Savio had a debilitating stutter when speaking to people in small groups, but when standing before a crowd and condemning his administration's latest injustice he spoke with divine fire. His words had inspired students to stage what was the largest campus protest in American history. Newspapers and magazines depicted him as the archetypal "angry young man," and it was true that he embodied a student movement fueled by anger at injustice, impatience for change, and a burning desire for personal freedom. Hoover ordered his agents to gather intelligence they could use to ruin his reputation or otherwise "neutralize" him, impatiently ordering them to expedite their efforts. Hoover's agents had also compiled a bulging dossier on the man Savio saw as his enemy: Clark Kerr. As campus dissent mounted, Hoover came to blame the university president more than anyone else for not putting an end to it. Kerr had led UC to new academic heights, and he had played a key role in establishing the system that guaranteed all Californians access to higher education, a model adopted nationally and internationally. These systems were modeled on the theories of Frederick Winslow Taylor, an industrial engineer, who argued that companies should be run “scientifically,” with each worker’s task minutely analyzed and quantified. Applying these methods to government, Progressives sought to end the tradition of crooked party bosses packing government agencies, including law enforcement, with patrons and hacks. Instead, a new class of technocratic civil servants would manage burgeoning bureaucracies, in the manner of Herbert Hoover—“ the Great Engineer”—who had become a hero for administering humanitarian relief efforts so expeditiously during World War I. As the historian Richard Gid Powers has noted, J. Edgar Hoover found in Progressivism an approach that reflected his own obsession with organization and social control. What’s more, here was a way for Hoover, a deskbound functionary, to cast himself as a dashing figure—a crusader for the modern scientific age. The fact that he didn’t fire a gun only burnished his image. Reporters noted that the “days of ‘old sleuth’ are over” and that Hoover had “scrapped the old ‘gum shoe, dark lantern and false moustache’ traditions of the Bureau of Investigation and substituted business methods of procedure.” One article said, “He plays golf. Hoover adopted a similar model, with its classifications and numbered subdivisions, to organize the bureau’s Central Files and General Indices. (Hoover’s “Personal File,” which included information that could be used to blackmail politicians, would be stored separately, in his secretary’s office.) Agents were now expected to standardize the way they filed their case reports, on single sheets of paper. Captain Wilmott, after a visit to the shipping line office, ordered the Morro Castledeck fire hydrants capped and sealed; 2100 feet of fire hose was locked away, along with nozzles, outlets, and wrenches for each length of hose. Whether the captain received positive instructions from an executive of the Ward Line, or whether he acted independently, is not known, nor is it important. What is known is that as a result of Wilmott’s order, the pride of the American merchant marine, one of the fastest and most luxurious liners afloat, became from that moment on, a floating fire hazard in all but its cargo holds. In one teletype sent to the director of the Domestic Intelligence Division of the FBI, as well as to the White House and the U.S. attorney general, at 11:58 p.m. on September 9, the Buffalo office reported that during the riot “the whites were reportedly forced into the yard area by the blacks” and Black Power militants there were rounding up not just employee hostages but also all white prisoners, which was misleading in that it suggested a race riot was unfolding.42 More inflammatory still, the FBI’s Buffalo office stated that the prisoners “have threatened to kill one guard for every shot fired [at them]”; that they “have threatened to kill all hostages unless demands are met”; and that all of the hostages “are being made to stand at attention” out in D Yard.43 None of this proved to be the case. During the tumultuous 1960s and 1970s the FBI was deeply invested in destabilizing and undermining grassroots organizations that it considered a threat to national security—as were the politicians, such as Nixon, Agnew, and Mitchell, who supported its efforts and relied on its briefings.44 One of the FBI’s counterintelligence programs in this period—COINTELPRO—was notorious for using rumor and outright fabrication stories in an attempt to destroy leftist, antiwar, and civil rights groups from within. For this reason Commissioner Oswald’s determination to keep negotiating with the men in D Yard infuriated much of the Bureau. As one internal FBI memo put it, state officials had “capitulated to the unreasonable demands of prisoners.”45 And these weren’t just any criminals; as the FBI noted on multiple occasions, “The majority of the mutinous prisoners are black.”46 As dusk fell over D Yard on the first day of the Attica uprising, FBI and State Police rumors about black prisoners’ threats and outrageous actions only multiplied. But no matter how hostile everyone else was to the idea of the state negotiating with the prisoners, Commissioner Russell Oswald insisted even more forcefully that he was going to see these talks through.

