They will be able to resort to “the privacy defense” also, especially if they are inventive enough to include, among their abuses, the abuse of the opposite sex. And they will only be impeachable by their own congressional supporters, since criticism from across the aisle will be automatically subjected to reverse impeachment as “partisan.” This is the tawdry legacy of a sub-Camelot court, where unchecked greed, thuggery, and egotism were allowed to operate just above the law, and well beneath contempt.

Psychological experiments have given us some stunning demonstrations, which should worry any jurist inclined to give superior weight to ‘eye-witness’ evidence. A famous example was prepared by Professor Daniel J. Simons at the University of Illinois. Half a dozen young people standing in a circle were filmed for 25 seconds tossing a pair of basketballs to each other, and we, the experimental subjects, watch the film. The players weave in and out of the circle and change places as they pass and bounce the balls, so the scene is quite actively complicated. Before being shown the film, we are told that we have a task to perform, to test our powers of observation. We have to count the total number of times balls are passed from person to person. At the end of the test, the counts are duly written down, but – little does the audience know – this is not the real test! After showing the film and collecting the counts, the experimenter drops his bombshell. ‘And how many of you saw the gorilla?’ The majority of the audience looks baffled: blank. The experimenter then replays the film, but this time tells the audience to watch in a relaxed fashion without trying to count anything. Amazingly, nine seconds into the film, a man in a gorilla suit strolls nonchalantly to the centre of the circle of players, pauses to face the camera, thumps his chest as if in belligerent contempt for eye-witness evidence, and then strolls off with the same insouciance as before (see colour page 8). He is there in full view for nine whole seconds – more than one-third of the film – and yet the majority of the witnesses never see him. They would swear an oath in a court of law that no man in a gorilla suit was present, and they would swear that they had been watching with more than usually acute concentration for the whole 25 seconds, precisely because they were counting ball-passes. Many experiments along these lines have been performed, with similar results, and with similar reactions of stupefied disbelief when the audience is finally shown the truth. Eye-witness testimony, ‘actual observation’, ‘a datum of experience’ – all are, or at least can be, hopelessly unreliable. It is, of course, exactly this unreliability among observers that stage conjurors exploit with their techniques of deliberate distraction.

The second aspect of the moral appeal of the inner-child movement is consolation. Life is full of setbacks. People we love reject us. We don't get the jobs we want. We get bad grades. Our children don't need us anymore. We drink too much. We have no money. We are mediocre. We lose. We get sick. When we fail, we look for consolation, one form of which is to see the setback as something other than failure-to interpret it in a way that does not hurt as much as failure hurts. Being a victim, blaming someone else, or even blaming the system is a powerful and increasingly widespread form of consolation. It softens many of life's blows. Such shifts of blame have a glorious past. Alcoholics Anonymous made the lives of millions of alcoholics more bearable by giving them the dignity of a “disease” to replace the ignominy of “failure,” “immorality,” or “evil.” Even more important was the civil rights movement. From the Civil War to the early 1950s, black people in America did badly-by every statistic. How did this get explained? “Stupid,” “lazy,” and “immoral” were the words shouted by demagogues or whispered by the white gentry. Nineteen fifty-four marks the year when these explanations began to lose their power. In Brown v. Board of Education, the Supreme Court held that racial segregation in schools was illegal. People began to explain black failure as “inadequate education,” “discrimination,” and “unequal opportunity.” These new explanations are literally uplifting. In technical terms, the old explanations—stupidity and laziness—are personal, permanent, and pervasive. They lower self-esteem; they produce passivity, helplessness, and hopelessness. If you were black and you believed them, they were self-fulfilling. The new explanations—discrimination, bad schools, lean opportunities are impersonal, changeable, and less pervasive. They don't deflate self-esteem (in fact, they produce anger instead). They lead to action to change things. They give hope. The recovery movement enlarges on these precedents. Recovery gives you a whole series of new and more consoling explanations for setbacks. Personal troubles, you're told, do not result as feared from your own sloth, insensitivity, selfishness, dishonesty, self-indulgence, stupidity, or lust. No, they stem from the way you were mistreated as a child. You can blame your parents, your brother, your teachers, your minister, as well as your sex and race and age. These kinds of explanations make you feel better. They shift the blame to others, thereby raising self-esteem and feelings of self-worth. They lower guilt and shame. To experience this shift in perspective is like seeing shafts of sunlight slice through the clouds after endless cold, gray days. We have become victims, “survivors” of abuse, rather than “failures” and “losers.” This helps us get along better with others. We are now underdogs, trying to fight our way back from misfortune. In our gentle society, everyone roots for the underdog. No one dares speak ill of victims anymore. The usual wages of failure—contempt and pity—are transmuted into support and compassion. So the inner-child premises are deep in their appeal: They are democratic, they are consoling, they raise our self-esteem, and they gain us new friends. Small wonder so many people in pain espouse them.

