After the Civil War the state's economy was in disarray, and cotton and sugar planters suddenly found themselves without hands they could force to work. It said that 'neither slavery nor involuntary servitude' shall exist in the United States 'except as punishment for a crime.' As long as black men were convicted of crimes, Texas could lease all of its prisoners to private cotton and sugar plantations and companies running lumber camps and coal mines, and building railroads. It did this for five decades after the abolition of slavery, but the state eventually became jealous of the revenue private companies and planters were earning from its prisoners. So, between 1899 and 1918, the state bought ten plantations of its own and began running them as prisons.

Severely compromising this system, insofar as it serves to further these ideals, is our vacillation or obsession with moral responsibility, which is, in the broadest sense, an attempt to isolate the subjective element of human choice, an exercise that all too readily deteriorates into blaming and scapegoating without providing effective solutions to the actual problem. The problem with the question of moral responsibility is that it is inherently subjective and involves conjecture about an individuals’ state of mind, awareness and ability to act that can rarely if ever be proved. Thus it involves precisely the same type of conjecture that characterizes superstitious notions of possession and the influence of the devil and provides no effective means of managing conduct: the individual convicted for an offence or crime considered morally wrong is convicted based on a series of hypotheses and probabilities and not necessarily because he or she is actually morally wrong. The fairness and effectiveness of a system of justice based on such hypotheses is highly questionable particularly as a basis for preventing or reducing drug use related harm. For example, with respect to drugs, the system quite obviously fails as a deterrent and the system is not organised to ‘reform’ the offender much less to ensure that he or she has ‘learned a lesson’; moreover, the offender does not get an opportunity to make amends or even have a conversation with the alleged victim. In the case of retributive justice, the justice system is effectively mopping up after the fact. In other words, as far as deterrence is concerned, the entire exercise of justice becomes an exercise based on faith, rather than one based on evidence.

In the foreword to your book you mention a book titled Satan’s Silence was the catalyst for your research. Tell us about that. Cheit: Debbie Nathan and Michael Snedeker solidified the witch-hunt narrative in their 1995 book, Satan’s Silence: Ritual Abuse and the Making of a Modern American Witch Hunt, which included some of these cases. I was initially skeptical of the book’s argument for personal reasons. It seemed implausible to me that we had overreacted to child abuse because everything in my own personal history said we hadn’t. When I read the book closely, my skepticism increased. Satan’s Silence has been widely reviewed as meticulously researched. As someone with legal training, I looked for how many citations referred to the trial transcripts. The answer was almost none. Readers were also persuaded by long list of [presumably innocent] convicted sex offenders to whom they dedicated the book. If I’m dedicating a book to fifty-four people, all of whom I think have been falsely convicted, I’m going to mention every one of these cases somewhere in the book. Most weren’t mentioned at all beyond that dedication. The witch-hunt narrative is so sparsely documented that it’s shocking.

It is hard to bring paedophile rings to justice. Thankfully it does happen. Perhaps the most horrific recent case came before the High Court in Edinburgh in June 2007. It involved a mother who stood by and watched as her daughter of nine was gang-raped by members of a paedophile ring at her home in Granton, in the north of Edinburgh. The mother, Caroline Dunsmore, had allowed her two daughters to be used in this way from the age of five. Sentencing Dunsmore to twelve years in prison judge, Lord Malcolm, said he would take into account public revulsion at the grievous crimes against the two girls. He told the forty-three-year-old woman: 'It is hard to imagine a more grievous breach of trust on the part of a mother towards her child.' Morris Petch and John O'Flaherty were also jailed for taking part in raping the children. Child abuse nearly always takes place at home and members of the family are usually involved.

