1. Bangladesh.... In 1971 ... Kissinger overrode all advice in order to support the Pakistani generals in both their civilian massacre policy in East Bengal and their armed attack on India from West Pakistan.... This led to a moral and political catastrophe the effects of which are still sorely felt. Kissinger’s undisclosed reason for the ‘tilt’ was the supposed but never materialised ‘brokerage’ offered by the dictator Yahya Khan in the course of secret diplomacy between Nixon and China.... Of the new state of Bangladesh, Kissinger remarked coldly that it was ‘a basket case’ before turning his unsolicited expertise elsewhere.
2. Chile.... Kissinger had direct personal knowledge of the CIA’s plan to kidnap and murder General René Schneider, the head of the Chilean Armed Forces ... who refused to countenance military intervention in politics. In his hatred for the Allende Government, Kissinger even outdid Richard Helms ... who warned him that a coup in such a stable democracy would be hard to procure. The murder of Schneider nonetheless went ahead, at Kissinger’s urging and with American financing, just between Allende’s election and his confirmation.... This was one of the relatively few times that Mr Kissinger (his success in getting people to call him ‘Doctor’ is greater than that of most PhDs) involved himself in the assassination of a single named individual rather than the slaughter of anonymous thousands. His jocular remark on this occasion—‘I don’t see why we have to let a country go Marxist just because its people are irresponsible’—suggests he may have been having the best of times....
3. Cyprus.... Kissinger approved of the preparations by Greek Cypriot fascists for the murder of President Makarios, and sanctioned the coup which tried to extend the rule of the Athens junta (a favoured client of his) to the island. When despite great waste of life this coup failed in its objective, which was also Kissinger’s, of enforced partition, Kissinger promiscuously switched sides to support an even bloodier intervention by Turkey. Thomas Boyatt ... went to Kissinger in advance of the anti-Makarios putsch and warned him that it could lead to a civil war. ‘Spare me the civics lecture,’ replied Kissinger, who as you can readily see had an aphorism for all occasions.
4. Kurdistan. Having endorsed the covert policy of supporting a Kurdish revolt in northern Iraq between 1974 and 1975, with ‘deniable’ assistance also provided by Israel and the Shah of Iran, Kissinger made it plain to his subordinates that the Kurds were not to be allowed to win, but were to be employed for their nuisance value alone. They were not to be told that this was the case, but soon found out when the Shah and Saddam Hussein composed their differences, and American aid to Kurdistan was cut off. Hardened CIA hands went to Kissinger ... for an aid programme for the many thousands of Kurdish refugees who were thus abruptly created.... The apercu of the day was: ‘foreign policy should not he confused with missionary work.’ Saddam Hussein heartily concurred.
5. East Timor. The day after Kissinger left Djakarta in 1975, the Armed Forces of Indonesia employed American weapons to invade and subjugate the independent former Portuguese colony of East Timor. Isaacson gives a figure of 100,000 deaths resulting from the occupation, or one-seventh of the population, and there are good judges who put this estimate on the low side. Kissinger was furious when news of his own collusion was leaked, because as well as breaking international law the Indonesians were also violating an agreement with the United States.... Monroe Leigh ... pointed out this awkward latter fact. Kissinger snapped: ‘The Israelis when they go into Lebanon—when was the last time we protested that?’ A good question, even if it did not and does not lie especially well in his mouth.

