First, it’s just complex enough to disguise the fact that it’s formulaic. Second, it’s useful for highlighting an argument by drawing a clear contrast. Third, it’s quite poppy, in the Swedish songwriting sense, building a hook around two elements—A and B—and inverting them to give listeners immediate gratification and meaning. In theory, Supreme Court justices don’t “make law” when exercising these powers; instead, they’re supposed to merely “interpret” the Constitution, helping to bridge how its provisions were understood by the framers and how they apply to the world we live in today. For the bulk of constitutional cases coming before the Court, the theory holds up pretty well. Justices have for the most part felt bound by the text of the Constitution and precedents set by earlier courts, even when doing so results in an outcome they don’t personally agree with. Throughout American history, though, the most important cases have involved deciphering the meaning of phrases like “due process,” “privileges and immunities,” “equal protection,” or “establishment of religion”—terms so vague that it’s doubtful any two Founding Fathers agreed on exactly what they meant. This ambiguity gives individual justices all kinds of room to “interpret” in ways that reflect their moral judgments, political preferences, biases, and fears. Huang, who used to work for the Lippo Group, an Indonesian conglomerate, set up a fundraising scheme for foreign businessmen seeking special favors from the U.S. government to meet with Clinton, in exchange for large sums of money. In fact, many of our progressive allies believed that we hadn’t been partisan enough. Over the years, that trust proved difficult to sustain. In particular, the fault line of race strained it mightily. Accepting that African Americans and other minority groups might need extra help from the government—that their specific hardships could be traced to a brutal history of discrimination rather than immutable characteristics or individual choices—required a level of empathy, of fellow feeling, that many white voters found difficult to muster. Historically, programs designed to help racial minorities, from “forty acres and a mule” to affirmative action, were met with open hostility. Even universal programs that enjoyed broad support—like public education or public sector employment—had a funny way of becoming controversial once Black and brown people were included as beneficiaries.

I hope that the [Smithsonian National Museum of African American History & Culture] never retreats from embracing controversy and, no matter how multifaceted or incendiary the issue, NMAAHC will strive to help the public find contextualization and common ground in a safe and civil environment. I trust that the museum will always be a bully pulpit where boldness and innovation are more than just words. And to use that platform to combat the creeping sense of selective historical amnesia that limits America's ability to understand its past, and itself. I hope that NMAAHC will always celebrate its diverse staff in ways that nurture, protect, and challenge. And it is my hope that the museum will prod and remind other cultural entities, both within and outside of the Smithsonian, that the ultimate goal is to make a people, make a country better.

Could the sitting vice president campaign against such a major piece of the president’s second-term agenda, even if it was unpopular with the Democratic base? Probably not, her aides thought. But Sullivan wanted her to embrace TPP on a national security basis—specifically that it would create powerful alliances between the United States and a number of countries in China’s sphere of influence—and he thought she could avoid a flip-flop label by doing that.

In one notable incident, the feminism and pop culture blog Jezebel publicly called out a dozen teenagers who tweeted racist remarks after Barack Obama’s reelection. The site went beyond posting the tweets by researching the students, writing short bios for each, and contacting their schools. While the students’ conduct was abhorrent, they were minors, and the manner in which Jezebel went about publicizing their own behavior offered the impression that the act was more about allowing Jezebel to grandstand as a moral authority and to rack up page views based on the resulting controversy. Jezebel could as easily have contacted the students’ schools—the kind of institution of authority that might be able to positively influence the children’s behavior, or, perhaps, enact some punishment in concert with the children’s families—and written a story about the experience while also keeping the students anonymous. Instead, the site ensured that, for many of these students, they would spend years trying to scrub the Internet of their bad behavior, while likely nursing a (perhaps understandable) grievance toward Jezebel, rather than reforming their own racist attitudes. It’s easy to forgo self-examination when you, too, feel like a victim.
