They could be forgiven for thinking that the country had viciously and deliberately neglected its poor and its blacks. Of course, it has not. Since the 1960s, the United States has poured a staggering amount of money into education, housing, welfare, Medicaid, and uplift programs of every kind. Government now spends $240 billion a year to fight poverty,1278 and despite the widespread notion that spending was curtailed during Republican administrations, it has actually gone up steadily, at a rate that would have astonished the architects of the Great Society. Federal spending on the poor, in real 1989 dollars, quadrupled from 1965 to 1975, and has nearly doubled since then.1279 As the economist Walter Williams has pointed out, with all the money spent on poverty since the 1960s, the government could have bought every company on the Fortune 500 list and nearly all the farmland in America.1280 What do we have to show for three decades and $2.5 trillion worth of war on poverty? The truth is that these programs have not worked. The truth that America refuses to see is that these programs have made things worse.

Bartholomew attempted to estimate where African Americans might encroach so the commission could respond with restrictions to control their spread. The St. Louis zoning ordinance was eventually adopted in 1919, two years after the Supreme Court's Buchanan ruling banned racial assignments; with no reference to race, the ordinance pretended to be in compliance. Guided by Bartholomew's survey, it designated land for future industrial development if it was in or adjacent to neighborhoods with substantial African American populations. Once such rules were in force, plan commission meetings were consumed with requests for variances. Race was frequently a factor. For example, on meeting in 1919 debated a proposal to reclassify a single-family property from first-residential to commercial because the area to the south had been 'invaded by negroes.' Bartholomew persuaded the commission members to deny the variance because, he said, keeping the first-residential designation would preserve homes in the area as unaffordable to African Americans and thus stop the encroachment. On other occasions, the commission changed an area's zoning from residential to industrial if African American families had begun to move into it. In 1927, violating its normal policy, the commission authorized a park and playground in an industrial, not residential, area in hopes that this would draw African American families to seek housing nearby. Similar decision making continued through the middle of the twentieth century. In a 1942 meeting, commissioners explained they were zoning an area in a commercial strip as multifamily because it could then 'develop into a favorable dwelling district for Colored people. In 1948, commissioners explained they were designating a U-shaped industrial zone to create a buffer between African Americans inside the U and whites outside. In addition to promoting segregation, zoning decisions contributed to degrading St. Louis's African American neighborhoods into slums. Not only were these neighborhoods zoned to permit industry, even polluting industry, but the plan commission permitted taverns, liquor stores, nightclubs, and houses of prostitution to open in African American neighborhoods but prohibited these as zoning violations in neighborhoods where whites lived. Residences in single-family districts could not legally be subdivided, but those in industrial districts could be, and with African Americans restricted from all but a few neighborhoods, rooming houses sprang up to accommodate the overcrowded population. Later in the twentieth century, when the Federal Housing Administration (FHA) developed the insure amortized mortgage as a way to promote homeownership nationwide, these zoning practices rendered African Americans ineligible for such mortgages because banks and the FHA considered the existence of nearby rooming houses, commercial development, or industry to create risk to the property value of single-family areas. Without such mortgages, the effective cost of African American housing was greater than that of similar housing in white neighborhoods, leaving owners with fewer resources for upkeep. African American homes were then more likely to deteriorate, reinforcing their neighborhoods' slum conditions.

More than $4 million of government largesse flows each year into the Colorado City public school district—which, according to the Phoenix New Times, “is operated primarily for the financial benefit of the FLDS Church and for the personal enrichment of FLDS school district leaders.” Reporter John Dougherty determined that school administrators have “plundered the district’s treasury by running up thousands of dollars in personal expenses on district credit cards, purchasing expensive vehicles for their personal use and engaging in extensive travel. The spending spree culminated in December [2000], when the district purchased a $220,000 Cessna 210 airplane to facilitate trips by district personnel to cities across Arizona.” Colorado City has received $1.9 million from the U.S. Department of Housing and Urban Development to pave its streets, improve the fire department, and upgrade the water system. Immediately south of the city limits, the federal government built a $2.8 million airport that serves almost no one beyond the fundamentalist community. Thirty-three percent of the town’s residents receive food stamps—compared to the state average of 4.7 percent. Currently the residents of Colorado City receive eight dollars in government services for every dollar they pay in taxes; by comparison, residents in the rest of Mohave County, Arizona, receive just over a dollar in services per tax dollar paid. “Uncle Rulon justifies all that assistance from the wicked government by explaining that really the money is coming from the Lord,” says DeLoy Bateman. “We’re taught that it’s the Lord’s way of manipulating the system to take care of his chosen people.” Fundamentalists call defrauding the government “bleeding the beast” and regard it as a virtuous act.

Just like dropped "end-of-life counseling" from health-care reform because Sarah Palin said it meant "death panels" on her Facebook page. Crazy morons make up things for Obama to do, and he does it. Same thing with the speech to schools this week, where the president attempted merely to tell children to work hard and wash their hands, and Cracker Nation reacted as if he was trying to hire the Black Panthers to hand out grenades in homeroom. Of course, the White House immediately capitulated. "No students will be forced to view the speech" a White House spokesperson assured a panicked nation. Isn't that like admitting that the president might be doing something unseemly? What a bunch of cowards. If the White House had any balls, they'd say, "He's giving a speech on the importance of staying in school, and if you jackasses don't show it to every damn kid, we're cutting off your federal education funding tomorrow." After lasting only eleven days as communications director, Anthony Scaramucci "was quickly terminated 'from' a position that he was totally incapable of handling" and was called "very much out of control." An anonymous adviser to the president was called "a drunk/drugged-up loser." Chief strategist Steve Bannon was "sloppy," a "leaker," and "dumped like a dog by almost everyone." His longtime lawyer Michael Cohen was "TERRIBLE," "hostile," "a convicted liar & fraudster," and a "failed lawyer." The president was "Never a big fan!" of his White House counsel Don McGahn and "not even a little bit happy" with Jerome Powell, his selection to head the Federal Reserve, whom he called an "enemy." His third national security advisor, John Bolton, was mocked as a "tough guy [who] got us into Iraq." Many of the Founding Fathers understood the importance of transparency in a nation’s rulers. James Madison wrote that “A popular government without popular information, or the means of acquiring it, is but a prologue to a Farce or a Tragedy, or perhaps both.” Thomas Jefferson said that “If we are to guard against ignorance and remain free, it is the responsibility of every American to be informed.” Judicial Watch has always believed that knowing the “characters and conduct” of the individuals who serve in the government and ensuring that the public is “informed” about what its government is doing is crucial to preserving our great republic. That is why for over twenty-two years we have been the most active user of the federal Freedom of Information Act (FOIA) to promote transparency, accountability, and integrity in government, politics, and the law. We are the nation’s largest and most effective government watchdog group that works to advance the public interest. Transparency is all about self-governance. If we don’t know what the government is doing, how is that self-governance? How is that even a republic? During the Bush administration, we used it to combat that administration’s penchant for improper secrecy. But the Bush administration pales in comparison to the Obama administration. Today, our government is bigger than ever, and also the most secretive in recent memory.

