The Federalist Society and the Heritage Foundation, the two outside interest groups most responsible for telling Republican judges how to rule, have fully adopted an absolutist, blood-soaked interpretation of the Second Amendment. These groups of alleged “textualists” read “well regulated militia” clear out of the text of the Amendment. Instead, they substitute self-defense as the “original purpose” of the language. There was an original purpose to the Second Amendment, but it wasn’t to keep people safe. It was to preserve white supremacy and slavery.

Today’s Democratic Party and its legislators, with a few notable individual exceptions, is well to the right of counterparts from the New Deal and Great Society eras. In the time of Lyndon Johnson, the average Democrat in Congress was for single-payer national health insurance. In 1971, Congress overwhelmingly passed the Comprehensive Child Development Act, for universal, public, tax-supported, high-quality day care and prekindergarten. Nixon vetoed the bill in 1972, but even Nixon was for a guaranteed annual income, and his version of health reform, “play or pay,” in which employers would have to provide good health insurance or pay a tax to purchase it, was well to the left of either Bill or Hillary Clinton’s version, or Barack Obama’s. The Medicare and Medicaid laws of 1965 were not byzantine mash-ups of public and private like Obamacare. They were public. Infrastructure investments were also public. There was no bipartisan drive for either privatization or deregulation. The late 1960s and early 1970s (with Nixon in the White House!) were the heyday of landmark health, safety, environmental, and financial regulation. To name just three out of several dozen, Nixon signed the 1970 Clean Air Act, the 1970 Occupational Safety and Health Act, and the 1973 Consumer Product Safety Act. Why did Democrats move toward the center and Republicans to the far right? Several things occurred. Money became more important in politics. The Democratic Leadership Council, formed by business-friendly and Southern Democrats after Walter Mondale’s epic 1984 defeat, believed that in order to be more competitive electorally, Democrats had to be more centrist on both economic and social issues.

The villagers knew it was their last Sankranti, a harvest festival celebrated to seek agricultural prosperity. For in two months, more than 30,000 acres of fertile farmland would be acquired for a brand new capital planned in collaboration with Singapore. The Nara Chandrababu Naidu government went about the capital project by setting aside the Centre’s land acquisition act and drawing up a compensation package for land-owning and tenant farmers and labourers. Many are opposed to it, and are not keen on snapping their centuries-old bond with their land and livelihood. In Penumaka village, Nageshwara Rao, 50, fears the future as he does not possess a tenancy certificate that could have brought some relief under the compensation package. “The entire village is against land-pooling but we hear the government is adamant,” Rao says, referring to municipal minister P Narayana’s alleged assertion that land would be taken with or without the farmers’ consent. Narayana is supervising the land-pooling process. “Naidu says he would give us Rs 50,000 per year in lieu of annual crops. We earn that much in a month here,” villager Meka Koti Reddy says. To drive home the point, locals in Undavalli village nearby have put up a board asking officials to keep off their lands that produce three crops a year. Unlike other parts of Andhra Pradesh, the water-rich land here is highly productive yielding 200 varieties of crops. Some farmers are also suspicious about the compensation because Naidu is yet to deliver on the loan-waiver promise. They are now weighing legal options besides seeking Prime Minister Narendra Modi’s intervention to retain their land. While the villagers opposing land-pooling are allegedly being backed by Jaganmohan Reddy’s YSR Congress Party, those belonging to the Kamma community — the support base for Naidu’s Telugu Desam Party — are said to be cooperative. It is also believed that Naidu chose this location over others suggested by experts to primarily benefit the Kamma industrialists who own large swathes of land in Krishna and Guntur districts. But even the pro-project villagers cannot help feel insecure. “We are clueless about where our developed area would be. What if the project is not executed within Naidu’s tenure? Is there a legal recourse?” Idupulapati Rambabu of Mandadam says. This is despite Naidu’s assurance on January 1 at nearby Thulluru, where he launched the land-pooling process, asking farmers to give land without any apprehension. He said the deal in its present form would make them richer than him in a decade. “We are not building a mere city but a hub of economic activity loaded with superior infrastructure that is aimed at generating wealth. This would be a win-win situation for all,” Naidu tells HT. As of now, villages like Nelapadu struggling with low soil fertility seem to be winning from the package.