The history of black workers in the United States illustrates the point. As already noted, from the late nineteenth-century on through the middle of the twentieth century, the labor force participation rate of American blacks was slightly higher than that of American whites. In other words, blacks were just as employable at the wages they received as whites were at their very different wages. The minimum wage law changed that. Before federal minimum wage laws were instituted in the 1930s, the black unemployment rate was slightly lower than the white unemployment rate in 1930. But then followed the Davis-Bacon Act of 1931, the National Industrial Recovery Act of 1933 and the Fair Labor Standards Act of 1938—all of which imposed government-mandated minimum wages, either on a particular sector or more broadly. The National Labor Relations Act of 1935, which promoted unionization, also tended to price black workers out of jobs, in addition to union rules that kept blacks from jobs by barring them from union membership. The National Industrial Recovery Act raised wage rates in the Southern textile industry by 70 percent in just five months and its impact nationwide was estimated to have cost blacks half a million jobs. While this Act was later declared unconstitutional by the Supreme Court, the Fair Labor Standards Act of 1938 was upheld by the High Court and became the major force establishing a national minimum wage. As already noted, the inflation of the 1940s largely nullified the effect of the Fair Labor Standards Act, until it was amended in 1950 to raise minimum wages to a level that would have some actual effect on current wages. By 1954, black unemployment rates were double those of whites and have continued to be at that level or higher. Those particularly hard hit by the resulting unemployment have been black teenage males. Even though 1949—the year before a series of minimum wage escalations began—was a recession year, black teenage male unemployment that year was lower than it was to be at any time during the later boom years of the 1960s. The wide gap between the unemployment rates of black and white teenagers dates from the escalation of the minimum wage and the spread of its coverage in the 1950s. The usual explanations of high unemployment among black teenagers—inexperience, less education, lack of skills, racism—cannot explain their rising unemployment, since all these things were worse during the earlier period when black teenage unemployment was much lower. Taking the more normal year of 1948 as a basis for comparison, black male teenage unemployment then was less than half of what it would be at any time during the decade of the 1960s and less than one-third of what it would be in the 1970s. Unemployment among 16 and 17-year-old black males was no higher than among white males of the same age in 1948. It was only after a series of minimum wage escalations began that black male teenage unemployment not only skyrocketed but became more than double the unemployment rates among white male teenagers. In the early twenty-first century, the unemployment rate for black teenagers exceeded 30 percent. After the American economy turned down in the wake of the housing and financial crises, unemployment among black teenagers reached 40 percent.

But the vastly more controversial question is the converse: Given a racial identity -- African or Asian, say -- can you infer anything about an individual's characteristics: not just skin or hair color, but more complex features, such as intelligence, habits, personality, and aptitude? /I/ Genes can certainly tell us about race, but can race tell us anything about genes? /i/
To answer this question, we need to measure how genetic variation is distributed across various racial categories. Is there more diversity _within_ races or _between_ races? Does knowing that someone is of African versus European descent, say, allow us to refine our understanding of their genetic traits, or their personal, physical, or intellectual attributes in a meaningful manner? Or is there so much variation within Africans and Europeans that _intraracial_ diversity dominates the comparison, thereby making the category "African" or "European" moot?
We now know precise and quantitative answers to these questions. A number of studies have tried to quantify the level of genetic diversity of the human genome. The most recent estimates suggest that the vast proportion of genetic diversity (85 to 90 percent) occurs _within_ so-called races (i.e., within Asians or Africans) and only a minor proportion (7 percent) within racial groups (the geneticist Richard Lewontin had estimated a similar distribution as early as 1972). Some genes certainly vary sharply between racial or ethnic groups -- sickle-cell anemia is an Afro-Caribbean and Indian disease, and Tay-Sachs disease has a much higher frequency in Ashkenazi Jews -- but for the most part, the genetic diversity within any racial group dominates the diversity between racial groups -- not marginally, but by an enormous amount. The degree of interracial variability makes "race" a poor surrogate for nearly any feature: in a genetic sense, an African man from Nigria is so "different" from another man from Namibia that it makes little sense to lump them into the same category.

Financial advisers at Edward Jones or Prudential can help you sign up for 529 college savings plans, but those plans' generous tax benefits will cost the federal government an estimated $28.5 billion between 2017 and 2026. For most Americans under the age of sixty-five, health insurance appears to come from their jobs, but supporting this arrangement is one of the single largest tax breaks issued by the federal government, one that exempts the cost of employer-sponsored health insurance from taxable incomes. In 2022, this benefit is estimated to have cost the government $316 billion for those under sixty-five. By 2032, its price tag is projected to exceed $6oo billion. Almost half of all Americans receive government-subsidized health benefits through their employers, and over a third are enrolled in government-subsidized retirement benefits. These participation rates, driven primarily by rich and middle-class Americans, far exceed those of even the largest programs directed at low income families, such as food stamps (14 percent of Americans) and the Earned Income Tax Credit (19 percent).
Altogether, the United States spent $1.8 trillion on tax breaks in 2021. That amount exceeded total spending on law enforcement, education, housing, healthcare, diplomacy, and everything else that makes up our discretionary budget. Roughly half the benefits of the thirteen largest individual tax breaks accrue to the richest families, those with incomes that put them in the top 20 percent. The top I percent of income earners take home more than all middle-class families and double that of families in the bottom 20 percent. I can't tell you how many times someone has informed me that we should reduce military spending and redirect the savings to the poor. When this suggestion is made in a public venue, it always garners applause. I've met far fewer people who have suggested we boost aid to the poor by reducing tax breaks that mostly benefit the upper class, even though we spend over twice as much on them as on the military and national defense.

