Strikingly, “Emily” and “Brendan” were 50 percent more likely to get called for an interview than “Lakisha” and “Jamal.” A few years later, a researcher at the University of Wisconsin conducted a similar study in Milwaukee, but with a unique twist. She recruited two black and two white actors (college students, posing as high school graduates) who were as similar as possible in every way. She sent these “job applicants” out in pairs, with virtually identical fake résumés, to apply for entry-level jobs. Her twist was to instruct one of the white and one of the black applicants to tell employers that they had a felony conviction and had just been released from prison the month before. Even the researcher was surprised by what she found: the white applicant with a felony conviction was more likely to get a positive response from a prospective employer than the black applicant with no criminal record. So this, for example, is one of the reasons that science has taken up arms against theory –that is to say, proper scientific theoreticians like me – and it has instead hired people who run big expensive experiments: Because big expensive experiments have big grants, and those big grants bring in money. But if you were a university and what you wanted was to have people writing big expensive grants who were capable of getting them, then what you would want to do is...you would want to free those people from teaching, and you would want to get people who weren't so expensive to do the work of the university...and the way you do that is: you bring them on as graduate students; and you pay them an appalling wage; you claim that they are not actually workers, that they are students; and they do most of the teaching, and they do a lot of the work of the university, for incredibly low amounts of money; they live under poor conditions; and increasingly they have to come from abroad where they are in some sense getting a deal that still makes sense. But this means that we overproduce PhDs. We give people degrees instead of money to do the work of the university, in order that people who are capable of getting the grants spend almost full time doing that job. And it's a racket. The person who knows the most about this is actually Eric, my brother. So...what he unearthed was actually that there was an explicit conspiracy to game the visa system in order to keep this system running...that effectively a fake shortage of science students was created to allow the universities to basically flood the market, to drive the wages down.

I have the greatest respect for conservation biologists. I care very much about conserving the rain forest and the wildlife in Indonesia, but I also found it disheartening. It often feels like you are fighting a losing battle, especially in areas where people depend so heavily on these natural resources for their own survival. After graduation, I decided to return to the original behavioral questions that motivated me. Although monogamy—both social and genetic—is rare in mammals, social monogamy is the norm in birds. Plus, birds are everywhere. I figured that if I turned my attention to studying our feathered friends, I wouldn’t have to spend months on end trying to secure research permits and travel visas from foreign governments. I wouldn’t even have to risk getting bitten by leeches (a constant problem in the Mentawais*). Birds seemed like the perfect choice for my next act. But I didn’t know anyone who studied birds. My PhD was in an anthropology department, without many links to researchers in biology departments. Serendipitously, while applying for dozens of academic jobs, I stumbled across an advertisement for a position managing Dr. Ellen Ketterson’s laboratory at Indiana University. The ad described Ketterson’s long-term project on dark-eyed juncos. Eureka! Birds! At the time, her lab primarily focused on endocrinology methods like hormone assays (a method to measure how much of a hormone is present in blood or other types of biological samples), because they were interested in how testosterone levels influenced behavior. I had no experience with either birds or hormone assays. But I had spent the last several years developing DNA sequencing and genotyping skills, which the Ketterson lab was just starting to use. I hoped that my expertise with fieldwork and genetic work would be seen as beneficial enough to excuse my lack of experience in ornithology and endocrinology. I submitted my application but heard nothing back. After a while, I did something that was a bit terrifying at the time. In 1994, a young Barack Obama, recently graduated from Harvard Law School, joined two other attorneys in suing Citibank for “discriminatory lending” because it had denied home loans to several bank applicants. The case was called Selma S. Buycks-Roberson v. Citibank. Citibank denied wrongdoing, but as often happens in such situations, it settled the lawsuit to avoid litigation costs and the negative publicity. Hillary helped to raise money for ACORN and also for a closely allied group, the Industrial Areas Foundation. The IAF had been founded by Saul Alinsky and continued to operate as an aggressive leftist pressure group long after Alinsky’s death in 1972. Hillary lent her name to these groups’ projects and met several times with their organizers in the White House. ACORN’s efforts were also supported by progressive politicians like Nancy Pelosi, Barney Frank, Jon Corzine, Chuck Schumer, and Harry Reid. I don’t get to solve problems or be creative. I don’t get to work with numbers, and I am a numbers guy. I basically babysit a team and deal with personnel.” When his loans came out of deferment, he couldn’t afford the monthly payments and decided to get a master’s degree—partly to increase his earning potential and partly to put his loans back into deferment. After all, it had been “hammered into his head” that higher education was the key to success. He put on twenty-five pounds while working and going to school full-time for three years. Let’s take the case of US law schools as an example. If you were to say to someone educated, “There are too many law schools producing too many lawyers in the US,” she would probably agree, in part because there have been dozens of articles over the past several years about the precipitous drop in positions at law firms and the many unemployed law school graduates.9 The general response to this problem is, “Well, people will figure it out and eventually stop applying to law school,” the suggestion being that the market will clear and self-correct if given enough time. In 2013, law school applications are projected to be down to about 54,000 from a high of 98,700 in 2004.10 That’s a dramatic decrease of 45 percent. However, a closer look shows that the number of students who started law school in 2011 and are set to graduate in 2014 was 48,697, about 43,000 of whom will graduate, based on historical graduation rates.11 We’ll still be producing 36,000–43,000 newly minted law school grads a year, not far from the peak of 44,495 set in 2012, from now until the current entering class graduates in 2016. Meanwhile, in 2011, only 65.4 percent of law school graduates got jobs for which they needed to pass the bar exam, and estimates of the number of new legal jobs available run as low as 2,180 per year.12 Bloomberg Businessweek has projected a surplus of 176,000 unemployed or underemployed law school graduates by 2020.13 So even as applications plummet, there will not be dramatically fewer law school graduates produced in the coming several years, though it will have been easier to get in as acceptance rates rise due to the diminished applicant pool.14 We’ll still be producing many more lawyers than the market requires, but now they’ll be less talented. If anything, the situation is going to get worse before it gets better. Human capital markets don’t self-correct very quickly, if at all. At a minimum there’s a massive time lag that spans years, for several reasons.

People and organizations have to make decisions, often between alternatives that are almost equally good or bad. What better way to justify such decisions than to consult an expert, and the more money he or she charges, the better. “We paid for the best possible medical advice,” can be a palliative for a fatal operation (or a losing legal defense), just as throwing the I Ching can relieve someone from regretting a bad marriage or a bad career choice. An expert who constructs a linear model is not as impressive as one who gives advice in a “burst” of intuition derived from “years of experience.” (One highly paid business expert we know constructs linear models in secret.) So we value the global judgment of experts independently of its validity. But there is also a situational reason for doubting the inferiority of global, intuitive judgment. It has to do with the biased availability of feedback. When we construct a linear model in a prediction situation, we know exactly how poorly it predicts. In contrast, our feedback about our own intuitive judgments is flawed. Not only do we selectively remember our successes, we often have no knowledge of our failures—and any knowledge we do have may serve to “explain” them (away). Who knows what happens to rejected graduate school applicants? Professors have access only to accepted ones, and if the professors are doing a good job, the accepted ones will likewise do well—reinforcing the impression of the professors’ good judgment.