The government’s obduracy in this matter clearly reflects its growing shamelessness and brazenness about corruption. It continues to show contempt and apathy to the Supreme Court order, and instead of starting the process of implementing the order, it is focusing on how to get it reviewed, recalled or diluted, including contesting the order and seeking its recall.

Chapter 17 of Deuteronomy, especially verses 8 to 12, appears to state that, in matters of legal and religious controversy, a full inquiry should be conducted and a majority verdict reached, and if any of those involved refuses to accept the decision, he shall be put to death. In a people as argumentative and strong-minded as the Jews, living under the rule of law, this provision, known as the offence of the ‘rebellious elder’, was considered essential to hold society together. Jesus was a learned man; that was why Judas, just before his arrest, called him ‘rabbi’. Hence, when brought before the Sanhedrin – or whatever court it was – he appeared as a rebellious elder; and by refusing to plead, he put himself in contempt of court and so convicted himself of the crime by his silence. No doubt it was the Temple priests and the Shammaite Pharisees, as well as the Sadducees, who felt most menaced by Jesus’ doctrine and wanted him put to death in accordance with scripture. But Jesus could not have been guilty of the crime, at any rate as it was later defined by Maimonides in his Judaic code. In any case it was not clear that the Jews had the right to carry out the death sentence. To dispose of these doubts, Jesus was sent to the Roman procurator Pilate as a state criminal. There was no evidence against him at all on this charge, other than the supposition that men claiming to be the Messiah sooner or later rose in rebellion – Messiah-claimants were usually packed off to the Roman authorities if they became troublesome enough. So Pilate was reluctant to convict but did so for political reasons. Hence Jesus was not stoned to death under Jewish law, but crucified by Rome.91 The circumstances attending Jesus’ trial or trials appear to be irregular, as described in the New Testament gospels.92 But then we possess little information about other trials at this time, and all seem irregular.

Enfranchised by the creation of a popularly elected territorial legislature, they achieved far more power than they ever had under Spanish or even French rule, and they were quick to turn it on the free people of color. In 1806, within three years of American accession, the planter-dominated legislature contained the growth of the free black population, severely circumscribing the rights of slaves to initiate manumission. Thereafter slaves could be freed only by special legislative enactment. That done, the legislature struck at the privileges free people of color had enjoyed under Spanish rule, issuing prohibitions against carrying guns, punishing free black criminals more severely than white ones, and authorizing slaves to testify in court against free blacks but not whites. In an act that represented the very essence of the planters' contempt for people of color, the territorial legislature declared that 'free people of color ought never to insult or strike white people, nor presume to conceive themselves equal to whites, but on the contrary . . . they ought to yield to them on every occasion and never speak or answer them but with respect.' With planters now in control, the free people's position in the society of the lower Mississippi Valley slipped sharply. Claiborne slowly reduced the size of the black militia, first placing it under the control of white officers and then deactiviting it entirely when the territorial legislature refused to recommission it. The free black population continued to grow, but - with limitations on manumission and self-purchase - most of the growth derived from the natural increase and immigration. The dynamism of the final decades of the eighteenth century, when the free black population grew faster than either the white or slave population, dissipated, prosperity declined, and the great thrust toward equality was blunted as the new American ruler turned its back on them. In the years that followed, as white immigrants flowed into the Mississippi Valley and the Gulf ports grew whiter, American administrators found it easier to ignore the free people of color or, worse yet, let the planters have their way. Occasionally, new crises arose, suddenly elevating free people to their old importance. In 1811, when slaves revolted in Pointe Coupee, and in 1815, when the British invaded Louisiana, free colored militiamen took up their traditional role as the handmaiden of the ruling class in hopes that their loyalty would be rewarded. But long-term gains were few. Free people of color were forced to settle for a middling status, above slaves but below whites. The collapse of the free people's struggle for equality cleared the way for the expansion of slavery. The Age of Revolution had threatened slavery in the lower Mississippi Valley, as it had elsewhere on the mainland. Planters parried the thrust with success. As in the Upper and Lower South, African-American slavery grew far more rapidly than freedom in the lower Mississippi Valley during the post-revolutionary years. The planters' westward surge out of the seaboard regions soon connected with their northward movement up the Mississippi Valley to create what would be the heartland of the plantation South in the nineteenth century. As the Age of Revolution receded, the plantation revolution roared ahead, and with it the Second Middle Passage.

