Lawyers are supposed to act on the evidence, rather than on their prejudgments. The sexist professor ultimately became a judge on the International Court of Justice.

I ran into similar, though less dramatic events after moving to Yale Law School, where I spent two years as a Senior Research Scholar. Hawaii’s two Democratic U.S. Senators once contacted the law school to complain about testimony that I gave before the Hawaii state legislature. They blamed me for somehow single-handedly scuttling the new gun registration laws that were being considered. The associate dean of the law school called me up about the complaints and grilled me about my testimony. I am certain that neither of these incidents would have occurred if I had been on the other side the gun debate. Over the years, many academics have told me that they would have studied gun control if not for fear of damage to their careers. They didn’t want to run the risk of coming out on the wrong side of the debate. From my experience, that is understandable. Eventually, I was forced out of academia. There is only an abundance of funding for those researchers who support gun control. There is a war on guns. Just like with any war there are real casualties. Police are probably the single most important factor in reducing crime, but police themselves understand that they almost always show up at the crime scene after the crime has been committed. When the police can’t be there, guns are by far the most effective way for people to protect themselves from criminals. And the most vulnerable people are the ones who benefit the most from being able to protect themselves: women and the elderly, people who are relatively weaker physically, as well as poor blacks who live in high crime urban areas—the most likely victims of violent crime. When gun control advocates can’t simply ban guns outright, they impose high fees and taxes on guns. When the Northern Mariana Islands, a U.S. territory, had their handgun ban struck down as unconstitutional by a federal judge in March 2016, they passed a $1,000 excise tax on guns—a tax they hoped would serve as a model for the rest of the U.S.8 I hope that this book provides the ammunition people need for some of the major battles ahead. We must fight to keep people safe.

What you believe about climate change doesn’t reflect what you know,” said Dan Kahan, a professor at Yale Law School who studies risk perception. “It expresses who you are."
To illustrate this point, Kahan cited the results of yet another survey by the Pew Research Center. This survey was designed to test basic scientific knowledge and it posed questions like “What is the main function of red blood cells?” When respondents were asked what gas “most scientists believe causes temperatures in the atmosphere to rise,” 58 percent chose the correct answer: “carbon dioxide.” There was little difference in the proportion of Democrats and Republicans who gave the right response; among the former it was 56 percent, among the latter 58 percent. (Among Independents, 63 percent chose correctly.)
But polls that ask Americans about their own beliefs about global warming show a significant partisan divide; in another Pew survey, 66 percent of Democrats said they believed that human activity was the “main cause” of global warming, while only 24 percent of Republicans did. This suggests there are many Democrats who don’t know what’s causing climate change but still believe humans are responsible for it and many Republicans who do know, yet still deny that humans play a role. And what this shows, according to Kahan, is that people’s views on climate change are shaped less by their knowledge of the science than by their sense of group identity. To break the political logjam, he argues, Americans need to find ways of talking about climate change that don’t require members of one group or the other to renounce their cultural identity.
“If you show people there is some way of responding to the problem that’s consistent with who they are, then they’re more likely to see the problem,” Kahan told me.
Kari Marie Norgaard is a sociologist at the University of Oregon who has studied how people talk about climate change. She, too, believes there’s a strong cultural component to Americans’ attitudes, but she sees the problem as reflecting the strategies people use to avoid painful subjects.
Norgaard argues that it’s difficult even for people who are privately worried about climate change to discuss the issue in public because on the one hand they feel guilty about the situation and on the other they feel helpless to change it. “We have a need to think of ourselves as good people,” she told me. Meanwhile, the very lack of discussion about the issue feeds itself: people feel that if it really were a serious problem, others would be dealing with it: “It’s difficult for people to feel that climate change is really happening in part because we’re embedded in a world where no one else around us is talking about it.”
“It becomes a vicious cycle between the political gridlock and the cultural and individual gridlock,” Norgaard went on.
What could possibly break this cycle? Norgaard argues that if the nation’s political leaders would candidly discuss the issue “it could be very powerful. It could free up a lot of the hopelessness people feel and allow them to mobilize.”

