Islamophobia” as a weapon of jihad The charge of “Islamophobia” is routinely used to shift attention away from jihad terrorists. After a rise in jihadist militancy and the arrest of eight people in Switzerland on suspicion of aiding suicide bombers in Saudi Arabia, some Muslims in Switzerland were in no mood to clean house: “As far as we’re concerned,” said Nadia Karmous, leader of a Muslim women’s group in Switzerland, “there is no rise in Islamism, but rather an increase in Islamophobia.”5 This pattern has recurred in recent years all over the world as “Islamophobia” has passed into the larger lexicon and become a self-perpetuating industry. In Western countries, “Islamophobia” has taken a place beside “racism,” “sexism,” and “homophobia.” The absurdity of all this was well illustrated by a recent incident in Britain: While a crew was filming the harassment of a Muslim for a movie about “Islamophobia,” two passing Brits, who didn’t realize the cameras were rolling, stopped to defend the person being assaulted. Yet neither the filmmakers nor the reporters covering these events seemed to realize that this was evidence that the British were not as violent and xenophobic as the film they were creating suggested.6 Historian Victor Davis Hanson has ably explained the dangerous shift of focus that “Islamophobia” entails: There really isn’t a phenomenon like “Islamophobia”—at least no more than there was a “Germanophobia” in hating Hitler or “Russophobia” in detesting Stalinism. Any unfairness or rudeness that accrues from the “security profiling” of Middle Eastern young males is dwarfed by efforts of Islamic fascists themselves—here in the U.S., in the UK, the Netherlands, France, Turkey, and Israel—to murder Westerners and blow up civilians. The real danger to thousands of innocents is not an occasional evangelical zealot or uncouth politician spouting off about Islam, but the deliberately orchestrated and very sick anti-Semitism and anti-Americanism that floods the airways worldwide, emanating from Iran, Lebanon, and Syria, to be sure, but also from our erstwhile “allies” in Egypt, Saudi Arabia, and Qatar.7

It can also emerge in response to persistent distress or ongoing abuse, like a relationship where sex is unwanted, though it may be technically “consensual” because the targeted person says yes in order to avoid being hurt or feels trapped in the relationship or is otherwise coerced. In that context, a survivor’s body gradually learns that it can’t escape and it can’t fight; freeze becomes the default stress response because of the learned pattern of shutdown as the best way to guarantee survival. Each person’s experience of survival is unique, but it often includes a kind of disengaged unreality. And afterward, that illusion of unreality gradually degrades, disintegrating under the weight of physical existence and burdened memory. The tentative recognition that this thing has actually happened incrementally unlocks the panic and rage that couldn’t find their way to the surface before, buried as they were under the overmastering mandate to survive. But survival is not recovery; survival happens automatically, sometimes even against the survivor’s will. Recovery requires an environment of relative security and the ability to separate the physiology of freeze from the experience of fear, so that the panic and the rage can discharge, completing their cycles at last.

And this is the most worrisome obverse of these advances: they have been accompanied by a multitude of assaults on the biosphere. Foremost among them has been the scale of the human claim on plants, including a significant reduction of the peak posts-glacial area of natural forests (on the order of 20%), mostly due to deforestation in temperate and tropical regions; a concurrent expansion of cropland to cover about 11% of continental surfaces; and an annual harvest of close to 20% of the biosphere's primary productivity (Smil 2013a). Other major global concerns are the intensification of natural soil erosion rates, the reduction of untouched wilderness areas to shrinking isolated fragments, and a rapid loss of biodiversity in general and within the most species-rich biomes in particular. And then there is the leading global concern: since 1850 we have emitted close to 300 Gt of fossil carbon to the atmosphere (Boden and Andres 2017). This has increased tropospheric CO2 concentrations from 280 ppm to 405 ppm by the end of 2017 and set the biosphere on a course of anthropogenic global warming (NOAA 2017).
These realities clearly demonstrate that our preferences have not been to channel our growing capabilities either into protecting the biosphere or into assuring decent prospects for all newborns and reducing life's inequalities to tolerable differences. Judging by the extraordinary results that are significantly out of line with the long-term enhancements of our productive and protective abilities, we have preferred to concentrate disproportionately on multiplying the destructive capacities of our weapons and, even more so, on enlarging our abilities for the mass-scale acquisition and storage of information and for instant telecommunication, and have done so to an extent that has become not merely questionable but clearly counterproductive in many ways.

Reputation is strictly a function of the subjective opinions of other minds, and they have the absolute right to their own opinions whatever they may be. Hence, outlawing defamation is itself a gross invasion of the defamer's right of freedom of speech, which is a subset of his property right in his own person.
An even broader assault on freedom of speech is the modern Warren-Brandeis-inspired tort of invasion of the alleged right of "privacy," which outlaws free speech and acts using one's own property that are not even false or "malicious."
In the law of torts, "harm" is generally treated as physical invasion of person or property and usually requires payment of damages for "emotional" harm if and only if that harm is a consequence of physical invasion. Thus, within the standard law of trespass — an invasion of person or property — "battery" is the actual invasion of someone else's body, while "assault" is the creation by one person in another of a fear, or apprehension, of battery.
To be a tortious assault and therefore subject to legal action, tort law wisely requires the threat to be near and imminent. Mere insults and violent words, vague future threats, or simple possession of a weapon cannot constitute an assault18; there must be accompanying overt action to give rise to the apprehension of an imminent physical battery. Or, to put it another way, there must be a concrete threat of an imminent battery before the prospective victim may legitimately use force and violence to defend himself.
Physical invasion or molestation need not be actually "harmful" or inflict severe damage in order to constitute a tort. The courts properly have held that such acts as spitting in someone's face or ripping off someone's hat are batteries. Chief Justice Holt's words in 1704 still seem to apply: "The least touching of another in anger is a battery." While the actual damage may not be substantial, in a profound sense we may conclude that the victim's person was molested, was interfered with, by the physical aggression against him, and that hence these seemingly minor actions have become legal wrongs.