A daunting example of the impact that the loose talk and heavy rhetoric of the Sixties had on policy can be seen in the way the black family—a time-bomb ticking ominously, and exploding with daily detonations—got pushed off the political agenda. While Carmichael, Huey Newton and others were launching a revolutionary front against the system, the Johnson administration was contemplating a commitment to use the power of the federal government to end the economic and social inequalities that still plagued American blacks. A presidential task force under Daniel Patrick Moynihan was given a mandate to identify the obstacles preventing blacks from seizing opportunities that had been grasped by other minority groups in the previous 50 years of American history. At about the same time as the passage of the Voting Rights Act of 1965, Moynihan published findings that emphasized the central importance of family in shaping an individual life and noted with alarm that 21 percent of black families were headed by single women. “[The] one unmistakable lesson in American history,” he warned, is that a country that allows “a large number of young men to grow up in broken families, dominated by women, never acquiring any stable relationship to male authority, never acquiring any set of rational expectations about the future—that community asks for and gets chaos. Crime, violence, unrest, disorder—most particularly the furious, unrestrained lashing out at the whole social structure—that is not only to be expected; it is very near to inevitable.” Moynihan proposed that the government confront this problem as a priority; but his conclusions were bitterly attacked by black radicals and white liberals, who joined in an alliance of anger and self-flagellation and quickly closed the window of opportunity Moynihan had opened. They condemned his report as racist not only in its conclusions but also in its conception; e.g., it had failed to stress the evils of the “capitalistic system.” This rejectionist coalition did not want a program for social change so much as a confession of guilt. For them the only “non-racist” gesture the president could make would be acceptance of their demand for $400 million in “reparations” for 400 years of slavery. The White House retreated before this onslaught and took the black family off the agenda.

I write these words in May of 2011, the week after a huge outbreak of tornadoes killed hundreds across the American South; it was the second recent wave of twisters of unprecedented size and intensity. In Texas, a drought worse than the Dust Bowl has set huge parts of the state ablaze. Meanwhile, the Army Corps of Engineers is moving explosives into place to blow up a levee along the Mississippi River, swollen by the the third “100-year-flood” in the last twenty years—though as the director of the Federal Emergency Management Administration noted at the end of 2010, “the term ‘100-year event’ really lost its meaning this year.” That’s because 2010 was the warmest year recorded, a year when 19 nations set new all-time high temperature records. The Arctic melted apace; Russia suffered a heat wave so epic that the Kremlin stopped all grain exports to the rest of the world; and nations from Australia to Pakistan suffered flooding so astonishing that by year’s end the world’s biggest insurance company, Munich Re, issued this statement: “The only plausible explanation for the rise in weather-related catastrophes is climate change. The view that weather extremes are more frequent and intense due to global warming coincides with the current state of scientific knowledge.” And that’s not the bad news. The bad news is that on April 6, the U.S. House of Representatives was presented with the following resolution: “Congress accepts the scientific findings of the Environmental Protection Agency that climate change is occurring, is caused largely by human activities, and poses significant risks for public health and welfare.” The final vote on the resolution? 184 in favor, 240 against. When some future Gibbon limns the decline and fall of our particular civilization, this may be one of the moments he cites.

In the many different scandals of the Obama administration, from Benghazi to Hillary Clinton’s emails, how has Judicial Watch succeeded so often in exposing the truth when Congress has failed? Part of it is the hard, focused, and dogged work of our investigators and the skill, professionalism, and tenacity of our lawyers, as well as our other staff who help support and run one of the most effective citizens’ groups in the country. But it is also because FOIA is a straightforward tool that quickly gives Judicial Watch access to the federal courts in order to ensure compliance with our record requests to ensure transparency. Congressional investigations, when committees bother to conduct them, are political by nature. Their effectiveness is often hindered by committee members of the political party whose president is in the White House in order to protect the president, their party, and their political allies. Congress today relies on the Justice Department to enforce subpoenas issued by committees that are intended to force executive branch compliance with requests for information and witnesses. With a politicized Justice Department, which has been the hallmark of the Obama administration, there is no effective enforcement of such congressional subpoenas. A sorry example of this is the refusal of the Obama Justice Department to enforce the contempt citation against Lois Lerner for refusing to comply with a subpoena for her testimony before the House Committee investigating the IRS scandal. The administration was not about to go to a judge for an order compelling Lerner to testify and reveal what she knew about the administration’s targeting of conservative organizations.

One of the Least Transparent Administrations in History President Barack Obama promised the most transparent administration in history, but our experience over the eight years of his administration was that the executive branch and its federal agencies were black holes in terms of disclosure. President Obama and his minions made remarkable assertions of secrecy over everything from White House visitor logs to Fannie Mae and Freddie Mac, to Operation Fast and Furious and even the photos of a dead Osama bin Laden and the details of the Islamic burial ceremony used for one of the worst terrorist organizers of the modern age. Judicial Watch filed well over three thousand FOIA requests with the Obama administration, many of which went unanswered. Our staff attorneys never had a day that wasn’t hectic—they were forced to file and litigate more than 250 FOIA lawsuits in federal court. Getting the administration to comply with our requests for information and documents under FOIA was like pulling teeth. Many of these lawsuits were filed just to get a “yes or no” answer from the administration on whether they had any responsive records. Administratively, federal agencies put up additional hurdles and stonewalled even the most basic FOIA requests. In many cases, we faced tough litigation fights, with Justice Department and administration attorneys and officials fighting hard to resist turning over records they were obligated under the law to disclose. And in many cases, like our fight to get former Secretary of State Hillary Clinton’s emails, the administration seems to have misled Judicial Watch and federal judges, claiming that records did not exist that actually did exist or not conducting the legally required searches for the information and documents we were requesting.

