Most incarcerated women—nearly two-thirds—are in prison for nonviolent, low-level drug crimes or property crimes. Drug laws in particular have had a huge impact on the number of women sent to prison. “Three strikes” laws have also played a considerable role. I started challenging conditions of confinement at Tutwiler in the mid-1980s as a young attorney with the Southern Prisoners Defense Committee. At the time, I was shocked to find women in prison for such minor offenses. One of the first incarcerated women I ever met was a young mother who was serving a long prison sentence for writing checks to buy her three young children Christmas gifts without sufficient funds in her account. Like a character in a Victor Hugo novel, she tearfully explained her heartbreaking tale to me. I couldn’t accept the truth of what she was saying until I checked her file and discovered that she had, in fact, been convicted and sentenced to over ten years in prison for writing five checks, including three to Toys “R” Us. None of the checks was for more than $150. She was not unique. Thousands of women have been sentenced to lengthy terms in prison for writing bad checks or for minor property crimes that trigger mandatory minimum sentences. The collateral consequences of incarcerating women are significant. Approximately 75 to 80 percent of incarcerated women are mothers with minor children. Nearly 65 percent had minor children living with them at the time of their arrest—children who have become more vulnerable and at-risk as a result of their mother’s incarceration and will remain so for the rest of their lives, even after their mothers come home. In 1996, Congress passed welfare reform legislation that gratuitously included a provision that authorized states to ban people with drug convictions from public benefits and welfare. The population most affected by this misguided law is formerly incarcerated women with children, most of whom were imprisoned for drug crimes. These women and their children can no longer live in public housing, receive food stamps, or access basic services. In the last twenty years, we’ve created a new class of “untouchables” in American society, made up of our most vulnerable mothers and their children.

It is possible to think of fragrance existing before a flower was created to contain it, and so it is that God created the world to reveal Himself, to reveal Mercy. Whether she is in possession of her full mental faculties, no one is sure. Perhaps she is sane and just pretending madness for self-protection. Many decades ago - long before the house was built, when this place was just an expanse of wild growth - she had discovered the name of God on a rosewood leaf, the green veins curving into sacred calligraphy. She picks each small leaf now, hoping for a repetition of the miracle, holding it in her palms in a gesture identical to prayer. The life of the house continues around her and occasionally she watches them, following the most ordinary human acts with an attention reserved by others for much greater events. If it is autumn, she has to remain in the garden for hours, following the surge and pull of the wind as it takes the dropped foliage to all corners. Afterwards, as the dusk begins to darken the air, they sit together, she and the tree, until only the tree remains. What need her search fulfils in her is not known. Perhaps healing had existed before wounds and bodies were created to be its recipient.

We have to hope that the Holy Spirit will come to forgive, purify and trim the rather twisted branches of our being. Our emotional makeup has grown from a thousand fears and egoisms since our infancy, as well as from signs of love and the gift of God. It is a mixture of shadow and light. And so it will not be straightened out in a day, but will take a thousand purifications and pardons, daily efforts and above all a gift of the Holy Spirit which renews us from within. It is a long haul to transform our emotional makeup so that we can really start loving our enemy. We have to be patient with our feelings and fears; we have to be merciful to ourselves. If we are to make the passage to acceptance and love of the other - all the others - we must start very simply, by recognizing our own blocks, jealousies, ways of comparing ourselves to others, prejudices and hatreds. We have to recognize that we are poor creatures, that we are what we are. And we have to ask our Father to forgive and purify us. It is good, then, to speak to a spiritual guide, who perhaps can help us to understand what is happening, strengthen us in our efforts and help us discover God's pardon.

