Private settlement of disputes by arbitration was replaced by court settlements, creating more dependence on lawyers, and the legal profession gained in importance. The ancient idea of a fair price for goods gave way in the courts to the idea of caveat emptor (let the buyer beware), thus throwing generations of consumers from that time on to the mercy of businessmen.

New people rarely went there to live. The same families married the same families until relationships were hopelessly entangled and the members of the community looked monotonously alike. Jean Louise, until the Second World War, was related by blood or marriage to nearly everybody in the town, but this was mild compared to what went on in the northern half of Maycomb County: there was a community called Old Sarum populated by two families, separate and apart in the beginning, but unfortunately bearing the same name. The Cunninghams and the Coninghams married each other until the spelling of the names was academic—academic unless a Cunningham wished to jape with a Coningham over land titles and took to the law. The only time Jean Louise ever saw Judge Taylor at a dead standstill in open court was during a dispute of this kind. Jeems Cunningham testified that his mother spelled it Cunningham occasionally on deeds and things but she was really a Coningham, she was an uncertain speller, and she was given to looking far away sometimes when she sat on the front porch. After nine hours of listening to the vagaries of Old Sarum’s inhabitants, Judge Taylor threw the case out of court on grounds of frivolous pleading and declared he hoped to God the litigants were satisfied by each having had his public say. They were. That was all they had wanted in the first place.

I understood slavery as bad and I had a vague sense that it had once been integral to the country and that the dispute over it had somehow contributed to the civil war. But even that partial sense ran contrary to the way the civil war was presented in the popular culture, as a violent misunderstanding, an honorable dual between wayward brothers instead of what it was. A spectacular chapter in a long war that was declared when the first Africans were brought chained to American shores. When it comes to the civil war, all of our popular understanding, our popular history and culture, our great films, the subtext of our arguments, are in defiance of its painful truths. It is not a mistake that Gone with the Wind is one of the most read works of American literature, or that The Birth of a Nation is the most revered touchstone of all American film. Both emerged from a need for palliatives and painkillers, an escape from the truth of those five short years in which seven hundred fifty thousand American soldiers were killed, more than all American soldiers kill in all other American wars combined, in a war declared for the cause of expanding African slavery. That war was inaugurated, not reluctantly, but lustily by men who believe property in humans to be the cornerstone of civilization, to be an edict of god, and so delivered their own children to his maw. And when that war was done the now defeated god lived on honored through the human sacrifice of lynching and racist programs. The history breaks the myth. And so, the history is ignored and fictions are weaved in to our art and politics that dress villainy in martyrdom, and transform banditry into chivalry. And so strong are these fictions that their emblem, the stars and bars, darkens front porches and state capitol buildings across the land to this day.

Kennewick Man is a skeleton discovered in Washington State in 1996, carbon-dated to older than 9,000 years. Anthropologists were intrigued by anatomical suggestions that he might be unrelated to typical Native Americans, and therefore might represent a separate early migration across what is now the Bering Strait, or even from Iceland. They were preparing to do all-important DNA tests when the legal authorities seized the skeleton, intending to hand it over to representatives of local Indian tribes, who proposed to bury it and forbid all further study. Naturally there was widespread opposition from the scientific and archaeological community. Even if Kennewick Man is an American Indian of some kind, it is highly unlikely that his affinities lie with whichever particular tribe happens to live in the same area 9,000 years later. Native Americans have impressive legal muscle, and ‘The Ancient One’ might have been handed over to the tribes, but for a bizarre twist. The Asatru Folk Assembly, a group of worshippers of the Norse gods Thor and Odin, filed an independent legal claim that Kennewick Man was actually a Viking. This Nordic sect, whose views you may follow in the Summer 1997 issue of The Runestone, were actually allowed to hold a religious service over the bones. This upset the Yakama Indian community, whose spokesman feared that the Viking ceremony could be ‘keeping Kennewick Man’s spirit from finding his body’. The dispute between Indians and Norsemen could well be settled by DNA comparison, and the Norsemen are quite keen to be put to this test. Scientific study of the remains would certainly cast fascinating light on the question of when humans first arrived in America. But Indian leaders resent the very idea of studying this question, because they believe their ancestors have been in America since the creation. As Armand Minthorn, religious leader of the Umatilla tribe, put it: ‘From our oral histories, we know that our people have been part of this land since the beginning of time. We do not believe our people migrated here from another continent, as the scientists do.’ Perhaps the best policy for the archaeologists would be to declare themselves a religion, with DNA fingerprints their sacramental totem. Facetious but, such is the climate in the United States at the end of the twentieth century, it is possibly the only recourse that would work.

