And we’re often not honest about what’s happening. If we’re on the inside and see someone on the outside, we often say to ourselves, “I’m not in that situation because I’m different. But that’s just pride talking. We could easily be that person. We have all things inside us. We just don’t like to confess what we have in common with outsiders because it’s too humbling. It suggests that maybe success and failure aren’t entirely fair. And if you know you got the better deal, then you have to be humble, and it hurts to give up your sense of superiority and say, “I’m no better than others.” So instead we invent excuses for our need to exclude. We say it’s about merit or tradition when it’s really just protecting our privilege and our pride.

Our racially biased system of mass incarceration exploits the fact that all people break the law and make mistakes at various points in their lives with varying degrees of justification. In a classic study of how names impact people’s experience on the job market, researchers show that, all other things being equal, job seekers with White-sounding first names received 50 percent more callbacks from employers than job seekers with Black-sounding names.5 They calculated that the racial gap was equivalent to eight years of relevant work experience, which White applicants did not actually have; and the gap persisted across occupations, industry, employer size – even when employers included the “equal opportunity” clause in their ads.6 With emerging technologies we might assume that racial bias will be more scientifically rooted out. Yet, rather than challenging or overcoming the cycles of inequity, technical fixes too often reinforce and even deepen the status quo. For example, a study by a team of computer scientists at Princeton examined whether a popular algorithm, trained on human writing online, would exhibit the same biased tendencies that psychologists have documented among humans. They found that the algorithm associated White-sounding names with “pleasant” words and Black-sounding names with “unpleasant” ones.7 Such findings demonstrate what I call “the New Jim Code”: the employment of new technologies that reflect and reproduce existing inequities but that are promoted and perceived as more objective or progressive than the discriminatory systems of a previous era.

The unfortunate reality we must face is that racism manifests itself not only in individual attitudes and stereotypes, but also in the basic structure of society. Academics have developed complicated theories and obscure jargon in an effort to describe what is now referred to as structural racism, yet the concept is fairly straightforward. In March 2002, the National Academy of Sciences, a private, nonprofit society of scholars, released a high-profile report documenting the unequivocal existence of racial bias in medical care, which many thought would mark a real turning point. Unequal Treatment: Confronting Racial and Ethnic Disparities in Health Care was so brutal and damning that it would seem impossible to turn away. The report, authored by a committee of mostly white medical educators, nurses, behavioral scientists, economists, health lawyers, sociologists, and policy experts, took an exhaustive plunge into more than 480 previous studies. These inequities, the report concluded, contribute to higher death rates overall for Black people and other people of color and lower survival rates compared with whites suffering from comparable illnesses of similar severity.

It is a bitter fruit of the nation’s legacy of four centuries of slavery in North America, of the Jim Crow rollback of Reconstruction that often was reinforced by lynching practices. Some of today’s prisons are, in fact, built on sites of former slave plantations.[95] More importantly, prisons today are institutions that preserve a white society marked by white dominance and the confinement of nonwhite bodies, especially black bodies, exposing those bodies to commodification, immobilization, and disintegration.

When Christians write and speak about racial issues, they sound much like their secular counterparts. Instead of initiating our own solutions to the problem of racism, we merely copy the solutions offered by the rest of the world. We use the Bible to support our own biases and presuppositions rather than looking to the Bible to transcend our moral limitations. Christians argue with other Christians about racial issues as much as non-Christians argue with each other because the solutions we propose are based not on intrinsic Christian values but on more worldly presuppositions. Because of the way we mimic the rest of society, Christianity does not appear to offer any unique solution to racism. It appears that the best Christians can do is to pick and choose from the ideas of the larger society. Christians can get on board with the best of these solutions, but we will never be leaders in the search for solutions.