Take food for example. We all assume that our craving or disgust is due to something about the food itself - as opposed to being an often arbitrary response preprogrammed by our culture. We understand that Australians prefer cricket to baseball, or that the French somehow find Gerard Depardieu sexy, but how hungry would you have to be before you would consider plucking a moth from the night air and popping it, frantic and dusty, into your mouth? Flap, crunch, ooze. You could wash it down with some saliva beer.How does a plate of sheep brain's sound? Broiled puppy with gravy? May we interest you in pig ears or shrimp heads? Perhaps a deep-fried songbird that you chew up, bones, beak, and all? A game of cricket on a field of grass is one thing, but pan-fried crickets over lemongrass? That's revolting.
Or is it? If lamb chops are fine, what makes lamb brains horrible? A pig's shoulder, haunch, and belly are damn fine eatin', but the ears, snout, and feet are gross? How is lobster so different from grasshopper? Who distinguishes delectable from disgusting, and what's their rationale? And what about all the expectations? Grind up those leftover pig parts, stuff 'em in an intestine, and you've got yourself respectable sausage or hot dogs. You may think bacon and eggs just go together, like French fries and ketchup or salt and pepper. But the combination of bacon and eggs for breakfast was dreamed up about a hundred years aqo by an advertising hired to sell more bacon, and the Dutch eat their fries with mayonnaise, not ketchup.
Think it's rational to be grossed out by eating bugs? Think again. A hundred grams of dehydrated cricket contains 1,550 milligrams of iron, 340 milligrams of calcium, and 25 milligrams of zinc - three minerals often missing in the diets of the chronic poor. Insects are richer in minerals and healthy fats than beef or pork. Freaked out by the exoskeleton, antennae, and the way too many legs? Then stick to the Turf and forget the Surf because shrimps, crabs, and lobsters are all anthropods, just like grasshoppers. And they eat the nastiest of what sinks to the bottom of the ocean, so don't talk about bugs' disgusting diets. Anyway, you may have bug parts stuck between your teeth right now. The Food and Drug Administration tells its inspectors to ignore insect parts in black pepper unless they find more than 475 of them per 50 grams, on average. A fact sheet from Ohio State University estimates that Americans unknowingly eat an average of between one and two pounds of insects per year.

The real loser in the eastern forests has been the songbird. One of the most striking losses was the Carolina parakeet, a lovely, innocuous bird whose numbers in the wild were possibly exceeded only by the unbelievably numerous passenger pigeon. (When the first pilgrims came to America there were an estimated nine billion passenger pigeons—more than twice the number of all birds found in America today.) Both were hunted out of existence—the passenger pigeon for pig feed and the simple joy of blasting volumes of birds from the sky with blind ease, the Carolina parakeet because it ate farmers’ fruit and had a striking plumage that made a lovely ladies’ hat. In 1914, the last surviving members of each species died within weeks of each other in captivity. A similar unhappy fate awaited the delightful Bachman’s warbler. Always rare, it was said to have one of the loveliest songs of all birds. For years it escaped detection, but in 1939, two birders, operating independently in different places, coincidentally saw a Bachman’s warbler within two days of each other. Both shot the birds (nice work, boys!), and that, it appears, was that for the Bachman’s warbler. But there are almost certainly others that disappeared before anyone much noticed. But for others, shattering experiences prompt them to face their fears, transcend the horrors of the past, and become resilient. PTSD is not a life sentence. POSTTRAUMATIC GROWTH While PTSD grabs the headlines, news stories about posttraumatic growth are rare. Up to two thirds of those who experience traumatic events do not develop PTSD. This estimate is based on studies of the mental health of people who have undergone similar experiences. Studies of US veterans who served in Iraq and Afghanistan show this two-thirds to one-third split. What’s the difference between the two groups? Research reveals a correlation between negative childhood events and the development of adult PTSD. Yet some people emerge from miserable childhoods stronger and more resilient than their peers. Adversity can sometimes make us even stronger than we might have been had we not suffered it. Research shows that people who experience a traumatic event but are then able to process and integrate the experience are more resilient than those who don’t experience such an event. Such people are even better prepared for future adversity. When you’re exposed to a stressor and successfully regulate your brain’s fight-or-flight response, you increase the neural connections associated with handling trauma, as we saw in Chapter 6. Neural plasticity works in your favor. You increase the size of the signaling pathways in your nervous system that handle recovery from stress. In an attempt to pander to Muslim constituents, both the Left and the Greens voted against the law for being “too general.”17 SHARIA COUNCILS AND LEGAL DOUBLE STANDARDS Societies that permit the existence of parallel communities resign themselves to the growth of parallel legal systems. This is the case with sharia courts that apply Islamic law to the marital affairs of believers. Dutch researcher Machteld Zee’s study of sharia councils in the United Kingdom estimates that between ten and eighty-five sharia councils operate there.18 Zee documents cases of women seeking divorce being sent back to abusive husbands by sharia courts and being denied the legal protections that non-Muslim wives receive under UK law.