We need to have pastors who are schooled in apologetics and engaged intellectually with our culture so as to shepherd their flock amidst the wolves. People who simply ride the roller coaster of emotional experience are cheating themselves out of a deeper and richer Christian faith by neglecting the intellectual side of that faith. They know little of the riches of deep understanding of Christian truth, of the confidence inspired by the discovery that one’s faith is logical and fits the facts of experience, and of the stability brought to one’s life by the conviction that one’s faith is objectively true. God could not possibly have intended that reason should be the faculty to lead us to faith, for faith cannot hang indefinitely in suspense while reason cautiously weighs and reweighs arguments. The Scriptures teach, on the contrary, that the way to God is by means of the heart, not by means of the intellect. When a person refuses to come to Christ, it is never just because of lack of evidence or because of intellectual difficulties: at root, he refuses to come because he willingly ignores and rejects the drawing of God’s Spirit on his heart. unbelief is at root a spiritual, not an intellectual, problem. Sometimes an unbeliever will throw up an intellectual smoke screen so that he can avoid personal, existential involvement with the gospel. In such a case, further argumentation may be futile and counterproductive, and we need to be sensitive to moments when apologetics is and is not appropriate. A person who knows that Christianity is true on the basis of the witness of the Spirit may also have a sound apologetic which reinforces or confirms for him the Spirit’s witness, but it does not serve as the basis of his belief. As long as reason is a minister of the Christian faith, Christians should employ it. It should not surprise us if most people find our apologetic unconvincing. But that does not mean that our apologetic is ineffective; it may only mean that many people are closed-minded. Without a divine lawgiver, there can be no objective right and wrong, only our culturally and personally relative, subjective judgments. This means that it is impossible to condemn war, oppression, or crime as evil. Nor can one praise brotherhood, equality, and love as good. Imagine that you are enjoying a quiet evening at home when suddenly you hear loud banging outside. You look out the window and see an African American man attempting to force open the door of a nearby house. Being a dutiful citizen, you call 911, and the police arrive and arrest the perpetrator. Congratulations, you have just brought about the arrest of Harvard professor Henry Louis Gates, Jr., as it happened on July 16, 2009. Gates was trying to force open the front door of his own home, which had become stuck while he was traveling. Affective realism strikes again. The real-life eyewitness in this incident had an affective feeling, presumably based on her concepts about crime and skin color, and made a mental inference that the man outside the window had intent to commit a crime.

I couldn't stop thinking about it on the trip home. I thought about Herbert, about how desperately he wanted the American flag he earned through his military service in Vietnam. I thought about his family and about the victim's family and the tragedy the crime created for them. I thought about the visitation officer, the Department of Corrections officials, the men who were paid to shave Herbert's body so that he could be killed more efficiently. I thought about the officers who had strapped him into the chair. I kept thinking that no one could actually believe this was a good thing to do or even a necessary thing to do. The next day there were articles in the press about the execution. Some state officials expressed happiness and excitement that an execution had taken place, but I knew that none of them had actually dealt with the details of killing Herbert. In debates about the death penalty, I had started arguing that we would never think it was humane to pay someone to rape people convicted of rape or assault and abuse someone guilty of assault or abuse. Yet we were comfortable killing people who kill, in part because we think we can do it in a matter that doesn't implicate our own humanity, the way that raping or abusing someone would. I couldn't stop thinking that we don't spend much time contemplating the details of what killing someone actually involves.

The critical point is that thousands of people are swept into the criminal justice system every year pursuant to the drug war without much regard for their guilt or innocence. The police are allowed by the courts to conduct fishing expeditions for drugs on streets and freeways based on nothing more than a hunch. Homes may be searched for drugs based on a tip from an unreliable, confidential informant who is trading the information for money or to escape prison time. And once swept inside the system, people are often denied attorneys or meaningful representation and pressured into plea bargains by the threat of unbelievably harsh sentences—sentences for minor drug crimes that are higher than many countries impose on convicted murderers. This is the way the roundup works, and it works this way in virtually every major city in the United States.

But just as the murderer can’t claim credit for all of the people he didn’t kill, Turner was no less a rapist for all of the women he didn’t violate. And when there is one victim, it must be said: there are often others. So his father’s estimated ratio may have been on the low side. 11

And, no, you can’t see their names or read about their crimes. A year before the 1996 presidential election, the Clinton White House worked feverishly to naturalize 1 million immigrants in time for Clinton’s reelection. Criminal background checks were jettisoned for 200,000 applicants, so that citizenship was granted to at least 70,000 people with FBI criminal records and 10,000 with felony records.2 Murderers, robbers, and rapists were all made our fellow Americans so the Democrats would have a million new voters by the 1996 election. In 2013 alone, the Obama administration released 36,007 convicted criminal aliens with about 88,000 convictions among them—including 426 for rape and 193 for murder.3 They’ll soon be your fellow citizens, too.

The results indicate that the ventromedial prefrontal cortex, implicated in the feeling of compassion, may be the foundation for moral regulations, assisting us in inhibiting (or not) harmful treatment of others. Failure in its development, or damage to it, might alter the way a person perceives the moral landscape, which will thus affect his or her actions. If juries include information of this kind in their deliberations, it could mitigate the harshness of the sentences they impose on convicted criminals. While more research must be done, other types of brain scans are being entered as evidence in the trials of some heinous crimes to show that the perpetrator could not help what he did.

