History is a friend to white America when it celebrates the glories of American exceptionalism, the beauty of American invention, the genius of the American soul. History is unrestrained bliss when it sings Walt Whitman’s body electric or touts the lyrical vision of the Transcendentalists. History that swings at the plate with Babe Ruth or slides into home with Joe DiMaggio is the American pastime at its best. History hovers low in solemn regard for the men who gave up the ghost at Appomattox and speaks with quiet reverence for the Confederate flags that gleefully waved to secession. Of course all of you don’t sing from the same hymnal. But American history, the collective force of white identity that picks up velocity across the centuries, mouths every note.

Everyone knew there had never been a cowardly Confederate soldier and they found this statement peculiarly irritating. He always referred to the soldiers as “our brave boys” or “our heroes in gray” and did it in such a way as to convey the utmost in insult. When daring young ladies, hoping for a flirtation, thanked him for being one of the heroes who fought for them, he bowed and declared that such was not the case, for he would do the same thing for Yankee women if the same amount of money were involved. Since Scarlett’s first meeting with him in Atlanta on the night of the bazaar, he had talked with her in this manner, but now there was a thinly veiled note of mockery in his conversations with everyone. When praised for his services to the Confederacy, he unfailingly replied that blockading was a business with him. If he could make as much money out of government contracts, he would say, picking out with his eyes those who had government contracts, then he would certainly abandon the hazards of blockading and take to selling shoddy cloth, sanded sugar, spoiled flour and rotten leather to the Confederacy. Most of his remarks were unanswerable, which made them all the worse. There had already been minor scandals about those holding government contracts. Letters from men at the front complained constantly of shoes that wore out in a week, gunpowder that would not ignite, harness that snapped at any strain, meat that was rotten and flour that was full of weevils. Atlanta people tried to think that the men who sold such stuff to the government must be contract holders from Alabama or Virginia or Tennessee, and not Georgians. For did not the Georgia contract holders include men from the very best families? Were they not the first to contribute to hospital funds and to the aid of soldiers’ orphans? Were they not the first to cheer at “Dixie” and the most rampant seekers, in oratory at least, for Yankee blood? The full tide of fury against those profiteering on government contracts had not yet risen, and Rhett’s words were taken merely as evidence of his own bad breeding. He not only affronted the town with insinuations of venality on the part of men in high places and slurs on the courage of the men in the field, but he took pleasure in tricking the dignified citizenry into embarrassing situations. He could no more resist pricking the conceits, the hypocrisies and the flamboyant patriotism of those about him than a small boy can resist putting a pin into a balloon. He neatly deflated the pompous and exposed the ignorant and the bigoted, and he did it in such subtle ways, drawing his victims out by his seemingly courteous interest, that they never were quite certain what had happened until they stood exposed as windy, high flown and slightly ridiculous.

On the first day of the meeting that would become known as the United States Constitutional Convention, Edmund Randolph of Virginia kicked off the proceedings. Addressing his great fellow Virginian General George Washington, victorious hero of the War of Independence, who sat in the chair, Randolph hoped to convince delegates sent by seven, so far, of the thirteen states, with more on the way, to abandon the confederation formed by the states that had sent them—the union that had declared American independence from England and won the war—and to replace it with another form of government. “Our chief danger,” Randolph announced, “arises from the democratic parts of our constitutions.” This was in May of 1787, in Philadelphia, in the same ground-floor room of the Pennsylvania State House, borrowed from the Pennsylvania assembly, where in 1776 the Continental Congress had declared independence. Others in the room already agreed with Randolph: James Madison, also of Virginia; Robert Morris of Pennsylvania; Gouverneur Morris of New York and Pennsylvania; Alexander Hamilton of New York; Washington. They wanted the convention to institute a national government. As we know, their effort was a success. We often say the confederation was a weak government, the national government stronger. But the more important difference has to do with whom those governments acted on. The confederation acted on thirteen state legislatures. The nation would act on all American citizens, throughout all the states. That would be a mighty change. To persuade his fellow delegates to make it, Randolph was reeling off a list of what he said were potentially fatal problems, urgently in need, he said, of immediate repair. He reiterated what he called the chief threat to the country. “None of the constitutions”—he meant those of the states’ governments—“have provided sufficient checks against the democracy.” The term “democracy” could mean different things, sometimes even contradictory things, in 1787. People used it to mean “the mob,” which historians today would call “the crowd,” a movement of people denied other access to power, involving protest, riot, what recently has been called occupation, and often violence against people and property. But sometimes “democracy” just meant assertive lawmaking by a legislative body staffed by gentlemen highly sensitive to the desires of their genteel constituents. Men who condemned the working-class mob as a democracy sometimes prided themselves on being “democratical” in their own representative bodies. What Randolph meant that morning by “democracy” is clear. When he said “our chief danger arises from the democratic parts of our constitutions,” and “none of the constitutions have provided sufficient checks against the democracy,” he was speaking in a context of social and economic turmoil, pervading all thirteen states, which the other delegates were not only aware of but also had good reason to be urgently worried about. So familiar was the problem that Randolph would barely have had to explain it, and he didn’t explain it in detail. Yet he did say things whose context everyone there would already have understood.