The most comprehensive studies of racial bias in the exercise of prosecutorial and judicial discretion involve the treatment of juveniles. These studies have shown that youth of color are more likely to be arrested, detained, formally charged, transferred to adult court, and confined to secure residential facilities than their white counterparts.65 A report in 2000 observed that among youth who have never been sent to a juvenile prison before, African Americans were more than six times as likely as whites to be sentenced to prison for identical crimes.66 A study sponsored by the U.S. Justice Department and several of the nation’s leading foundations, published in 2007, found that the impact of the biased treatment is magnified with each additional step into the criminal justice system. African American youth account for 16 percent of all youth, 28 percent of all juvenile arrests, 35 percent of the youth waived to adult criminal court, and 58 percent of youth admitted to state adult prison.67 A major reason for these disparities is unconscious and conscious racial biases infecting decision making. In the state of Washington, for example, a review of juvenile sentencing reports found that prosecutors routinely described black and white offenders differently.68 Blacks committed crimes because of internal personality flaws such as disrespect. Whites did so because of external conditions such as family conflict. The risk that prosecutorial discretion will be racially biased is especially acute in the drug enforcement context, where virtually identical behavior is susceptible to a wide variety of interpretations and responses and the media imagery and political discourse has been so thoroughly racialized. Whether a kid is perceived as a dangerous drug-dealing thug or instead is viewed as a good kid who was merely experimenting with drugs and selling to a few of his friends has to do with the ways in which information about illegal drug activity is processed and interpreted, in a social climate in which drug dealing is racially defined. As a former U.S. Attorney explained: I had an [assistant U.S. attorney who] wanted to drop the gun charge against the defendant [in a case in which] there were no extenuating circumstances. I asked, “Why do you want to drop the gun offense?” And he said, “‘He’s a rural guy and grew up on a farm. The gun he had with him was a rifle. He’s a good ol’ boy, and all good ol’ boys have rifles, and it’s not like he was a gun-toting drug dealer.” But he was a gun-toting drug dealer, exactly.

Latin percentages in those prestigious occupations ranged from 5.3 to 7.6 percent, but Latins are almost 18 percent of the population, so their underrepresentation was nearly the same. The picture flips when race differences in cognitive ability and job performance are taken into account. Africans and Latins get through the educational pipeline with preferential treatment in admissions to colleges and to professional programs. Their mean IQs in occupations across the range from unskilled to those requiring advanced degrees are substantially lower than the mean IQs for Europeans in the same occupations. Race differences in measures of on-the-job performance are commensurate with the differences in cognitive ability. I think it is fair to conclude that the American job market is indeed racially biased. A detached observer might even call it systemic racism. The American job market systemically discriminates in favor of racial minorities other than Asians.

MRI testing again shows what may be the underlying brain mechanism. The amygdalae are two small lobes in the brain associated with fear, arousal, and emotions. When they are active, it is thought to be a sign of vigilance, meaning that the brain is wary and wants more information. A study at Massachusetts General Hospital found that when subjects looked at photographs of faces—half were white, half were black—MRI scans found high amygdala activity. This was considered to be a normal reaction to unfamiliar faces. When the subjects looked at the photographs a second time the faces were more familiar; only the other-race faces continued to provoke high amygdala activity. This was true for both blacks and whites, suggesting that encounters with people of different races keep the brain at a higher level of watchfulness.
Amygdalae notice race even when a person does not. William A. Cunningham of Ohio State University showed white subjects pictures of faces for only 30 milliseconds—not long enough for the subjects to be conscious of them—but black faces triggered greater amygdala activity than white faces. When he showed faces for a half a second—long enough for people to notice race—he found that black faces prompted greater activity in the pre-frontal areas, a part of the brain associated with detecting internal conflicts and controlling conscious behavior. This suggested the subjects were trying to suppress certain feelings about blacks.
Steven Neuberg of Arizona State University attributes instinctive bias to evolution during our hunter-gatherer past. “By nature, people are group-living animals—a strategy that enhances individual survival and leads to what we might call a ‘tribal psychology’, ” he says. “It was adaptive for our ancestors to be attuned to those outside the group who posed threats such as to physical security, health or economic resources.

As noted earlier, studies suggest that most Americans violate drug laws in their lifetime. Indeed, most of us break the law not once but repeatedly throughout our lives. Yet only some of us will be arrested, charged, convicted of a crime, branded a criminal or felon, and ushered into a permanent undercaste. Who becomes a social pariah and excommunicated from civil society and who trots off to college bears scant relationship to the morality of crimes committed. Who is more blameworthy: the young black kid who hustles on the street corner, selling weed to help his momma pay the rent? Or the college kid who deals drugs out of his dorm room so that he’ll have cash to finance his spring break? Who should we fear? The kid in the ’hood who joined a gang and now carries a gun for security, because his neighborhood is frightening and unsafe? Or the suburban high school student who has a drinking problem but keeps getting behind the wheel? Our racially biased system of mass incarceration exploits the fact that all people break the law and make mistakes at various points in their lives and with varying degrees of justification. Screwing up—failing to live by one’s highest ideals and values—is part of what makes us human.