The first is what some psychologists call “hot hate,” based on anger. Imagine yourself yelling at the television, and you get the picture. Most Americans would be ashamed to say “I hate Republicans” or “I hate Democrats.” But our market preferences tell the true story. We reward professional political pundits who say or write that the other side is evil or stupid or both. For some haters, the hot variety is a little too crude. They prefer “cool hate,” based on contempt, and express disgust for another person through sarcasm, dismissal or mockery. Cool hate can be every bit as damaging as hot hate. The social psychologist and relationship expert John Gottman was famously able to predict with up to 94 percent accuracy whether couples would divorce just by observing a brief snippet of conversation. The biggest warning signs of all were indications of contempt, such as sarcasm, sneering and hostile humor. Want to see if a couple will end up in divorce court? Watch them discuss a contentious topic — which Mr. Gottman has done thousands of times — and see if either partner rolls his or her eyes. Disagreement is normal, but dismissiveness can be deadly. As it is in love, so it is in politics. With just an ironic smile, one can dismiss an entire class of citizens as uncultured rubes or mindless theocrats. Feigning shock and dismay at the resulting indignation simply adds insult to injury. The last variety is anonymous hate.

In the many different scandals of the Obama administration, from Benghazi to Hillary Clinton’s emails, how has Judicial Watch succeeded so often in exposing the truth when Congress has failed? Part of it is the hard, focused, and dogged work of our investigators and the skill, professionalism, and tenacity of our lawyers, as well as our other staff who help support and run one of the most effective citizens’ groups in the country. But it is also because FOIA is a straightforward tool that quickly gives Judicial Watch access to the federal courts in order to ensure compliance with our record requests to ensure transparency. Congressional investigations, when committees bother to conduct them, are political by nature. Their effectiveness is often hindered by committee members of the political party whose president is in the White House in order to protect the president, their party, and their political allies. Congress today relies on the Justice Department to enforce subpoenas issued by committees that are intended to force executive branch compliance with requests for information and witnesses. With a politicized Justice Department, which has been the hallmark of the Obama administration, there is no effective enforcement of such congressional subpoenas. A sorry example of this is the refusal of the Obama Justice Department to enforce the contempt citation against Lois Lerner for refusing to comply with a subpoena for her testimony before the House Committee investigating the IRS scandal. The administration was not about to go to a judge for an order compelling Lerner to testify and reveal what she knew about the administration’s targeting of conservative organizations.

