The political reaction against Roe v. Wade built slowly. The first justice to join the Court after the January 1973 decision was John Paul Stevens, named by President Gerald Ford in December 1975. Yet remarkably enough, the nominee was not asked a single question about abortion during his confirmation hearing. If the senators’ questions during a Supreme Court confirmation hearing provide a reliable window onto the country’s law-related concerns, then it is reasonable to conclude that abortion had not yet become a national political issue nearly three years after the Court’s decision.

The argument that personal moral views should not be imposed on others when it comes to lawmaking is incoherent and misleading. It is incoherent because a great deal of law implicitly "imposes" a particular moral view on the wider society. It would be disingenuous to pretend that the legalization of abortion on demand or euthanasia does not impose a certain moral view on the rest of society. This is especially true when arguments for abortion and euthanasia are based on rights. The appeal to rights is a moral argument, and it is this appeal to moral authority that gives force to laws enshrining rights.

Charlie Kushner, pursued by the feds for an income tax cheat, set up a scheme with a prostitute to blackmail his brother-in-law, who was planning to testify against him. Various accounts, mostly offered by Christie himself, make Jared the vengeful hatchet man in Christie’s aborted Trump administration career. It was a kind of perfect sweet-revenge story: the son of the wronged man (or, in this case—there’s little dispute—the guilty-as-charged man) uses his power over the man who wronged his family. But other accounts offer a subtler and in a way darker picture. Jared Kushner, like sons-in-law everywhere, tiptoes around his father-in-law, carefully displacing as little air as possible: the massive and domineering older man, the reedy and pliant younger one. In the revised death-of-Chris-Christie story, it is not the deferential Jared who strikes back, but—in some sense even more satisfying for the revenge fantasy—Charlie Kushner himself who harshly demands his due. It was his daughter-in-law who held the real influence in the Trump circle, who delivered the blow. Ivanka told her father that Christie’s appointment as chief of staff or to any other high position would be extremely difficult for her and her family, and it would be best that Christie be removed from the Trump orbit altogether.

We've known for a long time that this day would come. Today, an illegitimate Supreme Court-- stacked with justices who have been credibly accused of sexual harassment and assault, installed by presidents who took power via undemocratic sleights of hand-- ratified their cause of eroding the 14th amendment and the right to bodily autonomy. The decision to overturn Roe v. Wade will be lethal to Americans - particularly, Black women and queer people - who now will lose their already limited access to abortions. If establishment Democrats sit back and allow this Court to continue to dismantle every right protecting marginalized people, this decision won't just cost lives - it also will cost us our democracy. Our leaders in Washington must recognize how the tyranny of the minority, white supremacy, misogyny and bigotry brought us to this dark day. And they must act now to protect voting rights and enshrine the right to an abortion into federal law -- before it's too late.

Liquor, guns, motorcycle helmets (legislation had gone back and forth on that)—mainly white masculine pursuits—are fairly unregulated. But for women and black men, regulation is greater. Within given parameters, federal law gives women the right to decide whether or not to abort a fetus. But the state of Louisiana has imposed restrictions on clinics offering the procedure, which, if upheld in the U.S. Supreme Court, would prevent all but one clinic, in New Orleans, from offering women access to it. Any adult in the state can also be jailed for transporting a teenager out of state for the purposes of an abortion if the teen has not informed her parents. Young black males are regulated too. Jefferson Davis Parish passed a bill banning the wearing of pants in public that revealed "skin beneath their waists or their underwear" and newspaper accounts featured images, taken from the back, of two black teenage boys exposing large portions of their undershorts. The parish imposed a $50 fine for a first offense and $100 for a second.

Power has always been a temptation, and I want to argue that majority rule in America carries with it an empire temptation for many Christian citizens. Those of us who know our American history might be tempted to say, “That’s precisely the opposite of what our democracy, or representative democracy, stands for.” True enough, at one level, because giving everyone a voice vastly surpasses anything less. But take any heated political issue, from abortion to same-sex marriage to national health care to free-market enterprise to nuclear build-up for security, and you may glimpse what I’m trying to say. The political left takes one posture on issues while the political right draws swords from another posture. If we step back we see that each side seeks to impose its view on the minority. This is ruling over the other. Now to a few questions. Is this imposition of power over others consistent with following Christ? Do we ever wonder if the right to vote is the right to coerce and impose, the right to use the power of the majority against the minority?17 Is the power of the majority that different from the power of King Charles when the pilgrims and Puritans left England to establish the “city on a hill”? We would all agree that empowering the people improved the conditions, but I want to ask another question: Does it make the political process of voting the source of seeking for power over others? What is the best Christian response to the drive for power? I call this quest for power through the political process the “eschatology of politics”—that is, the belief that if we usher in the right political candidates and the right laws, then kingdom conditions will arrive. Every two years America goes through convulsions as one candidate after another promises (all but) the kingdom if he or she is elected. Every two years Americans go through the same convulsions as they lather up for the election because they believe if they get their candidate, not only will they win, but (all but) the kingdom will come. This is idolatry and yet another example of Constantinianism