Brigadier General John Buford commanded the 1st Cavalry Division, Army of the Potomac, prior to and during the battle of Gettysburg. This much is accepted by all historians and written accounts of the battle. On most other facts, disagreement begins and on specific facts, varies greatly. The purpose of this paper is to examine the facts as presented in different accounts, discover the differences, and try to determine what is important in terms of the lessons to be learned from the battle. The first was to form a network of terrorist organizations with names like the Constitutional Guards, the White Brotherhood, the Society of Pale Faces, and the Knights of the White Camelia. The second was to institute state-sponsored segregation throughout the South. Let us consider these two approaches one by one. The Democrats started numerous terror groups, but the most notorious of these was the Ku Klux Klan. Founded in 1866, the Klan was initially led by a former Confederate army officer, Nathan Bedford Forrest, who served two years later as a Democratic delegate to the party’s 1868 national convention. Forrest’s role in the Klan is controversial; he later disputed that he was ever involved, insisting he was active in attempting to disband the organization. Initially the Klan’s main targets weren’t blacks but rather white people who were believed to be in cahoots with blacks. The Klan unleashed its violence against northern Republicans who were accused of being “carpetbaggers” and unwarrantedly interfering in southern life, as well as southern “scalawags” and “white niggers” who the Klan considered to be in league with the northern Republicans. The Klan’s goal was to repress blacks by getting rid of these perceived allies of the black cause. Once again Republicans moved into action, passing a series of measures collectively termed the Ku Klux Klan Acts of 1871. These acts came to be known as the Force Bill, signed into law by a Republican President, Ulysses Grant. They restricted northern Democratic inflows of money and weapons to the Klan, and also empowered federal officials to crack down on the Klan’s organized violence. The Force Bill was implemented by military governors appointed by Grant. These anti-Klan measures seem modest in attempting to arrest what Grant described as an “invisible empire throughout the South.” But historian Eric Foner says the Force Bill did markedly reduce lawless violence by the Democrats. The measures taken by Republicans actually helped shut down the Ku Klux Klan. By 1873, the Klan was defunct, until it was revived a quarter-century later by a new group of racist Democrats.

Some might respond to the last point by claiming that, despite the obviously finite magnitude of both the human and nonhuman resources used by government forces, national defense nevertheless does represent equal protection for all in the sense that there is a perpetual commitment to resist aggression against any part of the nation. But that is false, and the American Civil War is clear evidence of this error in reasoning. Union forces would have done nothing to protect the Confederate states if, say, the government of France had attacked them. Instead, the French would have been viewed as allies in the subjugation of the Southern "traitors.” Intervention from abroad would only have been resisted by the North if it was accompanied by a demand that the Southern states, once defeated, would become a possession of that foreign power. And one cannot escape by claiming that the Confederacy was viewed as a separate nation and therefore was not owed protection. The North consistently maintained that the Confederacy was an unlawful entity along the lines of a criminal gang, not a sovereign nation. In short, governmental protection against aggression is never guaranteed, but instead may change with political conditions. In no sense, then, does national defense necessarily imply equal protection for all areas and all persons. True defense, though its effects may be widespread, is microeconomic in nature.