Bell’s activism did not come at the cost of his writing. A few years later he published two law review articles of startling originality that won him widespread attention in the law school world. The first was “Serving Two Masters: Integration Ideals and Client Interests in School Desegregation Litigation,” published in Yale Law Journal in 1976. Bell had became convinced that the black community did not need—or, in many cases, want—busing, the school desegregation remedy that civil rights lawyers had been pursuing for at least a dozen years. Instead, they wanted better schools. This kind of talk was heresy within the NAACP, which at that time was staunchly committed to enforcing the mandate of Brown v. Board of Education, their great legal breakthrough. Bell sounded what turned out to be one of his signature themes: the conflict of interest inherent in much public interest litigation. American law requires a flesh-and-blood plaintiff, usually an ordinary person, with “standing”—a specific, concrete grievance with a specific actor or defendant. Much public interest litigation, however, is maintained by specialized litigation centers, like the NAACP Legal Defense Fund or the National Organization of Women. These litigators must represent victims of the policies they want to change. Asians are still a small minority—14.5 million (including about one million identified as part Asian) or 4.7 percent of the population—but their impact is vastly disproportionate to their numbers. Forty-four percent of Asian-American adults have a college degree or higher, as opposed to 24 percent of the general population. Asian men have median earnings 10 percent higher than non Asian men, and that of Asian women is 15 percent higher than non-Asian women. Forty-five percent of Asians are employed in professional or management jobs as opposed to 34 percent for the country as a whole, and the figure is no less than 60 percent for Asian Indians.
The Information Technology Association of America estimates that in the high-tech workforce Asians are represented at three times their proportion of the population. Asians are more likely than the American average to own homes rather than be renters. These successes are especially remarkable because no fewer than 69 percent of Asians are foreign-born, and immigrant groups have traditionally taken several generations to reach their full economic potential. Asians are vastly overrepresented at the best American universities. Although less than 5 percent of the population they account for the following percentages of the students at these universities: Harvard: 17 percent, Yale: 13 percent, Princeton: 12 percent, Columbia: 14 percent, Stanford: 25 percent.
In California, the state with the largest number of Asians, they made up 14 percent of the 2005 high school graduating class but 42 percent of the freshmen on the campuses of the University of California system.
At Berkeley, the most selective of all the campuses, the 2005 freshman class was an astonishing 48 percent Asian.
Asians are also the least likely of any racial or ethnic group to commit crimes. In every category, whether violent crime, white-collar crime, alcohol, or sex offenses, they are arrested at about one-quarter to one-third the rate of whites, who are the next most law-abiding group.
It would be a mistake, however, to paint all Asians with the same brush, as different nationalities can have distinctive profiles. For example, 40 percent of the manicurists in the United States are of Vietnamese origin and half the motel rooms in the country are owned by Asian Indians.
Chinese (24 percent of all Asians) and Indians (16 percent), are extremely successful, as are Japanese and Koreans. Filipinos (18 percent) are somewhat less so, while the Hmong face considerable difficulties. Hmong earn 30 percent less than the national average, and 60 percent drop out of high school.
In the Seattle public schools, 80 percent of Japanese-American students passed Washington state’s standardized math test for 10th-graders—the highest pass rate for any ethnic group. The group with the lowest pass rate—14 percent—was another “Asian/Pacific Islanders” category: Samoans.
On the whole, Asians have a well-deserved reputation for high achievement.

Every few years, a teacher from Monroe Colored High loaded a band of students onto the flat bed of a pickup truck and rattled across the Missouri Pacific Railway tracks. They passed the rich people’s porticos and pulled up to the back entrance of the white high school in town. The boys jumped out and began stacking the truck bed with the books the white school was throwing away. That is how Monroe Colored High School got its books. The boys loaded the truck with old geography and English texts, some without covers and with pages torn out and love notes scrawled in the margins, and headed back to their side of town. By the time he was old enough to understand where the books came from, Pershing was fast putting together the pieces of the world he lived in. He knew there was a dividing line, but it was hitting him in the face now. He was showing a talent for science and was getting to the point that he needed reference books to do his lesson. But it was against the law for colored people to go to the public library. “And the library at the Colored High School did not live up to its name,” he said years later. He was in the eighth grade when word filtered to his side of the tracks that Monroe was getting a new high school. It wouldn’t replace the old building that Monroe Colored High was in. It was for the white students, who already had a big school. It would be called Neville High. The colored people could see it going up when they ventured to the other side of the tracks. It rose up like a castle, four stories of brick and concrete with separate wings and a central tower, looking as if it belonged at Princeton or Yale. It opened in 1931 on twenty-two acres of land. The city fathers made a fuss over the state-of-the-art laboratories for physics and chemistry, the 2,200-seat balconied auditorium, the expanded library, and the fact it was costing $664,000 to build. As the new high school took shape across town, Pershing watched his father rise in the black of morning to milk the cows and walk the mile and a half to open his building the size of a grade school. His father, his mother, and the other teachers at Monroe Colored High School were working long hours with hand-me-down supplies for a fraction of the pay their white counterparts were getting. In Louisiana in the 1930s, white teachers and principals were making an average salary of $1,165 a year. Colored teachers and principals were making $499 a year, forty-three percent of what the white ones were.
