The women of the national team proved they were the best in the world, they captured the country’s attention, and now they had leverage. “It was really the first time where we were like, Okay, we are worth something to the federation and we know it, so now we have to keep this going,” Solo says. “That’s what really empowered us. All of a sudden, we got a $10,000 fee, first-class tickets to fly to our NWSL games, and it was right before we were going to negotiate our new contract.” But things didn’t get better just because the federation paid the players a $10,000 fee. In less than a month, the players had to set out on the road again for a 10-game victory tour as World Cup champions and, as it turned out, the venues weren’t exactly befitting of a World Cup–winning national team. Eight of the 10 victory-tour games in 2015 were scheduled on artificial turf. Over the course of that year, U.S. Soccer scheduled the women to play 57 percent of their home games on artificial turf but scheduled zero of the men’s games on artificial turf. In fact, the men played at five venues that had artificial-turf surfaces, and in all five cases, the federation paid to have temporary grass installed.

The last time the federation had scheduled a men’s home friendly match on artificial turf had been in 1994. In that same time span since 1994, the women played dozens of U.S. Soccer–hosted matches on artificial turf. Now, even as World Cup winners, they were stuck on turf again.

The good news for the national team, at least, was that now the distraction of Solo’s legal issues was in the past and the team could focus on the Women’s World Cup, which was now only a few months away. But that didn’t quite happen. On January 19, 2015, Solo made headlines again. She was at the national team’s annual January camp outside of Los Angeles when she allowed her visiting husband, Jerramy Stevens, to drive a U.S. Soccer–rented car. Stevens had been drinking and was pulled over after police allegedly saw the car swerving off the road. Stevens was arrested on DUI charges, and Solo, who was the passenger, was reported to have been “belligerent” toward the arresting officers. The federation didn’t know about the incident until celebrity tabloid TMZ reported the news. After the federation had been slammed by the media for not punishing Solo throughout the episode surrounding her arrest, there was little choice this time. Solo was suspended from the team for 30 days. Her suspension was scheduled to end about four months before the World Cup was set to start.

The Canadians blamed the referee and floated conspiracy theories. Christine Sinclair, who told reporters that the game “was taken from us” and “the ref decided the result before it started,” was issued for a fine and a four-game suspension for allegedly calling referee Christina Pedersen a profanity after the game. Rich Nichols, another attorney, was there in Rochester, too. He had already been in contact with the players as far back as late 2012 through Hope Solo, who was frustrated with the team’s hesitance to take a stronger stance against U.S. Soccer. Solo didn’t know Nichols when she called him for the first time. She believed the national team needed a stronger voice in negotiations, and after asking around, she eventually got Nichols’s name. His highest-profile experience in sports came from representing Olympic track star Marion Jones in doping allegations and serving as general counsel for the American Basketball League, a women’s league that preceded the WNBA. Nichols’s expertise isn’t quite as a trial lawyer, but he speaks with the cadence and tempo of one, knowing which words to emphasize and where to pause for effect. As the players of the national team were debating how to move forward in contract negotiations, Solo called Nichols on her own to see if he could help. Their first conversation centered largely around the idea that the women should demand the same pay as the men’s national team. Nichols and Solo felt a philosophical connection right away. Both outspoken and unafraid to ruffle feathers, they had the same ideas about the tack the national team needed to take.

Rich Nichols became the attorney for the players and the new head of their players association. With that, the tone of the relationship between the national team and the federation was about to take a sharp turn. * * * Nichols’s first major action in his new role was to tell U.S. Soccer that, as far as the players association was concerned, there was no collective bargaining agreement in place and the players could strike if they wanted. U.S. Soccer got the letter on Christmas Eve of 2015. His argument went back to Langel’s memorandum of understanding. An MOU isn’t a CBA, his argument went, and therefore it could be canceled at any time. If that was true and the MOU was canceled, the no-strike provision of the previous CBA would not be in effect, and the players could threaten to boycott the 2016 Olympics. That’s not all the report showed, though. The women’s team was projected in 2017 to earn more than $5 million in revenue for the federation. The men’s team, meanwhile, was projected to lose about $1 million. That was even as U.S. Soccer planned to spend about $1.5 million more on the men’s team. “I couldn’t believe my eyes,” Nichols says. “I said: This is what we need. This is what we thought was the real story, and here it is. They basically provided us the financial data we needed to prove our premise that the women are the economic engine of U.S. Soccer. We knew that but we didn’t have the numbers to prove it. And the men are a losing proposition despite the fact that U.S. Soccer tries to sell the story that the men drive the revenue. When the next negotiation session came around on March 15, Nichols confidently pulled out a printed copy of the report and confronted U.S. Soccer’s representatives with it. U.S. Soccer responded that the jump in profitability for the women’s team was an aberration—not part of the larger pattern in the federation’s finances. “An aberration?” Nichols responded. “Aberrations don’t occur multiple years in a row. Aberrations aren’t projected. You guys have projected profitability. You projected the women to bring in more than the men.” What U.S. Soccer’s executives told him, and have maintained in the federation’s defense ever since, is that over the previous four-year cycle—which includes World Cups for both teams—the men brought in more revenue than the women. Both sides agree that is true. The gap in revenue between the national teams had historically been large—but the long-term trend showed the gap was shrinking. The national team players were in camp in Orlando, Florida, preparing for a pair of friendlies against Colombia when Rich Nichols and Jeffrey Kessler scheduled a conference call with the players on the team’s CBA committee. It was then that Hope Solo, Carli Lloyd, Alex Morgan, Becky Sauerbrunn, and Megan Rapinoe were presented with the idea of filing a wage-discrimination complaint with the Equal Employment Opportunity Commission, or EEOC, against U.S. Soccer. These sorts of battles were built into the DNA of the team. Their drive to win and their drive to stand up for themselves seemed to go hand in hand. The players had double training days, and in between sessions, a player had to run out and get food because U.S. Soccer didn’t provide catering like they did at the men’s training sessions. That went on the list, too. Other small things added up. Players weren’t allowed to keep their jerseys after they played—they had to give them back to the federation, which was unusual in the world of soccer. What are the plans?” remembers Julie Foudy. “They said we were going to Africa. We were like, Africa? We need to grow the game here. Why are we going to Africa? We had never even been to Africa.