How the jury responds to a victim is an enormous percentage of the verdict in any sex crimes trial–which is why prosecutors want Good Victims. In New York City, Good Victims have jobs (like stockbroker or accountant) or impeccable status (like a policeman’s wife); are well educated and articulate, and are, above all, presentable to a jury; attractive–but not too attractive, demure–but not pushovers. They should be upset–but in good taste–not so upset that they become hysterical. And they must have 100 percent trust and faith in the prosecutor, so that whatever the ADA decides to do with the case is fine with them. The criteria for a Good Victim varies with locale. In the Bible Belt, for example, the profile would be a “Christian Woman.” But the general principle remains the same. Such attitudes are not only distasteful, they are also frightening. They say that it’s O.K. to rape some people–just not us. Old-time convicts spell justice “just us”–prosecutors aren’t supposed to. Sex-crimes prosecutors are supposed to understand that the only way to keep the wolf from our own door isn’t to throw him fresh meat but to stop him the first time he darkens anybody’s door.

The genius of the current caste system, and what most distinguishes it from its predecessors, is that it appears voluntary. People choose to commit crimes, and that’s why they are locked up or locked out, we are told. This feature makes the politics of responsibility particularly tempting, as it appears the system can be avoided with good behavior. But herein lies the trap. All people make mistakes. All of us are sinners. All of us are criminals. All of us violate the law at some point in our lives. In fact, if the worst thing you have ever done is speed ten miles over the speed limit on the freeway, you have put yourself and others at more risk of harm than someone smoking marijuana in the privacy of his or her living room. Yet there are people in the United States serving life sentences for first-time drug offenses, something virtually unheard of anywhere else in the world. The notion that a vast gulf exists between “criminals” and those of us who have never served time in prison is a fiction created by the racial ideology that birthed mass incarceration, namely that there is something fundamentally wrong and morally inferior about “them.” The reality, though, is that all of us have done wrong. As noted earlier, studies suggest that most Americans violate drug laws in their lifetime. Indeed, most of us break the law not once but repeatedly throughout our lives. Yet only some of us will be arrested, charged, convicted of a crime, branded a criminal or felon, and ushered into a permanent undercaste. Who becomes a social pariah and excommunicated from civil society and who trots off to college bears scant relationship to the morality of crimes committed. Who is more blameworthy: the young black kid who hustles on the street corner, selling weed to help his momma pay the rent? Or the college kid who deals drugs out of his dorm room so that he’ll have cash to finance his spring break? Who should we fear? The kid in the ’hood who joined a gang and now carries a gun for security, because his neighborhood is frightening and unsafe? Or the suburban high school student who has a drinking problem but keeps getting behind the wheel? Our racially biased system of mass incarceration exploits the fact that all people break the law and make mistakes at various points in their lives and with varying degrees of justification. Screwing up—failing to live by one’s highest ideals and values—is part of what makes us human.

But Lord Bacon did not despair, and claimed one instance of a fingerpost which points in one direction only, and allows of no other possibility. The perfectly independent eyewitness, who has nothing to gain from his revelation, who is, in addition, schooled in observation and report through a gentlemanly status and education, this is the nearest we can get to a reliable witness and his testimony may be said to be conclusive, overwhelming all lesser forms.

Scrolling through the rest of the 3,500 documents in Michelle’s hard drive, one comes upon a file titled “RecentDNAresults,” which features the EAR’s Y-STR markers (short tandem repeats on the Y chromosome that establish male-line ancestry), including the elusive rare PGM marker. Having the Golden State Killer’s DNA was always the one ace up this investigation’s sleeve. But a killer’s DNA is only as good as the databases we can compare it to. There was no match in CODIS. And there was no match in the California penal system’s Y-STR database. If the killer’s father, brothers, or uncles had been convicted of a felony in the past sixteen years, an alert would have gone to Paul Holes or Erika Hutchcraft (the current lead investigator in Orange County). They would have looked into the man’s family, zeroed in on a member who was in the area of the crimes, and launched an investigation. But they had nothing. There are public databases that the DNA profile could be used to match, filled not with convicted criminals but with genealogical buffs. You can enter the STR markers on the Y chromosome of the killer into these public databases and try to find a match, or at least a surname that could help you with the search.

In this march through a virtual lifetime, we’ve visited school and college, the courts and the workplace, even the voting booth. Along the way, we’ve witnessed the destruction caused by WMDs. Promising efficiency and fairness, they distort higher education, drive up debt, spur mass incarceration, pummel the poor at nearly every juncture, and undermine democracy. It might seem like the logical response is to disarm these weapons, one by one. The problem is that they’re feeding on each other. Poor people are more likely to have bad credit and live in high-crime neighborhoods, surrounded by other poor people. Once the dark universe of WMDs digests that data, it showers them with predatory ads for subprime loans or for-profit schools. It sends more police to arrest them, and when they’re convicted it sentences them to longer terms. This data feeds into other WMDs, which score the same people as high risks or easy targets and proceed to block them from jobs, while jacking up their rates for mortgages, car loans, and every kind of insurance imaginable. This drives their credit rating down further, creating nothing less than a death spiral of modeling. Being poor in a world of WMDs is getting more and more dangerous and expensive.