By William McGurn | 801 words For those who see the rioting in Baltimore as primarily about race, two broad reactions dominate. One group sees rampaging young men fouling their own neighborhoods and concludes nothing can be done because the social pathologies are so overwhelming. In some cities, this view manifests itself in the unspoken but cynical policing that effectively cedes whole neighborhoods to the thugs. The other group tut-tuts about root causes. Take your pick: inequality, poverty, injustice. Or, as President Obama intimated in an ugly aside on the rioting, a Republican Congress that will never agree to the “massive investments” (in other words, billions more in federal spending) required “if we are serious about solving this problem.” There is another view. In this view, the disaster of inner cities isn’t primarily about race at all. It’s about the consequences of 50 years of progressive misrule—which on race has proved an equal-opportunity failure. Baltimore is but the latest liberal-blue city where government has failed to do the one thing it ought—i.e., put the cops on the side of the vulnerable and law-abiding—while pursuing “solutions” that in practice enfeeble families and social institutions and local economies. These supposed solutions do this by substituting federal transfers for fathers and families. They do it by favoring community organizing and government projects over private investment. And they do it by propping up failing public-school systems that operate as jobs programs for the teachers unions instead of centers of learning. If our inner-city African-American communities suffer disproportionately from crippling social pathologies that make upward mobility difficult—and they do—it is in large part because they have disproportionately been on the receiving end of this five-decade-long progressive experiment in government beneficence. How do we know? Because when we look at a slice of white America that was showered with the same Great Society good intentions—Appalachia—we find the same dysfunctions: greater dependency, more single-parent families and the absence of the good, private-sector jobs that only a growing economy can create. Remember, in the mid-1960s when President Johnson put a face on America’s “war on poverty,” he didn’t do it from an urban ghetto. He did it from the front porch of a shack in eastern Kentucky’s Martin County, where a white family of 10 eked out a subsistence living on an income of $400 a year. In many ways, rural Martin County and urban Baltimore could not be more different. Martin County is 92% white while Baltimore is two-thirds black. Each has seen important sources of good-paying jobs dry up—Martin County in coal mining, Baltimore in manufacturing. In the last presidential election, Martin Country voted 6 to 1 for Mitt Romney while Baltimore went 9 to 1 for Barack Obama. Yet the Great Society’s legacy has been depressingly similar. In a remarkable dispatch two years ago, the Lexington Herald-Leader’s John Cheves noted that the war on poverty sent $2.1 billion to Martin County alone (pop. 12,537) through programs including “welfare, food stamps, jobless benefits, disability compensation, school subsidies, affordable housing, worker training, economic development incentives, Head Start for poor children and expanded Social Security, Medicare and Medicaid.” The result? “The problem facing Appalachia today isn’t Third World poverty,” writes Mr. Cheves. “It’s dependence on government assistance.” Just one example: When Congress imposed work requirements and lifetime caps for welfare during the Clinton administration, claims of disability jumped. The national sea change occurred in part due to a surge of interest in state and local politics caused by greater demand from constituents. State lawmakers have more of an impact on the daily lives of voters of color and the marginalized than Congress ever likely will. Just as they set the law overseeing the right to vote, they also determine criminal justice, health care access, housing policy, educational equity, and transportation. Governors set budgets, sign bills, and implement these ideas. Secretaries of state act as superintendents of election law, but in many states they also manage access for small businesses and a host of administrative duties invisible to citizens until the policies go awry. Attorneys general serve as the chief law enforcement arm of the state, determining statewide matters that can have local impact.

When something in society goes so wrong, that something is often a product of one very large agreement instead of the various small disagreements that consume the political sphere. Looming over the fights about which administration is to blame for housing becoming so unstable and what percentage increase this or that program is entitled to sits the inconsistency of America spending about $70 billion a year subsidizing homeownership through tax breaks like deferred taxes on capital gains and the mortgage interest deduction (MID), which allows homeowners to deduct the interest on their home loan from their federal income taxes. Together these tax breaks amount to a vast upper-middle-class welfare program that encourages people to buy bigger and more expensive houses, but because their biggest beneficiaries are residents of high-cost cities in deep blue redoubts like New York and California, even otherwise liberal politicians fight any attempt to reduce them. These programs are also entitlements that live on budgetary autopilot, meaning people get the tax breaks no matter how much they cost the government. Contrast that with programs like Section 8 rental vouchers, which cost about $20 billion a year, have been shown to be highly effective at reducing homelessness, and cost far less than the morally repugnant alternative of letting people live in tents and rot on sidewalks, consuming police resources and using the emergency room as a public hospital. That program has to be continually re-upped by Congress, and unlike middle-class homeowner programs, when the money runs out, it’s gone. This is why many big cities either have decades-long lines for rental vouchers or have closed those lines indefinitely on account of excess demand. The message of this dichotomy, which has persisted for decades regardless of which party is in charge and despite the mountains of evidence showing just how well these vouchers work, is that America is willing to subsidize as much debt as homeowners can gorge themselves on but that poor renters, the majority of whom live in market-rate apartments, are a penny-ante side issue unworthy of being prioritized.

Quoting page 56-57: Most important for the content of immigration reform, the driving force at the core of this movement, reaching back to the 1920s, were Jewish organizations long active in opposing racial and ethnic quotas. These included the American Jewish Congress, the American Jewish Committee, the Anti-Defamation League of B’nai B’rith, and the American Federation of Jews from Eastern Europe. Jewish members of Congress, particularly representatives from New York and Chicago, had maintained steady but largely ineffective pressure against the national origins quotas since the 1920s. But the war against Hitler and the postwar movement against colonialism sharply changed the ideological and moral environment, putting defenders of racial, caste, and ethnic hierarchies on the defensive. Jewish political leaders in New York, most prominently Governor Herbert Lehman, had pioneered in the 1940s in passing state antidiscrimination legislation. The day after Republicans used Black votes to regain the House in the 1906 midterm elections, President Theodore Roosevelt ordered the dishonorable discharge (and loss of pensions) of 167 Black soldiers in the 25th Infantry Regiment, a Black unit that had been a huge source of Black pride. A dozen or so members of the regiment had been falsely accused of murdering a bartender and wounding a police officer in the horrifically racist town of Brownsville, Texas, on August 13, 1906. Overnight, the most popular US president in Black communities since Abraham Lincoln became the most unpopular. “Once enshrined in our hearts as Moses,” shouted out a Harlem pastor, the Reverend Adam Clayton Powell Sr., Roosevelt was “now enshrouded in our scorn as Judas.” In the final days of 1906, it was hard to find an African American who was not spitting ire at the Roosevelt administration. Roosevelt’s efforts to regain Black support with new Black federal appointments failed. Sounding the indignation of the observant press, the New York Times reported that “not a particle of evidence” had been given to prove the men were guilty. Roosevelt was defiant in his Annual Message to Congress on December 3, 1906 (defiant in his crude attempts to gain southern White voters). He warned “respectable colored people… not to harbor criminals,” meaning the criminals of Brownsville. And then he turned to lynchings: “The greatest existing cause of lynching is the perpetration, especially by black men, of the hideous crime of rape.