According to researcher David Rusin, “estimates for the United States typically run into the tens of thousands of polygamous unions.”39 In May 2008 researchers estimated that between 50,000 and 100,000 Muslims were living in polygamous arrangements in the United States.40 And Muslim imams don’t seem concerned about U.S. laws forbidding the practice: Ibrahim Hooper of the Council on American-Islamic Relations asserted that a “minority” of Muslims in America were polygamous, and that “Islamic scholars would differ on whether one could do so while living in the United States.”41 He didn’t say anything about the necessity of obeying U.S. laws in this regard. Toronto imam Aly Hindy explained that such laws would have no force for Muslims: “This is in our religion and nobody can force us to do anything against our religion. If the laws of the country conflict with Islamic law, if one goes against the other, then I am going to follow Islamic law, simple as that.”42 The Koran has further gifts for men as well. As we have seen, it stipulates that if a man cannot deal justly with multiples wives, then he should marry only one, or resort to “the captives that your right hands possess”—that is, slave girls (4:3).

In 1999, a bunch of researchers published a study of about 1,600 adults examined in order to come up with equations to estimate kidney function. Just plug in the patient’s creatinine, age (because adults tend to lose muscle mass as we get older), and gender (because men tend to have more muscle mass than women), and voila!—an estimate of kidney function. Most laboratories can do this for us now. A rising creatinine level in the blood means the kidneys are not able to pee creatinine out as well as they used to, so the person’s estimated kidney function is lower. But wait—if the patient is Black, the study determined that you have to multiply by 1.2 to get a more accurate estimate. This finding was attributed to Blacks in the study having higher muscle mass than Whites and, therefore, higher amounts of creatinine in their bodies. Laboratories report the eGFR, and just below it, the eGFR if Black. Of course one of the problems with generalizations is that they aren’t always true. In medicine, in particular, they make us lazy and we often accept them without question—especially when they are in line with our underlying assumptions and beliefs. Like the belief that Black and African are inherently different from White and European at a DNA level, a belief that dates back to the days when American researchers were measuring Black-White differences in skull size to prove Black inferiority and justify slavery. But I wonder how often health-care providers make the mental adjustment that the “race adjustment” is really a proxy for muscle mass rather than just focusing on the race of the person in front of them when they are assessing lab results. I wonder if the person in front of them were a White male bodybuilder how many would tell him the race-adjusted estimate of kidney function, or a skinny Black woman the non-race-adjusted estimate. Then too I wonder how many health-care practitioners realize that equations derived from the original study of 1,600 people only included about 200 Blacks—and no American Samoans, no Hispanics, no Asians. These groups have very different body frames, but all are simply “not Black” in our equations. The implication, then, is that only Black people are different. This shortcut has the potential for a significant negative impact on Black patients who happen to not have a high muscle mass. Patients like Book of Eli. When the non-race-adjusted eGFR is 20 (when a person can be placed on the waiting list), the race-adjusted value is closer to 25. Just as the difference between eGFRs of 20 and 10 can be several years for many patients, so can the difference between 25 and 20. Years of accruing time on the kidney transplant waiting list when thirteen people on the waiting list die every day waiting for a kidney.