Rather than schedule the usual slate of games, the federation would instead focus on scouting new players. “If there are no games, where will the women play?” Langel asked. “The W-League,” replied Flynn. “Are you kidding me?” Langel said. The W-League wasn’t a professional league. It was a development league that included amateur, unpaid players. The players demanded to know how U.S. Soccer could justify skipping the tournaments. Flynn replied that it was “the technical director’s recommendation” to play a lighter schedule. The technical director? April Heinrichs. The players wanted to figure out if Heinrichs really believed the team should play so few games in 2005, so Julie Foudy reached out to her. “Is that true? Did you tell U.S. Soccer we should only play five games?” Foudy asked. “I never said anything like that,” Heinrichs told her. “I told them you should play 20 games.” If Heinrichs hadn’t recommended such a sparse schedule and, in fact, recommended around 20 games, it seemed that U.S. Soccer was making a decision that went against what was best for the players. The players saw a clear double standard—the men’s team hadn’t played so few games since 1987, almost two decades earlier. They concluded U.S. Soccer’s real reason was the same one behind most disputes between the players and the federation: money. The federation, it appeared, did not want to spend the money for training camps, player stipends, and travel for overseas competitions, even as it was sitting on a $30 million surplus at the time. “In 2005, they had no plans for us and wanted us to go quiet so they didn’t have to pay us the entire year,” says defender Kate Markgraf.

The players’ demands included better conditions and noneconomic issues, but the sticking points largely came down to compensation. For the months when the players had games to play, the federation was paying the most veteran players a modest $3,150 per month while newer players earned even less. The players had earned about $5,000 per month during the World Cup—a combined wage between U.S. Soccer and the World Cup organizing committee—and that’s what they wanted in their new contract. Even more of an issue than the amount of compensation was the reliability of it. Payment was contingent on the team’s schedule, which U.S. Soccer set, so if there were no camps or games in a month, the players got nothing. If a player got injured and couldn’t play, she no longer got paid, either.

The USOC told U.S. Soccer officials they had to cooperate with the team, and after some back-and-forth, the federation agreed to send the team to the 2005 Algarve Cup. “They were incredibly reluctant to cooperate until the USOC told them they had to cooperate,” Langel says. Tiffeny Milbrett, who returned to the team after April Heinrichs left, says the ordeal reinforced a second-class status for the women’s national team with the federation. “U.S. Soccer had to be threatened by the Olympic Committee that they weren’t managing their governing status toward the women appropriately,” she says. “It was like, Why do we have to deal with this discrimination and these attitudes? It was the Olympic Committee that changed things, not these men at the federation saying, Yes, the women deserve it.

Back at the hotel, the turmoil was only getting started. The Americans and the Brazilians, who were staying at the same hotel, ran into each other in the lobby. The Americans cried as the Brazilians danced. “That was one of the most excruciating postgame hotel moments I can remember,” Heather O’Reilly says. “We were with family and friends, sobbing, and they’re trying to console us, and the Brazilians show up and are just relentless in their celebrations. I’ll confidently use the word obnoxious, because it was. It was pretty over-the-top and absurd. I remember them in the turnstile of the door, just going around and around.” *

The first-tier players who competed in the highest-profile competitions would earn $70,000, mid-tier would earn $50,000, and bottom tier $30,000. It was hardly a windfall for the players, but it allowed them to make a stable living playing soccer, and that’s all they had ever wanted. “The 2005 contract was really the contract that secured them without regard to residency,” Langel says. “That’s when they earned a true salary and injury protection.

