The police enlist the protest organizers to control the demonstrators, putting the organization at least partly in the service of the state and intensifying the function of control. (...) Police/protestor cooperation required a fundamental adjustment in the attitude of the authorities. The Negotiated Management approach demanded the institutionalization of protest. Demonstrations had to be granted some degree of legitimacy so they could be carefully managed rather than simply shoved about. This approach de-emphasized the radical or antagonistic aspects of protest in favor of a routinized and collaborative approach. Naturally such a relationship brought with it some fairly tight constraints as to the kinds of protest activity available. Rallies, marches, polite picketing, symbolic civil disobedience actions, and even legal direct action — such as strikes or boycotts — were likely to be acceptable, within certain limits. Violence, obviously, would not be tolerated. Neither would property destruction. Nor would any of the variety of tactics that had been developed to close businesses, prevent logging, disrupt government meetings, or otherwise interfere with the operation of some part of society. That is to say, picketing may be fine, barricades are not. Rallies were in, riots were out. Taking to the streets — under certain circumstances — may be acceptable; taking over the factories was not. The danger, for activists, is that they might permanently limit themselves to tactics that were predictable, non-disruptive, and ultimately ineffective.

Although Israel is targeted by terrorists much more frequently than the United States, Israelis do not live in fear of terrorism. A 2012 survey of Israeli Jews found that only 16 percent described terrorism as their greatest fear81—no more than the number who said they were worried about Israel’s education system. No Israeli politician would say outright that he tolerates small-scale terrorism, but that’s essentially what the country does. It tolerates it because the alternative—having everyone be paralyzed by fear—is incapacitating and in line with the terrorists’ goals. A key element in the country’s strategy is making life as normal as possible for people after an attack occurs. For instance, police typically try to clear the scene of an attack within four hours of a bomb going off,82 letting everyone get back to work, errands, or even leisure. Small-scale terrorism is treated more like crime than an existential threat. What Israel certainly does not tolerate is the potential for large-scale terrorism (as might be made more likely, for instance, by one of their neighbors acquiring weapons of mass destruction). There is some evidence that their approach is successful: Israel is the one country that has been able to bend Clauset’s curve. If we plot the fatality tolls from terrorist incidents in Israel using the power-law method (figure 13-8), we find that there have been significantly fewer large-scale terror attacks than the power-law would predict; no incident since 1979 has killed more than two hundred people. The fact that Israel’s power-law graph looks so distinct is evidence that our strategic choices do make some difference.

Memories fail, eyewitness identifications are notoriously unreliable, even the best-intentioned cops are subject to failures of judgment and recall. The human element in any system is always prone to error. Why should the courts be any different? They are not. Our blind trust in the system is the product of ignorance and magical thinking, and there was no way in hell I was going to trust my son’s fate to it. Not because I believed he was guilty, I assure you, but precisely because he was innocent. I was doing what little I could to ensure the right result, the just result. If you do not believe me, go spend a few hours in the nearest criminal court, then ask yourself if you really believe it is error-free. Ask yourself if you would trust your child to it.

Magyar developed his own concept: the 'post-communist mafia state.' Both halves of the designation were significant: 'post-communist' because "the conditions preceding the democratic big bang have a decisive role in the formation of the system. Namely that it came about on the foundations of a communist dictatorship, as a product of the debris left by its decay." (quoting Balint Magyar) The ruling elites of post-communist states most often hail from the old nomenklatura, be it Party or secret service. But to Magyar this was not the countries' most important common feature: what mattered most was that some of these old groups evolved into structures centered around a single man who led them in wielding power. Consolidating power and resources was relatively simple because these countries had just recently had Party monopoly on power and a state monopoly on property. ... A mafia state, in Magyar's definition, was different from other states ruled by one person surrounded by a small elite. In a mafia state, the small powerful group was structured just like a family. The center of the family is the patriarch, who does not govern: "he disposes--of positions, wealth, statuses, persons." The system works like a caricature of the Communist distribution economy. The patriarch and his family have only two goals: accumulating wealth and concentrating power. The family-like structure is strictly hierarchical, and membership in it can be obtained only through birth or adoption. In Putin's case, his inner circle consisted of men with whom he grew up in the streets and judo clubs of Leningrad, the next circle included men with whom he had worked with in the KGB/FSB, and the next circle was made up of men who had worked in the St. Petersburg administration with him. Very rarely, he 'adopted' someone into the family as he did with Kholmanskikh, the head of the assembly shop, who was elevated from obscurity to a sort of third-cousin-hood. One cannot leave the family voluntarily: one can only be kicked out, disowned and disinherited. Violence and ideology, the pillars of the totalitarian state, became, in the hands of the mafia state, mere instruments. The post-communist mafia state, in Magyar's words, is an "ideology-applying regime" (while a totalitarian regime is 'ideology-driven'). A crackdown required both force and ideology. While the instruments of force---the riot police, the interior troops, and even the street-washing machines---were within arm's reach, ready to be used, ideology was less apparently available. Up until spring 2012, Putin's ideological repertoire had consisted of the word 'stability,' a lament for the loss of the Soviet empire, a steady but barely articulated restoration of the Soviet aesthetic and the myth of the Great Patriotic War, and general statements about the United States and NATO, which had cheated Russia and threatened it now. All these components had been employed during the 'preventative counter-revolution,' when the country, and especially its youth, was called upon to battle the American-inspired orange menace, which threatened stability. Putin employed the same set of images when he first responded to the protests in December. But Dugin was now arguing that this was not enough. At the end of December, Dugin published an article in which he predicted the fall of Putin if he continued to ignore the importance of ideas and history.

