To try answer Ryan's question, I attempted to use my own experience to explain that for many people in New Orleans, and in poor communities across the country, the government was merely an antagonist, a terrible landlord, a jailer, and a prosecutor. As a lawyer assigned to indigent people under sentence of death and paid with tax dollars, I explained the difficulty of working with clients who stand to be executed and who are provided my services by the state, not because they deserve them, but because the Constitution requires that certain appeals to be filed before these people can be killed. The state is providing my clients with my assistance, maybe the first real assistance they have ever received from the state, so that the state can kill them. I explained my view that the country had grown complacent before Hurricane Katrina, believing that the civil rights struggle had been fought and won, as though having a national holiday for Martin Luther King, or an annual march by politicians over the bridge in Selma, Alabama, or a prosecution - forty years too late - of Edgar Ray Killen for the murder of civil rights workers in Philadelphia, Mississippi, were any more than gestures. Even though President Bush celebrates his birthday, wouldn't Dr. King cry if he could see how little things have changed since his death? If politicians or journalists went to Selma any other day of the year, they would see that it is a crumbling city suffering from all of the woes of the era before civil rights were won as well as new woes that have come about since. And does anyone really think that the Mississippi criminal justice system could possibly be a vessel of social change when it incarcerates a greater percentage of its population than almost any place in the world, other than Louisiana and Texas, and then compels these prisoners, most of whom are black, to work prison farms that their ancestors worked as chattel of other men? ... I hoped, out loud, that the post-Katrina experience could be a similar moment [to the Triangle Shirtwaist factory fiasco], in which the American people could act like the children in the story and declare that the emperor has no clothes, and hasn't for a long time. That, in light of Katrina, we could be visionary and bold about what people deserve. We could say straight out that there are people in this country who are racist, that minorities are still not getting a fair shake, and that Republican policies heartlessly disregard the needs of individual citizens and betray the common good. As I stood there, exhausted, in front of the thinning audience of New Yorkers, it seemed possible that New Orleans's destruction and the suffering of its citizens hadn't been in vain.

I believe and have said on many occasions that violence is not the answer to social conflict whether it is engaged in by white people in Alabama or by Negroes in Los Angeles. Violence is all the more regrettable in this period in light of the tremendous nonviolent sacrifices that both Negro and white people together have endured to bring justice to all men. But it is equally clear, as President Johnson pointed out yesterday, that it is the job of all Americans “to right the wrong from which such violence and disorder spring.” The criminal responses which led to the tragic outbreaks of violence in Los Angeles are environmental and not racial. The economic deprivation, racial isolation, inadequate housing, and general despair of thousands of Negroes teaming in Northern and Western ghettoes are the ready seeds which gave birth to tragic expressions of violence. By acts of commission and omission none of us in this great country has done enough to remove injustice. I therefore humbly suggest that all of us accept our share of responsibility for these past days of anguish.

