A Great Rabbi stands, teaching in the marketplace. It happens that a husband finds proof that morning of his wife's adultery, and a mob carries her to the marketplace to stone her to death.
There is a familiar version of this story, but a friend of mine - a Speaker for the Dead - has told me of two other Rabbis that faced the same situation. Those are the ones I'm going to tell you.
The Rabbi walks forward and stands beside the woman. Out of respect for him the mob forbears and waits with the stones heavy in their hands. 'Is there any man here,' he says to them, 'who has not desired another man's wife, another woman's husband?'
They murmur and say, 'We all know the desire, but Rabbi none of us has acted on it.'
The Rabbi says, 'Then kneel down and give thanks that God has made you strong.' He takes the woman by the hand and leads her out of the market. Just before he lets her go, he whispers to her, 'Tell the Lord Magistrate who saved his mistress, then he'll know I am his loyal servant.'
So the woman lives because the community is too corrupt to protect itself from disorder.
Another Rabbi. Another city. He goes to her and stops the mob as in the other story and says, 'Which of you is without sin? Let him cast the first stone.'
The people are abashed, and they forget their unity of purpose in the memory of their own individual sins. ‘Someday,’ they think, ‘I may be like this woman. And I’ll hope for forgiveness and another chance. I should treat her as I wish to be treated.’
As they opened their hands and let their stones fall to the ground, the Rabbi picks up one of the fallen stones, lifts it high over the woman’s head and throws it straight down with all his might it crushes her skull and dashes her brain among the cobblestones. ‘Nor am I without sins,’ he says to the people, ‘but if we allow only perfect people to enforce the law, the law will soon be dead – and our city with it.’
So the woman died because her community was too rigid to endure her deviance.
The famous version of this story is noteworthy because it is so startlingly rare in our experience. Most communities lurch between decay and rigor mortis and when they veer too far they die. Only one Rabbi dared to expect of us such a perfect balance that we could preserve the law and still forgive the deviation.
So of course, we killed him.

3. Cyprus.... Kissinger approved of the preparations by Greek Cypriot fascists for the murder of President Makarios, and sanctioned the coup which tried to extend the rule of the Athens junta (a favoured client of his) to the island. When despite great waste of life this coup failed in its objective, which was also Kissinger’s, of enforced partition, Kissinger promiscuously switched sides to support an even bloodier intervention by Turkey. Thomas Boyatt ... went to Kissinger in advance of the anti-Makarios putsch and warned him that it could lead to a civil war. ‘Spare me the civics lecture,’ replied Kissinger, who as you can readily see had an aphorism for all occasions.
4. Kurdistan. Having endorsed the covert policy of supporting a Kurdish revolt in northern Iraq between 1974 and 1975, with ‘deniable’ assistance also provided by Israel and the Shah of Iran, Kissinger made it plain to his subordinates that the Kurds were not to be allowed to win, but were to be employed for their nuisance value alone. They were not to be told that this was the case, but soon found out when the Shah and Saddam Hussein composed their differences, and American aid to Kurdistan was cut off. Hardened CIA hands went to Kissinger ... for an aid programme for the many thousands of Kurdish refugees who were thus abruptly created.... The apercu of the day was: ‘foreign policy should not he confused with missionary work.’ Saddam Hussein heartily concurred.
5. East Timor. The day after Kissinger left Djakarta in 1975, the Armed Forces of Indonesia employed American weapons to invade and subjugate the independent former Portuguese colony of East Timor. Isaacson gives a figure of 100,000 deaths resulting from the occupation, or one-seventh of the population, and there are good judges who put this estimate on the low side. Kissinger was furious when news of his own collusion was leaked, because as well as breaking international law the Indonesians were also violating an agreement with the United States.... Monroe Leigh ... pointed out this awkward latter fact. Kissinger snapped: ‘The Israelis when they go into Lebanon—when was the last time we protested that?’ A good question, even if it did not and does not lie especially well in his mouth.

I’ve said this earlier but it’s worth repeating: close your eyes and imagine these same voices if President Hillary Clinton had told the FBI director, “I hope you will let it go,” about the investigation of a senior aide, or told casual, easily disprovable lies nearly every day and then demanded we believe them. The hypocrisy is so thick as to almost be darkly funny. I say this as someone who has worked in law enforcement for most of my life, and served presidents of both parties. What is happening now is not normal. It is not fake news. It is not okay.