In 2005, when Congress still depended on Communist votes for a majority in Parliament, a National Rural Employment Guarantee Act (NREGA) was passed, assuring any household in the countryside a hundred days labour a year at the legal minimum wage on public works, with at least a third of these jobs for women. It is work for pay, rather than a direct cash transfer scheme as in Brazil, to minimize the danger of money going to those who are not actually the poor, and so ensure it reaches only those willing to do the work. Denounced by all right-thinking opinion as debilitating charity behind a façade of make-work, it was greeted by the middle-class like ‘a wet dog at a glamorous party’, in the words of one of its architects, the Belgian-Indian economist Jean Drèze. Unlike the Bolsa Família in Brazil, the application of NREGA was left to state governments rather than the centre, so its impact has been very uneven and incomplete, wages often paid lower than the legal minimum, for days many fewer than a hundred.75 Works performed are not always durable, and as with all other social programmes in India, funds are liable to local malversation. But in scale NREGA now represents the largest entitlement programme in the world, reaching some 40 million rural households, a quarter of the total in the country. Over half of these dalit or adivasi, and 48 per cent of its beneficiaries are women – double their share of casual labour in the private sector. Such is the demand for employment by NREGA in the countryside that it far outruns supply. A National Survey Sample for 2009–2010 has revealed that 45 per cent of all rural households wanted the work it offers, of whom only 56 per cent got it.76 What NREGA has started to do, in the formulation Drèze has taken from Ambedkar, is break the dictatorship of the private employer in the countryside, helping by its example to raise wages even of non-recipients. Since inception, its annual cost has risen from $2.5 to over $8 billion, a token of its popularity. This remains less than 1 per cent of GDP, and the great majority of rural labourers in the private sector are still not paid the minimum wage due them. Conceived outside the party system, and accepted by Congress only when it had little expectation of winning the elections of 2004, the Act eventually had such popular demand behind it that the Lok Sabha adopted it nem con. Three years later, with typical dishonesty, the Manmohan regime renamed it as ‘Gandhian’ to fool the masses that Congress inspired it.

The following is the Oath of loyalty for Public Officials:
“I swear: I shall be loyal and obedient to Adolf Hitler, the Führer of the German Reich and people, respect the laws, and fulfill my official duties conscientiously, so help me God.”
It is interesting to note that these oaths were pledged to Hitler himself, and not to the Constitution or the German state. Oaths were very seriously taken by members of the German armed forces and were considered to be part of their own code of honor. This put the entire military in a position of servitude, making them the personal instrument of Hitler.