Clark Foreman proposed a Detroit development, the Sojourner Truth Homes, for African Americans. The project was in the district of Democratic Congressman Rudolph Tenerowicz, who persuaded his colleagues that funding for the agency should be cut off unless Foreman was fired and the Sojourner Truth units were assigned only to whites. The director of the Federal Housing Administration supported Tenerowicz, stating that the presence of African Americans in the area would threaten property values of nearby residents. Foreman was forced to resign. The Federal Works Agency then proposed a different project for African Americans on a plot that the Detroit Housing Commission recommended, in an industrial area deemed unsuitable for whites. It soon became apparent that this site, too, would provoke protests because it was not far enough away from a white neighborhood. First Lady Eleanor Roosevelt protested to the president. The FWA again reversed course and assigned African Americans to the Sojourner Truth project. Whites in the neighborhood rioted, leading to one hundred arrests (all but three were African Americans) and thirty-eight hospitalizations (all but five were African Americans). Following the war, Detroit's politicians moblized white voters by stirring up fear of integration in public housing. Mayor Edward Jeffries's successful 1945 reelection campaign warned that projects with African Americans could be located in white neighborhoods if his opponent, Dick Frankensteen, won. Jeffries's literature proclaimed, 'Mayor Jeffries Is Against Mixed Housing.

Over the next few years, the number of African Americans seeking jobs and homes in and near Palo Alto grew, but no developer who depended on federal government loan insurance would sell to them, and no California state-licensed real estate agent would show them houses. But then, in 1954, one resident of a whites-only area in East Palo Alto, across a highway from the Stanford campus, sold his house to a black family. Almost immediately Floyd Lowe, president of the California Real Estate Association, set up an office in East Palo Alto to panic white families into listing their homes for sale, a practice known as blockbusting. He and other agents warned that a 'Negro invasion' was imminent and that it would result in collapsing property values. Soon, growing numbers of white owners succumbed to the scaremongering and sold at discounted prices to the agents and their speculators. The agents, including Lowe himself, then designed display ads with banner headlines-"Colored Buyers!"-which they ran in San Francisco newspapers. African Americans desperate for housing, purchased the homes at inflated prices. Within a three-month period, one agent alone sold sixty previously white-owned properties to African Americans. The California real estate commissioner refused to take any action, asserting that while regulations prohibited licensed agents from engaging in 'unethical practices,' the exploitation of racial fear was not within the real estate commission's jurisdiction. Although the local real estate board would ordinarily 'blackball' any agent who sold to a nonwhite buyer in the city's white neighborhoods (thereby denying the agent access to the multiple listing service upon which his or her business depended), once wholesale blockbusting began, the board was unconcerned, even supportive. At the time, the Federal Housing Administration and Veterans Administration not only refused to insure mortgages for African Americans in designated white neighborhoods like Ladera; they also would not insure mortgages for whites in a neighborhood where African Americans were present. So once East Palo Alto was integrated, whites wanting to move into the area could no longer obtain government-insured mortgages. State-regulated insurance companies, like the Equitable Life Insurance Company and the Prudential Life Insurance Company, also declared that their policy was not to issue mortgages to whites in integrated neighborhoods. State insurance regulators had no objection to this stance. The Bank of America and other leading California banks had similar policies, also with the consent of federal banking regulators. Within six years the population of East Palo Alto was 82 percent black. Conditions deteriorated as African Americans who had been excluded from other neighborhoods doubled up in single-family homes. Their East Palo Alto houses had been priced so much higher than similar properties for whites that the owners had difficulty making payments without additional rental income. Federal and state hosing policy had created a slum in East Palo Alto. With the increased density of the area, the school district could no longer accommodate all Palo Alto students, so in 1958 it proposed to create a second high school to accommodate teh expanding student population. The district decided to construct the new school in the heart of what had become the East Palo Alto ghetto, so black students in Palo Alto's existing integrated building would have to withdraw, creating a segregated African American school in the eastern section and a white one to the west. the board ignored pleas of African American and liberal white activists that it draw an east-west school boundary to establish two integrated secondary schools. In ways like these, federal, state, and local governments purposely created segregation in every metropolitan area of the nation.

Government's commitment to separating residential areas by race began nationwide following the violent suppression of Reconstruction after 1877. Although the Supreme Court in 1917 forbade the first wave of policies—racial segregation by zoning ordinance—the federal government began to recommend ways that cities could evade that ruling, not only in the southern and border states but across the country. In the 1920s a Harding administration committee promoted zoning ordinances that distinguished single-family from multifamily districts. Although government publications did not say it in as many words, committee members made little effort to hide that an important purpose was to prevent racial integration. Simultaneously, and through the 1920s and the Hoover administration, the government conducted a propaganda campaign directed at white middle-class families to persuade them to move out of apartments and into single-family dwellings. During the 1930s the Roosevelt administration created maps of every metropolitan area, divided into zones of foreclosure risk based in part on the race of their occupants. The administration then insured white homeowners' mortgages if they lived in all-white neighborhoods into which there was little danger of African Americans moving. After World War II the federal government went further and spurred the suburbanization of every metropolitan area by guaranteeing bank loans to mass-production builders who would create the all-white subdivisions that came to ring American cities. In 1973, the U.S. Commission on Civil Rights concluded that the 'housing industry, aided and abetted by Government, must bear the primary responsibility for the legacy of segregated housing. . . . Government and private industry came together to create a system of residential segregation.