To our amazement Jimmy received a letter, dated August 20, 1963, from Bertrand Russell, the world-famous philosopher and peace activist, saying “I have recently finished your remarkable book The American Resolution” and “have been greatly impressed with its power and insight.” The letter goes on to ask for Jimmy’s views on whether American whites “will understand the negro [sic] revolt because “the survival of mankind may well follow or fail to follow from political and social behavior of Americans in the next decades.” On September 5 Jimmy wrote back a lengthy reply saying among other things that “so far, with the exception of the students, there has been no social force in the white population which the Negroes can respect and a handful of liberals joining in a demonstration doesn’t change this one bit.” Russell replied on September 18 with more questions that Jimmy answered in an even longer letter dated December 22. Meanwhile, Russell had sent a telegram to the November 21 Town Hall meeting in New York City at which Jimmy was scheduled to speak, warning Negroes not to resort to violence. In response Jimmy said at the meeting that “I too would like to hope that the issues of our revolt might be resolved by peaceful means,” but “the issues and grievances were too deeply imbedded in the American system and the American peoples so that the very things Russell warned against might just have to take place if the Negroes in the U.S.A. are ever to walk the streets as free men.” In his December 22 letter Jimmy repeats what he said at the meeting and then patiently explains to Russell that what has historically been considered democracy in the United States has actually been fascism for millions of Negroes. The letter concludes: I believe that it is your responsibility as I believe that it is my responsibility to recognize and record this, so that in the future words do not confuse the struggle but help to clarify it. This is what I think philosophers should make clear. Because even though Negroes in the United States still think they are struggling for democracy, in fact democracy is what they are struggling against. This exchange between Jimmy and Russell has to be seen to be believed. In a way it epitomizes the 1960s—Jimmy Boggs, the Alabama-born autoworker, explaining the responsibility of philosophers to The Earl Russell, O.M., F.R.S., in his time probably the West’s best-known philosopher. Within the next few years The American Revolution was translated and published in French, Italian, Japanese, Spanish, Catalan, and Portuguese. To this day it remains a page-turner for grassroots activists because it is so personal and yet political, so down to earth and yet visionary.

I finally realized that he was keeping an eye on his car—making sure that no one put a bomb in it, perhaps. As he said nothing about this, however, naturally I could not. But I was worried about his driving home alone, and, as he was leaving, I could not resist saying something to this effect. And he smiled—smiled as though I were a novice, with much to learn, which was true, and as though he would be glad to give me a few pointers, which, indeed, not much later on, he did—and told me he’d be all right and went downstairs and got into his car, switched on the motor and drove off into the soft Alabama night. There was no hint of defiance or bravado in his manner. Only, when I made my halting observation concerning his safety, a shade of sorrow crossed his face, deep, impatient, dark; then it was gone. It was the most impersonal anguish I had ever seen on a man’s face. It was as though he were wrestling with the mighty fact that the danger in which he stood was as nothing compared to the spiritual horror which drove those who were trying to destroy him. She told him the origins of the “buck dance,” when “white people would come up and say ‘N____r, dance’, and then start shooting around the feet of blacks so that they would dance like everything.” 45 Big Ma was an important presence in Jimmy’s childhood and adolescence, and he credited her with giving him a unique and powerful sense of historical change. “When she talked about slavery,” he recalled, “she always talked not about how they freed the slaves, but about how [slaveholders] surrendered. There was a big difference. She saw the change as something that had been won by somebody, not something that had been given. She realized that there had been a struggle and that somebody had to lose.” 46 It would not take much for young Jimmy to see a historical connection and a continuity in struggle between these two moments—the buck dance that Big Ma witnessed in her childhood and the marauding Selma sheriff who came to town “shooting and raising Cain to see the colored folks run” during his childhood. Big Ma lived until the mid-1930s, when Jimmy was in his teens. By this time he could see new spaces of struggle emerging from shifts in the region’s economy and black people’s employment patterns. These shifts had impacted his family, specifically through his father’s work opportunities, and would shape his own prospects. Cotton continued to be an important part of the economy, both in the state and in the Black Belt region, but its significance declined relative to Alabama’s growing industrial economy. African Americans saw expanded employment opportunities, as labor shortages, strikes, and union organizing during the first two decades of the century led companies to open up jobs previously unavailable to black workers. The steel industry, which had previously satisfied its need for cheap labor with immigrant workers, came to rely heavily on black labor after World War I. 47