Microaggression” became part of a whole vocabulary of old and new words—like “cultural wars” and “stereotype” and “implicit bias” and “economic anxiety” and “tribalism”—that made it easier to talk about or around the R-word. I do not use “microaggression” anymore. I detest the post-racial platform that supported its sudden popularity. I detest its component parts—“micro” and “aggression.” A persistent daily low hum of racist abuse is not minor. I use the term “abuse” because aggression is not as exacting a term. Abuse accurately describes the action and its effects on people: distress, anger, worry, depression, anxiety, pain, fatigue, and suicide. What other people call racial microaggressions I call racist abuse. And I call the zero-tolerance policies preventing and punishing these abusers what they are: antiracist. On May 28, 1987, Judge Michael Tynan set September 30 for the trial, warning the Hernandezes to be ready. On September 11, the Hernandezes again requested a delay of a few months, citing the prosecution’s failure to turn over items the defense needed to plot strategy and plan defense. Tynan refused to give them six months and set trial for February 1, 1988, only to grant another delay before then because the Hernandezes appealed to the district court of appeals to get certain evidence the prosecution was refusing to give the defense—namely, crime-scene photographs. On January 19, Tynan announced that the state court had granted a last-minute request by the Hernandezes for the state to turn over the evidence the defense wanted. On the twenty-fifth, he set March 22 for the trial date because of the uncertainty surrounding the appellate ruling. On March 16, the defense asked for yet another delay to review the new material they’d gotten as a result of the appellate decision, which Tynan granted, making April 29 the date for trial. Again, on the twenty-ninth, the defense asked for a delay, citing the huge amount of work as reason they weren’t ready. Tynan then scheduled June 30 for trial, but on June 21, the defense filed a motion to exclude Tynan, citing him as being racially biased against the defense, a tactic expected to buy more time. On July 8, Orange County Superior Court presiding judge Philip E. Cox ruled that Tynan was not biased. Finally, on July 21, 1988, jury selection began, and the battle began in earnest.

Racial reformers have customarily requested or demanded that Americans, particularly White Americans, sacrifice their own privileges for the betterment of Black people. And yet, this strategy is based on one of the oldest myths in the modern era, a myth continuously produced and reproduced by racists and antiracists alike: that racism materially benefits the majority of White people, that White people would lose and not gain in the reconstruction of an antiracist America. It has been true that racist policies have benefited White people in general at the expense of Black people (and others) in general. That is the story of racism, of unequal opportunity in a nutshell. But it is also true that a society of equal opportunity, without a top 1 percent hoarding the wealth and power, would actually benefit the vast majority of southern Whites poor. It is not coincidental that slavery kept the vast majority of southern Whites poor. It is not coincidental that more White Americans thrived during the antiracist movements from the 1930s to the 1970s than ever before or since. It is not coincidental that the racist movements that followed in the late twentieth century paralleled the stagnation or reduction of middle and low income Whites’ salaries and their skyrocketing costs of living.
Antiracists should stop connecting selfishness to racism, and unselfishness to antiracism. Altruism is wanted, not required. Antiracists do not have to be altruistic. Antiracists do not have to be selfless. Antiracists merely have to have intelligent self-interest, and to stop consuming those racist ideas that have engendered so much unintelligent self-interest over the years. It is in the intelligent self-interest of middle and upper income Blacks to challenge the racism affecting the Black poor, knowing they will not be free of the racism that is slowing their socioeconomic rise until poor blacks are free of racism. It is in the intelligent self-interest of Asians, Native Americans, and Latinos to challenge anti-Black racism, knowing they will not be free of racism until Black people are of racism. It is in the intelligent self-interest of White Americans to challenge racism, knowing they will not be free of sexism, class bias, homophobia, and ethnocentrism until Black people are free from racism. The histories of anti-Asian, anti-Native, and anti-Latino racist ideas; the histories of sexist, elitist, homophobic, and ethnocentric ideas all sound eerily similar to this history of racist ideas, and feature some of the same defenders of bigotry in America. Supporting these prevailing bigotries is only in the intelligent self-interest of a tiny group of super rich, Protestant, heterosexual, non-immigrant, White, Anglo-Saxon males. Those are the only people who need to be altruistic in order to be antiracist. The rest of us merely need to do the intelligent thing for ourselves.