As much as the Christian right of the twenty-first century is now fixated on abortion and sexual politics, the backlash against the efforts of the federal government to desegregate tax-exempt private schools is embedded in the movement’s DNA. The white evangelical attraction to Trump was not in spite of his extended birther crusade against Barack Obama, his racist outbursts in tweets and rallies, and his administration’s plans to eviscerate federal protection of racial minorities from discrimination in housing and education by eliminating their ability to show discrimination based on the disparate impact of a policy, as opposed to having to prove discriminatory intent. The Christian right movement was born out of grievance against civil rights gains for blacks, and a backlash against the government’s efforts to ensure those gains could endure. When Trump offers paeans to “religious freedom”—the very clarion call of the Bob Jones University defenders—or sloganeers “Make America Great Again,” he is sending a message that rings true for a movement driven by the rhetoric and organizing pioneered by Weyrich and Billings. Trump’s white evangelical admirers do not just see a leader who is making it safe to say Merry Christmas again, or holding the IRS back from penalizing pastors who endorse him from the pulpit. In Trump’s words and deeds, they see an idealized white Christian America before civil rights for people of color—and a meddling government—ruined it.

Although the federal government had been trying to persuade middle-class families to buy single-family homes for more than fourteen years, the campaign had achieved little by the time Franklin D. Roosevelt took office in 1933. Homeownership remained prohibitively expensive for working- and middle-class families: bank mortgages typically required 50 percent down, interest-only payments, and repayment in full after five to seven years, at which point the borrower would have to refinance or find another bank to issue a new mortgage with similar terms. Few urban working- and middle-class families had the financial capacity to do what was being asked. The Depression made the housing crisis even worse. Many property-owning families with mortgages couldn't make their payments and were subject to foreclosure. With most others unable to afford homes at all, the construction industry was stalled. The New Deal designed one program to support existing homeowners who couldn't make payments, and another to make first-time homeownership possible for the middle class. In 1933, to rescue households that were about to default, the administration created the Home Owners' Loan Corporation (HOLC). It purchased existing mortgages that were subject to imminent foreclosure and then issued new mortgages with repayment schedules of up to fifteen years (later extended to twenty-five years). In addition, HOLC mortgages were amortized, meaning that each month's payment included some principal as well as interest, so when the loan was paid off, the borrower would own the home. Thus, for the first time, working- and middle-class homeowners could gradually gain equity while their properties were still mortgaged. If a family with an amortized mortgage sold its home, the equity (including any appreciation) would be the family's to keep. HOLC mortgages had low interest rates, but the borrowers still were obligated to make regular payments. The HOLC, therefore, had to exercise prudence about. its borrowers' abilities to avoid default. to assess risk, the HOLC wanted to know something about the condition of the house and of surrounding houses in the neighborhood to see whether the property would likely maintain its value. The HOLC hired local real estate agents to make the appraisals on which refinancing decisions could be based. With these agents required by their national ethics code to maintain segregation, it's not surprising that in gauging risk HOLK considered the racial composition of neighborhoods. The HOLC created color-coded maps of every metropolitan area in the nation, with the safest neighborhoods colored green and the riskiest colored red. A neighborhood earned a red color if African Americans lived in it, even if it was a solid middle-class neighborhood of single-family homes. For example, in St. Louis, the white middle-class suburb of Ladue was colored green because, according to an HOLC appraiser in 1940, it had 'not a single foreigner or negro.' The similarly middle-class suburban area of Lincoln Terrace was colored red because it had 'little or no value today . . . due to the colored element now controlling the district.' Although HOLC did not always decline to rescue homeowners in neighborhoods colored red on its maps (i.e., redlined neighborhoods), the maps had a huge impact and put the federal government on record as judging that African Americans, simply because of their race, were poor risks.

To solve the inability of middle-class renters to purchase single-family homes for the first time, Congress and President Roosevelt created the Federal Housing Administration in 1934. The FHA insured bank mortgages that covered 80 percent of purchase prices, had terms of twenty years, and were fully amortized. To be eligible for such insurance, the FHA insisted on doing its own appraisal of the property to make certain that the loan had a low risk of default. Because the FHA's appraisal standards included a whites-only requirement, racial segregation now became an official requirement of the federal mortgage insurance program. The FHA judged that properties would probably be too risky for insurance if they were in racially mixed neighborhoods or even in white neighborhoods near black ones that might possibly integrate in the future. When a bank applied to the FHA for insurance on a prospective loan, the agency conducted a property appraisal, which was also likely performed by a local real estate agent hired by the agency. as the volume of applications increased, the agency hired its own appraisers, usually from the ranks of the private real estate agents who had previously been working as contractors for the FHA. To guide their work, the FHA provided them with an Underwriting Manual. The first, issued in 1935, gave this instruction: 'If a neighborhood is to retain stability it is necessary that properties shall continue to be occupied by the same social and racial classes. A change in social or racial occupancy generally leads to instability and a reduction in values.' Appraisers were told to give higher ratings where '[p]rotection against some adverse influences is obtained,' and that '[i]mportant among adverse influences . . . are infiltration of inharmonious racial or nationality groups.' The manual concluded that '[a]ll mortgages on properties protected against [such] unfavorable influences, to the extent such protection is possible, will obtain a high rating.' The FHA discouraged banks from making any loans at all in urban neighborhoods rather than newly built suburbs; according to the Underwriting Manual, 'older properties . . . have a tendency to accelerate the rate of transition to lower class occupancy.' The FHA favored mortgages in areas where boulevards or highways served to separate African American families from whites, stating that '[n]atural or artificially established barriers will prove effective in protecting a neighborhood and the locations within it from adverse influences, . . . includ[ing] prevention of the infiltration of . . . lower class occupancy, and inharmonious racial groups.

The Center for Immigration Studies (CIS) estimates that there are 340 jurisdictions with sanctuary policies, located in forty-three states and the District of Columbia. CIS found that in just one eight-month period in 2014, more than 8,100 deportable aliens were released by sanctuary jurisdictions. Three thousand were felons and 62 percent had prior criminal records. Nineteen hundred were later rearrested a total of 4,300 times on 7,500 offenses including assaults, burglaries, sexual assaults, thefts, and even murders—none of which would have occurred except for these sanctuary policies! Such sanctuary policies are illegal under federal immigration law, which specifies that “no State or local government entity may be prohibited, or in any way restricted, from sending to or receiving from the Immigration and Naturalization Service information regarding the immigration status, lawful or unlawful, of any alien in the United States.”9 But in accordance with its nonenforcement policy on immigration, the Obama administration announced in 2010 that it would not sue sanctuary cities for violating federal law. As Kate Steinle’s father, Jim Steinle, told the Senate Judiciary Committee on July 21, 2015: Everywhere Kate went throughout the world, she shined the light of a good citizen of the United States of America. Unfortunately, due to disjointed laws and basic incompetence at many levels, the U.S. has suffered a self-inflicted wound in the murder of our daughter by the hand of a person who should have never been on the streets of this country.10 Kate Steinle’s murderer had been deported five times, and kept reentering the country with no consequences. So on July 9, 2015, Rep. Matt Salmon (R-AZ) introduced H.R. 3011—Kate’s Law—to impose a five-year mandatory prison sentence on anyone arrested in the United States after having been previously deported. A companion bill was introduced in the Senate by Sen. Ted Cruz (R-TX). But the Obama administration made it clear it would not support such a bill if it passed Congress.