Despite the refusal of the Obama Justice Department to prosecute anyone at the IRS, it is clear that what happened was an epic clampdown on any conservative voices speaking or advocating against the president’s disastrous policies and in favor of patriotism and adherence to the Constitution and the rule of law. Over the course of twenty-seven months leading up to the 2012 election, not a single Tea Party–type organization received tax-exempt status. Many were unable to operate; others disbanded because donors refused to fund them without the IRS seal of approval; some organizations and their donors were audited without justification; and many incurred legal fees and costs fighting the unlawful conduct by Lerner and other IRS employees. The IRS suppressed the entire Tea Party movement just in time to help Obama win reelection. And everyone in the administration involved in this outrageous conduct got away with it without being punished or prosecuted. Was it simply a case of retribution against the perceived “enemies” of the administration? No, this was much bigger than political payback. It was a systematic and concerted effort to squash the Tea Party movement—one of the most organic and powerful political movements in recent memory—during an election season. [See Appendix for select IRS documents uncovered by Judicial Watch.] This was about campaign politics. It was a scandal for the ages. President Obama obviously wanted this done even if he gave no direct orders for it. In 2015, he told Jon Stewart on The Daily Show that “you don’t want all this money pouring through non-profits.” But there is no law preventing money from “pouring through non-profits” that they use to achieve their legal purposes and the objectives of their members. Who didn’t want this money pouring through nonprofits? Barack Obama. In the subsequent FOIA litigation filed by Judicial Watch, the IRS obstructed and lied to a federal judge and Judicial Watch in an effort to hide the truth about what Lois Lerner and other senior officials had done. The IRS, including its top political appointees like IRS Commissioner John Koskinen and General Counsel William J. Wilkins, have much to answer for over their contempt of court and of Congress. And the Department of Justice lawyers and officials enabling this cover-up in court need to be held accountable as well. If the Tea Party and other conservative groups had been fully active in the critical months leading up to the 2012 election, would Mitt Romney have been elected president? We will, of course, never know for certain. But we do know that President Obama’s Internal Revenue Service targeted right-leaning organizations applying for tax-exempt status and prevented them from entering the fray during that period. That is how you steal an election in plain sight. Accountability is not something we will get from the Obama administration. But Judicial Watch will continue its independent investigation and certainly any new presidential administration should take a fresh look at this IRS scandal.

When Congress passed Obamacare it attempted by statute to confer fundamental legislative powers on the executive branch, and even sought to prohibit future Congresses from altering its unconstitutional act. Specifically, Congress created the fifteen-member Independent Payment Advisory Board (IPAB), which ostensibly is responsible for controlling Medicare costs. The board submits a proposal to Congress, which automatically becomes law, and the Department of Health and Human Services must implement it, unless the proposal is affirmatively blocked by Congress and the president. Even then, it can be stopped only if the elected branches agree on a substitute. Obamacare also attempts to prohibit citizens from challenging the board’s decisions in court. Moreover, Obamacare seeks to tie the hands of future Congresses by forbidding Congress from dissolving the board outside of a seven-month period in 2017, and only by a supermajority three-fifths vote of both houses. If Congress does not act in that time frame, Congress is prohibited from even altering a board proposal.42 Apart from all the rest, the abuse of power by one Congress and president in attempting to reorganize the federal government and redraft fundamentally the Constitution outside of the amendment processes, with the intention of binding all future Congresses in perpetuity and leaving citizens with no political or legal recourse, is simply sinister. But it underscores the Statists’ contempt for the Constitution and self-government.

Deputy Warden asked to speak to the judge at a sidebar and told Tynan that Richard was cursing and yelling and had stated he’d fight before he allowed deputies to bring him into court. Tynan announced that for security reasons, the defendant would sign the waiver on September 5. The jury’s deliberations moved on. On September 5, when Ramirez was led into court, he was subdued. Doreen was in her usual place, her eyes riveted to him. There was not an empty seat in the house. Ramirez signed the waiver form and was taken to the holding pen. The defense had decided to seek a mistrial based on several points: one, the death of Singletary, the other, that the juror who had replaced her, Mary Herrera, had two brothers in law enforcement who’d been shot to death, which she had failed to mention on her initial questionnaire. The judge refused to grant a new trial, court was recessed, and the jury continued its deliberations. On September 14, court was convened because of Arturo Hernandez. He had been ordered to call the court daily but had failed to do so on the sixth through the fourteenth. Judge Tynan found him in contempt and issued a body attachment with $5000 bail. On the eighteenth, Arturo showed up in court. Tynan bawled him out for not calling in as he had agreed to. He didn’t want to hear any excuses, he just wanted to know how Arturo pled. The lawyer said he was guilty. Tynan fined him $2400 or twenty-four days in jail. He gave him until September 24 to come up with the money. The judge then had Arturo remanded to do a day in jail for a September 1 contempt charge.

On May 14, 2008, when Michelle Obama pronounced that “[w]e are going to have to change our conversation; we’re going to have to change our traditions, our history; we’re going to have to move into a different place as a nation,” she meant it.2 The Obamas are not alone among Democrat Party apparatchiks in their contempt for the country.