Consider a conversation I had with a white friend. She was telling me about a "white) couple she knew who had just moved to New Orleans and bought a house for a mere twenty-five thousand dollars. "Of course," she immediately added, "they also had to buy a gun, and Joan is afraid to leave the house." I immediately knew they had bought a home in a black neighborhood. This was a moment of white racial bonding between this couple who shared the story of racial danger and my friend, and then between my friend and me, as she repeated the story. Through this tale, the four of us fortified familiar images of the horror of black space and drew boundaries between "us" and "them" without ever having to directly name race or openly express our disdain for black space.
Notice that the need for a gun is a key part of this story--it would not have the degree of social capital it holds if the emphasis were on the price of the house alone. Rather, the story’s emotional power rests on why a house would be that cheap--because it is in a black neighborhood where white people literally might not get out alive. Yet while very negative and stereotypical representations of blacks were reinforced in that exchange, not naming race provided plausible deniability. In fact, in preparing to share this incident, I texted my friend and asked her the name of the city her friends had moved to. I also wanted to confirm my assumption that she was talking about a black neighborhood. I share the text exchange here:
"Hey, what city did you say your friends had bought a house in for $25,000?"
"New Orleans. They said they live in a very bad neighborhood and they each have to have a gun to protect themselves. I wouldn’t pay 5 cents for that neighborhood."
"I assume it’s a black neighborhood?"
"Yes. You get what you pay for. I’d rather pay $500,00 and live somewhere where I wasn’t afraid."
"I wasn’t asking because I want to live there. I’m writing about this in my book, the way that white people talk about race without ever coming out and talking about race."
"I wouldn’t want you to live there it’s too far away from me!"
Notice that when I simply ask what city the house is in, she repeats the story about the neighborhood being so bad that her friends need guns. When I ask if the neighborhood is black, she is comfortable confirming that it is. But when I tell her that I am interested in how whites talks about race without talking about race, she switches the narrative. Now her concern is about not wanting me to live so far away. This is a classic example of aversive racism: holding deep racial disdain that surfaces in daily discourse but not being able to admit it because the disdain conflicts with our self-image and professed beliefs.
Readers may be asking themselves, "But if the neighborhood is really dangerous, why is acknowledging this danger a sign of racism?" Research in implicit bias has shown that perceptions of criminal activity are influenced by race. White people will perceive danger simply by the presence of black people; we cannot trust our perceptions when it comes to race and crimes. But regardless of whether the neighborhood is actually more or less dangerous than other neighborhoods, what is salient about this exchange is how it functions racially and what that means for the white people engaged in it. For my friend and me, this conversation did not increase our awareness of the danger of some specific neighborhood. Rather, the exchange reinforced our fundamental beliefs about black people. When this status is accepted by the subject people, as in the case where the caste or slavery systems become fully established, racial competition ceases and racial animosity tends to disappear ... Each race being in its place, no obstacle to racial cooperation exists.49 This paper shows that Park’s thought in 1917 was not free of obfuscation and bias. Compare this scenario to a recent case in Bremerton, a city in western Washington State. An African-American man, waiting for his girlfriend to get off work, was “insulted and challenged” by three drunk young white men who “used racial epithets.” One of the young men ordered his pit bull to attack. The African-American “pulled a handgun from his car” and fired it to defend himself against the dog. “By the time deputies arrived, things had calmed down, the black man was found to have a permit to carry the gun,” and he declined to press charges against his attackers. Fortunately, no one was injured.81 Without a gun, it is not obvious what else the African-American man could have done. The best approach to big data might be one put forward by the Obama campaign’s chief technology officer, Michael Slaby, who said, “There’s going to be a constant mix between your qualitative experience and your quantitative experience. And at times, they’re going to be at odds with each other, and at times they’re going to be in line. And I think it’s all about the blend. It’s kind of like you have a mixing board, and you have to turn one up sometimes, and turn down the other. And you never want to be just one or the other, because if it’s just one, then you lose some of the soul.” Slaby has made an impressive career out of developing big data tools, but even he recognizes that these tools work best when governed by human judgment. The choices we make about how we manage data will be as important as the decisions about managing land during the agricultural age and managing industry during the industrial age. We have a short window of time—just a few years, I think—before a set of norms set in that will be nearly impossible to reverse. Let’s hope humans accept the responsibility for making these decisions and don’t leave it to the machines.

If you are accused of racial bias, do not take it personally. Rather than reacting in a defensive manner, acknowledge the possibility that your judgment may be biased and ask for more information from the parent’s perspective. It is hard to grow up in a race-conscious society without being influenced by stereotypes. “There’s not a prejudiced bone in my body!” is a familiar refrain; such categorical denials only reinforce suspicion on the part of black parents who view them as naive at best. How much more effective it would be to ask sincerely, “Help me understand what I did that made you think so.” An invitation to enter into dialogue rather than a rush to defend oneself goes a long way in cultivating trust even in the midst of a difficult interaction.