By 1970, the peak of our involvement in Vietnam had come and gone, we were beginning détente with the Soviets, and we were anointing the Shah as our protégé in the Gulf region. By 1980, the Soviets were in Afghanistan, Iran was in the throes of revolution, there was talk of our ‘hollow forces’ and a ‘window of vulnerability,’ and the U.S. was the greatest creditor nation the world had ever seen. In the real world, however, the claim that censorship or enforced orthodoxy protects minorities and the marginalized has been comprehensively disproved, again and again and again. “Censorship has always been on the side of authoritarianism, conformity, ignorance, and the status quo,” write Erwin Chemerinsky and Howard Gillman in their book Free Speech on Campus, “and advocates for free speech have always been on the side of making societies more democratic, more diverse, more tolerant, more educated, and more open to progress.”30 They and former American Civil Liberties Union president Nadine Strossen, in her powerful book Hate: Why We Should Resist It with Free Speech, Not Censorship, list the horrors and oppressions which have befallen minorities in the name of making society safe from dangerous ideas. “Laws censoring ‘hate speech’ have predictably been enforced against those who lack political power,” writes Strossen.31 In America, under the Alien and Sedition Acts, authorities censored and imprisoned sympathizers of the opposition party (including members of Congress) and shut down opposition newspapers; under the Comstock laws, they censored works by Aristophanes, Balzac, Oscar Wilde, and James Joyce (among others); under the World War I anti-sedition laws, they convicted more than a thousand peace activists, including the Socialist presidential candidate Eugene V. Statistical discrimination explains why the police in the United States justify stopping black drivers more often. And how the Hindu majoritarian government of the state of Uttar Pradesh recently explained why so many of the people “accidentally” killed by the state police (in what are called “encounter deaths”) are Muslim. There are more blacks and Muslims among criminals. In other words, what looks like naked racism does not have to be that; it can be the result of targeting some characteristic (drug dealing, criminality) that happens to be correlated with race or religion. So statistical discrimination, rather than old-fashioned prejudice—what economists call taste-based discrimination—may be the cause. The end result is the same if you are black or Muslim, though. A recent study on the impact of “ban the box” (BTB) policies on the rate of unemployment of young black men provides a compelling demonstration of statistical discrimination. BTB policies restrict employers from using application forms where there is a box that needs to be checked if you have a criminal conviction. Twenty-three states have adopted these policies in the hope of raising employment among young black men, who are much more likely to have a conviction than others and whose unemployment rate is double the national average.31 To test the effect of these policies, two researchers sent fifteen thousand fictitious online job applications to employers in New Jersey and New York City, just before and right after the states of New York and New Jersey implemented the BTB policy.32 They manipulated the perception of race by using typically white or typically African American first names on the résumés. Whenever a job posting required indicating whether or not the applicant had a prior felony conviction, they also randomized whether he or she had one. They found, as many others before them, clear discrimination against blacks in general: white “applicants” received about 23 percent more callbacks than black applicants with the same résumé. Unsurprisingly, among employers who asked about criminal convictions before the ban, there was a very large effect of having a felony conviction: applicants without a felony conviction were 62 percent more likely to be called back than those with a conviction but an otherwise identical résumé, an effect similar for whites and blacks. The most surprising finding, however, was that the BTB policy substantially increased racial disparities in callbacks. White applicants to BTB-affected employers received 7 percent more callbacks than similar black applicants before BTB. After BTB, this gap grew to 43 percent. The reason was that without the actual information about convictions, the employers assumed all black applicants were more likely to have a conviction. In other words, the BTB policy led employers to rely on race to predict criminality, which is of course statistical discrimination.

