Yet the Confederate States of America faced significant challenges in waging a successful war for independence. One of its outstanding fighting generals, Irish-born Patrick Ronayne Cleburne, certainly understood that in a protracted conflict, his country did not have the manpower to sustain its armies in the field against a numerically superior foe. His solution to the problem placed patriotism over any desire to leave the peculiar institution inviolate. If the armed forces of the Confederate States employed blacks as combatants, he felt that not only would the disparity in numbers be addressed but also slavery would become an asset to the South rather than a liability. During the latter half of the nineteenth century, African Americans served in a largely integrated American Navy and made up about 25 percent of its enlisted strength. Some thirty thousand African Americans manned Union vessels during the Civil War, with little discrimination as to duties. After segregation was legalized in 1896, African American enlistments declined and black men were increasingly relegated to the galley or engine room. After World War I, African American enlisted personnel declined further as the Navy recruited Filipino stewards for mess duties. By June 1940, African Americans accounted for only 2.3 percent of the Navy’s 170,000 total manpower. The fleet had mostly converted from coal to oil, and the vast majority of African Americans performed mess duties. Black reenlistments in technical specialties were never barred, however, and a few African American gunner’s mates, torpedo men, and machinist mates continued to serve. Amendments to the Selective Training and Service Act of 1940 guaranteed the right to enlist regardless of race or color, but in practice, “separate but equal” prejudices consigned most blacks to the Steward’s Branch. Over Europe as a whole, alterations in state control of capital and of coercion between AD 900 and the present have followed two parallel arcs. At first, during the age of patrimonialism, European monarchs generally extracted what capital they needed as tribute or rent from lands and populations that lay under their immediate control - often within stringent contractual limits on the amounts they could demand. In the time of brokerage (especially between 1400 and 1700 or so), they relied heavily on formally independent capitalists for loans, for management of revenue-producing enterprises, and for collection of taxes. By the eighteenth century, however, the time of nationalization had come; many sovereigns were incorporating the fiscal apparatus directly into the state structure, and drastically curtailing the involvement of independent contractors. By the nineteenth century, most European states had internalized both armed forces and fiscal mechanisms; they thus reduced the governmental roles of tax farmers, military contractors, and other independent middlemen. Their rulers then continued to bargain with capitalists and other classes for credit, revenues, manpower, and the necessities of war. Bargaining, in its turn, created numerous new claims on the state: pensions, payments to the poor, public education, city planning, and much more. In the process, states changed from magnified war machines into multiple-purpose organizations. Their efforts to control coercion and capital continued, but in the company of a wide variety of regulatory, compensatory, distributive, and protective activities.

Finally, I gave the following nine suggestions which will enable our judicial system to administer timely justice to our citizens. 1) Judges and members of the bar should consider how to limit the number of adjournments being sought. 2) E-judiciary must be implemented in our courts. 3) Cases should be classified and grouped according to their facts and relevant laws. 4) Experts in specialized branches of law such as military law, service matters, taxation and cyber law should be appointed as judges. 5) The quality of legal education in all our universities should be improved on the pattern of law schools. 6) An exemplary penalty should be imposed on those seeking undue adjournments and initiating frivolous litigation. 7) Judges of high courts and district courts may follow the suggested model for the Supreme Court and enhance the number of cases decided by them by voluntarily working extra hours on working days and Saturdays. 8) ‘Multi sessions in courts’ should be instituted, with staggered timings, to enhance capacity utilization with additional manpower and an empowered management structure. 9) A National Litigation Pendency Clearance Mission should be created for a two-year operation for time-bound clearance of pending cases.