The extraordinary increase in prison admissions due to parole and probation violations is due almost entirely to the War on Drugs. With respect to parole, in 1980, only 1 percent of all prison admissions were parole violators. Twenty years later, more than one third (35 percent) of prison admissions resulted from parole violations. To put the matter more starkly: About as many people were returned to prison for parole violations in 2000 as were admitted to prison in 1980 for all reasons. Of all parole violators returned to prison in 2000, only one-third were returned for a new conviction; two-thirds were returned for a technical violation such as missing appointments with a parole officer, failing to maintain employment, or failing a drug test. In this system of control, failing to cope well with one's exile status is treated like a crime. If you fail, after being released from prison with a criminal record - your personal badge of inferiority - to remain drug free, or if you fail to get a job against all the odds, or if you get depressed and miss an appointment with your parole officer (or if you cannot afford the bus fare to take you there), you can sent right back to prison - where society apparently thinks millions of Americans belong.

With this hard truth in mind, I venture to suggest that the corpus of English and American laws--for the two arise for the most part from a common root of belief and experience--cannot endure forever unless it is animated by the spirit that moved it in the beginning: that is, by religion, and specifically by the Christian people. Certain moral postulates of Christian teaching have been taken for granted, in the past, as the ground of justice. When courts of law ignore those postulates, we grope in judicial darkness. . . . We suffer from a strong movement to exclude such religious beliefs from the operation of courts of law, and to discriminate against those unenlightened who cling fondly to the superstitions of the childhood of the race. Many moral beliefs, however, though sustained by religious convictions, may not be readily susceptible of "scientific" demonstration. After all, our abhorrence of murder, rape, and other crimes may be traced back to the Decalogue and other religious injunctions. If it can be shown that our opposition to such offenses is rooted in religion, then are restraints upon murder and rape unconstitutional? We arrive at such absurdities if we attempt to erect a wall of separation between the operation of the laws and those Christian moral convictions that move most Americans. If we are to try to sustain some connection between Christian teaching and the laws of this land of ours, we must understand the character of that link. We must claim neither too much nor too little for the influence of Christian belief upon our structure of law. . . . I am suggesting that Christian faith and reason have been underestimated in an age bestridden, successively, by the vulgarized notions of the rationalists, the Darwinians, and the Freudians. Yet I am not contending that the laws ever have been the Christian word made flesh nor that they can ever be. . . . What Christianity (or any other religion) confers is not a code of positive laws, but instead some general understanding of justice, the human condition being what it is. . . . In short, judges cannot well be metaphysicians--not in the execution of their duties upon the bench, at any rate, even though the majority upon the Supreme Court of this land, and judges in inferior courts, seem often to have mistaken themselves for original moral philosophers during the past quarter century. The law that judges mete out is the product of statute, convention, and precedent. Yet behind statute, convention, and precedent may be discerned, if mistily, the forms of Christian doctrines, by which statute and convention and precedent are much influenced--or once were so influenced. An original inspiration had flowed from small-scale shipments of Portuguese children to its Asian colonies before the Dutch supplanted the Portuguese as the world's premier long-range shippers. Vagrant minors, kidnapped persons, convicts, and indentured servants from the British Isles might labor under differing names in law and for longer or shorter terms in the Americas, but the harshness of their lives dictated that they be, in the worlds of Daniel Defoe, "more properly called slaves." First in Barbados, then in Jamaica, then in North America, notably in Virginia, Maryland, and Pennsylvania, bound Britons, Scots, and Irish furnished a crucial workforce in the Americas in the seventeenth and eighteenth centuries. In 1618, the City of London and the Virginia Company forged an agreement to transport vagrant children. London would pay £5 per head to the company for shipment on the Duty, hence the children's sobriquet "Duty boys." Supposedly bound for apprenticeship, these homeless children—a quarter of them girls—were then sold into field labor for twenty pounds of tobacco each.