Everyone knew there had never been a cowardly Confederate soldier and they found this statement peculiarly irritating. He always referred to the soldiers as “our brave boys” or “our heroes in gray” and did it in such a way as to convey the utmost in insult. When daring young ladies, hoping for a flirtation, thanked him for being one of the heroes who fought for them, he bowed and declared that such was not the case, for he would do the same thing for Yankee women if the same amount of money were involved. Since Scarlett’s first meeting with him in Atlanta on the night of the bazaar, he had talked with her in this manner, but now there was a thinly veiled note of mockery in his conversations with everyone. When praised for his services to the Confederacy, he unfailingly replied that blockading was a business with him. If he could make as much money out of government contracts, he would say, picking out with his eyes those who had government contracts, then he would certainly abandon the hazards of blockading and take to selling shoddy cloth, sanded sugar, spoiled flour and rotten leather to the Confederacy. Most of his remarks were unanswerable, which made them all the worse. There had already been minor scandals about those holding government contracts. Letters from men at the front complained constantly of shoes that wore out in a week, gunpowder that would not ignite, harness that snapped at any strain, meat that was rotten and flour that was full of weevils. Atlanta people tried to think that the men who sold such stuff to the government must be contract holders from Alabama or Virginia or Tennessee, and not Georgians. For did not the Georgia contract holders include men from the very best families? Were they not the first to contribute to hospital funds and to the aid of soldiers’ orphans? Were they not the first to cheer at “Dixie” and the most rampant seekers, in oratory at least, for Yankee blood? The full tide of fury against those profiteering on government contracts had not yet risen, and Rhett’s words were taken merely as evidence of his own bad breeding. He not only affronted the town with insinuations of venality on the part of men in high places and slurs on the courage of the men in the field, but he took pleasure in tricking the dignified citizenry into embarrassing situations. He could no more resist pricking the conceits, the hypocrisies and the flamboyant patriotism of those about him than a small boy can resist putting a pin into a balloon. He neatly deflated the pompous and exposed the ignorant and the bigoted, and he did it in such subtle ways, drawing his victims out by his seemingly courteous interest, that they never were quite certain what had happened until they stood exposed as windy, high flown and slightly ridiculous.

The alternative to violence is nonviolent resistance. This method was made famous in our generation by Mohandas K. Gandhi, who used it to free India from the domination of the British empire. Five points can be made concerning nonviolence as a method in bringing about better racial conditions. First, this is not a method for cowards; it does resist. The nonviolent resister is just as strongly opposed to the evil against which he protests as the person who uses violence. His method is passive or nonaggressive in the sense that he is not physically aggressive toward his opponent. But his mind and emotions are always active, constantly seeking to persuade the opponent that he is mistaken. This method is passive physically but strongly active spiritually; it is nonaggressive physically but dynamically aggressive spiritually. A second point is that nonviolent resistance does not seek to defeat or humiliate the opponent, but to win his friendship and understanding. The nonviolent resister must often express his protest through noncooperation or boycotts, but he realizes that noncooperation and boycotts are not ends themselves; they are merely means to awaken a sense of moral shame in the opponent. The end is redemption and reconciliation. The aftermath of nonviolence is the creation of the beloved community, while the aftermath of violence is tragic bitterness. A third characteristic of this method is that the attack is directed against forces of evil rather than against persons who are caught in those forces. It is evil we are seeking to defeat, not just the persons victimized by evil. Those of us who struggle against racial injustice must come to see that the basic tension is not between races. As I like to say to the people in Montgomery, Alabama: ‘The tension in this city is not between white people and Negro people. The tension is at bottom between justice and injustice, between the forces of light and the forces of darkness. And if there is a victory it will be a victory not merely for fifty thousand Negroes, but a victory for justice and the forces of light. We are out to defeat injustice and not white persons who may happen to be unjust.’ A fourth point that must be brought out concerning nonviolent resistance is that it avoids not only external physical violence but also internal violence of spirit. At the center of nonviolence stands the principle of love. In struggling for human dignity, the oppressed people of the world must not allow themselves to become bitter or indulge in hate campaigns. To retaliate with hate and bitterness would do nothing but intensify the hate in the world. Along the way of life, someone must have sense enough and morality enough to cut off the chain of hate. This can be done only by projecting the ethics of love to the center of our lives.