Humans have natural rights in the state of nature but they do not have civil rights. Civil rights are derived from membership in a society. The Republicans who controlled both houses of Congress after the Civil War knew this. They also knew that, before conferring civil rights, they had to once and for all abolish slavery. The Thirteenth Amendment ending slavery was passed by the Senate on April 8, 1864, and by the House on January 31, 1865. Republican support for the amendment: 100 percent. Democratic support: 23 percent. Even after the Civil War, only a tiny percentage of Democrats were willing to sign up to permanently end slavery. Most Democrats wanted it to continue. In the following year, on June 13, 1866, the Republican Congress passed the Fourteenth Amendment overturning the Dred Scott decision and granting full citizenship and equal rights under the law to blacks. This amendment prohibited states from abridging the “privileges and immunities” of all citizens, from depriving them of “due process of law” or denying them “equal protection of the law.” The Fourteenth Amendment passed the House and Senate with exclusive Republican support. Not a single Democrat either in the House or the Senate voted for it. Two years later, in 1868, Congress with the support of newly-elected Republican president Ulysses Grant passed the Fifteenth Amendment granting suffrage to blacks. The right to vote, it said, cannot be “denied or abridged by the United States or any state on account of race, color or previous condition of servitude.” In the Senate, the Fifteenth Amendment passed by a vote of 39 to 13. Every one of the 39 “yes” votes came from Republicans. (Some Republicans like Charles Sumner abstained because they wanted the measure to go even further than it did.) All the 13 “no” votes came from Democrats. In the House, every “yes” vote came from a Republican and every Democrat voted “no.” It is surely a matter of the greatest significance that the constitutional provisions that made possible the Civil Rights Act, the Voting Rights Act, and the Fair Housing Bill only entered the Constitution thanks to the Republican Party. Beyond this, the GOP put forward a series of Civil Rights laws to further reinforce black people’s rights to freedom, equality, and social justice. When Republicans passed the Civil Rights Act of 1866—guaranteeing to blacks the rights to make contracts and to have the criminal laws apply equally to whites and blacks—the Democrats struck back. They didn’t have the votes in Congress, but they had a powerful ally in President Andrew Johnson. Johnson vetoed the legislation. Now this may seem like an odd act for Lincoln’s vice president, but it actually wasn’t. Many people don’t realize that Johnson wasn’t a Republican; he was a Democrat. Historian Kenneth Stampp calls him “the last Jacksonian.”8 Lincoln put him on the ticket because he was a pro-union Democrat and Lincoln was looking for ways to win the votes of Democrats opposed to secession. Johnson, however, was both a southern partisan and a Democratic partisan. Once the Civil War ended, he attempted to lead weak-kneed Republicans into a new Democratic coalition based on racism and white privilege. Johnson championed the Democratic mantra of white supremacy, declaring, “This is a country for white men and, by God, as long as I am president, it shall be a government of white men.” In his 1867 annual message to Congress, Johnson declared that blacks possess “less capacity for government than any other race of people. No independent government of any form has ever been successful in their hands. On the contrary, wherever they have been left to their own devices they have shown a consistent tendency to relapse into barbarism.”9 These are perhaps the most racist words uttered by an American president, and no surprise, they were uttered by a Democrat.

It is often used in more than one provision in a contract, and as a result may be separately defined: "Material adverse effect" means any material adverse effect on the Borrower’s business, assets, liabilities, prospects or condition (financial or otherwise). In order to fall within the ambit of this definition, the matter in question must be both material and adverse to the party. Materiality is a subjective concept; a change that would be reasonably likely to affect the other party’s evaluation of the transaction will generally be viewed as material. The change must also be adverse. Obviously, if it’s a change for the better, it isn’t covered. The definition refers to the areas where the material adverse effect has occurred: the party’s business, assets, liabilities, financial condition and prospects. Let’s look at examples of each of these. The loss of a customer that represented 40% of the borrower’s earnings would have a material adverse effect on its business. An uninsured casualty loss in respect of the borrower’s primary manufacturing plant would have a material adverse effect on its assets. The entering of a judgment against the borrower for damages in an amount equal to its total annual sales would have a material adverse effect on its liabilities. A loss of sales resulting in a diminution in cash flow that impairs the borrower’s ability to pay its operating expenses would have a material adverse effect on its financial condition. Lastly, the development of proprietary technology by a competitor that allows it to produce goods at a more favorable price may have a material adverse effect on the borrower’s prospects, because it may be forced to reduce its profit margins. Inclusion of the word "prospects" as a component of the definition of material adverse effect is almost always a point of contention. The party to whom the material adverse effect standard is applicable will argue that the use of prospects gives the other party too much room to speculate about the future impact of an event. The other party will argue that its counterparty’s future condition and performance is important to it, and the party should not be required to wait until a reasonably foreseeable bad result has occurred before having any remedies. Closely related to material adverse effect is material adverse change, referred to colloquially as "MAC.