On April 8, 2005, the federation announced that Greg Ryan would become the new head coach and dropped the interim tag. Players suspected it was a power play by U.S. Soccer. When the hire was announced, one player anonymously told the San Diego Union-Tribune’s Mark Zeigler: “The federation wants to show us who’s running the show.” Hope Solo later said: “It seemed to me that Greg was a pawn in a power struggle.” Robert Contiguglia admits he hired Ryan on April Heinrichs’s recommendation. Then, Langel launched into a laundry list of allegations of how U.S. Soccer discriminated against the women: • USSF’s statements in the 1990s to the effect that they would not have a women’s national team if they were not required to do so; • USSF has attempted to persuade the Men’s National Team Players’ Association to structure its contracts in a way that would not result in any payments to the women under the same matrix; • USSF’s unwillingness to pay the women anywhere near equal compensation for successes comparable to the men’s (indeed, USSF is committed to paying the women less than the men even though the women have been far more successful on the playing field);

It was a scathing rebuke of not just U.S. Soccer’s decision to cut the national team’s schedule in 2005, but the federation’s treatment of the team over the years up to that point. “These recent events are shocking,” Langel wrote, after summarizing the back-and-forth over the 2005 schedule. “It is unethical and violates the USSF’s obligations of transparency to misrepresent to United States Olympic athletes about the reason they will be denied the right to compete in protected competitions.” “Unfortunately, over the years, there have been a number of other telling illustrations of discrimination,” the letter continued.

Ultimately, the strike never happened. Some players felt, after speaking with the team’s attorney, John Langel, that striking before the Algarve Cup didn’t offer enough leverage. They were better off going to Portugal and continuing negotiations there with striking as an option after the tournament, before the start of the NWSL. They believed the launch of the new league offered the urgency that could make a strike effective. For Solo, who pushed for the strike, it was frustrating to see her teammates back off so quickly. Even though the Algarve Cup was a relatively minor tournament, it was the biggest national team event on the calendar until the 2015 World Cup, two and a half years away. Dear …, I’m writing as a Canadian woman and a member of one of the so-called “visible” or “ethnic” minorities to protest the exclusionary—racist and sexist—practices of Canadian publishers. Why racist? Because they discriminate against white writers. Why sexist? Because they discriminate against male writers. I feel quite perturbed about Penguin Canada’s submission policy which solicits exclusively unagented LGBTQIA2S+ and BIPOC writers (as well as those from "traditionally underrepresented” communities). This is publishing madness that has gone too far in the name of diversity. If publishing exclusively white male writers (and that has never been the case) is a clearcut wrong, two wrongs do not make a right. Oddly enough, only Penguin Canada has this bizarre exclusionary policy. Penguin Australia and Penguin New Zealand, in contrast, welcome submissions from writers of all backgrounds. Penguin UK Merky Books New Writers’ Prize aims to discover new UK voices and writers regardless of race, creed, or colour. Could this be the reason why Canada lags so far behind UK and arguably even Australia/NZ in reputation in the literary and publishing worlds? You may say, oh, look at the history, white male writers have traditionally dominated the publishing field. But why should white male writers TODAY be discriminated against in order to address the inequities of the past? That's the crux of the problem created by Penguin Canada’s woke madness. So, let’s look at the books published recently. Are white males still dominating the field? The truth of the matter is, they don’t, with a whopping 73% of editors being female (Editor Demographics in the United States, 2023). The quality of books isn’t decided by a writer’s colour or gender. It’s decided by the story and writers’ skills in presenting that story. As an avid lifelong reader of books in 3 languages (one of them English), I love books. At times I can’t even remember a writer’s name, far less their skin colour or sexual orientation, but I DO remember the story. Yet today’s exclusionary publishing policies at Penguin Canada imply that only people of colour have the chops to write about people of colour (ditto for any social subgroup you choose). This not only suffocates the world of fiction writing but, as a logical corollary, limits writing about 59-year-old, ethnically Chinese, twice-divorced soccer moms with 2 mortgages SOLELY to 59-year-old, ethnically Chinese, twice-divorced soccer moms with 2 mortgages. For the record, I—and thousands of others, judging by mountains of internet posts—am interested in how men write about women, how white writers write about other races, how old men write about youth—and of course vice versa. I’m interested in how writers see the world regardless of their sexual orientation. Paying the piper to play only a single +ALPHABETSOUP tune, we get to hear only that single tune, reducing the depth of human experience to only what passes through that one artificially imposed filter. One last example: Simon & Schuster (US) has books like us first novel contest to discover new local writers regardless of who they are. Only in Canada’s Orwellian publishing world some writers are more equal than others. Shame on my country. Let the books speak for themselves!!
