Postscript, 2005 From the Publisher ON APRIL 7, 2004, the Mid-Hudson Highland Post carried an article about an appearance that John Gatto made at Highland High School. Headlined “Rendered Speechless,” the report was subtitled “Advocate for education reform brings controversy to Highland.” The article relates the events of March 25 evening of that year when the second half of John Gatto’s presentation was canceled by the School Superintendent, “following complaints from the Highland Teachers Association that the presentation was too controversial.” On the surface, the cancellation was in response to a video presentation that showed some violence. But retired student counselor Paul Jankiewicz begged to differ, pointing out that none of the dozens of students he talked to afterwards were inspired to violence. In his opinion, few people opposing Gatto had seen the video presentation. Rather, “They were taking the lead from the teacher’s union who were upset at the whole tone of the presentation.” He continued, “Mr. Gatto basically told them that they were not serving kids well and that students needed to be told the truth, be given real-life learning experiences, and be responsible for their own education. [Gatto] questioned the validity and relevance of standardized tests, the prison atmosphere of school, and the lack of relevant experience given students.” He added that Gatto also had an important message for parents: “That you have to take control of your children’s education.” Highland High School senior Chris Hart commended the school board for bringing Gatto to speak, and wished that more students had heard his message. Senior Katie Hanley liked the lecture for its “new perspective,” adding that ”it was important because it started a new exchange and got students to think for themselves.” High School junior Qing Guo found Gatto “inspiring.” Highland teacher Aliza Driller-Colangelo was also inspired by Gatto, and commended the “risk-takers,” saying that, following the talk, her class had an exciting exchange about ideas. Concluded Jankiewicz, the students “were eager to discuss the issues raised. Unfortunately, our school did not allow that dialogue to happen, except for a few teachers who had the courage to engage the students.” What was not reported in the newspaper is the fact that the school authorities called the police to intervene and ‘restore the peace’ which, ironically enough, was never in the slightest jeopardy as the student audience was well-behaved and attentive throughout. A scheduled evening meeting at the school between Gatto and the Parents Association was peremptorily forbidden by school district authorities in a final assault on the principles of free speech and free assembly… There could be no better way of demonstrating the lasting importance of John Taylor Gatto’s work, and of this small book, than this sorry tale. In the past twenty years, according to some estimates, the cost to pay legal settlements to those victimized by the clergy was as much as $1.3 billion. Now the meter was running faster. In the case of our current President, Donald John Trump, he abandoned a life of liberal luxury linked to self imposed limited responsibilities for an intensely grueling, veritably non stop two year nightmare of criss crossing this immense Country's varied terrain, both literally and socially when he could have easily maintained his life of liberal leisure. While my assertion that his personal choice was, in my view, sacrificially done for the sake of a great power in a state of rapid decline can be contradicted by saying it was motivated by selfish reasons, all evidence points to the contrary. For knowing the human condition, fraught with a plentitude of weaknesses, for a man in the end portion of his lifetime to sacrifice an easy life for a hard working incessant schedule of thankless tasks it is entirely doubtful that this choice was made devoid of a special and even exalted inspiration to do so. And while the right motivations are pivotal to a President's success, what is also obviously needed are generic and specific political, military and ministerial skills which must be naturally endowed by Our Creator upon the particular President elected for the purposes of advancing a Nation's general well being for one and all. If one looks at the latest National statistics since President Trump took office, (such as our rising GNP, the booming market, the dramatically shrinking unemployment rate, and the overall positive emotive strains in regards to our Nation's future, on both the left and the right) one can make definitive objective conclusions pertaining to the exceptionally noble character and efficiency of the current resident at 1600 Pennsylvania Avenue. And if one can drown out the constant communicative assaults on our current Commander In Chief, and especially if one can honestly assess the remarkable lack of substantial mistakes made by the current President, all of these factors point to a leader who is impressively strong, morally and in other imperative ways. And at the most propitious time. His father wished him deceased, his family exiled him from the warren, he was physically mistreated and preyed on by homophobic mobs in the surrounding community by Elephants—Hyenas—rats. They splashed spit at his face, advising him that God condemns homosexuality—as Christ did not. They would slam him on the pavement with their Bibles, strike him in the stomach with their feet, throw boulders of stone at his body: imploring—abusing—condemning him to a tyrannical sentence. Skiddy Cottontail thought that his existence would