it, you hit her, and she mewled till her face was a mess of tears and mucus which you also had to clean up. The only thing that would ease the weight on your heart would be to tell the funniest, sharpest-tongued person you know about it: but that person no longer inhabits the creature who will meet you when you unlock the door. Respite care would help, but nothing will restore your sweetheart, your true love, your darling, your joy. Or suppose you’re that boy in the wheelchair, the one with the spasming corkscrew limbs and the funny-looking head. Always before you’ve had this story you tell yourself about getting clean, but now you see it isn’t true, now you know you haven’t the strength. Social services will be keeping your little boy. And in about half an hour you’ll be giving someone a blowjob for a fiver behind the bus station. Better drugs policy might help, but it won’t ease the need, and the shame over the need, and the need to wipe away the shame. So when the atheist bus comes by, and tells you that there’s probably no God so you should stop worrying and enjoy your life, the slogan is not just bitterly inappropriate in mood. What it means, if it’s true, is that anyone who isn’t enjoying themselves is entirely on their own. The three of you are, for instance; you’re all three locked in your unshareable situations, banged up for good in cells no other human being can enter. What the atheist bus says is: there’s no help coming … But let’s be clear about the emotional logic of the bus’s message. It amounts to a denial of hope or consolation, on any but the most chirpy, squeaky, bubble-gummy reading of the human situation. St Augustine called this kind of thing “cruel optimism” fifteen hundred years ago, and it’s still cruel.

Then, with the tenderness that makes her grandson feel safe and loved, Grandma says, “That's my good boy.” The boy learns that by complying with the rules of the dream, he can earn a reward; in this case, he is a good boy in the eyes of his grandmother and receives her love and encouragement. The punishment would have been to be seen as a selfish child, a sinner in her eyes, and a bad boy. This is a simple example of domestication in action. No one doubts that the grandmother has the best of intentions; she loves her grandson and wants him to eat his lunch, but the method she is using to achieve that goal has negative unintended consequences. Anytime guilt and shame are deployed as tools to provoke action, this counters any good that has been achieved. Eventually, these negative elements will resurface in one way or another. In this case, let's imagine that when this boy grows up, the domestication that occurred around this issue is so strong that it still has an imposing power over him well into adulthood. For instance, many years later he goes into a restaurant where they serve a big plate of food, and halfway through his meal his body signals to him the truth of that moment: I am full. Consciously, or subconsciously, he hears a voice: It's a sin to waste food. Consciously, or subconsciously, he answers Yes, Grandma, and continues to eat. Finishing his plate like a good boy, he responds to his domestication rather than his needs of the moment. In that instant, he completely goes against himself by continuing to eat after his body has already let him know that he is full. The idea is so strong that it overrules his body's natural preference to stop. Overeating may damage his body, which is one of the negative consequences in this case of using guilt and shame as a tool. Although I’d seen bits and pieces of this opus as it was coming together, I didn’t feel the full power of it until this morning, when Jonathan hit the “play” button. You heard “Emergency 911,” then the static confusion on the caller’s end. The thumps of blows landing on flesh. Then, the more frantic pleas of the 1993 call. “He’s O. J. Simpson. I think you know his record. He’s fucking going nuts.” All the while, on the large screen, we showed the photo of Nicole taken after the beating of 1989. She was lifting her hair to reveal the full extent of the damage to her face. Her eyes were downcast, as if in shame. Then, the photo of her smeared with mud. Cut to the Bundy trail, the knit cap, a close-up of Ron’s shirt. Behind those images, O. J. Simpson’s voice rose to a peak of rage. Suddenly, the audio stopped, and all that was left was a picture of Nicole’s body curled in a pool of blood. We held on that image for thirty seconds in complete silence. There was sobbing throughout the courtroom. But all I could think was, It’s over.