William James said near the end of the nineteenth century, “No mental modification ever occurs which is not accompanied or followed by a bodily change.” A hundred years later, Norman Cousins summarized the modern view of mind-body interactions with the succinct phrase “Belief becomes biology.”6 That is, an external suggestion can become an internal expectation, and that internal expectation can manifest in the physical body. While the general idea of mind-body connections is now widely accepted, forty years ago it was considered dangerously heretical nonsense. The change in opinion came about largely because of hundreds of studies of the placebo effect, psychosomatic illness, psychoneuroimmunology, and the spontaneous remission of serious disease.7 In studies of drug tests and disease treatments, the placebo response has been estimated to account for between 20 to 40 percent of positive responses. The implication is that the body’s hard, physical reality can be significantly modified by the more evanescent reality of the mind.8 Evidence supporting this implication can be found in many domains. For example: • Hypnotherapy has been used successfully to treat intractable cases of breast cancer pain, migraine headache, arthritis, hypertension, warts, epilepsy, neurodermatitis, and many other physical conditions.9 People’s expectations about drinking can be more potent predictors of behavior than the pharmacological impact of alcohol.10 If they think they are drinking alcohol and expect to get drunk, they will in fact get drunk even if they drink a placebo. Fighter pilots are treated specially to give them the sense that they truly have the “right stuff.” They receive the best training, the best weapons systems, the best perquisites, and the best aircraft. One consequence is that, unlike other soldiers, they rarely suffer from nervous breakdowns or post-traumatic stress syndrome even after many episodes of deadly combat.11 Studies of how doctors and nurses interact with patients in hospitals indicate that health-care teams may speed death in a patient by simply diagnosing a terminal illness and then letting the patient know.12 People who believe that they are engaged in biofeedback training are more likely to report peak experiences than people who are not led to believe this.13 Different personalities within a given individual can display distinctly different physiological states, including measurable differences in autonomic-nervous-system functioning, visual acuity, spontaneous brain waves, and brainware-evoked potentials.14 While the idea that the mind can affect the physical body is becoming more acceptable, it is also true that the mechanisms underlying this link are still a complete mystery. Besides not understanding the biochemical and neural correlates of “mental intention,” we have almost no idea about the limits of mental influence. In particular, if the mind interacts not only with its own body but also with distant physical systems, as we’ve seen in the previous chapter, then there should be evidence for what we will call “distant mental interactions” with living organisms.

Key Point The regression coefficient is the effect on the dependent variable, controlled for all other independent variables in the model. The regression coefficients in simple regression do not control for other independent variables, because they are not in the model. The word independent also means that each independent variable should be relatively unaffected by other independent variables in the model. To ensure that independent variables are indeed independent, it is useful to think of the distinctively different types (or categories) of factors that affect a dependent variable. This was the approach taken in the preceding example. There is also a statistical reason for ensuring that independent variables are as independent as possible. When two independent variables are highly correlated with each other (r2 > .60), it sometimes becomes statistically impossible to distinguish the effect of each independent variable on the dependent variable, controlled for the other. The variables are statistically too similar to discern disparate effects. This problem is called multicollinearity and is discussed later in this chapter. This problem is avoided by choosing independent variables that are not highly correlated with each other. A WORKING EXAMPLE Previously (see Chapter 14), the management analyst with the Department of Defense found a statistically significant relationship between teamwork and perceived facility productivity (p <.01). The analyst now wishes to examine whether the impact of teamwork on productivity is robust when controlled for other factors that also affect productivity. This interest is heightened by the low R-square (R2 = 0.074) in Table 14.1, suggesting a weak relationship between teamwork and perceived productivity. A multiple regression model is specified to include the effects of other factors that affect perceived productivity. Scatterplot The relationship between two continuous variables can be portrayed in a scatterplot. A scatterplot is merely a plot of the data points for two continuous variables, as shown in Figure 14.1 (without the straight line). By convention, the dependent variable is shown on the vertical (or Y-) axis, and the independent variable on the horizontal (or X-) axis. The relationship between the two variables is estimated as a straight line relationship. The line is defined by the equation y = a + bx, where a is the intercept (or constant), and b is the slope. The slope, b, is defined as Figure 14.1 Scatterplot or (y2 – y1)/(x2 – x1). The line is calculated mathematically such that the sum of distances from each observation to the line is minimized.2 By definition, the slope indicates the change in y as a result of a unit change in x. The straight line, defined by y = a + bx, is also called the regression line, and the slope (b) is called the regression coefficient. A positive regression coefficient indicates a positive relationship between the variables, shown by the upward slope in Figure 14.1. A negative regression coefficient indicates a negative relationship between the variables and is indicated by a downward-sloping line. Test of Significance The test of significance of the regression coefficient is a key test that tells us whether the slope (b) is statistically different from zero. The slope is calculated from a sample, and we wish to know whether it is significant. When the regression line is horizontal (b = 0), no relationship exists between the two variables. Then, changes in the independent variable have no effect on the dependent variable. The following hypotheses are thus stated: H0: b = 0, or the two variables are unrelated. HA: b ≠ 0, or the two variables are (positively or negatively) related. To determine whether the slope equals zero, a t-test is performed. The test statistic is defined as the slope, b, divided by the standard