My friend Dr. Rod Rosenbladt told me the story of how he’d wrecked his car when he was sixteen years old after he and his friends had been drinking. Following the accident, Rod called his dad, and the first thing his dad asked him was, “Are you all right?” Rod said yes. Then he confessed to his father that he was drunk. Rod was naturally terrified about how his father might respond. Later that night after Rod had made it home, he wept and wept in his father’s study. He was embarrassed, ashamed. At the end of the ordeal, his father asked him this question: “How about tomorrow we go and get you a new car?” Rod now says that he became a Christian in that moment. God’s grace became real to him in that moment of forgiveness and mercy. Now nearly seventy, Rod has since spent his life as a spokesman for the theology of grace. Rod’s father’s grace didn’t turn Rod into a drunk—it made him love his father and the Lord he served. Now let me ask you: What would you like to say to Rod’s dad? Rod says that every time he tells that story in public, there are always people in the audience who get angry. They say, “Your dad let you get away with that? He didn’t punish you at all? What a great opportunity for your dad to teach you responsibility!” Rod always chuckles when he hears that response and says, “Do you think I didn’t know what I had done? Do you think it wasn’t the most painful moment of my whole life up to that point? I was ashamed; I was scared. My father spoke grace to me in a moment when I knew I deserved wrath … and I came alive.” Isn’t that the nature of grace? We know that we deserve punishment and then, when we receive mercy instead, we discover grace. Romans 5:8 reads, “While we were still sinners, Christ died for us.” God gives forgiveness and imputes righteousness to us even though we are sinful and while we were His enemies (vv. 6, 8, 10). Our offenses are infinitely greater than a sixteen-year-old getting drunk and wrecking his car, yet God’s grace is greater still.

On the bus, I pull out my book. It's the best book I've ever read, even if I'm only halfway through. It's called Jane Eyre by Charlotte Brontë, with two dots over the e. Jane Eyre lives in England in Queen Victoria's time. She's an orphan who's taken in by a horrid rich aunt who locks her in a haunted room to punish her for lying, even though she didn't lie. Then Jane is sent to a charity school, where all she gets to eat is burnt porridge and brown stew for many years. But she grows up to be clever, slender, and wise anyway. Then she finds work as a governess in a huge manor called Thornfield, because in England houses have names. At Thornfield, the stew is less brown and the people less simple. That's as far as I've gotten... Diving back into Jane Eyre... Because she grew up to be clever, slender and wise, no one calls Jane Eyre a liar, a thief or an ugly duckling again. She tutors a young girl, Adèle, who loves her, even though all she has to her name are three plain dresses. Adèle thinks Jane Eyre's smart and always tells her so. Even Mr. Rochester agrees. He's the master of the house, slightly older and mysterious with his feverish eyebrows. He's always asking Jane to come and talk to him in the evenings, by the fire. Because she grew up to be clever, slender, and wise, Jane Eyre isn't even all that taken aback to find out she isn't a monster after all... Jane Eyre soon realizes that she's in love with Mr. Rochester, the master of Thornfield. To stop loving him so much, she first forces herself to draw a self-portrait, then a portrait of Miss Ingram, a haughty young woman with loads of money who has set her sights on marrying Mr. Rochester. Miss Ingram's portrait is soft and pink and silky. Jane draws herself: no beauty, no money, no relatives, no future. She show no mercy. All in brown. Then, on purpose, she spends all night studying both portraits to burn the images into her brain for all time. Everyone needs a strategy, even Jane Eyre... Mr. Rochester loves Jane Eyre and asks her to marry him. Strange and serious, brown dress and all, he loves her. How wonderful, how impossible. Any boy who'd love a sailboat-patterned, swimsuited sausage who tames rabid foxes would be wonderful. And impossible. Just like in Jane Eyre, the story would end badly. Just like in Jane Eyre, she'd learn the boy already has a wife as crazy as a kite, shut up in the manor tower, and that even if he loves the swimsuited sausage, he can't marry her. Then the sausage would have to leave the manor in shame and travel to the ends of the earth, her heart in a thousand pieces... Oh right, I forgot. Jane Eyre returns to Thornfield one day and discovers the crazy-as-a-kite wife set the manor on fire and did Mr. Rochester some serious harm before dying herself. When Jane shows up at the manor, she discovers Mr. Rochester in the dark, surrounded by the ruins of his castle. He is maimed, blind, unkempt. And she still loves him. He can't believe it. Neither can I. Something like that would never happen in real life. Would it? ... You'll see, the story ends well.