They matter to no one aside from the police and their victims. But this particular humiliation, on December 17, 2010, caused Mohamed Bouazizi, aged twenty-six, to set himself on fire, and Bouazizi’s self-immolation sparked protests. The police responded with typical brutality. The protests spread. Hoping to assuage the public, the dictator of Tunisia, President Zine el-Abidine Ben Ali, visited Bouazizi in the hospital. Bouazizi died on January 4, 2011. The unrest grew. On January 14, Ben Ali fled to a cushy exile in Saudi Arabia, ending his twenty-three-year kleptocracy. The Arab world watched, stunned. Then protests erupted in Egypt, Libya, Syria, Jordan, Kuwait, and Bahrain. After three decades in power, the Egyptian dictator Hosni Mubarak was driven from office. Elsewhere, protests swelled into rebellions, rebellions into civil wars. This was the Arab Spring—and it started with one poor man, no different from countless others, being harassed by police, as so many have been, before and since, with no apparent ripple effects. It is one thing to look backward and sketch a narrative arc, as I did here, connecting Mohamed Bouazizi to all the events that flowed out of his lonely protest. Tom Friedman, like many elite pundits, is skilled at that sort of reconstruction, particularly in the Middle East, which he knows so well, having made his name in journalism as a New York Times correspondent in Lebanon. But could even Tom Friedman, if he had been present that fatal morning, have peered into the future and foreseen the self-immolation, the unrest, the toppling of the Tunisian dictator, and all that followed? Of course not. No one could. Maybe, given how much Friedman knew about the region, he would have mused that poverty and unemployment were high, the number of desperate young people was growing, corruption was rampant, repression was relentless, and therefore Tunisia and other Arab countries were powder kegs waiting to blow. But an observer could have drawn exactly the same conclusion the year before. And the year before that. Indeed, you could have said that about Tunisia, Egypt, and several other countries for decades. Almost no one—not even the police officers who deal with it every day, not even most psychiatrists—publicly connects marijuana and crime. We all know alcohol causes violence, but somehow, we have grown to believe that marijuana does not, that centuries of experience were a myth. As a pediatrician wrote in a 2015 piece for the New York Times in which he argued that marijuana was safer for his teenage children than alcohol: “People who are high are not committing violence.” But they are. Almost unnoticed, the studies have piled up. On murderers in Pittsburgh, on psychiatric patients in Italy, on tourists in Spain, on emergency room patients in Michigan. Most weren’t even designed to look for a connection between marijuana and violence, because no one thought one existed. Yet they found it. In many cases, they have even found marijuana’s tendency to cause violence is greater than that of alcohol. A 2018 study of people with psychosis in Switzerland found that almost half of cannabis users became violent over a three-year period; their risk of violence was four times that of psychotic people who didn’t use. (Alcohol didn’t seem to increase violence in this group at all.) The effect is not confined to people with preexisting psychosis. A 2012 study of 12,000 high school students across the United States showed that those who used cannabis were more than three times as likely to become violent as those who didn’t, surpassing the risk of alcohol use. Even worse, studies of children who have died from abuse and neglect consistently show that the adults responsible for their deaths use marijuana far more frequently than alcohol or other drugs—and far, far more than the general population. Marijuana does not necessarily cause all those crimes, but the link is striking and large. We shouldn’t be surprised. The violence that drinking causes is largely predictable. Alcohol intoxicates. It disinhibits users. It escalates conflict. It turns arguments into fights, fights into assaults, assaults into murders. Marijuana is an intoxicant that can disinhibit users, too. And though it sends many people into a relaxed haze, it also frequently causes paranoia and psychosis. Sometimes those are short-term episodes in healthy people. Sometimes they are months-long spirals in people with schizophrenia or bipolar disorder. And paranoia and psychosis cause violence. The psychiatrists who treated Raina Thaiday spoke of the terror she suffered, and they weren’t exaggerating. Imagine voices no one else can hear screaming at you. Imagine fearing your food is poisoned or aliens have put a chip in your brain. When that terror becomes too much, some people with psychosis snap. But when they break, they don’t escalate in predictable ways. They take hammers to their families. They decide their friends are devils and shoot them. They push strangers in front of trains. The homeless man mumbling about God frightens us because we don’t have to be experts on mental illness and violence to know instinctively that untreated psychosis is dangerous. And finding violence and homicides connected to marijuana is all too easy.