In general, the Fascist and Nazi regimes had no serious difficulty establishing control over public services. They largely protected civil servants’ turf from party intrusion and left their professional identity intact. Civil servants were frequently in broad sympathy with fascist regimes’ biases for authority and order against parliament and the Left, and they appreciated enhanced freedom from legal restraint. Eliminating Jews sometimes opened up career advancement.
The police were the key agency, of course. The German police were very quickly removed from the normative state and brought under Nazi Party control via the SS. Himmler, supported by Hitler against rivals and the Ministry of the Interior, which traditionally controlled the police, ascended in April 1933 from political police commander of Bavaria (where he set up the first concentration camp at Dachau) to chief of the whole German police system in June 1936.
This process was facilitated by the disgruntlement many German police had felt for the Weimar Republic and its “coddling of criminals,” and by the regime’s efforts to enhance police prestige in the eyes of the public. By 1937, the annual congratulatory “Police Day” had expanded from one day to seven. Initially the SA were deputized as auxiliary Exercising Power police in Prussia, but this practice was ended on August 2, 1933, and the police faced no further threat of dilution from party militants. They enjoyed a privileged role above the law as the final arbiters of their own form of unlimited “police justice.”
While the German police were run more directly by Nazi Party chiefs than any other traditional state agency, the Italian police remained headed by a civil servant, and their behavior was little more unprofessional or partisan than under previous governments. This is one of the most profound differences between the Nazi and Fascist regimes. The head of the Italian police for most of the Fascist period was the professional civil servant Arturo Bocchini. There was a political police, the OVRA, but the regime executed relatively few political enemies.
Another crucial instrument of rule was the judiciary. Although very few judges were Nazi Party members in 1933, the German magistracy was already overwhelmingly conservative. It had established a solid track record of harsher penalties against communists than against Nazis during the 1920s. In exchange for a relatively limited invasion of their professional sphere by the party’s Special Courts and People’s Court, the judges willingly submerged their associations in a Nazi organization and happily accepted the powerful role the new regime gave them.71 The Italian judiciary was little changed, since political interference had already been the norm under the liberal monarchy. Italian judges felt general sympathy for the Fascist regime’s commitment to public order and national grandeur.

They were new Americans and proud of their adopted country, so they alone didn’t salute the repressive flag that was paraded by and they certainly didn’t feel that they had to show any loyalty to it. It did not take long before my family was aggressively surrounded by “Nazi Brown Shirts” and confronted for this unpardonable violation. Pretending not to understand German or the importance of the circumstances, they were allowed to depart from the scene, being thought of as uneducated schweinehunde, another derogatory slang word meaning pig-dogs. It seems that this conflict could have been avoided, had they just stood up and paid due deference to the flag. Considering the times, it was lucky that they got away with their little scam. To the Nazis it was not just a game, the swastika represented their new order, in defiance of the Treaty of Versailles. I don’t know if my family realized how lucky they were, that this incident didn’t escalate.
It is interesting to note that civil servants and members of the German military were expected to take oaths pledged to Hitler himself, and not to the Constitution or the German state. Oaths were taken very seriously by members of the German armed forces. They considered them to be part of a personal code of honor. This put the military in a position of personal servitude, making them the personal instrument of Hitler.
In September of that year, at the annual Nuremberg Nazi Party rallies, Hitler euphemistically proclaimed that the German form of life would continue for the next thousand years.

This innovation rapidly spread, and the province’s party secretary, Wan Li, realized he was facing a powerful popular revolt against an immiserating system. Rather than crush it, he decided to promote this land-to-the-tiller reform. The party secretary of Sichuan province, Zhao Ziyang, made a similar decision. At the national level, the December 1978 party plenum that launched the reform era raised agricultural prices and gave a blessing to rural collectives experimenting with different ways of management, but it still condemned private farming. By 1980, however, Zhao Ziyang had become premier and Wan Li was vice premier in charge of agriculture policy. Together they rammed through a national policy to disband the communes and return to family farming. By the end of 1982 virtually all agricultural collectives were gone, and family farmers had been assigned rights to cultivate individual plots of land. The effect on agricultural output and farm incomes was spectacular. By 1984 grain output was over 400 million tons, a third higher than it had been just six years before; production of oilseeds and cotton sustained annual growth rates of 15 percent; and meat production was growing by 10 percent a year. Rural per capita income more than doubled between 1979 and 1984. Per capita cash savings by rural families rose from essentially zero in 1979 to 300 renminbi (Rmb) by 1989. Rapid gains in agricultural output and incomes continued throughout the 1980s, as farmers continued to diversify their crops and apply new technologies that increased yields. Use of chemical fertilizer, which had risen gradually in the 1970s, tripled between 1978 and 1990. So did the use of farm machinery, notably pumps, small tractors, and food processing equipment.3