The same lesson can be learned from one of the most widely read books in history: the Bible. What is the Bible “about”? Different people will of course answer that question differently. But we could all agree the Bible contains perhaps the most influential set of rules in human history: the Ten Commandments. They became the foundation of not only the Judeo-Christian tradition but of many societies at large. So surely most of us can recite the Ten Commandments front to back, back to front, and every way in between, right? All right then, go ahead and name the Ten Commandments. We’ll give you a minute to jog your memory . . . . . . . . . . . . Okay, here they are:        1. I am the Lord your God, who brought you out of the land of Egypt, the house of bondage.        2. You shall have no other gods before Me.        3. You shall not take the name of the Lord your God in vain.        4. Remember the Sabbath day, to make it holy.        5. Honor your father and your mother.        6. You shall not murder.        7. You shall not commit adultery.        8. You shall not steal.        9. You shall not bear false witness against your neighbor.       10. You shall not covet your neighbor’s house, nor your neighbor’s wife . . . nor any thing that is your neighbor’s. How did you do? Probably not so well. But don’t worry—most people don’t. A recent survey found that only 14 percent of U.S. adults could recall all Ten Commandments; only 71 percent could name even one commandment. (The three best-remembered commandments were numbers 6, 8, and 10—murder, stealing, and coveting—while number 2, forbidding false gods, was in last place.) Maybe, you’re thinking, this says less about biblical rules than how bad our memories are. But consider this: in the same survey, 25 percent of the respondents could name the seven principal ingredients of a Big Mac, while 35 percent could name all six kids from The Brady Bunch. If we have such a hard time recalling the most famous set of rules from perhaps the most famous book in history, what do we remember from the Bible? The stories. We remember that Eve fed Adam a forbidden apple and that one of their sons, Cain, murdered the other, Abel. We remember that Moses parted the Red Sea in order to lead the Israelites out of slavery. We remember that Abraham was instructed to sacrifice his own son on a mountain—and we even remember that King Solomon settled a maternity dispute by threatening to slice a baby in half. These are the stories we tell again and again and again, even those of us who aren’t remotely “religious.” Why? Because they stick with us; they move us; they persuade us to consider the constancy and frailties of the human experience in a way that mere rules cannot.

The mixture of a solidly established Romance aristocracy with the Old English grassroots produced a new language, a “French of England,” which came to be known as Anglo-Norman. It was perfectly intelligible to the speakers of other langues d’oïl and also gave French its first anglicisms, words such as bateau (boat) and the four points of the compass, nord, sud, est and ouest. The most famous Romance chanson de geste, the Song of Roland, was written in Anglo-Norman. The first verse shows how “French” this language was: Carles li reis, nostre emperere magnes, set anz tuz pleins ad estéd en Espaigne, Tresqu’en la mer cunquist la tere altaigne… King Charles, our great emperor, stayed in Spain a full seven years: and he conquered the high lands up to the sea… Francophones are probably not aware of how much England contributed to the development of French. England’s court was an important production centre for Romance literature, and most of the early legends of King Arthur were written in Anglo-Norman. Robert Wace, who came from the Channel Island of Jersey, first evoked the mythical Round Table in his Roman de Brut, written in French in 1155. An Englishman, William Caxton, even produced the first “vocabulary” of French and English (a precursor of the dictionary) in 1480. But for four centuries after William seized the English crown, the exchange between Old English and Romance was pretty much the other way around—from Romance to English. Linguists dispute whether a quarter or a half of the basic English vocabulary comes from French. Part of the argument has to do with the fact that some borrowings are referred to as Latinates, a term that tends to obscure the fact that they actually come from French (as we explain later, the English worked hard to push away or hide the influence of French). Words such as charge, council, court, debt, judge, justice, merchant and parliament are straight borrowings from eleventh-century Romance, often with no modification in spelling. In her book Honni soit qui mal y pense, Henriette Walter points out that the historical developments of French and English are so closely related that anglophone students find it easier to read Old French than francophones do. The reason is simple: Words such as acointance, chalenge, plege, estriver, remaindre and esquier disappeared from the French vocabulary but remained in English as acquaintance, challenge, pledge, strive, remain and squire—with their original meanings. The word bacon, which francophones today decry as an English import, is an old Frankish term that took root in English. Words that people think are totally English, such as foreign, pedigree, budget, proud and view, are actually Romance terms pronounced with an English accent: forain, pied-de-grue (crane’s foot—a symbol used in genealogical trees to mark a line of succession), bougette (purse), prud (valiant) and vëue. Like all other Romance vernaculars, Anglo-Norman evolved quickly. English became the expression of a profound brand of nationalism long before French did. As early as the thirteenth century, the English were struggling to define their nation in opposition to the French, a phenomenon that is no doubt the root of the peculiar mixture of attraction and repulsion most anglophones feel towards the French today, whether they admit it or not. When Norman kings tried to add their French territory to England and unify their kingdom under the English Crown, the French of course resisted. The situation led to the first, lesser-known Hundred Years War (1159–1299). This long quarrel forced the Anglo-Norman aristocracy to take sides. Those who chose England got closer to the local grassroots, setting the Anglo-Norman aristocracy on the road to assimilation into English.