In 2013, a federal judge ruled in favor of Judicial Watch, chastising the agency for withholding documents, and he specifically ruled against DHS’s improper claim of attorney-client privilege. The documents uncovered by Judicial Watch showed that DHS officials misled Congress and the public about its implementation of a new policy that resulted in the dismissal of multiple deportation cases against illegal alien criminals convicted of violent crimes. The administration decided to halt almost all enforcement actions (on an alleged “case-by-case” basis) against any illegal alien who has not committed any other “serious” crimes. As a result, it is failing to protect citizens from the scourge of rampant illegal immigration and criminal illegal aliens. In 2014, Judicial Watch filed another FOIA lawsuit to get more information about this issue, after the Center for Immigration Studies (CIS) reported that 36,000 criminal aliens who were awaiting the outcome of deportation proceedings were released by DHS in 2013.3 This group consisted of aliens convicted of hundreds of serious, often violent crimes, including homicide, sexual assault, kidnapping, and aggravated assault. The 36,000 criminal aliens had nearly 88,000 convictions, including one for willfully killing a public official with a gun. Yet this alien, and tens of thousands of other dangerous thugs, were released by DHS onto an unsuspecting American public.

As has been the case far too often in the Obama administration, which may go down as the least transparent administration in history, the IRS refused to respond to our FOIA requests. Judicial Watch was forced to sue the IRS in federal court in October 2013, shortly after Lois Lerner had “retired” to avoid the consequences of her actions. Judicial Watch’s efforts through these FOIA requests and subsequent litigation led to the discovery that in addition to targeting conservatives at the IRS, Lois Lerner sent confidential taxpayer information to attorneys at the Federal Election Commission, which enforces federal campaign finance rules, in violation of federal law. Email communications revealed that Lerner, who formerly worked at the Federal Election Commission (FEC), sent extensive materials on conservative organizations—the American Issues Project and Citizens for the Republic—to the FEC, including detailed confidential information, after inquiries from the FEC attorneys. She disclosed this information in spite of Section 6103 of the Internal Revenue Code, which bars the IRS from sending such information to anyone, including other federal agencies. It also turned out that the FEC attorneys were acting without authority to make such an inquiry, because the commissioners who run the agency had never approved an investigation. The emails discovered by Judicial Watch provided a disturbing window into the activities of two out-of-control federal agencies, whose employees, because of their political bias, were trying to target conservative organizations.

Despite the refusal of the Obama Justice Department to prosecute anyone at the IRS, it is clear that what happened was an epic clampdown on any conservative voices speaking or advocating against the president’s disastrous policies and in favor of patriotism and adherence to the Constitution and the rule of law. Over the course of twenty-seven months leading up to the 2012 election, not a single Tea Party–type organization received tax-exempt status. Many were unable to operate; others disbanded because donors refused to fund them without the IRS seal of approval; some organizations and their donors were audited without justification; and many incurred legal fees and costs fighting the unlawful conduct by Lerner and other IRS employees. The IRS suppressed the entire Tea Party movement just in time to help Obama win reelection. And everyone in the administration involved in this outrageous conduct got away with it without being punished or prosecuted. Was it simply a case of retribution against the perceived “enemies” of the administration? No, this was much bigger than political payback. It was a systematic and concerted effort to squash the Tea Party movement—one of the most organic and powerful political movements in recent memory—during an election season. [See Appendix for select IRS documents uncovered by Judicial Watch.] This was about campaign politics. It was a scandal for the ages. President Obama obviously wanted this done even if he gave no direct orders for it. In 2015, he told Jon Stewart on The Daily Show that “you don’t want all this money pouring through non-profits.” But there is no law preventing money from “pouring through non-profits” that they use to achieve their legal purposes and the objectives of their members. Who didn’t want this money pouring through nonprofits? Barack Obama. In the subsequent FOIA litigation filed by Judicial Watch, the IRS obstructed and lied to a federal judge and Judicial Watch in an effort to hide the truth about what Lois Lerner and other senior officials had done. The IRS, including its top political appointees like IRS Commissioner John Koskinen and General Counsel William J. Wilkins, have much to answer for over their contempt of court and of Congress. And the Department of Justice lawyers and officials enabling this cover-up in court need to be held accountable as well. If the Tea Party and other conservative groups had been fully active in the critical months leading up to the 2012 election, would Mitt Romney have been elected president? We will, of course, never know for certain. But we do know that President Obama’s Internal Revenue Service targeted right-leaning organizations applying for tax-exempt status and prevented them from entering the fray during that period. That is how you steal an election in plain sight. Accountability is not something we will get from the Obama administration. But Judicial Watch will continue its independent investigation and certainly any new presidential administration should take a fresh look at this IRS scandal.

A prime example of intimidation at the polls that reveals the Obama administration’s disappointing attitude toward election crimes occurred in the 2008 federal election when two members of the New Black Panther Party stood in a doorway of a polling place in Philadelphia. They were in black paramilitary uniforms and one of them carried and brandished a nightstick. They argued with passersby and shouted racial insults at poll watchers. They attempted to block a poll watcher from entering the polling place and were recorded by a poll watcher with his video camera. At the time, Robert Popper was a deputy chief in the Voting Section of the Civil Rights Division of the US Justice Department. He was assigned to prosecute a civil action against these men for intimidation and attempted intimidation under the relevant federal statute, Section 11(b) of the Voting Rights Act. The case against the defendants was strong, and they subsequently defaulted by refusing even to answer the charges against them. But the case was abruptly curtailed and all but shut down by the newly appointed officials of the Obama administration. In the end, they ordered Popper to settle the case for a short, limited, and toothless injunction against only one of the four defendants. There was never a convincing explanation from Eric Holder or the administration as to why the case was cut short. Popper believes that it was a partisan abuse of what are supposed to be neutral law enforcement efforts to enforce the Voting Rights Act. This was only the beginning of the Obama administration’s abuse of its power over elections. The damage to the reputation of the Justice Department was enormous and enduring, and the damage to the public’s perception of the integrity of elections was incalculable.