Others, however, have an overwhelming sense of their own inadequacy and see only their failings, and to these Edwards brings the sweetness of the Christian experience of God's comfort. He reminds us that when we come to the gospel, there is repentance and reliance upon Christ. The biblical repentance to which Edwards draws us is marked out by its all-encompassing nature. We repent not only of our sins but also of our righteousness, as we see the utter unacceptability of even our best deeds. By resting in Christ, by which we see ourselves as completely accepted by him, his record becomes ours, and our record is imputed to him. His blessings and the reward of his sacrifice become ours, and our sin is imputed to him. The consequence of this is an intense humility in our lives, and with it a blessing of comfort and sense of pardon. Paradoxically, we discover that the more sinful we see ourselves, the more radical appears the nature of the grace of God, and the sweeter the fruit of repentance becomes in our lives. Genuine repentance is brought about, ultimately, neither by the fear of consequences nor by the fear of rejection, but as a ministry of the Holy Spirit, who gives to us a deep conviction of the mercy of God.

I grant that they are never tired of professing their wonder at the profound mysteries of Holy Writ; still I cannot discover that they teach anything but speculations of Platonists and Aristotelians, to which (in order to save their credit for Christianity) they have made Holy Writ conform; not content to rave with the Greeks themselves, they want to make the prophets rave also; showing conclusively, that never even in sleep have they caught a glimpse of Scripture’s Divine nature. The very vehemence of their admiration for the mysteries plainly attests, that their belief in the Bible is a formal assent rather than a living faith: and the fact is made still more apparent by their laying down beforehand, as a foundation for the study and true interpretation of Scripture, the principle that it is in every passage true and divine.

Sibbes sought to draw his audience’s eyes from their own hearts to the Saviour, for ‘there are heights, and depths, and breadths of mercy in him above all the depths of our sin and misery’. How so? Because, since ‘God’s love resteth on Christ, as well pleased in him, we may gather that he is as well pleased with us, if we be in Christ!’ Thus Christian confidence in our spiritual state rests not on our strength of faith or performance, but upon ‘the joint agreement of all three persons of the Trinity’, that the Father loves the Son, and it is in the Son’s merits, and not our own, that Christians are loved. Because God is a loving community, Christians can be confident. Then, instead of simply laying moral burdens on young and struggling Christians, Sibbes showed them Christ’s attractiveness so that they might love him from the heart. From then, the Christian’s first task is ‘to warm ourselves at this fire of his love and mercy in giving himself for us’. Only when Christians do that do they truly stop sinning from the heart (whereas when they merely alter their behaviour it does nothing for the sin of the heart). In other words, Sibbes believed that the solution to sin is not the attempt to live without sin, but the gospel of God’s free grace.

Facts about scientific subjects and the news delivered to us about the past and future, facts that no one could have known at the time of the Qur'an's revelation, are announced in its verses. It is impossible for this information, examples of which we have discussed in detail in this book, to have been known with the level of knowledge and technology available in 7th century Arabia. With this in mind, let us ask: Could anyone in 7th century Arabia have known that our atmosphere is made up of seven layers? Could anyone in 7th century Arabia have known in detail the various stages of development from which an embryo grows into a baby and then enters the world from inside his mother? Could anyone in 7th century Arabia have known that the universe is "steadily expanding," as the Qur'an puts it, when modern scientists have only in recent decades put forward the idea of the "Big Bang"? Could anyone in 7th century Arabia have known about the fact that each individual's fingertips are absolutely unique, when we have only discovered this fact recently, using modern technology and modern scientific equipment? Could anyone in 7th century Arabia have known about the role of one of Pharaoh's most prominent aids, Haman, when the details of hieroglyphic translation were only discovered two centuries ago? Could anyone in 7th century Arabia have known that the word "Pharaoh" was only used from the 14th century B.C. and not before, as the Old Testament erroneously claims? Could anyone in 7th century Arabia have known about Ubar and Iram's Pillars, which were only discovered in recent decades via the use of NASA satellite photographs? The only answer to these questions is as follows: the Qur'an is the word of the Almighty Allah, the Originator of everything and the One Who encompasses everything with His knowledge. In one verse, Allah says, "If it had been from other than Allah, they would have found many inconsistencies in it." (Qur'an, 4:82) Every piece of information the Qur'an contains reveals the secret miracles of this divine book. The human being is meant to hold fast to this Divine Book revealed by Allah and to receive it with an open heart as his one and only guide in life. In the Qur'an, Allah tells us the following: This Qur'an could never have been devised by any besides Allah. Rather it is confirmation of what came before it and an elucidation of the Book which contains no doubt from the Lord of all the worlds. Do they say, "He has invented it"? Say: "Then produce a sura like it and call on anyone you can besides Allah if you are telling the truth." (Qur'an, 10:37-38) And this is a Book We have sent down and blessed, so follow it and have fear of Allah so that hopefully you will gain mercy. (Qur'an, 6:155)