Many religious fundamentalists around the world would like to see the establishment of theocracies — states where religion and government are closely intertwined. While some just reject separation of [name of place of worship] and state, others go further and insist that one religion’s tenets be made law.
The normal arguments for a theocracy are that, for example, it would lend a greater sense of morality to the making and enforcement of laws. Or that as our laws were originally derived from some moral commandments in a particular religion, it makes sense to enthrone this religion as chief in the state.
Basically, theocrats can talk until the cows come home about how great it would be if we were ruled by God, how great it would be if our laws followed God’s laws, and so forth. But this vision of theocracy will never come to be, and should never come to be.
The fundamental problem with every theocracy is that is innately unfair. Not just unfair to those who do not follow the state religion, but also unfair to those who do not follow the state religion as it is understood and interpreted by the humans who run the state.
After all, who really believes that all the Muslims in any of the Islamic theocracies we have today are happy? Those who believe the wrong things about Islam from one particular point of view are mercilessly vilified — the present civil war in Iraq is an excellent example.
Why a theocracy would be unfair to those who don’t practice the state religion should be very apparent. Whatever flowery talk there may be of equality, if the laws are derived from one religion, then the laws will favour that religion, like it or not.
At this point, supporters of theocracy often get riled up. This is because they can point topassages in their holy book which they argue justify their claims that their religion would be fair to all. On occasion they will also argue that their particular God’s laws are perfect.

The victims of right-wing violence are typically immigrants, Muslims, and people of color, while the targets of environmental and animal rights activism are among “the most powerful corporations on the planet” — hence the state’s relative indifference to the one and obsession with the other.
The broader pattern helps to explain one partial exception to the left/right gap in official scrutiny—namely, the domestic aspects of the “War on Terror.” Al Qaeda is clearly a reactionary organization. Like much of the American far right, it is theocratic, anti-Semitic, and patriarchal. Like Timothy McVeigh, the 9/11 hijackers attacked symbols of institutional power, killing a great many innocent people to further their cause. But while the state’s bias favors the right over the left, the Islamists were the wrong kind of right-wing fanatic. These right-wing terrorists were foreigners, they were Muslim, and above all they were not white. And so, in retrospect and by comparison, the state’s response to the Oklahoma City bombing seems relatively restrained—short-lived, focused, selectively targeting unlawful behavior for prosecution. The government’s reaction to the September 11th attacks has been something else entirely — an open-ended war fought at home and abroad, using all variety of legal, illegal, and extra-legal military, police, and intelligence tactics, arbitrarily jailing large numbers of people and spying on entire communities of immigrants, Muslims, and Middle Eastern ethnic groups. At the same time, law enforcement was also obsessively pursuing — and sometimes fabricating—cases against environmentalists, animal rights activists, and anarchists while ignoring or obscuring racist violence against people of color. What that shows, I think, is that the left/right imbalance persists, but sometimes other biases matter more.

Applying these methods to government, Progressives sought to end the tradition of crooked party bosses packing government agencies, including law enforcement, with patrons and hacks. Instead, a new class of technocratic civil servants would manage burgeoning bureaucracies, in the manner of Herbert Hoover—“ the Great Engineer”—who had become a hero for administering humanitarian relief efforts so expeditiously during World War I. As the historian Richard Gid Powers has noted, J. Edgar Hoover found in Progressivism an approach that reflected his own obsession with organization and social control. What’s more, here was a way for Hoover, a deskbound functionary, to cast himself as a dashing figure—a crusader for the modern scientific age. The wise legislator will not limit himself to giving simple commands accompanied by sanctions, i.e., threats of punishment. This is the way for guiding slaves, not free men. He will preface the laws with preambles or preludes setting forth the reasons of the laws. Yet different kinds of reasons are needed for persuading different kinds of men, and the multiplicity of reasons may be confusing and thus endanger the simplicity of obedience. The legislator must then possess the art of saying simultaneously different things to different kinds of citizens in such a way that the legislator’s speech will effect in all cases the same simple result: obedience to his laws. In acquiring this art he will be greatly helped by the poets. Laws must be twofold; they must consist of the “unmixed law,” the bald statement of what ought to be done or forborne “or else,” i.e., the “tyrannical prescription,” and the prelude to the law which gently persuades by appealing to reason. The proper mixture of coercion and persuasion, of “tyranny” and “democracy,” of wisdom and consent, proves everywhere to be the character of wise political arrangements.

This was going to be a handshake, nothing more. The president gripped my hand. Then he pulled it forward and down. There it was. He was going for the hug on national TV. I tightened the right side of my body, calling on years of side planks and dumbbell rows. He was not going to get a hug without being a whole lot stronger than he looked. He wasn’t. I thwarted the hug, but I got something worse in exchange. The president leaned in and put his mouth near my right ear. “I’m really looking forward to working with you,” he said. Unfortunately, because of the vantage point of the TV cameras, what many in the world, including my children, thought they saw was a kiss. The whole world “saw” Donald Trump kiss the man who some believed got him elected. Surely this couldn’t get any worse. President Trump made a motion as if to invite me to stand with him and the vice president and Joe Clancy. Backing away, I waved it off with a smile. “I’m not worthy,” my expression tried to say. “I’m not suicidal,” my inner voice said. Defeated and depressed, I retreated back to the far side of the room. The press was excused, and the police chiefs and directors started lining up for pictures with the president. They were very quiet. I made like I was getting in the back of the line and slipped out the side door, through the Green Room, into the hall, and down the stairs. On the way, I heard someone say the score from the Packers-Falcons game. Perfect. It is possible that I was reading too much into the usual Trump theatrics, but the episode left me worried. It was no surprise that President Trump behaved in a manner that was completely different from his predecessors—I couldn’t imagine Barack Obama or George W. Bush asking someone to come onstage like a contestant on The Price Is Right. What was distressing was what Trump symbolically seemed to be asking leaders of the law enforcement and national security agencies to do—to come forward and kiss the great man’s ring. To show their deference and loyalty. It was tremendously important that these leaders not do that—or be seen to even look like they were doing that. Trump either didn’t know that or didn’t care, though I’d spend the next several weeks quite memorably, and disastrously, trying to make this point to him and his staff.