Successful con men are treated with considerable respect in the South. A good slice of the settler population of that region were men who’d been given a choice between being shipped off to the New World in leg-irons and spending the rest of their lives in English prisons. The Crown saw no point in feeding them year after year, and they were far too dangerous to be turned loose on the streets of London—so, rather than overload the public hanging schedule, the King’s Minister of Gaol decided to put this scum to work on the other side of the Atlantic, in The Colonies, where cheap labor was much in demand. Most of these poor bastards wound up in what is now the Deep South because of the wretched climate. No settler with good sense and a few dollars in his pocket would venture south of Richmond. There was plenty of opportunity around Boston, New York, and Philadelphia—and by British standards the climate in places like South Carolina and Georgia was close to Hell on Earth: swamps, alligators, mosquitoes, tropical disease... all this plus a boiling sun all day long and no way to make money unless you had a land grant from the King... So the South was sparsely settled at first, and the shortage of skilled labor was a serious problem to the scattered aristocracy of would-be cotton barons who’d been granted huge tracts of good land that would make them all rich if they could only get people to work it. The slave-trade was one answer, but Africa in 1699 was not a fertile breeding ground for middle-management types... and the planters said it was damn near impossible for one white man to establish any kind of control over a boatload of black primitives. The bastards couldn’t even speak English. How could a man get the crop in, with brutes like that for help? There would have to be managers, keepers, overseers: white men who spoke the language, and had a sense of purpose in life. But where would they come from? There was no middle class in the South: only masters and slaves... and all that rich land lying fallow. The King was quick to grasp the financial implications of the problem: The crops must be planted and harvested, in order to sell them for gold—and if all those lazy bastards needed was a few thousand half-bright English-speaking lackeys in order to bring the crops in... hell, that was easy: Clean out the jails, cut back on the Crown’s grocery bill, jolt the liberals off balance by announcing a new “Progressive Amnesty” program for hardened criminals.... Wonderful. Dispatch royal messengers to spread the good word in every corner of the kingdom; and after that send out professional pollsters to record an amazing 66 percent jump in the King’s popularity... then wait a few weeks before announcing the new 10 percent sales tax on ale. That’s how the South got settled. Not the whole story, perhaps, but it goes a long way toward explaining why George Wallace is the Governor of Alabama. He has the same smile as his great-grandfather—a thrice-convicted pig thief from somewhere near Nottingham, who made a small reputation, they say, as a jailhouse lawyer, before he got shipped out. With a bit of imagination you can almost hear the cranky little bastard haranguing his fellow prisoners in London jail, urging them on to revolt: “Lissen here, you poor fools! There’s not much time! Even now—up there in the tower—they’re cookin up some kind of cruel new punishment for us! How much longer will we stand for it? And now they want to ship us across the ocean to work like slaves in a swamp with a bunch of goddamn Hottentots! “We won’t go! It’s asinine! We’ll tear this place apart before we’ll let that thieving old faggot of a king send us off to work next to Africans! “How much more of this misery can we stand, boys? This justification was accepted by a young W. E. B. Du Bois, by the middle-aged, ambitious principle of Alabama’s Tuskegee Institute, Booker T. Washington, and by a dying Frederick Douglass. It took a young antiracist Black woman to set these racist men straight. Mississippi-born Memphis journalist Ida B. Wells recoiled from the lynching of friends and the sheer number of lynchings during the peak of the era in 1892, when the number of Blacks lynched in the nation reached a whopping 255 souls. She released a blazing pamphlet in 1892 called Southern Horrors: Lynch Law in All Its Phases. From a sample of 728 lynching reports in recent years, Wells found that only about a third of lynching victims had “ever been charged with rape, to say nothing of those who were innocent of the charge.” White men were lying about Black-on-White rape, and hiding their own assaults of Black women, Wells raged.11

Unlike modern amendments, the proposed amendments in the Bill of Rights didn’t have expiration dates. So in 1982, 191 years after it failed, a sophomore political science student at the University of Texas–Austin named Gregory Watson noticed that some states had ratified it, but that it hadn’t expired. So he wrote a paper about the failed amendment and got a C from his TA. He appealed the grade, but his professor upheld the C. Pissed off, Watson started writing letters to various state legislatures. They noticed and began ratifying the amendment. Ten years after his C, Alabama became the 38th state to ratify it, giving it the ¾ (38) needed to add it to the U.S. Constitution. In 2016, Watson’s paper was resubmitted for a grade change, with a request of an A+ for having caused an actual constitutional amendment. The University of Texas–Austin honored the change, but only gave the paper an A.