Eleven people have been killed as a result of violence targeted at abortion providers: four doctors, two clinic employees, a security guard, a police officer, a clinic escort, and two others. Anti-abortion extremists are considered a domestic terrorist threat by the U.S. Department of Justice. Yet violence is not the only threat to abortion clinics. In the past five years, politicians have passed more than 280 laws restricting access to abortion. In 2016, the Supreme Court struck down a Texas law that would have required every abortion clinic to have a surgical suite, and doctors to have admitting privileges at a local hospital in case of complications. For many clinics, these requirements were cost prohibitive and would have forced them to close. Also, since many abortion doctors fly in to do their work, they aren’t able to get admitting privileges at local hospitals. It is worth noting that less than 0.3 percent of women who have an abortion require hospitalization due to complications. In fact colonoscopies, liposuction, vasectomies…and childbirth—all of which are performed outside of surgical suites—have higher risks of death. In Indiana in 2016, Mike Pence signed a law to ban abortion based on fetal disability and required providers to give information about perinatal hospice—keeping the fetus in utero until it dies of natural causes. This same law required aborted fetuses to be cremated or given a formal burial even if the mother did not wish this to happen.

For fifty years, they’ve been carrying on about overpopulation; promoting family planning, birth control, abortion; and saying old people have a “duty to die and get out of the way”—in Colorado’s Democratic Governor Richard Lamm’s words. In 1971, Oregon governor and environmentalist Tom McCall told a CBS interviewer, “Come visit us again. . . . But for heaven’s sake, don’t come here to live.” How about another 30 million people coming here to live? The Sierra Club began sounding the alarm over the country’s expanding population in 1965—the very year Teddy Kennedy’s immigration act passed65—and in 1978, adopted a resolution expressly asking Congress to “conduct a thorough examination of U.S. immigration laws.” For a while, the Club talked about almost nothing else. “It is obvious,” the Club said two years later, “that the numbers of immigrants the United States accepts affects our population size and growth rate,” even more than “the number of children per family.”66 Over the next three decades, America took in tens of millions of legal immigrants and illegal aliens alike. The advantages of overpopulation dawned on the Sierra Club right after it received a $100 million donation from hedge fund billionaire David Gelbaum with the express stipulation that—as he told the Los Angeles Times—“if they ever came out anti-immigration, they would never get a dollar from me.”67 It would be as if someone offered the Catholic Church $100 million to be pro-abortion. But the Sierra Club said: Sure! Did you bring the check? Obviously, there’s no longer any reason to listen to them on anything. They want us to get all excited about some widening of a road that’s going to disturb a sandfly, but the Sierra Club is totally copasetic with our national parks being turned into garbage dumps. Not only did the Sierra Club never again say another word against immigration, but, in 2004, it went the extra mile, denouncing three actual environmentalists running for the Club’s board, by claiming they were racists who opposed mass immigration. The three “white supremacists” were Dick Lamm, the three-time Democratic governor of Colorado; Frank Morris, former head of the Black Congressional Caucus Foundation; and Cornell professor David Pimentel, who created the first ecology course at the university in 1957 and had no particular interest in immigration.68 But they couldn’t be bought off, so they were called racists.

For the question of abortion, perhaps the most significant passage of all is found in the specific laws God gave Moses for the people of Israel during the time of the Mosaic covenant. One particular law spoke of the penalties to be imposed in case the life or health of a pregnant woman or her preborn child was endangered or harmed: When men strive together and hit a pregnant woman, so that her children come out, but there is no harm, the one who hit her shall surely be fined, as the woman’s husband shall impose on him, and he shall pay as the judges determine. But if there is harm, then you shall pay life for life, eye for eye, tooth for tooth, hand for hand, foot for foot, burn for burn, wound for wound, stripe for stripe (Exod. 21:22–25).1 This law concerns a situation when men are fighting and one of them accidentally hits a pregnant woman. Neither one of them intended to do this, but as they fought they were not careful enough to avoid hitting her. If that happens, there are two possibilities: 1. If this causes a premature birth but there is no harm to the pregnant woman or her preborn child, there is still a penalty: “The one who hit her shall surely be fined” (v. 22). The penalty was for carelessly endangering the life or health of the pregnant woman and her child. We have similar laws in modern society, such as when a person is fined for drunken driving, even though he has hit no one with his car. He recklessly endangered human life and health, and he deserved a fine or other penalty. 2. But “if there is harm” to either the pregnant woman or her child, then the penalties are quite severe: “Life for life, eye for eye, tooth for tooth …” (vv. 23–24). This means that both the mother and the preborn child are given equal legal protection. The penalty for harming the preborn child is just as great as for harming the mother. Both are treated as persons, and both deserve the full protection of the law.2

What if you kill a man who was plotting to shoot up a McDonald's? What if you commit one murder to prevent a dozen murders? The "obviously correct" judgment of the law starts to sound more and more like an opinion when a new variable is introduced, doesn't it? And okay, these "what if this?" exercises may feel like cerebral game play, but you don't even need to look to extreme examples to see the tenuous, opinion-based nature of laws. Abortion. Gay marriage. Determining fair use in a copyright infringement case. Every time a law is applied, it is applied as a matter of opinion. And those are the laws -- the biggest and baddest rules we have.