end with this case of cruelty—violence—assault that was perpetrated against him. He wanted to cease to exist— he wanted to commit the ultimate murder on himself—he no more desired to go on living— he realized hope is already deceased. He yearned to have the courage to emerge, to discover his bravery that would sever this spiral of sensations of oppression. Being a victim made him a slave to his opponent—as his adversaries have full leverage against him. Life has become a thread of light, which he longed to be liberated from its shackles. His demon—a voice that keeps blaming him for his crimes in the back of his mind—a glass that continually cracks in his heart—will keep breaking him if he does not devise a way out of this crisis. He was conscious by his innermost conviction that there was candlelight with a key that had the potential to illuminate a new chapter that will erase this trail of obscurity behind him. He sees a new horizon with greater comprehension, a journey that can give him the roses of affection than a handful of dead birds that his adversaries handed him along the way. The stunning blossoming trees did have a forest—beautiful greenery that was colorful like the rainbow in the Heavens. This home will embrace him with a warm embrace of open arms, where cruelty is forbidden; where adoration can forever abound. Dawn will know him when he arrives. No more hurricanes or strife will be here—no crying of a sad humanity are here—only a gift of harmony and devotion, beyond all explanation, will abide in the heart of Skiddy Cottontail—when he finds his way out from this opponent world for a beautiful existence that is called liberation. Skiddy Cottontail has found a happiness that can only bring him contentment like nothing in this hurtful world can. An even broader assault on freedom of speech is the modern Warren-Brandeis-inspired tort of invasion of the alleged right of "privacy," which outlaws free speech and acts using one's own property that are not even false or "malicious." In the law of torts, "harm" is generally treated as physical invasion of person or property and usually requires payment of damages for "emotional" harm if and only if that harm is a consequence of physical invasion. Thus, within the standard law of trespass — an invasion of person or property — "battery" is the actual invasion of someone else's body, while "assault" is the creation by one person in another of a fear, or apprehension, of battery. To be a tortious assault and therefore subject to legal action, tort law wisely requires the threat to be near and imminent. Mere insults and violent words, vague future threats, or simple possession of a weapon cannot constitute an assault18; there must be accompanying overt action to give rise to the apprehension of an imminent physical battery. Or, to put it another way, there must be a concrete threat of an imminent battery before the prospective victim may legitimately use force and violence to defend himself. Physical invasion or molestation need not be actually "harmful" or inflict severe damage in order to constitute a tort. The courts properly have held that such acts as spitting in someone's face or ripping off someone's hat are batteries. Chief Justice Holt's words in 1704 still seem to apply: "The least touching of another in anger is a battery." While the actual damage may not be substantial, in a profound sense we may conclude that the victim's person was molested, was interfered with, by the physical aggression against him, and that hence these seemingly minor actions have become legal wrongs. The generality of Mexicans refused the constitution, and the commander of the Spanish army in Mexico, General Agustin de Iturbide united with General Vicente Guerrero, commander of the insurgents (what remained of revolutionary forces launched by Fr. Hidalgo in 1810), in declaring the independence of Mexico. Thus, unlike the rest of Latin America, where independence came as the result of direct assaults on altar and throne by men like Bolivar, it was brought about in Mexico to defend them. Iturbide and Guerrero produced on February 24, 1821 the Plan of Iguala (from the town where it was proclaimed). This plan had three guarantees: 1) Mexico was to be an independent monarchy—under a Spanish or some other European prince; 2) Native and foreign-born Spanish were to be equal; and 3) Catholicism was to be the religion of the state and no others were to be tolerated. The following August 24, the Viceroy, Don Juan O’Donoju surrendered, and Mexico became an independent empire. No European prince would accept the throne, however, and so Iturbide became Emperor Agustin I on May 19, 1822. But influences from the north opposed the idea of a Catholic Mexican Empire; these inspired certain elements to back Antonio Lopez de Santa Ana against Agustin, who was deposed on March 19, 1823, and went into exile. He returned a year later, attempted unsuccessfully to regain the throne, and was executed. The next year saw the appointment of Joel Poinsett as first American Consul in Mexico. In this country, Poinsett is remembered as the importer of Poinsettia, which is so much a part of our Christmas celebrations. But in Mexico he is recalled as the originator of “Poinsettismo,” as the interference of the United States in the internal affairs of Mexico is often called there. He introduced the Masonic lodges into Mexico, and helped organize and strengthen the anti-clerical Liberal Party. From that day to this, the Mexican Liberals have always looked to the United States for assistance in battling the pro-Catholic Conservatives.