Sung was a land which was famous far and wide, simply because it was so often and so richly insulted. However, there was one visitor, more excitable than most, who developed a positive passion for criticizing the place. Unfortunately, the pursuit of this hobby soon lead him to take leave of the truth. This unkind traveler once claimed that the king of Sung, the notable Skan Askander, was a derelict glutton with a monster for a son and a slug for a daughter. This was unkind to the daughter. While she was no great beauty, she was definitely not a slug. After all, slugs do not have arms and legs - and besides, slugs do not grow to that size. There was a grain of truth in the traveler's statement, in as much as the son was a regrettable young man. However, soon afterwards, the son was accidentally drowned when he made the mistake of falling into a swamp with his hands and feet tied together and a knife sticking out of his back. This tragedy did not encourage the traveler to extend his sympathies to the family. Instead, he invented fresh accusations. This wayfarer, an ignorant tourist if ever there was one, claimed that the king had leprosy. This was false. The king merely had a well-developed case of boils. The man with the evil mouth was guilty of a further malignant slander when he stated that King Skan Askander was a cannibal. This was untrue. While it must be admitted that the king once ate one of his wives, he did not do it intentionally; the whole disgraceful episode was the fault of the chef, who was a drunkard, and who was subsequently severely reprimanded. .The question of the governance, and indeed, the very existence of the 'kingdom of Sung' is one that is worth pursuing in detail, before dealing with the traveler's other allegations. It is true that there was a king, his being Skan Askander, and that some of his ancestors had been absolute rulers of considerable power. It is also true that the king's chief swineherd, who doubled as royal cartographer, drew bold, confident maps proclaiming that borders of the realm. Furthermore, the king could pass laws, sign death warrants, issue currency, declare war or amuse himself by inventing new taxes. And what he could do, he did. "We are a king who knows how to be king," said the king. And certainly, anyone wishing to dispute his right to use of the imperial 'we' would have had to contend with the fact that there was enough of him, in girth, bulk, and substance, to provide the makings of four or five ordinary people, flesh, bones and all. He was an imposing figure, "very imposing", one of his brides is alleged to have said, shortly before the accident in which she suffocated. "We live in a palace," said the king. "Not in a tent like Khmar, the chief milkmaid of Tameran, or in a draughty pile of stones like Comedo of Estar." . . .From Prince Comedo came the following tart rejoinder: "Unlike yours, my floors are not made of milk-white marble. However, unlike yours, my floors are not knee-deep in pigsh*t." . . .Receiving that Note, Skan Askander placed it by his commode, where it would be handy for future royal use. Much later, and to his great surprise, he received a communication from the Lord Emperor Khmar, the undisputed master of most of the continent of Tameran. The fact that Sung had come to the attention of Khmar was, to say the least, ominous. Khmar had this to say: "Your words have been reported. In due course, they will be remembered against you." The king of Sung, terrified, endured the sudden onset of an attack of diarrhea that had nothing to do with the figs he had been eating. His latest bride, seeing his acute distress, made the most of her opportunity, and vigorously counselled him to commit suicide. Knowing Khmar's reputation, he was tempted - but finally, to her great disappointment, declined. Nevertheless, he lived in fear; he had no way of knowing that he was simply the victim of one of Khmar's little jokes.