Pollard wrote that he was “profoundly convinced that the true cause fought for in the late war has not been ‘lost’ immeasurably or irrevocably, but is yet in a condition to be ‘regained’ by the South on ultimate issues of the political contest.” The question was no longer slavery, but white supremacy, which Pollard described as the “true cause of the war” and the “true hope of the South.” The reassertion of states’ rights and the rejection of federal rule was a holy cause. Likening the lot of the Southerner to that of Christ himself, Pollard spoke in terms religiously inclined Southerners—which was to say most Southerners—could understand, calling on the defeated Confederates to be patient in the tribulation of Reconstruction. The South, Pollard wrote, “must wear the crown of thorns before she can assume that of victory.” The blood of their brothers and the faith of their fathers had consecrated a postwar Southern path. Someone who probably did mean it was Maurice Heath, who heads the Philadelphia chapter of the New Black Panther party. He once told a crowd, “I hate white people—all of them! . . . You want freedom? You’re gonna have to kill some crackers! You’re gonna have to kill some of their babies!” Another one who probably meant it is Dr. Kamau Kambon, black activist and former visiting professor of Africana Studies at North Carolina State University in Raleigh. In 2005, Prof. Kambon told a panel at Howard University Law School that “white people want to kill us,” and that “we have to exterminate white people off the face of the planet to solve this problem.” In 2005, James “Jimi” Izrael, a black editorial assistant for the Lexington, Kentucky, Herald- Leader, was on a radio program to talk about Prof. Kambon. Another guest mentioned other blacks who have written about the fantasy of killing whites, and Mr. Izrael began to laugh. “Listen,” he said, “I’m laughing because if I had a dollar for every time I heard a black person [talking about] killing somebody white I’d be a millionaire.” For some, killing whites is not fantasy. Although the press was quiet about this aspect of the story, the two snipers who terrorized the Washington, DC, area in 2002 had a racial motive. Lee Malvo testified that his confederate, John Muhammad, was driven by hatred of America because of its “slavery, hypocrisy and foreign policy.” His plan was to kill six whites every day for 30 days. For a 179-day period in 1973 and 1974, a group of Black Muslim “Death Angels” kept the city of San Francisco in a panic as they killed scores of randomly-chosen “blue-eyed devils.” Some 71 deaths were eventually attributed to them. Four of an estimated 14 Death Angels were convicted of first-degree murder. Most Americans have never heard of what became known as the Zebra Killings. A 2005 analysis of crime victim surveys found that 45 percent of the violent crimes blacks committed were against whites, 43 percent against blacks, and 10 percent against Hispanics. There was therefore slightly more black-on-white than black-on-black crime. When whites committed violence they chose black victims only 3 percent of the time. Violence by whites against blacks, such as the 1998 dragging death of James Byrd, is well reported, but racial murder by blacks is little publicized. For example, in Wilkinsburg, near Philadelphia, 39-year-old Ronald Taylor killed three men and wounded two others in a 2000 rampage, in which he targeted whites. At one point, he pushed a black woman out of his way, saying “Not you, sister. I’m not going to hurt any black people. I’m just out to kill all white people.

The issue of whether Chrysler’s tax breaks were unfair to competing businesses and individuals is how the Articles of Confederation come into play. Under the first American government, from 1781 to 1788, the states regulated commerce. They used this power to enact tariffs to protect their own businesses. Anyone trying to import, say, furniture into New York from Connecticut faced a heavy tariff by New York, and Connecticut retaliated with its own tariffs. This economic warfare was destroying the whole experiment in self-governance. Efforts to find a solution transformed into the Constitutional Convention. The Constitution grants Congress the power to regulate commerce “among the several states.” Implied, but not explicitly stated, is the power of the federal government to block protectionist tariffs and similar devices that discriminate.

From that day forward, we became more purposeful in how we showed up for rallies and protests, advocating for the causes we supported in between attending classes and study sessions, and refusing to allow our necessary activism to undermine our academic success.