Never be guided by arbitrariness in law, which tends to have a good deal of influence on ignorant men who take pride in being clever. Let the tears of the poor find in you more compassion, but not more justice, than the briefs of the wealthy. Try to discover the truth in all the promises and gifts of the rich man, as well as in the poor man’s sobs and entreaties. When there can and should be a place for impartiality, do not bring the entire rigor of the law to bear on the offender, for the reputation of the harsh judge is not better than that of the compassionate one. If you happen to bend the staff of justice, let it be with the weight not of a gift, but of mercy. If you judge the case of one of your enemies, put your injury out of your mind and turn your thoughts to the truth of the question. Do not be blinded by your own passion in another’s trial, for most of the time the mistakes you make cannot be remedied, and if they can, it will be to the detriment of your good name and even your fortune. If a beautiful woman comes to you to plead for justice, turn your eyes from her tears and your ears from her sobs, and consider without haste the substance of what she is asking if you do not want your reason to be drowned in her weeping and your goodness in her sighs. If you must punish a man with deeds, do not abuse him with words, for the pain of punishment is enough for the unfortunate man without the addition of malicious speech. The crime was discovered when Trina became pregnant. As is often the case, the correctional officer was fired but not criminally prosecuted. Trina remained imprisoned and gave birth to a son. Like hundreds of women who give birth while in prison, Trina was completely unprepared for the stress of childbirth. She delivered her baby while handcuffed to a bed. It wasn’t until 2008 that most states abandoned the practice of shackling or handcuffing incarcerated women during delivery. Trina’s baby boy was taken away from her and placed in foster care. After this series of events—the fire, the imprisonment, the rape, the traumatic birth, and then the seizure of her son—Trina’s mental health deteriorated further. Over the years, she became less functional and more mentally disabled. Her body began to spasm and quiver uncontrollably, until she required a cane and then a wheelchair. By the time she had turned thirty, prison doctors diagnosed her with multiple sclerosis, intellectual disability, and mental illness related to trauma. Trina had filed a civil suit against the officer who raped her, and the jury awarded her a judgment of $62,000. The guard appealed, and the Court reversed the verdict because the correctional officer had not been permitted to tell the jury that Trina was in prison for murder. Consequently, Trina never received any financial aid or services from the state to compensate her for being violently raped by one of its “correctional” officers. In 2014, Trina turned fifty-two. She has been in prison for thirty-eight years. She is one of nearly five hundred people in Pennsylvania who have been condemned to mandatory life imprisonment without parole for crimes they were accused of committing when they were between the ages of thirteen and seventeen. It is the largest population of child offenders condemned to die in prison in any single jurisdiction in the world.