Police can stop, interrogate, and search anyone they choose for drug investigations, provided they get “consent.” Because there is no meaningful check on the exercise of police discretion, racial biases are granted free rein. In fact, police are allowed to rely on race as a factor in selecting whom to stop and search (even though people of color are no more likely to be guilty of drug crimes than whites)—effectively guaranteeing that those who are swept into the system are primarily black and brown. The conviction marks the beginning of the second phase: the period of formal control. Once arrested, defendants are generally denied meaningful legal representation and pressured to plead guilty whether they are or not. Prosecutors are free to “load up” defendants with extra charges, and their decisions cannot be challenged for racial bias. Once convicted, due to the drug war’s harsh sentencing laws, people convicted of drug offenses in the United States spend more time under the criminal justice system’s formal control—in jail or prison, on probation or parole—than people anywhere else in the world. While under formal control, virtually every aspect of one’s life is regulated and monitored by the system, and any form of resistance or disobedience is subject to swift sanction. This period of control may last a lifetime, even for those convicted of extremely minor, nonviolent offenses, but the vast majority of those swept into the system are eventually released. They are transferred from their prison cells to a much larger, invisible cage. The final stage has been dubbed by some advocates as the “period of invisible punishment.”13 This term, first coined by Jeremy Travis, is meant to describe the unique set of criminal sanctions that are imposed on individuals after they step outside the prison gates, a form of punishment that operates largely outside of public view and takes effect outside the traditional sentencing framework. These sanctions are imposed by operation of law rather than decisions of a sentencing judge, yet they often have a greater impact on one’s life course than the months or years one actually spends behind bars. These laws operate collectively to ensure that the vast majority of people convicted of crimes will never integrate into mainstream, white society. They will be discriminated against, legally, for the rest of their lives—denied employment, housing, education, and public benefits. Unable to surmount these obstacles, most will eventually return to prison and then be released again, caught in a closed circuit of perpetual marginality.

His credible recreation of scenes reveals insight into the civilization that had considerable influence on him. Family dynamics also play a significant role in Ayoade’s life. His recollection of his father’s contradictory behaviors both confuse and enlighten him. His fond memories of his grandmother—the family member he trusted the most—are heartfelt and touching.
While coming to the United States offers many positive experiences for Ayoade, it doesn’t come without problems, and one that the author talks about with deep emotion and candidness is racism. For as long as statistics have been kept, blacks have had higher crime rates than whites. Containing crime is one of the top priorities of any society, so it is perplexing that the United States has added to its crime problem through immigration. Hispanics, who have been by far the most numerous post-1965 immigrant group, commit crimes at rates lower than blacks but higher than whites.
Some people claim that all population groups commit crimes at the same rates, and that racial differences in incarceration rates reflect police and justice system bias. This view is wrong. The US Department of Justice carefully tracks murder, which is the violent crime for which racial data on victim and perpetrator are most complete. In 2005, the department noted that blacks were six times more likely than whites to be victims of murder and seven times more likely to commit murder.
There are similar differences for other crimes. The United States regularly conducts a huge, 100,000-person crime study known as the National Crime Victimization Survey (NCVS), in which Americans are asked to describe the crimes of which they have been victim during the year, and to indicate race of perpetrator. NCVS figures are therefore a reliable indication of the racial distribution of violent criminals. The National Incident-Based Reporting System (NIBRS) is another huge database that records the races of all suspects reported to the police as well as those arrested by police. Both these data sets prove that blacks commit a vastly disproportionate amount of violent crime. In fact, blacks are arrested less frequently than would be expected from reports by crime victims of the race of perpetrator. Racial differences in arrest rates reflect racial differences in crime rates, not police bias.
Justice Department figures show that blacks commit crimes and are incarcerated at roughly 7.2 times the white rate, and Hispanics at 2.9 times the white rate. (Asians are the least crime-prone group in America, and are incarcerated at only 22 percent of the white rate.) Robbery or “mugging” shows the greatest disparities, with blacks offending at 15 times and Hispanics at just over four times the white rate.
There are practically no crimes blacks and Hispanics do not commit at higher rates than whites, whether it is larceny, car theft, drug offenses, burglary, rape, or alcohol offenses. Even for white collar crimes—fraud, racketeering, bribery/conflict of interest, embezzlement—blacks are incarcerated at three to five times the white rate, and Hispanics at about twice the white rate.
Racial differences in crime rates are such an embarrassment they can interfere with law enforcement. In 2010 the Greater Cleveland Regional Transit Authority had a problem with scores of young people openly beating fares—which cuts into revenue and demoralizes other riders. It considered a crackdown, but decided against it. The scoff-laws were overwhelmingly black, and the transit authority did not have the stomach to take any action that would fall heavily on minorities.