Although help and counsel flowed both ways, recipients were not always ready to accept advice. In 1615 several churches in Royal Prussia wrote to Mennonites in the Netherlands and urged them to resolve divisions and disputes among themselves.30 Apparently the Dutch Mennonites were less than enthusiastic about the spiritual counseling received from Royal Prussia; they now chose representatives to go to the Mennonite congregations in the Vistula Delta to enlighten them about the real situation in Amsterdam. Even if Dutch congregations were not always eager to accept advice and discipline from congregations in Royal Prussia, the event demonstrates strong mutual concern. In both countries, Mennonites attempted to transcend political boundaries. Throughout most of the sixteenth and much of the seventeenth centuries, Mennonites in the Netherlands and in Royal Prussia together tried to assist their co-religionists in other lands. Efforts were made at congregational and government levels, for example, when fellow believers were harshly treated in Switzerland, where authorities still resorted to burning of "heretics" as late as the early seventeenth century. Centuries have passed since the wars of religion ceased in Europe, and since men stopped dying in large numbers because of arcane theological disputes. Hence, perhaps, the incredulity and denial with which Westerners have greeted news of the theology and practices of the Islamic State. Many refuse to believe that this group is as devout as it claims to be, or as backward-looking or apocalyptic as its actions and statements suggest. "Their skepticism is comprehensible. In the past, Westerners who accused Muslims of blindly following ancient scriptures came to deserved grief from academics—notably the late Edward Said—who pointed out that calling Muslims 'ancient' was usually just another way to denigrate them. Look instead, these scholars urged, to the conditions in which these ideologies arose—the bad governance, the shifting social mores, the humiliation of living in lands valued only for their oil. "Without acknowledgment of these factors, no explanation of the rise of the Islamic State could be complete. But focusing on them to the exclusion of ideology reflects another kind of Western bias: that if religious ideology doesn’t matter much in Washington or Berlin, surely it must be equally irrelevant in Raqqa or Mosul. When a masked executioner says Allahu akbar while beheading an apostate, sometimes he’s doing so for religious reasons.

It went on to purport that Constantine – then based in the later Empire’s eastern seat in what would become Constantinople – had decided to site himself there because it would not be right for him to be located in the city where the head of the Christian faith reigned. The supposed donation was not revealed publicly until the mid-700s when it was used in 754 by Pope Stephen to negotiate with Frankish King Pepin about the division of lands between the two rival authorities. It was wheeled out again in 1054 when Leo IX was in dispute with the patriarch of Constantinople over the rights and powers of Roman rule. It became an essential document in later years as popes reacted to challenges against their authority in the growing post-Dark Age Europe in the 10th and 11th centuries. It was, though, entirely fictitious. Thought now to have been concocted by the papal chancery to provide retrospective authority for the increasingly strained church, it was not until the 15th century, nearly 700 years after its appearance, that scholars began openly questioning its veracity. It was finally debunked in 1518. It should have been easy. One of the giveaways to the forgery was Constantine’s apparent bequeathing of his own city to papal spiritual control. Although supposedly written in 315, Constantine did not in fact found Constantinople until 326, 11 years after his apparent donation.

As far as the patriarch can see, he can claim, and we may do the like by faith. Abram had to wait for the actual possession, but the Lord entailed the land upon him and his posterity. Boundless blessings belong to us by covenant gift. All things are ours. When we please the Lord, he makes us to look everywhere, and see all things our own, whether things present, or things to come: all are ours, and we are Christ’s, and Christ is God’s.