But we should do no such thing. Instead, when a young man who was born in the ghetto and who knows little of life beyond the walls of his prison cell and the invisible cage that has become his life, turns to us in bewilderment and rage, we should do nothing more than look him in the eye and tell him the truth. We should tell him the same truth the great African American writer James Baldwin told his nephew in a letter published in 1962, in one of the most extraordinary books ever written, The Fire Next Time. With great passion and searing conviction, Baldwin had this to say to his young nephew: This is the crime of which I accuse my country and my countrymen, and for which neither I nor time nor history will ever forgive them, that they have destroyed and are destroying hundreds of thousands of lives and do not know it and do not want to know it …. It is their innocence which constitutes the crime …. This innocent country set you down in a ghetto in which, in fact, it intended that you should perish. The limits of your ambition were, thus, expected to be set forever. You were born into a society which spelled out with brutal clarity, and in as many ways as possible, that you were a worthless human being. In any discussion of serial killers, a few notorious names—those of the most prolific killers—always get mentioned. Ted Bundy admitted to killing thirty women, but it could well have been more. Gary Ridgeway, also known as the Green River Killer, was convicted of murdering forty-eight, but later confessed to others. John Wayne Gacy was convicted of killing thirty-three people. Jeffrey Dahmer was convicted of murdering and partially ingesting fifteen people. David Berkowitz, New York City’s “Son of Sam,” shot and killed six people. Less well known but significant are Dennis Rader, who killed ten people in Wichita, Kansas, and Aileen Wuornos, portrayed by Charlize Theron in the film Monster, who killed six men. Wayne Williams was convicted of killing only two men, but he is believed to have killed anywhere from twenty-three to twenty-nine children in Atlanta. Robert Hansen confessed to four murders but is suspected of more than seventeen. Juan Corona was convicted of murdering twenty-five people. Their crimes are all horrific, and the number of victims is heartbreaking. But all these most notorious serial killers stand in the shadow of Dr. Kermit Gosnell. Strangely, Gosnell appears in no list we have found of known U.S. serial killers, though he is the biggest of them all. In reality, Kermit Gosnell deserves the top spot on any list of serial murderers. He’s earned it.

In October 2004, seven Milwaukee police officers sadistically beat Frank Jude Jr. outside an off-duty police party. The Journal Sentinel newspaper in Milwaukee investigated the crime and published photos of Jude taken right after the beating. The officers were convicted, and some reforms were put in place. But the city saw an unexpected side effect. Calls to 911 dropped dramatically—twenty-two thousand less than the previous year. You know what did rise? The number of homicides—eighty-seven in the six months after the photos were published, a seven-year high. That information comes from a 2016 study done by Matthew Desmond, an associate social sciences professor at Harvard University and New York Times bestselling author of Evicted. He told the Journal Sentinel that a case like Jude’s “tears the fabric apart so deeply and delegitimizes the criminal justice system in the eyes of the African-American community that they stop relying on it in significant numbers.” With shootings of unarmed civilians being captured on cell phones and shared on the internet, the distrust of the police is not relegated to that local community. The stories of the high-profile wrongful death cases of Tamir Rice in Cleveland or Eric Brown in New York spread fast across the country. We were in a worse place than we were twenty years earlier, when the vicious police officer beating of Rodney King went unpunished and Los Angeles went up in flames. As I see it, the War on Drugs—more than any other government program or political initiative—gave rise to mass incarceration as defined above. Although the political dynamics that gave birth to the system date back to slavery, the drug war marked an important turning point in American history, one that cannot be measured simply by counting heads in prisons and jails. The declaration and escalation of the War on Drugs marked a moment in our past when a group of people defined by race and class was viewed and treated as the “enemy.” A literal war was declared on a highly vulnerable population, leading to a wave of punitiveness that permeated every aspect of our criminal justice system and redefined the scope of fundamental constitutional rights. The war mentality resulted in the militarization of local police departments and billions invested in drug law enforcement at the state and local levels. It also contributed to astronomical expenditures for prison building for people convicted of all crimes and the slashing of billions from education, public housing and welfare programs, as well as a slew of legislation authorizing legal discrimination against millions of people accused of drug offenses, denying them access to housing, food stamps, credit, basic public benefits, and financial aid for schooling. This war did not merely increase the number of people in prisons and jails. It radically altered the life course of millions, especially black men who were the primary targets in the early decades of the war. Their lives and families were destroyed for drug crimes that were largely ignored on the other side of town. Our belief is not a belief. Our principles are not a faith. We do not rely solely upon science and reason, because these are necessary rather than sufficient factors, but we distrust anything that contradicts science or outrages reason. We may differ on many things, but what we respect is free inquiry, openmindedness, and the pursuit of ideas for their own sake. We do not hold our convictions dogmatically: the disagreement between Professor Stephen Jay Gould and Professor Richard Dawkins, concerning “punctuated evolution” and the unfilled gaps in post-Darwinian theory, is quite wide as well as quite deep, but we shall resolve it by evidence and reasoning and not by mutual excommunication. (My own annoyance at Professor Dawkins and Daniel Dennett, for their cringe-making proposal that atheists should conceitedly nominate themselves to be called “brights,” is a part of a continuous argument.) We are not immune to the lure of wonder and mystery and awe: we have music and art and literature, and find that the serious ethical dilemmas are better handled by Shakespeare and Tolstoy and Schiller and Dostoyevsky and George Eliot than in the mythical morality tales of the holy books. Literature, not scripture, sustains the mind and—since there is no other metaphor—also the soul. We do not believe in heaven or hell, yet no statistic will ever find that without these blandishments and threats we commit more crimes of greed or violence than the faithful. (In fact, if a proper statistical inquiry could ever be made, I am sure the evidence would be the other way.) We are reconciled to living only once, except through our children, for whom we are perfectly happy to notice that we must make way, and room. We speculate that it is at least possible that, once people accepted the fact of their short and struggling lives, they might behave better toward each other and not worse. But nothing in my previous work had prepared me for the experience of reinvestigating Cleveland. It is worth — given the passage of time — recalling the basic architecture of the Crisis: 121 children from many different and largely unrelated families had been taken into the care of Cleveland County Council in the three short months of the summer of 1987. (p18) The key to resolving the puzzle of Cleveland was the children. What had actually happened to them? Had they been abused - or had the paediatricians and social workers (as public opinion held) been over-zealous and plain wrong? Curiously — particularly given its high profile, year-long sittings and £5 million cost — this was the one central issue never addressed by the Butler-Sloss judicial testimony and sifting of internal evidence, the inquiry's remit did not require it to answer the main question. Ten years after the crisis, my colleagues and I set about reconstructing the records of the 121 children at its heart to determine exactly what had happened to them... (p19) Eventually, though, we did assemble the data given to the Butler-Sloss Inquiry. This divided into two categories: the confidential material, presented in camera, and the transcripts of public sessions of the hearings. Putting the two together we assembled our own database on the children each identified only by the code-letters assigned to them by Butler-Sloss. When it was finished, this database told a startlingly different story from the public myth. In every case there was some prima fade evidence to suggest the possibility of abuse. Far from the media fiction of parents taking their children to Middlesbrough General Hospital for a tummy ache or a sore thumb and suddenly being presented with a diagnosis of child sexual abuse, the true story was of families known to social services for months or years, histories of physical and sexual abuse of siblings and of prior discussions with parents about these concerns. In several of the cases the children themselves had made detailed disclosures of abuse; many of the pre-verbal children displayed severe emotional or behavioural symptoms consistent with sexual abuse. There were even some families in which a convicted sex offender had moved in with mother and children. (p20)