The most important mystery of ancient Egypt was presided over by a priesthood. That mystery concerned the annual inundation of the Nile flood plain. It was this flooding which made Egyptian agriculture, and therefore civilisation, possible. It was the centre of their society in both practical and ritual terms for many centuries; it made ancient Egypt the most stable society the world has ever seen. The Egyptian calendar itself was calculated with reference to the river, and was divided into three seasons, all of them linked to the Nile and the agricultural cycle it determined: Akhet, or the inundation, Peret, the growing season, and Shemu, the harvest. The size of the flood determined the size of the harvest: too little water and there would be famine; too much and there would be catastrophe; just the right amount and the whole country would bloom and prosper. Every detail of Egyptian life was linked to the flood: even the tax system was based on the level of the water, since it was that level which determined how prosperous the farmers were going to be in the subsequent season. The priests performed complicated rituals to divine the nature of that year’s flood and the resulting harvest. The religious elite had at their disposal a rich, emotionally satisfying mythological system; a subtle, complicated language of symbols that drew on that mythology; and a position of unchallenged power at the centre of their extraordinarily stable society, one which remained in an essentially static condition for thousands of years. But the priests were cheating, because they had something else too: they had a nilometer. This was a secret device made to measure and predict the level of flood water. It consisted of a large, permanent measuring station sited on the river, with lines and markers designed to predict the level of the annual flood. The calibrations used the water level to forecast levels of harvest from Hunger up through Suffering through to Happiness, Security and Abundance, to, in a year with too much water, Disaster. Nilometers were a – perhaps the – priestly secret. They were situated in temples where only priests were allowed access; Herodotus, who wrote the first outsider’s account of Egyptian life the fifth century BC, was told of their existence, but wasn’t allowed to see one. As late as 1810, thousands of years after the nilometers had entered use, foreigners were still forbidden access to them. Added to the accurate records of flood patters dating back centuries, the nilometer was an essential tool for control of Egypt. The nilometer offers a good paradigm for many kinds of expertise, many varieties of religious and professional mystery. Many of the words for deliberately obfuscating nonsense come from priestly ritual: mumbo jumbo from the Mandinka word maamajomboo, a masked shamanic ceremonial dancer; hocus pocus from hoc est corpus meum in the Latin Mass. On the one hand, the elaborate language and ritual, designed to bamboozle and mystify and intimidate and add value; on the other the calculations that the pros make in private. Practitioners of almost every métier, from plumbers to chefs to nurses to teachers to police, have a gap between the way they talk to each other and they way they talk to their customers or audience. Victor Niederhoffer was the son of a police lieutenant, and he needed to get A's at Harvard. But he didn't want to do any serious work at Harvard because what he really liked doing was, one, playing world-class checkers; two, gambling in high-stakes card games, at which he was very good, all hours of the day and night; three, being the squash champion of the United States, which he was for years; and, four, being about as good a tennis player as a part-time tennis player could be. This did not leave much time for getting A's at Harvard. So he went into the Economics Department. You'd think he would have chosen French poetry. But remember, this was a guy who could play championship checkers. He thought he was up to outsmarting the Harvard Economics Department. And he was. He noticed that the graduate students did most of the boring work that would otherwise go to the professors, and he noticed that because it was so hard to get to be a graduate student at Harvard, they were all very brilliant and organized and hardworking, as well as much needed by grateful professors. And, therefore, by custom, and as would be predicted from the psychological force called "reciprocity tendency," in a really advanced graduate course, the professors always gave an A. So Victor Niederhoffer signed up for nothing but the most advanced graduate courses in the Harvard Economics Department, and, of course, he got A, after A, after A, after A, and was hardly ever near a class. And, for a while. Some people at Harvard may have thought it had a new prodigy on its hands. That's a ridiculous story, but the scheme will work still. And Niederhoffer is famous: They call his style "Niederhoffering the curriculum.