There is no foreseeable scenario under which Beijing will back away, either rhetorically or in practice, from its territorial claims in Taiwan and in the South and East China Seas. As Xi Jinping told the then US Defence Secretary Jim Mattis in June 2018, China will not give up 'even an inch' of its territory, which includes its expansive maritime claims and a large land area disputed with India. Within the Chinese system, any leader who stepped back from these claims would be committing political suicide. The internal sensitivity of the territorial issue helps explain the bellicose way Beijing handles these disputes outside of its borders. China constantly schools its Asian neighbours on its red lines in territorial disputes, all the while rapidly building up its military capability and regional diplomatic sway to entrench them. With the possible exception of Vietnam, smaller countries have taken to either submitting or swerving in the face of Beijing's pressure. Yet it is far from game over, if history is any guide. Total capitulation in international relations is rare. Behind the scenes in Beijing, there has always been recognition that it was dangerous for China to bully its way to regional domination. 'The history of contemporary relations does not provide any precedent of a large country successfully bringing to its knees another country,' wrote Wang Jisi, formerly of Peking University, and for many years an informal government adviser. Wang pointed to America's experience in Vietnam and more recently Afghanistan, where its vastly superior military firepower couldn't drag it out of a military and then political quagmire. Wang was writing in 2014. Such strategic humility is rare in Beijing these days, either because the Chinese themselves have become cockier or because the country's diplomats fear being caught out of step with the temper of Xi's times. In times of strife, taliban have usually mobilized in defense of tradition. British documents from as early as 1901 decry taliban opposition to colonialism in present-day Pakistan. However, as with so much else, it was the Soviet invasion and the US response that sent the transformative shock. In the 1980s, as guns and money coursed through the ranks of the Kandahar mujahedeen, squabbling over resources grew so frequent that many increasingly turned to religious law to settle their disputes. Small, informal bands of taliban, who were also battling against the Russians, established religious courts that heard cases from feuding fighters from across the south. Seemingly impervious to the lure of foreign riches, the taliban courts were in many eyes the last refuge of tradition in a world in upheaval. ... Thousands of talibs rallied to the cause, and an informal, centuries-old phenomenon of the Pashtun countryside morphed into a formal political and military movement, the Taliban. As a group of judges and legal-minded students, the Taliban applied themselves to the problem of anarchy with an unforgiving platform of law and order. The mujahedeen had lost their way, abandoned their religious principles, and dragged society into a lawless pit. So unlike most revolutionary movements, Islamic or otherwise, the Taliban did not seek to overthrow an existing state and substitute it with one to their liking. Rather, they sought to build a new state where none existed. This called for “eliminating the arbitrary rule of the gun and replacing it with the rule of law—and for countryside judges who had arisen as an alternative to a broken tribal system, this could only mean religious law. Jurisprudence is thus part of the Taliban’s DNA, but its single-minded pursuit was carried out to the exclusion of all other aspects of basic governance. It was an approach that flirted dangerously with the wrong kind of innovation: in the countryside, the choice was traditionally yours whether to seek justice in religious or in tribal courts, yet now the Taliban mandated religious law as the compulsory law of the land. It is true that, given the nature of the civil war, any law was better than none at all—but as soon as things settled down, fresh problems arose. The Taliban’s jurisprudence was syncretic, mixing elements from disparate schools of Islam along with heavy doses of traditional countryside Pashtun practice that had little to do with religion. As a result, once the Taliban marched beyond the rural Pashtun belt and into cities like Kabul or the ethnic minority regions of northern Afghanistan, they encountered a resentment that rapidly bred opposition.

Castine predates the Plymouth Colony by 7 years and, being one of the oldest settlements in America, has a rich history. Founded during the winter of 1613 as Fort Pentagöet, named after the French Baron of Pentagöet, Castine is located in eastern Maine or “Down East,” as it is now popularly called. During much of the 17th and 18th centuries, the French Parish of Acadia included parts of eastern Quebec and the Maritime Provinces. The pine-forested land of French controlled Maine extended as far south as Fort Pentagöet and the Kennebec River. That same year, 1613, English Captain Samuel Argall raided Mount Desert Island, the largest island to be found in present-day Maine, thus starting a long-running dispute over the boundary between French Acadia and the English colonies lying to the south. In 1654, Major General Robert Sedgwick led 100 New England volunteers and 200 of Oliver Cromwell's soldiers on an expedition against French Acadia. Sedgwick captured and plundered Fort Pentagöet and occupied Acadia for the next 16 years. This relatively short period ended when the Dutch bombarded the French garrison defending Penobscot Bay and the Bagaduce River, thereby dominating Castine in 1674 and again in 1676. It was during this time that they completely destroyed Fort Pentagöet. After the Treaty of Breda brought peace to the region in 1667, French authorities dispatched Baron Jean-Vincent de Saint- Castin to take command of Fort Pentagöet. The community surrounding the fort served as the capital of this French colony from 1670 to 1674, and was named Castine after him.