In a sample of 125 Canadians convicted of homicide, 27% scored as psychopaths with the recommended cutoff on a standard scale (Woodworth and Porter, 2002; see also Haritos-Fatouros, 1995). However, in a broad stratified sample of 496 prisoners in England and Wales convicted of many offenses, violent and non-violent, Coid et al. (2009b) found that only 7.7% of men and 1.9% of women scored above the standard cutoff for psychopathy, and among all prisoners there was no correlation between psychopathy and any particular type of crime; psychopathy scores were not specifically associated with violent crimes. In a study of 416 German prisoners, 7% were categorized as psychopaths; just 8.8% of the 217 convicted of violent offenses were categorized as psychopaths (Ullrich et al., 2003). In an Iranian stratified sample of 351 prisoners, just 12% of violent offenders met the usual criterion of psychopathy; percentages of psychopaths among those convicted of other types of crime were the same or higher (Assadi et al., 2006). Given that the prevalence of psychopathy in the general population is estimated (with great uncertainty) at less than 1% (Coid et al., 2009a), it is clear that psychopaths commit far more than their share of violent crimes, but most crimes are not committed by psychopaths, nor do psychopaths perpetrate most violence of other kinds. Two cohort studies confirm this. In Finland from 1984 to 1991, 97% of 1,037 homicides were “solved,” and the court required a psychiatric evaluation by a neutral expert if it deemed that there was any possibility that the crime had been affected by a mental disorder, so 70% of the accused were examined. Men with antisocial personality disorder committed 11% of all homicides committed by men; women with antisocial personality disorder committed 13% of all homicides committed by women (Eronen et al., 1996). Men and women with all personality disorders combined committed 34% and 36% of homicides, respectively; alcoholics committed a similar proportion. More generally, mental disorders of all kinds together account for only a small minority of crimes. In a national cohort of all Danes, the 2.2% of men who were ever hospitalized for a mental disorder committed 10% of all violent crimes by males for which convictions were registered; for the 2.6% of women ever hospitalized, it was 16% of all violent crimes (Brennan et al., 2000).

