He is clearly surprised when I swat his hand and step away. His girlfriend/relative seems taken aback that I mimic his stance-crossed arms and deep frown. I doubt she has ever met her threshold for embarrassment. "I said I was fine. No blood, no foul." "This is my sister Rayna," he says, as if the conversation steered naturally in that direction. She smiles at me as if forced at knifepoint, the kind of smile that comes purely from manners, like the smile you give your grandmother when she gives you the rotten-cabbage-colored sweater she's been knitting. I think of that sweater now as I return her smile.

I grab a new piece of charcoal from the bottom of the easel and begin hastily making lines in my sketchbook. I can’t not look at him, or he’ll think I’m not drawing him. I glance hurriedly, trying to avoid the region my eyes continuously return to. I start to feel fluttery. How long has it been? Surely it’s been seven minutes. I try to add some tone to my drawing’s chest. I wonder what Silas’s chest looks like . . . Stop! Stop stop stop stop stop—” “Right, then!” the older man says as his stopwatch beeps loudly and the scratchy sound of charcoal on paper ends. INTERNATIONAL LAW WAS CREATED DURING THE BUSH ADMINISTRATION BECAUSE a group of Mexicans—and one African American—gang-raped and murdered two teenaged girls in Houston, Texas.1 The crime made history in another way: It led to the most death sentences handed out for a single crime in Texas since 1949.2 Do you even know about this case? The only reason the media eventually admitted that the lead rapist, Jose Ernesto Medellin, was an illegal alien from Mexico was to try to overturn his conviction on the grounds that he had not been informed of his right, as a Mexican citizen, to confer with the Mexican consulate. Journalists have an irritating tendency to skimp on detail when reporting crimes by immigrants, a practice that will not be followed here. One summer night in June 1993, fourteen-year-old Jennifer Ertman and Elizabeth Peña, who had just turned sixteen, were returning from a pool party, and decided to take a shortcut through a park to make their 11:30 p.m. curfew. They encountered a group of Hispanic men, who were in the process of discussing “gang etiquette,” such as not complaining if other members talked about having sex with your mother.3 The girls ran away, but Medellin grabbed Jennifer and began ripping her clothes off. Hearing her screams, Elizabeth came back to help her friend. For more than an hour, the five Hispanics and one black man raped the teens, vaginally, anally, and orally—“every way you can assault a human being,” as the prosecutor put it.4 The girls were beaten, kicked, and stomped, their teeth knocked out and their ribs broken. One of the Hispanic men told Medellin’s fourteen-year-old brother to “get some,” so he raped one of the girls, too. But when it was time to kill the girls, Medellin said his brother was “too small to watch” and dragged the girls into the woods.5 There, the girls were forced to kneel on the ground and a belt or shoelace was looped around their necks. Then a man on each side pulled on the cord as hard as he could. The men strangling Jennifer pulled so hard they broke the belt. Medellin later complained that “the bitch wouldn’t die.” When it was done, he repeatedly stomped on the girls’ necks, to make sure they were dead.6 At trial, Medellin’s sister-in-law testified that shortly after the gruesome murders, Medellin was laughing about it, saying they’d “had some fun with some girls” and boasting that he had “virgin blood” on his underpants.7 It’s difficult to understand a culture where such an orgy of cruelty is bragged about at all, but especially in front of women.

That child is me. But why is she me? I have no memory at all of that summer’s day, no privileged knowledge of whether that child succeeded in getting the watermelon into her mouth. It’s true that a smooth series of contiguous physical events can be traced from her body to mine, so that we would want to say that her body is mine; and perhaps bodily identity is all that our personal identity consists in. But bodily persistence over time, too, presents philosophical dilemmas. The series of contiguous physical events has rendered the child’s body so different from the one I glance down on at this moment; the very atoms that composed her body no longer compose mine. And if our bodies are dissimilar, our points of view are even more so. Mine would be as inaccessible to her—just let her try to figure out [Spinoza’s] Ethics—as hers is now to me. Her thought processes, prelinguistic, would largely elude me. Yet she is me, that tiny determined thing in the frilly white pinafore. She has continued to exist, survived her childhood illnesses, the near-drowning in a rip current on Rockaway Beach at the age of twelve, other dramas. There are presumably adventures that she—that is that I—can’t undergo and still continue to be herself. Would I then be someone else or would I just no longer be? Were I to lose all sense of myself—were schizophrenia or demonic possession, a coma or progressive dementia to remove me from myself—would it be I who would be undergoing those trials, or would I have quit the premises? Would there then be someone else, or would there be no one? Is death one of those adventures from which I can’t emerge as myself? The sister whose hand I am clutching in the picture is dead. I wonder every day whether she still exists. A person whom one has loved seems altogether too significant a thing to simply vanish altogether from the world. A person whom one loves is a world, just as one knows oneself to be a world. How can worlds like these simply cease altogether? But if my sister does exist, then what is she, and what makes that thing that she now is identical with the beautiful girl laughing at her little sister on that forgotten day? I alone of little escaped a hell of beating, neglect, and snuffling dumpsters for sustenance before this gullible man adopted me. Now my new owner would like me to walk nicely by his side on a leash (without cowering or pulling) and to lie down on a towel when he asks, regardless of whether he has a piece of bologna in his pocket or not. I’m growing fond of that optimistic young man in spite of myself. Then we learn that the man has Traumatic Brain Injury and medical issues that can rip normalcy in two, and we realize that one of the main problems is in ourselves for failing to consider that not all other people have our good fortune of functioning bodies and brains, with emotional and psychological landscapes that are level and fertile and stable and predictable.
