As we saw in chapter 9, it is only when groups get large enough that people regularly interact with strangers that cultures invent moralizing gods. These are not gods who sit around the banquet table laughing with detachment at the foibles of humans down below, or gods who punish humans for lousy sacrificial offerings. Today the dominant etiquette around race is colorblindness. It has a strong moral appeal, for it laudably envisions an ideal world in which race is no longer relevant to how we perceive or treat each other. It also has an intuitive practical appeal: to get beyond race, colorblindness urges, the best strategy is to immediately stop recognizing and talking about race. But it is especially as a strategy that colorblindness fails its liberal adherents. We cannot will ourselves to un-see something that we’ve already seen. In turn, refusing to talk about a powerful social reality doesn’t make that reality go away, but it does leave confused thinking unchallenged, in ourselves and in others.

In its abdication of responsibility, motivated by the fear of a lawsuit, it closely mirrors the beginning of the end of a doomed relationship: “It’s not you, it’s … no wait, it’s not me, either. It just is what it is.” Not surprisingly, estimates of recurrence of symptoms range from a half to two-thirds of all cases, making this one of the most common conditions that a neurologist will face, again and again.

If demonstrations are regarded as a form of speech, then anyone and everyone must be permitted. But what I challenge (and not only because of that particular case) is the interpretation of demonstrations and of other actions as so-called symbolic speech. When you lose the distinction between action and speech, you lose, eventually, the freedom of both. The Skokie case is a good illustration of that principle. There is no such thing as “symbolic speech.” You do not have the right to parade through the public streets or to obstruct public thoroughfares. You have the right of assembly, yes, on your own property, and on the property of your adherents or your friends. But nobody has the “right” to clog the streets. The streets are only for passage.