error of the slope, se(b). The standard error of the slope is a measure of the distribution of the observations around the regression slope, which is based on the standard deviation of those observations to the regression line: Thus, a regression line with a small slope is more likely to be statistically significant when observations lie closely around it (that is, the standard error of the observations around the line is also small, resulting in a larger test statistic). A management analyst with the Department of Defense wishes to evaluate the impact of teamwork on the productivity of naval shipyard repair facilities. Although all shipyards are required to use teamwork management strategies, these strategies are assumed to vary in practice. Coincidentally, a recently implemented employee survey asked about the perceived use and effectiveness of teamwork. These items have been aggregated into a single index variable that measures teamwork. Employees were also asked questions about perceived performance, as measured by productivity, customer orientation, planning and scheduling, and employee motivation. All those multiforms are understood by the pure, unalloyed devotees, but not by a simple study of the Vedas (vedeṣu durlabham adurlabham ātma-bhaktau). Devotees like Arjuna are constant companions of the Lord, and whenever the Lord incarnates, the associate devotees also incarnate in order to serve the Lord in different capacities. Arjuna is one of these devotees, and in this verse it is understood that some millions of years ago when Lord Kṛṣṇa spoke the Bhagavad-gītā to the sun-god Vivasvān, Arjuna, in a different capacity, was also present. But the difference between the Lord and Arjuna is that the Lord remembered the incident whereas Arjuna could not remember. That is the difference between the part-and-parcel living entity and the Supreme Lord. Although Arjuna is addressed herein as the mighty hero who could subdue the enemies, he is unable to recall what had happened in his various past births. Therefore, a living entity, however great he may be in the material estimation, can never equal the Supreme Lord. Anyone who is a constant companion of the Lord is certainly a liberated person, but he cannot be equal to the Lord. The Lord is described in the Brahma-saḿhitā as infallible (acyuta), which means that He never forgets Himself, even though He is in material contact. Therefore, the Lord and the living entity can never be equal in all respects, even if the living entity is as liberated as Arjuna. Although Arjuna is a devotee of the Lord, he sometimes forgets the nature of the Lord, but by the divine grace a devotee can at once understand the infallible condition of the Lord, whereas a nondevotee or a demon cannot understand this transcendental nature. Consequently these descriptions in the Gītā cannot be understood by demonic brains. Kṛṣṇa remembered acts which were performed by Him millions of years before, but Arjuna could not, despite the fact that both Kṛṣṇa and Arjuna are eternal in nature. We may also note herein that a living entity forgets everything due to his change of body, but the Lord remembers because He does not change His sac-cid-ānanda body. He is advaita, which means there is no distinction between His body and Himself. Everything in relation to Him is spirit — whereas the conditioned soul is different from his material body. And because the Lord's body and self are identical, His position is always different from that of the ordinary living entity, even when He descends to the material platform. The demons cannot adjust themselves to this transcendental nature of the Lord, which the Lord Himself explains in the following verse.

it is not uncommon for experts in DNA analysis to testify at a criminal trial that a DNA sample taken from a crime scene matches that taken from a suspect. How certain are such matches? When DNA evidence was first introduced, a number of experts testified that false positives are impossible in DNA testing. Today DNA experts regularly testify that the odds of a random person’s matching the crime sample are less than 1 in 1 million or 1 in 1 billion. With those odds one could hardly blame a juror for thinking, throw away the key. But there is another statistic that is often not presented to the jury, one having to do with the fact that labs make errors, for instance, in collecting or handling a sample, by accidentally mixing or swapping samples, or by misinterpreting or incorrectly reporting results. Each of these errors is rare but not nearly as rare as a random match. The Philadelphia City Crime Laboratory, for instance, admitted that it had swapped the reference sample of the defendant and the victim in a rape case, and a testing firm called Cellmark Diagnostics admitted a similar error.20 Unfortunately, the power of statistics relating to DNA presented in court is such that in Oklahoma a court sentenced a man named Timothy Durham to more than 3,100 years in prison even though eleven witnesses had placed him in another state at the time of the crime. It turned out that in the initial analysis the lab had failed to completely separate the DNA of the rapist and that of the victim in the fluid they tested, and the combination of the victim’s and the rapist’s DNA produced a positive result when compared with Durham’s. A later retest turned up the error, and Durham was released after spending nearly four years in prison.21 Estimates of the error rate due to human causes vary, but many experts put it at around 1 percent. However, since the error rate of many labs has never been measured, courts often do not allow testimony on this overall statistic. Even if courts did allow testimony regarding false positives, how would jurors assess it? Most jurors assume that given the two types of error—the 1 in 1 billion accidental match and the 1 in 100 lab-error match—the overall error rate must be somewhere in between, say 1 in 500 million, which is still for most jurors beyond a reasonable doubt. But employing the laws of probability, we find a much different answer. The way to think of it is this: Since both errors are very unlikely, we can ignore the possibility that there is both an accidental match and a lab error. Therefore, we seek the probability that one error or the other occurred. That is given by our sum rule: it is the probability of a lab error (1 in 100) + the probability of an accidental match (1 in 1 billion). Since the latter is 10 million times smaller than the former, to a very good approximation the chance of both errors is the same as the chance of the more probable error—that is, the chances are 1 in 100. Given both possible causes, therefore, we should ignore the fancy expert testimony about the odds of accidental matches and focus instead on the much higher laboratory error rate—the very data courts often do not allow attorneys to present! And so the oft-repeated claims of DNA infallibility are exaggerated.