They showed that it needed no possession of unusual strength to overcome an opponent that depended entirely on his bulk and ferocious appearance to cow the meeker ones of the earth into submission. The Japanese, by the very fact of their small stature, are compelled to place more emphasis on strategy than on force. Thus they have thoroughly developed Jiu-jitsu and there is barely a saffron-hued tot in Japan that doesn't know something about the "Gentle-Art" as it is known. President Masaryk of Czechoslovakia, one of the world's greatest educators, who, together with millions of his enlightened and progressive countrymen, is a firm believer in "a strong mind in a strong body," sought to teach every schoolboy in his country some knowledge of the wisest of all physical sciences. While it does not itself develop and build muscle, it is an invaluable aid to the sensible use of the body. It is a form of wrestling that combines the cunning of the fox with the lithe grace and agility of the panther. It sharpens the brain and quickens the nerve centers. The man or woman who has self-respect must not sit by and permit our people to become a nation of spectators watching athletic specialists perform, while we become obese and ungainly applauders. As they open their hands and let the stones fall to the ground, the rabbi picks up one of the fallen stones, lifts it high over the woman’s head, and throws it straight down with all his might. It crushes her skull and dashes her brains onto the cobblestones. “Nor am I without sin,” he says to the people. “But if we allow only perfect people to enforce the law, the law will soon be dead, and our city with it.” So the woman died because her community was too rigid to endure her deviance. This con job was nothing but a power grab to control how citizens—including corporations and conservative interest groups—can express their political views, a grab to help keep corrupt incumbents in office. After all, it’s tough to be voted out of office when you help control what your opponents and constituents can say about you. And it’s awfully hard to express one’s individual right to a fair vote when the outcome of an election is effectively rigged. Note the special carveout for the media. Reid and company were trying to make it so corporations and conservative interest groups would be muzzled, but unions and the Democrats’ tame press would be free to spew any kind of biased crap they like. If they can’t win elections fair and square, Democrats are more than willing to silence huge portions of the citizenry to stay in power. Had the amendment somehow passed, it would have been the first time one of the Constitution’s core individual rights would have been infringed through the amendment process itself.9 The attempt itself is disgraceful.

The theory holds that there isn’t enough to go around, and can never be. Therefore human aspirations and liberties must be constrained, and authorities must be empowered to enforce the constraining. During Malthus’s own time, his theory was used to justify regressive legislation directed against England’s lower classes, most notably the Poor Law Act of 1834, which forced hundreds of thousands of poor Britons into virtual slavery. 11 However, a far more horrifying example of the impact of Malthusianism was to occur a few years later, when the doctrine motivated the British government’s refusal to provide relief during the great Irish famine of 1846. In a letter to economist David Ricardo, Malthus laid out the basis for this policy: “The land in Ireland is infinitely more peopled than in England; and to give full effect to the natural resources of the country, a great part of the population should be swept from the soil.” 12 For the last century and a half, the Irish famine has been cited by Malthusians as proof of their theory of overpopulation, so a few words are in order here to set the record straight. 13 Ireland was certainly not overpopulated in 1846. In fact, based on census data from 1841 and 1851, the Emerald Isle boasted a mere 7.5 million people in 1846, less than half of England’s 15.8 million, living on a land mass about two-thirds that of England and of similar quality. So compared to England, Ireland before the famine was if anything somewhat underpopulated. 14 Nor, as is sometimes said, was the famine caused by a foolish decision of the Irish to confine their diet to potatoes, thereby exposing themselves to starvation when a blight destroyed their only crop. In fact, in 1846 alone, at the height of the famine, Ireland exported over 730,000 cattle and other livestock, and over 3 million quarts of corn and grain flour to Great Britain. 15 The Irish diet was confined to potatoes because—having had their land expropriated, having been forced to endure merciless rack-rents and taxes, and having been denied any opportunity to acquire income through manufactures or other means—tubers were the only food the Irish could afford. So when the potato crop failed, there was nothing for the Irish themselves to eat, despite the fact that throughout the famine, their homeland continued to export massive amounts of grain, butter, cheese, and meat for foreign consumption. Bell’s activism did not come at the cost of his writing. A few years later he published two law review articles of startling originality that won him widespread attention in the law school world.