When applied to room entries, the OODA loop suggests that the entering officer will be slower to act than a suspect who is already in the room. The entering officer must first scan the room to see if there are any potential threats. The officer must then put what he or she sees into context (e.g., There is a person with a gun. Are they behaving in a threatening manner? Are there other threats? Is it another police officer?). Then the officer must decide what action to take (e.g., shoot/ don’t shoot, give verbal commands, back out of the room, close distance). Finally, the officer must act. The suspect who has already committed to shooting people has a much shorter process to navigate. The suspect must simply observe the officers entering the room and then shoot. The suspect has already done all of the orientation that is needed and decided on his or her course of action. Therefore, the OODA loop predicts that the suspect will be able to move through the cycle faster than the officer. Given the reaction time and decision-making literature, we predict that officers will not generally be able to shoot before the suspects when conducting room entries. We test this hypothesis in the next chapter.

Many people fear that decriminalization and the controlled dispensing of drugs will lead to widespread substance use among people who are now deterred from becoming addicts only by existing legal prohibitions. Like other tenets of the War on Drugs, this view entirely lacks supporting evidence. Any data on the subject points to the opposite prediction. For example, for many decades in the United Kingdom, heroin has been dispensed, under legal supervision, to addicts. The same type of program has been offered on a limited basis in other countries as well, and nowhere has it been found that this measure served in any way to entice unaddicted people into addiction. That is not surprising, given that addiction is a response to life experience, not simply to a drug. People who do not suffer the searing emotional pain that drives hardcore drug addiction will rarely fall into dependency on chemicals, even if these were more readily available — and, once more, public access to habit-forming substances is not being proposed. The call for the decriminalization of drugs for personal use does not imply legal acceptance of drug dealing. Criminalization and prevention are not identical — if anything, the first undermines the other. Paradoxical though it may seem, current drug laws against possession make drugs more readily available to potential new users than decriminalization would. Only the War on Drugs creates the raison d’être of the international trafficking industry, most of whose wealth is based on satisfying the cravings of established drug addicts. Without the exorbitant profits yielded by supplying to addicted users desperate for their substances, the illegal market would shrink to a fragment of its present size. Further, much of the street-level front-line sales force of the illicit drug trade consists of users raising money to support their habit. With the decriminalization of possession for personal use and the medically supervised distribution of drugs, the incentive to sell to new “customers,” including young kids, would largely evaporate. Policing resources could then be concentrated on the remaining large-scale traffickers — if any.

Looking down I saw the patrol boat heading back to shore. The poor vendor was floating face down, alongside his boat. As the ship started to pull away, I saw that he was adrift in a growing pool of blood, which was spreading out around him. Life was cheap here and I realized that the old woman’s prediction had come true. I had seen death before leaving Haiti!

My home was under constant observation from the sidewalk and from the Security Police cars that cruised close by, and there were clear indications that apart from monitoring all telephone calls and intercepting all mail, they had planted listening devices inside the house. Law and order: At level four, right and wrong are determined by a codified system of rules, impartial judges, and prescribed punishments. At this level, individuals defer judgment to properly elected or otherwise constituted authority. Right is getting a proper pay or reward for good work and a prescribed infliction of punishment for breaking the rules. Authority figures are rarely questioned; “He must be right—he is the president, the judge, the pastor, the pope.” Elementary school children operate at this level and find security, predictability, and peace in the rules. At this level, tattletales abound as children are intolerant of rule breakers and demand fairness, which is typically some imposed punishment. The black-and-white thinking of this level of operation leads to fragmenting into divergent groups or cliques who share a core set of group rules and who demean and criticize those who don’t share their rules. This was ancient Israel at the time of Christ—“We have a law!” the Pharisees proclaimed, as they sought to stone Jesus for healing on the Sabbath. The Jews in Christ’s day were separatists who were intolerant of those who didn’t keep their rules and obey their rituals. This is much of our modern world too, with its codified laws, courts, prosecutors, judges, juries, and imposed punishments. Authority at this level rests in the coercive pressure of the state to bring punishment upon those who deviate from the established laws. At this level, police agencies and law enforcers are required to monitor the populace, search for breaches in the law, and inflict codified penalties. This is the first level that requires the emergence of thinking but only minimal thinking—basic indoctrination and memorization of rules. One doesn’t have to understand reasons for things. One only has to know the rules and obey them.