The ‘atrocities’ that are occurring or are alleged to have occurred in Israel are overshadowed by the myriads of killings of innocents in Syria, Somalia, Rwanda, Sudan, Egypt, Afghanistan and Iraq to name a few. So what makes this particular conflict so outstanding? The most logical explanation is that the Arab-Israeli conflict is not about land, occupation, politics, or a dispute over historical legitimacy and ownership of a tiny corner of real estate -especially one that lays within a sea of sand and has virtually no natural resources. This conflict is rooted in a much more encompassing issue: it is the battle between Islam and Judaism. Judaism and Islam are indeed at odds.

It is astonishing to see how many philosophical disputes collapse into insignificance the moment you subject them to this simple test of tracing a concrete consequence. There can BE no difference any- where that doesn't MAKE a difference elsewhere—no difference in abstract truth that doesn't express itself in a difference in concrete fact and in conduct consequent upon that fact, imposed on somebody, somehow, somewhere and somewhen. The whole function of philosophy ought to be to find out what definite difference it will make to you and me, at definite instants of our life, if this world-formula or that world-formula be the true one. There is absolutely nothing new in the pragmatic method. Socrates was an adept at it. Aristotle used it methodically. Locke, Berkeley and Hume made momentous contributions to truth by its means. Shadworth Hodgson keeps insisting that realities are only what they are 'known-as.' But these forerunners of pragmatism used it in fragments: they were preluders only. Not until in our time has it generalized itself, become conscious of a universal mission, pretended to a conquering destiny. I believe in that destiny, and I hope I may end by inspiring you with my belief. Pragmatism represents a perfectly familiar attitude in philosophy, the empiricist attitude, but it represents it, as it seems to me, both in a more radical and in a less objectionable form than it has ever yet assumed. A pragmatist turns his back resolutely and once for all upon a lot of inveterate habits dear to professional philosophers. He turns away from abstraction and insufficiency, from verbal solutions, from bad a priori reasons, from fixed principles, closed systems, and pretended absolutes and origins. He turns towards concreteness and adequacy, towards facts, towards action, and towards power. That means the empiricist temper regnant, and the rationalist temper sincerely given up. It means the open air and possibilities of nature, as against dogma, artificiality and the pretence of finality in truth. At the same time it does not stand for any special results. It is a method only. But the general triumph of that method would mean an enormous change in what I called in my last lecture the 'temperament' of philosophy. Teachers of the ultra-rationalistic type would be frozen out, much as the courtier type is frozen out in republics, as the ultramontane type of priest is frozen out in protestant lands. Science and metaphysics would come much nearer together, would in fact work absolutely hand in hand.

According to the Greek historian Diodorus Siculus, writing in the first century BC, 'There lies out in the deep off Libya [Africa] an island of considerable size, and situated as it is in the ocean it is a distant from Libya a voyage of a number of days to the west. Its land is fruitful, much of it being mountainous and not a little being a level plain of surpassing beauty. Through it flow navigable rivers ...' Diodorus goes on to tell us how Phoenician mariners, blown off course in a storm, had discovered this Atlantic island with navigable rivers quite by chance. Soon its value was recognized and its fate became the subject of dispute between Tyre and Carthage, two of the great Phoenician cities in the Mediterranean: 'The Tyrians ... purposed to dispatch a colony to it, but the Carthaginians prevented their doing so, partly out of concern lest many inhabitants of Carthage should remove there because of the excellence of the island, and partly in order to have ready in it a place in which to seek refuge against an incalculable turn of fortune, in case some total disaster should overtake Carthage. For it was their thought that since they were masters of the sea, they would thus be able to move, households and all, to an island which was unknown to their conquerors.' Since there are no navigable rivers anywhere to the west of Africa before the seafarer reaches Cuba, Haiti and the American continent, does this report by Diodorus rank as one of the earliest European notices of the New World?