in Canada, Hawaii, Chicago, or Washington, D.C., police are unable to point to a single instance of gun registration aiding the investigation of a violent crime. In a 2013 deposition, D.C. Police Chief Cathy Lanier said that the department could not “recall any specific instance where registration records were used to determine who committed a crime.”1 The idea behind a registry is that guns left at a crime scene can be used to trace back to the criminals. Unfortunately, guns are very rarely left at the scene of the crime. Those that are left behind are virtually never registered—criminals are not stupid enough to leave behind guns registered to them. In the few cases where registered guns were left at the scene, the criminal had usually been killed or seriously injured. Canada keeps some of the most thorough data on gun registration. From 2003 to 2009, a weapon was identified in fewer than a third of the country’s 1,314 firearm homicides. Of these identified weapons, only about a quarter were registered. Roughly half of these registered guns were registered to someone other than the person accused of the homicide. In just sixty-two cases—4.7 percent of all firearm homicides—was the gun identified as being registered to the accused. Since most Canadian homicides are not committed with a gun, these sixty-two cases correspond to only about 1 percent of all homicides. From 2003 to 2009, there were only sixty-two cases—just nine a year—where registration made any conceivable difference. But apparently, the registry was not important even in those cases. Despite a handgun registry in effect since 1934, the Royal Canadian Mounted Police and the Chiefs of Police have not yet provided a single example in which tracing was of more than peripheral importance in solving a case. No more successful was the long-gun registry that started in 1997 and cost Canadians $2.7 billion before being scrapped. In February 2000, I testified before the Hawaii State Senate joint hearing between the Judiciary and Transportation committees on changes that were being proposed to the state gun registration laws.2 I suggested two questions to the state senators: (1) how many crimes had been solved by their current registration and licensing system, and (2) how much time did it currently take police to register guns? The Honolulu police chief was notified in advance about those questions to give him time to research them. He told the committee that he could not point to any crimes that had been solved by registration, and he estimated that his officers spent over 50,000 hours each year on registering guns. But those aren’t the only failings of gun registration. Ballistic fingerprinting was all the rage fifteen years ago. This process requires keeping a database of the markings that a particular gun makes on a bullet—its unique fingerprint, so to speak. Maryland led the way in ballistic investigation, and New York soon followed. The days of criminal gun use were supposedly numbered. It didn’t work.3 Registering guns’ ballistic fingerprints never solved a single crime. New York scrapped its program in 2012.4 In November 2015, Maryland announced it would be doing the same.5 But the programs were costly. Between 2000 and 2004, Maryland spent at least $2.5 million setting up and operating its computer database.6 In New York, the total cost of the program was about $40 million.7 Whether one is talking about D.C., Canada, or these other jurisdictions, think of all the other police activities that this money could have funded. How many more police officers could have been hired? How many more crimes could have been solved? A 2005 Maryland State Police report labeled the operation “ineffective and expensive.”8 These programs didn’t work.