A whopping 1 percent said they like him because he’s honest, which proves you can fool 1 percent of the people all the time. All of this is a sign of trouble ahead for Donald Trump, because his economic record is a rickety construction prone to collapse from external forces at any moment. A BUBBLE, READY TO POP The long, sweet climb in economic prosperity we’ve enjoyed for a decade comes down to the decisions of two men and one institution: George W. Bush in taking the vastly unpopular step of bailing out Wall Street in the 2009 economic crisis, and Barack Obama for flooding the economy with economic stimulus in his first term. The Federal Reserve enabled both of these decisions by issuing an ocean of low- or zero-interest credit for ten years. Sure, the bill will come due someday, but the party is still going. While Trump took short-term political advantage of it, every bubble gets pricked by the old invisible hand. In the current economic case, the blizzard of Trumpian bullshit will inevitably hit the fan. We’re awash in trillion-dollar deficits, the national debt is asymptotically approaching infinity, and we have a president who’s never hesitated to borrow and spend well beyond his means, or to simply throw up his hands and declare bankruptcy when it suits him. We never did—and most likely never will—tackle entitlement reform. Nations don’t get to go bankrupt; they collapse. The GOP passed a tax bill that is performing exactly as expected and predicted: A handful of hedge funds, America’s top corporations, and a few dozen billionaires were given a trillion-dollar-plus tax benefit. Even the tax cut’s most fervent proponents know that its effects were short-lived, the bill is coming due, and in 2022 or thereabouts it’s going to lead to annual deficits of close to $2 trillion.

Your Behavioral Responses to Anxiety
The ways in which people react to social situations are often a result of physical and mental responses. Feeling anxious is a clue from your body that you are in danger and need to take action. However, because the danger is exaggerated, your actions often do not fit the situation and do not help you. Two typical behaviors are freezing and avoidance.
When people freeze in a situation, they cannot react. Movement, speech, and memory are all affected. You may have experienced freezing when a teacher called on you in class. When attention like that was placed upon you, you probably felt the physical responses of blushing, shortness of breath, and rapid heart rate, among others. You probably had negative thoughts running through your head, such as “I’m such an idiot. I look stupid.” As a result of the strong physical and mental reactions, you froze and were unable to remember the answer; perhaps you could not speak at all.
Because feelings of anxiety are unpleasant, some people try to avoid stressful situations altogether. If you are nervous around crowds of people, you may avoid going to parties or dances. If you are afraid of speaking in public, you probably avoid classes or situations in which you would be asked to speak or make a presentation.
There are also other, subtler forms of avoidance. If you are nervous in crowds, you may not avoid parties entirely, but you might leave early or latch onto one person the entire time. Or, you may distract yourself by daydreaming or flipping through CDs instead of talking with people.
Because of her social anxiety, Ruby hadn’t participated in any extracurricular activities during high school. At the beginning of her senior year, her guidance counselor told her she would have a better chance of getting into her top-choice college if she would join activities, so she joined the Spanish club.
The group was led by the Spanish teacher and met once a week before school. When Ruby joined, they were beginning to plan the annual fiesta, and there were many decisions to make. At first, the other students tried to include her and would ask her opinion about decorations or games, but Ruby was so anxious that she couldn’t respond. Soon, they stopped asking and left her alone.
Ruby thought she was being a part of the group simply by showing up, but she never volunteered for any of the planning committees and never offered suggestions. When it was time to fill out college applications, Ruby asked the Spanish teacher to write her a recommendation. The teacher said she couldn’t because she didn’t know Ruby well enough.
Patterns of avoidance may be so deeply ingrained in your lifestyle that you are not even aware that you are exhibiting them. Think carefully about your reactions to various situations. When you receive an invitation, do you instantly think of reasons why you can’t accept? When you are with a group of people, do you use escape mechanisms, such as reading a magazine, hiding in the restroom, or daydreaming?
Avoidance may help lessen your anxiety in the moment, but in the long run, it usually makes things worse. Life is very unsatisfying when you avoid so many situations, and such behavior hurts self-esteem and self-confidence.