For millennia, sages have proclaimed how outer beauty reflects inner goodness. While we may no longer openly claim that, beauty-is-good still holds sway unconsciously; attractive people are judged to be more honest, intelligent, and competent; are more likely to be elected or hired, and with higher salaries; are less likely to be convicted of crimes, then getting shorter sentences. Jeez, can’t the brain distinguish beauty from goodness? Not especially. In three different studies, subjects in brain scanners alternated between rating the beauty of something (e.g., faces) or the goodness of some behavior. Both types of assessments activated the same region (the orbitofrontal cortex, or OFC); the more beautiful or good, the more OFC activation (and the less insula activation). It’s as if irrelevant emotions about beauty gum up cerebral contemplation of the scales of justice. Which was shown in another study—moral judgments were no longer colored by aesthetics after temporary inhibition of a part of the PFC that funnels information about emotions into the frontal cortex.[*] “Interesting,” the subject is told. “Last week, you sent that other person to prison for life. But just now, when looking at this other person who had done the same thing, you voted for them for Congress—how come?” And the answer isn’t “Murder is definitely bad, but OMG, those eyes are like deep, limpid pools.” Where did the intent behind the decision come from? The fact that the brain hasn’t had enough time yet to evolve separate circuits for evaluating morality and aesthetics.[6] Next, want to make someone more likely to choose to clean their hands? Have them describe something crummy and unethical they’ve done. Afterward, they’re more likely to wash their hands or reach for hand sanitizer than if they’d been recounting something ethically neutral they’d done. Subjects instructed to lie about something rate cleansing (but not noncleansing) products as more desirable than do those instructed to be honest. Another study showed remarkable somatic specificity, where lying orally (via voice mail) increased the desire for mouthwash, while lying by hand (via email) made hand sanitizers more desirable. One neuroimaging study showed that when lying by voice mail boosts preference for mouthwash, a different part of the sensory cortex activates than when lying by email boosts the appeal of hand sanitizers. Neurons believing, literally, that your mouth or hand, respectively, is dirty.

INTERNATIONAL LAW WAS CREATED DURING THE BUSH ADMINISTRATION BECAUSE a group of Mexicans—and one African American—gang-raped and murdered two teenaged girls in Houston, Texas.1 The crime made history in another way: It led to the most death sentences handed out for a single crime in Texas since 1949.2 Do you even know about this case? The only reason the media eventually admitted that the lead rapist, Jose Ernesto Medellin, was an illegal alien from Mexico was to try to overturn his conviction on the grounds that he had not been informed of his right, as a Mexican citizen, to confer with the Mexican consulate. Journalists have an irritating tendency to skimp on detail when reporting crimes by immigrants, a practice that will not be followed here. One summer night in June 1993, fourteen-year-old Jennifer Ertman and Elizabeth Peña, who had just turned sixteen, were returning from a pool party, and decided to take a shortcut through a park to make their 11:30 p.m. curfew. They encountered a group of Hispanic men, who were in the process of discussing “gang etiquette,” such as not complaining if other members talked about having sex with your mother.3 The girls ran away, but Medellin grabbed Jennifer and began ripping her clothes off. Hearing her screams, Elizabeth came back to help her friend. For more than an hour, the five Hispanics and one black man raped the teens, vaginally, anally, and orally—“every way you can assault a human being,” as the prosecutor put it.4 The girls were beaten, kicked, and stomped, their teeth knocked out and their ribs broken. One of the Hispanic men told Medellin’s fourteen-year-old brother to “get some,” so he raped one of the girls, too. But when it was time to kill the girls, Medellin said his brother was “too small to watch” and dragged the girls into the woods.5 There, the girls were forced to kneel on the ground and a belt or shoelace was looped around their necks. Then a man on each side pulled on the cord as hard as he could. The men strangling Jennifer pulled so hard they broke the belt. Medellin later complained that “the bitch wouldn’t die.” When it was done, he repeatedly stomped on the girls’ necks, to make sure they were dead.6 At trial, Medellin’s sister-in-law testified that shortly after the gruesome murders, Medellin was laughing about it, saying they’d “had some fun with some girls” and boasting that he had “virgin blood” on his underpants.7 It’s difficult to understand a culture where such an orgy of cruelty is bragged about at all, but especially in front of women.