Crews that fight forest fires in Oregon are now so heavily Hispanic that in 2003, the Oregon Department of Forestry required that crew chiefs be bilingual. In 2006, the department started forcing out veterans. Jaime Pickering, who used to run a squad of 20 firefighters, says the rule means “job losses for Americans—the white people.” Zita Wilensky, a 16-year veteran, was the only white employee of Miami-Dade County Domestic Violence Unit. Her co-workers made fun of her and called her gringa and Americana. Miss Wilensky says her boss gave her 60 days to learn Spanish, and fired her when she failed to do so. It is increasingly common, therefore, for Americans to be penalized because they cannot speak Spanish, but employers who insist that workers speak English are guilty of discrimination. In 2001, the Equal Employment Opportunity Commission forced a small Catholic college in San Antonio to pay $2.4 million to housekeepers who were required to speak English at work. There are now about 45 million Hispanics in the country. What will the status of Spanish be when there are 130 million Hispanics, as the Census Bureau projects for 2050? In 2000, President Bill Clinton decided that the prohibition against discrimination because of “national origin” in the Civil Rights Act of 1964 meant that if a foreigner cannot speak to a government agency in his own language he is a victim. Executive Order 13166 required all local governments that receive federal money (all of them, essentially) to translate official documents into any language spoken by at least 3,000 people in the area or 10 percent of the local population. It also required interpreters for non-English speakers. In 2002, the Office of Management and Budget estimated that hospitals alone would spend $268 million every year implementing Executive Order 13166, and state departments of motor vehicles would spend $8.5 million. OMB estimated that communicating with food stamp recipients who don’t speak English would cost $25.2 million per year.

The young man who was their target was not at home at the time. The weapon had been stolen by this FBI provocateur. According to the local branch of the ACLU, the gun was handed over the next day to the San Diego FBI Bureau, who hid it; and for six months the FBI lied to the San Diego police about the incident. This affair did not become publicly known until later. This terrorist group, directed and financed by the FBI, was finally broken up by the San Diego police, after they had tried to fire-bomb a theater in the presence of police. The FBI agent in question, who had hidden the weapon, was transferred outside the state of California so that he could not be prosecuted. The FBI provocateur also escaped prosecution, though several members of the secret terrorist organization were prosecuted.

Finally, the gun homicide and murder data leave out an extremely important point. To contribute to the homicide data, a gun must be fired and kill someone. Guns can be fired without killing, and they can be used to threaten without being fired. The Bureau of Justice maintains records on instances in which crime victims protect themselves with a gun, either by firing the gun or threatening to fire the gun. Over the five years from 2007 through 2011, there were 235,700 instances in which a potential victims of violent crime defended themselves with a gun in the U.S. Over the same period, there were 64,695 gun deaths (excluding suicides) – and some of those deaths include deaths in which the potential victim killed the criminal. In other words, from 2007 through 2011, potential victims used guns (either by firing or threatening to fire) in defense against violent crime well over three times as often as someone used a gun to kill another. And this ignores gun use in defense against property crime. From 2007 through 2011, potential victims either fired or threatened to fire guns in defense of property crime 103,000 times. In total, guns were used defensively more than five times as often as someone used a gun to kill another.

Disruption always kicks off a three-day news cycle that opens the Bureau up to criticism. On day one, everyone is shocked at the plot that has been uncovered, riveted by the danger, and relieved to hear of the arrest. By day three, the tone has turned 180 degrees. Now the story is, These guys couldn't have pulled off a serious attack. They failed out of kindergarten and their ex-wives say they have mental disabilities. The theme of the conversation becomes, The FBI is taking advantage of goofballs who probably couldn't have blown up a balloon. The operative word there is "probably." The FBI does not have the luxury of assessing whether people are fully capable of doing what they suggest they might do. If you are inclined to film yourself firing an AK-47 while hollering about jihad, and if you are taking affirmative actions in line with those sentiments, then you have cast the die and have set yourself up for investigation. It would not be a reasonable response to those situations if the FBI were to say, Well, this guy, he's kind of dumb, so we'll just leave him be--we only build cases on people who got good grades in high school. That would not be a wise or just process. But it's the strange way some people suggest we should operate.