Islam means “submission.”1 The faith teaches that Muslims must submit to the will of Allah2 and prepare themselves for the final judgment in order to be able to enter paradise.3 Muslims believe that Allah revealed his will through Sharia, which literally means “path” but is generally translated as “Islamic law.”4 Unlike the traditional Western legal system, which is limited to basic civil and criminal elements, Sharia covers everything from religious rituals and private hygiene to principles of conducting business, criminal punishments, and more. Sharia prescribes, for example, how many times a Muslim must pray, how husbands should treat their wives, and what punishments are to be given for different crimes. It mandates flogging for consuming alcohol,5 stoning adulterers to death,6 cutting off a thief’s limbs,7 and executing apostates and blasphemers.8 Many Muslims around the world do not adhere to the jihadist ideology of terrorists. Most Muslims are moderate, peaceful people who, while following their religious traditions and rituals—attending mosques for worship, fasting, witnessing to others—reasonably coexist with followers of other religions. They do not impose their beliefs on others. They have non-Muslim friends, neighbors, and coworkers with whom they socialize on a daily basis. To these Muslims, Islam is a religion of peace. A small but increasingly significant segment of Muslims (some estimate its size as between 10 and 20 percent),9 however, believe in the supremacy of Islam and Sharia law over any other religion or law and feel obligated to force such beliefs on everybody. The book’s original title (translated from the German) reveals Frankl’s amazing outlook on life: Saying Yes to Life in Spite of Everything: A Psychologist Experiences the Concentration Camp. In 1942, Frankl and his wife and parents were sent to the Nazi Theresienstadt ghetto in Czechoslovakia, which was one of the show camps used to deceive Red Cross inspectors as to the true purpose and conditions of the concentration camps. In October 1944, Frankl and his wife were moved to Auschwitz, where an estimated 1.1 million people would meet their deaths. Later that month, he was transported to one of the Kaufering labor camps (subcamps of Dachau), and then, after contracting typhoid, to the Türkheim camp where he remained until American troops liberated the camp on April 27, 1945. Frankl and his sister, Stella, were the only ones in his immediate family to survive the Holocaust. In Man’s Search for Meaning, Frankl observed that a sense of meaning is what makes the difference in being able to survive painful and even horrific experiences. He wrote, “We who lived in concentration camps can remember the men who walked through the huts comforting others, giving away their last piece of bread. They may have been few in number, but they offer sufficient proof that everything can be taken from a man but one thing: the last of human freedoms—to choose one’s own attitude in any given set of circumstances—to choose one’s own way.” Frankl maintained that while we cannot avoid suffering in life, we can choose the way we deal with it. We can find meaning in our suffering and proceed with our lives with our purpose renewed. What can explain this difference? On the surface, much appears to hinge on Richard’s programming feat, his software shim. Otherwise, his effort with Konqueror seems much like my struggles with Mozilla. Perhaps he was just a better programmer than me, and without his coding cleverness, there would be no story. That explanation is too simple. Richard made his shim only after determining he needed one last link in a chain of inspiration, intuition, reasoning, and estimation. His shim was a consequence of his overall plan. To show what I mean, here’s an accounting of what Richard did in his first couple of days at Apple. He began by quizzing us on the browser analysis we had done before his arrival, and after hearing it, he quickly discarded our effort with Mozilla as unlikely to bear fruit. By doing so, he demonstrated the self-confidence to skip any ingratiating display of deference to his new manager, a person who had years of experience in the technical field he was newly entering. Next, Richard resolved to produce a result on the shortest possible schedule. He downloaded an open source project that held genuine promise, the Konqueror code from KDE, a browser that might well serve as the basis for our long-term effort. In getting this code running on a Mac, he decided to make the closest possible approximation of a real browser that was feasible on his short schedule. He identified three features—loading web pages, clicking links, and going back to previous pages. He reasoned these alone would be sufficiently compelling proofs of concept. He then made his shortcuts, and these simplifying choices defined a set of nongoals: Perfect font rendering would be cast aside, as would full integration with the Mac’s native graphics system, same for using only the minimum source code from KDE. He reasoned that these shortcuts, while significant, would not substantially detract from the impact of seeing a browser surf web pages. He resolved to draw together these strands into a single demo that would show the potential of Konqueror. Then, finally, he worked through the technical details, which led him to develop his software shim, since that was the only thing standing between him and the realization of his plan. His thought process amplified his technical acumen. In contrast, Don and I were hoping Mozilla would pan out somehow. I was trying to get the open source behemoth to build on the Mac, with little thought beyond that. I had no comparable plan, goals, nongoals, tight schedule, or technical shortcuts.

Yet in the Christian histories, men like Libanius barely exist. The voices of the worshippers of the old gods are rarely, if ever, recorded. But they were there. It is thought that when Constantine had come to the throne, ten percent of the empire, at most, were Christian. That is not to say that the rest were fervent worshippers of Isis or Jupiter—the popularity of different gods waxed and waned over time and the spectrum of classical belief ran from firm believer to utter skeptic. But what is more certain is that probably around ninety percent were not Christian. By the end of that first, tumultuous century of Christian rule, estimates suggest that this figure had been reversed: between seventy and ninety percent of the empire were now Christian.57 One law from around that time declared, entirely untruthfully, that there were no more “pagans.” None. The aggression of the claim is remarkable. Christians were writing the wicked “pagans” out of existence.