Unable to understand how or why the person we see behaves as he does, we attribute his behavior to a person we cannot see, whose behavior we cannot explain either but about whom we are not inclined to ask questions. We probably adopt this strategy not so much because of any lack of interest or power but because of a longstanding conviction that for much of human behavior there are no relevant antecedents. The function of the inner man is to provide an explanation which will not be explained in turn. Explanation stops with him. He is not a mediator between past history and current behavior, he is a center from which behavior emanates. He initiates, originates, and creates, and in doing so he remains, as he was for the Greeks, divine. We say that he is autonomous—and, so far as a science of behavior is concerned, that means miraculous. The position is, of course, vulnerable. Autonomous man serves to explain only the things we are not yet able to explain in other ways. His existence depends upon our ignorance, and he naturally loses status as we come to know more about behavior. The task of a scientific analysis is to explain how the behavior of a person as a physical system is related to the conditions under which the human species evolved and the conditions under which the individual lives. Unless there is indeed some capricious or creative intervention, these events must be related, and no intervention is in fact needed. The contingencies of survival responsible for man’s genetic endowment would produce tendencies to act aggressively, not feelings of aggression. The punishment of sexual behavior changes sexual behavior, and any feelings which may arise are at best by-products. Our age is not suffering from anxiety but from the accidents, crimes, wars, and other dangerous and painful things to which people are so often exposed. Young people drop out of school, refuse to get jobs, and associate only with others of their own age not because they feel alienated but because of defective social environments in homes, schools, factories, and elsewhere. We can follow the path taken by physics and biology by turning directly to the relation between behavior and the environment and neglecting supposed mediating states of mind. Physics did not advance by looking more closely at the jubilance of a falling body, or biology by looking at the nature of vital spirits, and we do not need to try to discover what personalities, states of mind, feelings, traits of character, plans, purposes, intentions, or the other perquisites of autonomous man really are in order to get on with a scientific analysis of behavior.

He yearned to have the courage to emerge, to discover his bravery that would sever this spiral of sensations of oppression. Being a victim made him a slave to his opponent—as his adversaries have full leverage against him. Life has become a thread of light, which he longed to be liberated from its shackles. His demon—a voice that keeps blaming him for his crimes in the back of his mind—a glass that continually cracks in his heart—will keep breaking him if he does not devise a way out of this crisis. He was conscious by his innermost conviction that there was candlelight with a key that had the potential to illuminate a new chapter that will erase this trail of obscurity behind him. He sees a new horizon with greater comprehension, a journey that can give him the roses of affection than a handful of dead birds that his adversaries handed him along the way. The stunning blossoming trees did have a forest—beautiful greenery that was colorful like the rainbow in the Heavens. A famous British writer is revealed to be the author of an obscure mystery novel. An immigrant is granted asylum when authorities verify he wrote anonymous articles critical of his home country. And a man is convicted of murder when he’s connected to messages painted at the crime scene. The common element in these seemingly disparate cases is “forensic linguistics”—an investigative technique that helps experts determine authorship by identifying quirks in a writer’s style. Advances in computer technology can now parse text with ever-finer accuracy. Consider the recent outing of Harry Potter author J.K. Rowling as the writer of The Cuckoo’s Calling , a crime novel she published under the pen name Robert Galbraith. England’s Sunday Times , responding to an anonymous tip that Rowling was the book’s real author, hired Duquesne University’s Patrick Juola to analyze the text of Cuckoo , using software that he had spent over a decade refining. One of Juola’s tests examined sequences of adjacent words, while another zoomed in on sequences of characters; a third test tallied the most common words, while a fourth examined the author’s preference for long or short words. Juola wound up with a linguistic fingerprint—hard data on the author’s stylistic quirks. He then ran the same tests on four other books: The Casual Vacancy , Rowling’s first post-Harry Potter novel, plus three stylistically similar crime novels by other female writers. Juola concluded that Rowling was the most likely author of The Cuckoo’s Calling , since she was the only one whose writing style showed up as the closest or second-closest match in each of the tests. After consulting an Oxford linguist and receiving a concurring opinion, the newspaper confronted Rowling, who confessed. Juola completed his analysis in about half an hour. By contrast, in the early 1960s, it had taken a team of two statisticians—using what was then a state-of-the-art, high-speed computer at MIT—three years to complete a project to reveal who wrote 12 unsigned Federalist Papers. Robert Leonard, who heads the forensic linguistics program at Hofstra University, has also made a career out of determining authorship. Certified to serve as an expert witness in 13 states, he has presented evidence in cases such as that of Christopher Coleman, who was arrested in 2009 for murdering his family in Waterloo, Illinois. Leonard testified that Coleman’s writing style matched threats spray-painted at his family’s home (photo, left). Coleman was convicted and is serving a life sentence.