You have unfairly tasked me with three very difficult questions. I was very interested in your comments about Christ’s atheism on the cross. That final moment of atheism, that’s something I have never thought about in that way. It’s a very interesting thought because what it really ….it’s an unbelievably merciful idea in some sense. That the burden of life is so unbearable and you see in the Christian passion, of course, torture, unfair judgement by society, betrayal by friends and then a low death. That’s about …as bad as it gets. Right? Which is why it is an archetypal story. It’s about as bad as it gets. And the story that you describe points out that it’s so bad that even God himself might despair about the essential quality of being. Right? Right. So that is merciful in some sense because it does say that there is something that’s built into the fabric of existence, that tests us so severely in our faith about being itself that even God himself falls prey to the temptation to doubt. So that’s…ok now… There is a very large critical literature that suggests that if you want to develop optimal resilience, what you do is lay out a pathway towards somewhere better, someone comes in, they have a problem, you try to figure out what the problem is and then you try to figure out what might constitute a solution. So you have a map. And it’s a tentative map of how you get from where things aren’t so good to where they are better. And then you have the person go out in the world and confront those things that they are avoiding, that are stopping them from moving to that higher place. And there’s an archetypal reality to that, you’re in a fallen state, you are attempting to redeem yourself and there is a process by which that has to occur. And that process involves voluntary confrontation with what you’re afraid of, disgusted by and inclined to avoid. And that’s works. Every psychological school agrees upon that exposure therapy, psychoanalysts expose you to the tragedies of your past, and redeem you in that manner, the behaviourists expose you to the terrors of the present and redeem you in that manner, but there is a broad agreement between psychological schools that that works. My sense is that we are called upon as individuals precisely to do that in our life. We are faced by this unbearable reality, that you made reference to when you talked about the situation on the cross, life itself is fundamentally - and this is a pessimism that we might share - it’s fundamentally suffering and malevolence. But this is I think where we differ, I believe that the evidence suggests that the light that you discover in your life is proportionate to the amount of darkness that you are willing to forthrightly confront and that there is no necessarily upper limit to that. So I think that the good that people are capable of it’s a higher good than the evil that people are capable of. And believe me that I do not say that lightly, given that I know about the evil that people are capable of. And I believe that the central psychological message of the biblical corpus fundamentally it’s that. That’s why it culminates in some sense with the idea that it is necessary to confront the devil and to accept the unjustness of your tortured mortality. If you can do that, and that’s a challenge sufficient to challenge even God himself, you have the best chance of transcending it, and living the kind of life that would set your house in order and everyone’s house in order at the same time. 'If, therefore, a bare march, or reconnoitering a country is sufficient reason to ground a claim to it, we shall insist upon transposing the demand, and your relinquishing your settlements on the western waters and removing one hundred miles back towards the east, whither some of our warriors advanced against you in the course of last year's campaign. Let us examine the facts of your present eruption into our country, and we shall discover your pretentions on that ground. What did you do? You marched into our territories with a superior force; our vigilance gave us no timely notice of your manouvres [sic]; your numbers far exceeded us, and we fled to the stronghold of our extensive woods, there to secure our women and children. Thus, you marched into our towns; they were left to your mercy; you killed a few scattered and defenseless individuals, spread fire and desolation wherever you pleased, and returned again to your own habitations. If you meant this, indeed, as a conquest you omitted the most essential point; you should have fortified the junction of the Holstein and Tennessee rivers, and have thereby conquered all the waters above you. But, as all are fair advantages during the existence of a state of war, it is now too late for us to suffer for your mishap of generalship! Again, were we to inquire by what law or authority you set up a claim, I answer, none! Your laws extend not into our country, nor ever did. You talk of the law of nature and the law of nations, and they are both against you. Indeed, much has been advanced on the want of what you term civilization among the Indians; and many proposals have been made to us to adopt your laws, your religion, your manners, and your customs. But, we confess that we do not yet see the propriety, or practicability of such a reformation, and should be better pleased with beholding the good effect of these doctrines in your own practices than with hearing you talk about them, or reading your papers to us upon such subjects. You say: Why do not the Indians till the ground and live as we do? May we not, with equal propriety, ask, Why the white people do not hunt and live as we do? You profess to think it no injustice to warn us not to kill our deer and other game for the mere love of waste; but it is very criminal in our young men if they chance to kill a cow or a hog for their sustenance when they happen to be in your lands. We wish, however, to be at peace with you, and to do as we would be done by. We do not quarrel with you for killing an occasional buffalo, bear or deer on our lands when you need one to eat; but you go much farther; your people hunt to gain a livelihood by it; they kill all our game; our young men resent the injury, and it is followed by bloodshed and war. This is not a mere affected injury; it is a grievance which we equitably complain of and it demands a permanent redress. The Great God of Nature has placed us in different situations. It is true that he has endowed you with many superior advantages; but he has not created us to be your slaves. We are a separate people! He has given each their lands, under distinct considerations and circumstances: he has stocked yours with cows, ours with buffaloe; yours with hogs, ours with bear; yours with sheep, ours with deer.