The typical argument we hear from the Obama administration and other leftists is that voter ID laws discourage minorities, young people, and the elderly from voting. Yet, we know from reputable surveys that the common sense use of photo ID is supported by every demographic group in America. Two-thirds of African Americans support it; two-thirds of Hispanics; two-thirds of liberals; and even two-thirds of those who consider themselves to be Democrats. There is simply no evidence to support the contention that the requirement to show a photo ID (which are provided for free in every state with such a requirement) discourages legitimate voters from voting. In fact, in states such as Indiana and Georgia where photo ID requirements have been in place for almost a decade, studies show that voter turnout has actually increased. Photo IDs are part and parcel of living in a modern society. We have to show a photo ID to fly on a plane, cash a check, purchase prescription drugs, and to enter federal and private office buildings—including the US Department of Justice in Washington, where the Obama administration has directed its mostly unsuccessful attacks on voter ID laws. South Carolina beat the Justice Department in a court fight, when former Attorney General Eric Holder tried to stop the state from implementing its law.

While marriage rates for middle-class white women soared through the 1940s and 1950s, for black women, mid-twentieth century conditions were very different. Since emancipation, black women had married earlier and more often than their white counterparts. In the years directly after World War II, thanks to the return of soldiers, black marriage rates briefly increased further.66 However, as white women kept marrying in bigger numbers and at younger ages throughout the 1950s, black marriage rates began to decrease, and the age of first marriage to climb.67 By 1970, there had been a sharp reversal: Black women were not marrying nearly as often or as early as their white counterparts. It was nothing as benign as coincidence. While one of the bedrocks of the expansion of the middle class was the aggressive reassignment of white women to domestic roles within the idealized nuclear family, another was the exclusion of African-Americans from the opportunities and communities that permitted those nuclear families to flourish. Put more plainly, the economic benefits extended to the white middle class, both during the New Deal and in the post-World War II years, did not extend to African-Americans. Social Security, created in 1935, did not apply to either domestic laborers or agricultural workers, who tended to be African-Americans, or Asian or Mexican immigrants. Discriminatory hiring practices, the low percentages of black workers in the country’s newly strengthened labor unions, and the persistent (if slightly narrowed68) racial wage gap, along with questionable practices by the Veterans Administration, and the reality that many colleges barred the admission of black students, also meant that returning black servicemen had a far harder time taking advantage of the GI Bill’s promise of college education.69 Then there was housing. The suburbs that bloomed around American cities after the war, images of which are still summoned as symbols of midcentury familial prosperity, were built for white families. In William Levitt’s four enormous “Levittowns,” suburban developments which, thanks to government guarantees from the VA and the Federal Housing Association, provided low-cost housing to qualified veterans, there was not one black resident.70 Between 1934 and 1962, the government subsidized $120 billion in new housing; 98 percent of it for white families.

This mostly restrictionist trend reached an important pivot in 2012. Three major developments prompted this change in direction and momentum. First, the U.S. Supreme Court issued its Arizona v. United States opinion, delivering its most consequential decision on the limits of state authority in immigration in three decades. Rejecting several provisions of Arizona's controversial omnibus immigration enforcement bill, SB 1070, the opinion nevertheless still left open possibilities for state and local involvement. Second, President Barack Obama, against the backdrop of a stalemate in comprehensive immigration reform (CIR) in Congress and contentious debates over the role of the federal executive in immigration enforcement, instituted the Deferred Action for Child Arrivals (DACA) program, providing administrative relief and a form of lawful presence to hundreds of thousands of undocumented youth. Finally, Mitt Romney, the Republican presidential candidate whose platform supported laws like Arizona's and called them a model for the rest of the country, lost his bid for the White House with especially steep losses among Latinos and immigrant voters. After these events in 2012, restrictive legislation at the state level waned in frequency, and a growing number of states began to pass laws aimed at the integration of unauthorized immigrants. As this book goes to press, this integrationist trend is still continuing.

The Boston Fed’s PhDs encouraged banks to allow loans from nonprofits or government assistance agencies to go toward a borrower’s down payment, though such borrowers are more likely to default on their mortgages. The Boston Fed distributed more than ninety thousand copies of this remarkably naïve guide. The mortgage industry, anxious to extend its reach and generate fees, embraced its suggestions.

Another example, one that touches more people, is the nursing home industry. Numerous studies have shown that living at home, in a house or an apartment, is better psychologically, more fulfilling, and cheaper than living in nursing homes.14 Yet these institutions prosper when federal programs that foster living in the community are cut. There are also funding disincentives that the U.S. Congress, through Medicare and Medicaid, has created to ensure the profit bonanza of nursing homes. According to the activist disability journal Mouth (1995), there are 1.9 million people with disabilities living in nursing homes at an annual cost of $40,784, although it would cost only $9,692 a year to provide personal assistance services so the same people could live at home. Sixty-three percent of this cost is taxpayer funded. In 1992, 77,618 people with developmental disabilities (DD) lived in state-owned facilities at an average annual cost of $82,228, even though it would cost $27,649 for the most expensive support services to live at home. There are 150,257 people with mental illness living in tax-funded asylums at an average annual cost of $58,569. Another 19,553 disabled veterans also live in institutions, costing the Veterans Administration a whopping $75,641 per person.15 It is illogical that a government would want to pay more for less. It is illogical until one studies the amount of money spent by the nursing home lobby. Nursing homes are a growth industry that many wealthy people, including politicians, have wisely invested in. The scam is simple: get taxpayers to fund billions of dollars to these institutions which a few investors divide up. The idea that nursing homes are compassionate institutions or necessary resting places has lost much of its appeal recently, but the barrier to defunding them is built on a paternalism that eschews human dignity. As we have seen with public housing programs in the United States, the tendency is to warehouse (surplus) people in concentrated sites. This too has been the history with elderly people and people with disabilities in nursing homes. These institutions then can serve as a mechanism of social control and, at the same time, make some people wealthy.