Literally looking for new worlds to conquer, De Soto returned to Spain soon after his exploits in Peru. In Charles V's court he persuaded the bored monarch to let him loose in North America with an expedition of his own. He sailed to Florida with six hundred soldiers, two hundred horses, and three hundred pigs. From today's perspective, it is difficult to imagine the ethical system that culd justify De Soto's subsequent actions. For four years his force wandered through what are now Florida, Georgia, North and South Carolina, Tennessee, Alabama, Mississippi, Arkansas, Texas and Louisiana, looking for gold and wrecking most everything it touched. The inhabitants often fought back viorously, but they were baffled by the Spaniards' motives. De Soto and his soldiers managed to rape, torture, enslave, and kill countless Indians. No fewer than 87 percent of blacks who identified themselves as conservatives said they would vote for him. In the three states that track party registration by race—Florida, Louisiana, and North Carolina—blacks were dropping off the Republican rolls in record numbers and rallying to the Democrats. Someone who probably did mean it was Maurice Heath, who heads the Philadelphia chapter of the New Black Panther party. He once told a crowd, “I hate white people—all of them! . . . You want freedom? You’re gonna have to kill some crackers! You’re gonna have to kill some of their babies!” Another one who probably meant it is Dr. Kamau Kambon, black activist and former visiting professor of Africana Studies at North Carolina State University in Raleigh. In 2005, Prof. Kambon told a panel at Howard University Law School that “white people want to kill us,” and that “we have to exterminate white people off the face of the planet to solve this problem.” In 2005, James “Jimi” Izrael, a black editorial assistant for the Lexington, Kentucky, Herald- Leader, was on a radio program to talk about Prof. Kambon. Another guest mentioned other blacks who have written about the fantasy of killing whites, and Mr. Izrael began to laugh. “Listen,” he said, “I’m laughing because if I had a dollar for every time I heard a black person [talking about] killing somebody white I’d be a millionaire.” For some, killing whites is not fantasy. Although the press was quiet about this aspect of the story, the two snipers who terrorized the Washington, DC, area in 2002 had a racial motive. Lee Malvo testified that his confederate, John Muhammad, was driven by hatred of America because of its “slavery, hypocrisy and foreign policy.” His plan was to kill six whites every day for 30 days. For a 179-day period in 1973 and 1974, a group of Black Muslim “Death Angels” kept the city of San Francisco in a panic as they killed scores of randomly-chosen “blue-eyed devils.” Some 71 deaths were eventually attributed to them. Four of an estimated 14 Death Angels were convicted of first-degree murder. Most Americans have never heard of what became known as the Zebra Killings. A 2005 analysis of crime victim surveys found that 45 percent of the violent crimes blacks committed were against whites, 43 percent against blacks, and 10 percent against Hispanics. There was therefore slightly more black-on-white than black-on-black crime. When whites committed violence they chose black victims only 3 percent of the time. Violence by whites against blacks, such as the 1998 dragging death of James Byrd, is well reported, but racial murder by blacks is little publicized. For example, in Wilkinsburg, near Philadelphia, 39-year-old Ronald Taylor killed three men and wounded two others in a 2000 rampage, in which he targeted whites. At one point, he pushed a black woman out of his way, saying “Not you, sister. I’m not going to hurt any black people. I’m just out to kill all white people.