Criminal records for marijuana possession have also imposed needless barriers to employment, housing, and educational opportunities. And while white and Black and brown people use marijuana at similar rates, Black and brown people have been arrested, prosecuted, and convicted at disproportionate rates. Today, I am announcing three steps that I am taking to end this failed approach. First, I am announcing a pardon of all prior Federal offenses of simple possession of marijuana. I have directed the Attorney General to develop an administrative process for the issuance of certificates of pardon to eligible individuals. There are thousands of people who have prior Federal convictions for marijuana possession, who may be denied employment, housing, or educational opportunities as a result. My action will help relieve the collateral consequences arising from these convictions. Second, I am urging all Governors to do the same with regard to state offenses. Just as no one should be in a Federal prison solely due to the possession of marijuana, no one should be in a local jail or state prison for that reason, either. Third, I am asking the Secretary of Health and Human Services and the Attorney General to initiate the administrative process to review expeditiously how marijuana is scheduled under federal law. Federal law currently classifies marijuana in Schedule I of the Controlled Substances Act, the classification meant for the most dangerous substances. This is the same schedule as for heroin and LSD, and even higher than the classification of fentanyl and methamphetamine – the drugs that are driving our overdose epidemic. Finally, even as federal and state regulation of marijuana changes, important limitations on trafficking, marketing, and under-age sales should stay in place. Too many lives have been upended because of our failed approach to marijuana. It’s time that we right these wrongs.

It is to do a remake of King Kong without the gorilla. It is also a bad example of whiggish history, a genre depressingly familiar to anyone who has done any reading in the conventional accounts of the sexual revolution and the civil rights movement, where effects have no causes and actual people making actual decisions in actual rooms are replaced by broad historical forces and Enlightenment melodramas like the triumph of liberation over bondage and light over darkness.

That covered an estimated seventy-five thousand mental patients. But in February 2017, the House and Senate passed bills to reverse the Social Security Administration’s rule.10 President Trump signed into law the restoration of firearm eligibility to those who are so mentally ill that they are considered by the government to be disabled.

Throughout the week, banks were receiving net deposits rather than facing panicked withdrawals. Over the following weeks, the administration developed a sweeping farm package designed to “increase purchasing power of our farmers” and “relieve the pressure of farm mortgages.” To guarantee the safety of bank deposits, the Federal Deposit Insurance Corporation was created. To regulate the entire American stock and bond markets, the Exchange Act of 1933 required companies to report their financial condition accurately to the buying public, establishing the Securities and Exchange Commission. Safety nets such as Social Security for retirement and home loan guarantees for individuals would be added to the government’s portfolio of responsibilities within a couple of years. It was the largest peacetime escalation of government in American history.

As in most Northern cities fielding black migrants, housing remained a pernicious obstacle in the 1950s. Suburban tracts constructed on a vast scale for soldiers returning from World War II—and backed by Federal Housing Administration (FHA) grants—were generally closed to Negro veterans. “Restrictive covenants” limited ownership to whites only, including recent immigrants from Europe. In developments like the 17,000 tract houses of Levittown, built on Long Island between 1947 and 1951, federally subsidized housing generated equity wealth and spawned a new generation of white middle-class Americans. Shut out of Levittown—the prototype for postwar suburbia—and other such developments for decades, Negro veterans were belatedly granted lesser subsidies for scatter-site housing in generally depressed areas. Moreover, the government subsidized public housing for Negroes that were not owner-occupied—like the homes for whites in suburbia—but rented to low-income families in inner-city areas. These federally backed housing projects capped family earning for eligibility at little more than minimum wage. The U.S. government essentially ran a two-tier program, encouraging a permanent Negro underclass of renters while operating the FHA-backed suburban home ownership program to stimulate a dramatic growth of the white middle class.

But the New Deal also created racial, gender, and class divisions that continue to produce inequities in our society today. Roosevelt’s administration capitulated to white supremacy in ways that still bear bitter fruit. The Civilian Conservation Corps capped Black participation in federally supported work relief at 10 percent of available jobs, though African Americans experienced 80 percent unemployment in northern cities. The National Housing Act of 1934 redoubled the burden on Black neighborhoods by promoting residential segregation and encouraging mortgage redlining. The Wagner Act granted workers the right to organize, but allowed segregated trade unions. Most importantly, in response to threats that southern states would not support the Social Security Act, both agricultural and domestic workers were explicitly excluded from its employment protections. The “southern compromise” left the great majority of African American workers—and a not-insignificant number of poor white tenant farmers, sharecroppers, and domestics—with no minimum wage, unemployment protection, old-age insurance, or right to collective bargaining.

And so in the 1960s organizations like the Black Panther Party were created. (And I should say the Black Panther Party was founded in 1966, which means that there should be a fiftieth anniversary celebration coming up!) I wonder how we are going to address, for example, the Ten-Point Program of the Black Panther Party. I’ll just summarize the Ten-Point Program and you might get an idea why there are not efforts under way to guarantee a large fiftieth anniversary celebration for the Black Panther Party. Number one was “We want freedom.” Two, full employment. Three, an end to the robbery by the capitalists of our Black and oppressed communities—it was anticapitalist! Number four, we want decent housing, fit for the shelter of human beings. Number five, we want decent education for our people that exposes the true nature of this decadent American society. We want education that teaches us our true history and our role in present-day society. And number six—which is especially significant in relation to the right-wing effort to undo the very small efforts made by the Obama administration to produce health care for poor people in the US—we want completely free health care for all Black and oppressed people. Number seven, we want an immediate end to police brutality and the murder of Black people, other people of color, and all oppressed people inside the United States. Number eight, we want an immediate end to all wars of aggression—you see how current this still sounds. Number nine, we want freedom for all Black and oppressed people now held in US federal, state, county, city, and military prisons and jails. We want trials by a jury of peers for all persons charged with so-called crimes under the laws of this country. And finally, number ten: we want land, bread, housing, education, clothing, justice, peace, and people’s community control of modern technology.

The term ‘redlining’… comes from the development by the New Deal, by the federal government of maps of every metropolitan area in the country. And those maps were color-coded by first the Home Owners Loan Corp. and then the Federal Housing Administration and then adopted by the Veterans Administration, and these color codes were designed to indicate where it was safe to insure mortgages. And anywhere where African-Americans lived, anywhere where African-Americans lived nearby were colored red to indicate to appraisers that these neighborhoods were too risky to insure mortgages.”35
